Conditions Imposed under Section 5(12) of the Ordinance

for Permission to Apply Directly for Environmental Permit

1. All measures described in the Project Profile submitted with the Application on 3 October 2007 shall be fully implemented.

2. The applicant shall, prior to the application for an Environmental Permit, submit a report of a survey on the presence of bats in the project area. Should bats be found in the project area, the applicant shall identify any potential impact on the bats due to the project and propose mitigation measures as necessary in the report to mitigate the impacts identified to acceptable level.

Note

Under section 17 of the EIA Ordinance, the Applicant may appeal to the Appeal Board against the above condition within 30 days of the receipt of this notice of the Director’s decision.
