1. All measures described in the Project Profile No. PP-422/2010 submitted by the Applicant on 3 September 2010 shall be fully implemented ;
2. Prior to application for an environmental permit, the Applicant shall submit a survey report to DEP for approval on presence of bats in the Project site and if bats are found, propose measures needed for mitigating the potential impact on the bat population ; and
3. An independent checker shall be employed to audit the implementation of all mitigation measures and monitoring programme recommended in the Project Profile No. PP-422/2010 and the bat survey in (ii) above.
Under section 17 of the EIA Ordinance, the Applicant may appeal to the Appeal Board against the above conditions within 30 days of receipt of this notice of the Director’s decision.
