Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to THE TERRITORY DEVELOPMENT DEPARTMENT (the 'Permit Holder') to decommission a designated project described in Part B subject to the conditions described in or attached to Part C. ³¡(³\¥iÃÒªº±ø¥ó)1 General Conditions

1.3 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance with this permit may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or permit cancellation where applicable.
³\¥iÃÒ«ù¦³¤H¥²¶·½T«O§¹¥þ²Å¦X¥»Àô¹Ò³\¥iÃÒªº¥þ³¡±ø¥ó¡C¦p¦³¤£²Å¦X¥»³\¥iÃÒªº±¡ªp¡A¥i¯àºc¦¨¹H¤ÏÀô¹Ò¼vÅTµû¦ô±ø¨Ò

/¦a½L¬d¾\¡C1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the site.
³\¥iÃÒ«ù¦³¤H¶·±N¥»³\¥iÃÒªº¤@¥÷°Æ¥»¥æ¤©¦³Ãö¤u¦a
/¦a½Lªºt³d¤H¡C1.5 The Permit Holder shall display a copy of this permit on the construction site at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the permit, the notice he sends to the Director shall also be displayed on the next day at the same locations as the original permit.

B³¡ªº¤uµ{¶µ¥Ø»¡©ú¨Ó¸Ñ°£«ü©w¤uµ{¶µ¥Øªº¹B§@¡C1.7 The Designated Project shall be decommissioned in accordance with the information and recommendations contained in the EIA Report.

2 Special Conditions
¯S§O±ø¥ó
2.1 A copy of the EIA Report and the Environmental Monitoring and Audit (EM&A) Manual submitted together with the EIA Report shall be kept in the Resident Engineer¡¦s office and another copy shall be kept in the Contractor¡¦s office on site for reference.

2.2 The Permit Holder shall carry out the decontamination works in accordance with the Contamination Remediation Action Plan as detailed in Section 8.6 and shown in Figure 8.5 in the EIA Report such that the remediation targets as set out in Table 8.7 of the EIA Report and shown in Annex A attached to this permit are fully met.

8.6±ø©Ò¸Ôz©M¹Ï8.5©Ò¸üªº°£¦Ã¸É±Ï¦æ°Êp¹º¦Ó¶i¦æ°£¦Ã¤uµ{¡A¥H§¹¥þ²Å¦XÀôµû³ø§iªí8.7©Òq¤Î¥»³\¥iÃÒªþ¥óA©Ò¥Üªº¸É±Ï¤u§@¥Ø¼Ð¡C2.3 The Permit Holder shall carry out a pilot test to produce the necessary information to verify (or otherwise) the effectiveness of the Soil Vapour Extraction/Air Sparging (SVE/AS) system in achieving the remediation targets. Before commencing the pilot test, the Permit Holder shall agree the details of it with the Director and satisfy the Director that the pilot test will produce the required information.

(©Î§_©w)¤gÄ[»]®ð©â¨úªk¡þªÅ®ð¤À¥¬ªk¨t²Î¹ï¹FP¸É±Ï¤u§@¥Ø¼Ðªº¦¨®Ä¡C¦b¶i¦æ¤p«¬¸ÕÅç©Ê´ú¸Õ«e¡A³\¥iÃÒ«ù¦³¤H¶·Àò¸pªø¦P·N¤@¤Á²Ó¸`¡A¨Ã¨Ï¸pªø«H¯Ç¤p«¬¸ÕÅç©Ê´ú¸Õ¥i´£¨Ñ©Ò»Ý¸ê®Æ¡C2.4 Before starting the decontamination works using the SVE/AS system, the Permit Holder shall submit to the EIA Sub-committee of the Advisory Council on the Environment, a report containing the results of the pilot test on the effectiveness of the SVE/AS system. The Permit Holder shall properly address any comments raised by the EIA Sub-committee of the Advisory Council on the Environment.

2.5 The Permit Holder shall submit the results of the pilot test of the SVE/AS system, and the recommendation, if any, on fallback option(s) together with the associated method statements including a detailed plan for cleanup progress monitoring, and detailed environmental controls to the Director for his approval. Before the commencement of the decontamination work at Hotspot B, the Permit Holder shall demonstrate to the Director's satisfaction that the proposed method of decontamination is able to achieve the remediation targets. The Permit Holder shall make the results of the pilot test available to the public as specified by the Director.

(¦p¦³ªÌ)³s¦P¦³Ãöªº¤èªk»¡©ú®Ñ(¥]¬A¤@¥÷²M²z¶i«×ºÊ´ú¸Ô²Óp¹º)©M¸Ô²ÓÀô¹ÒºÞ¨î±¹¬I¡A´£¥æ¸pªø¥H«Ý§åã¡C¦b¼öÂIB®i¶}°£¦Ã¤uµ{«e¡A³\¥iÃÒ«ù¦³¤H¶·®i¥Ü¨Ã¨Ï¸pªø«H¯Ç«Øijªº°£¦Ã¤èªk½T¯à¹FP¸É±Ï¤u§@¥Ø¼Ð¡C³\¥iÃÒ«ù¦³¤H¶·«ö¸pªø«ü©w±N¤p«¬¸ÕÅç©Ê´ú¸Õµ²ªG¦s³Æ¥H¨Ñ¤½²³¬d¾\¡C2.6 For Hotspot B, excavation of contaminated soil and treatment by biopile shall be carried out if it has been demonstrated that the SVE/AS method cannot achieve the remediation targets as shown in Annex A attached to this permit. The control measures for biopiles as described in Special Conditions 2.16 and 2.17 b) shall be adopted to minimise environmental impacts.

B¡A¦pªG¤gÄ[»]®ð©â¨úªk¡þªÅ®ð¤À¥¬ªk¤wÅã¥Ü¤£¯à¹F¨ì¥»³\¥iÃÒªþ¥óA©Ò¥Üªº¸É±Ï¤u§@¥Ø¼Ð¡A«hÀ³«õ¥X¨ü¦Ã¬Vªd¤g¨Ã¥H¥Íª«°ï¤èªk³B²z¡CÀ³±Ä¥Î¯S§O±ø¥ó²Ä2.16¤Î2.17b)¶µ©Ò´yzªº¥Íª«°ïºÞ¨î±¹¬I¡A¥HºÉ¶q´î¤ÖÀô¹Ò¼vÅT¡C2.7 The person in charge of the detailed design and implementation of the decontamination works shall be a specialist with at least 7 years experience at the professional level in the design and site supervision/management of the decontamination techniques to be applied.

7¦~±M·~¸gÅç¡C2.8 On completion of the decontamination works and before starting the proposed housing development at the project area, the Permit Holder shall submit the final soil quality report of the previously contaminated areas to the EIA Sub-committee of the Advisory Council on the Environment for inspection. The Permit Holder shall make the results of the final soil quality report available to the public as specified by the Director.

2.9 The Permit Holder shall submit to the Director for approval, within 30 days of the award of decommissioning contract, a plan for additional site investigation for "low risk" areas including the Hong Kong Aircraft Engineering Company (HAECO) building as mentioned in Section 7.6.2 and Figure 8.5 of the EIA Report. The Permit Holder shall submit to the Director for approval, within 90 days of the award of decommissioning contract, a report on the results of such additional site investigation and a remediation plan if the results reveal that additional decontamination is necessary.

30¤é¤º¡A¶·«öÀôµû³ø§i²Ä7.6.2±ø¤Î¹Ï8.5©Ò´£z¦V¸pªø´£¥æ¤@¥÷¡u§C·ÀI¡v¦a±a(¥]¬A»´ä¸¾÷¤uµ{¤½¥q¤j¼Ó)¶i¦æÃB¥~¤u¦a½Õ¬dªºp¹º®Ñ¥H«Ý§åã¡C³\¥iÃÒ«ù¦³¤H¶·¦b§å¥X¸Ñ°£¹B§@¤uµ{¦X¬ù90¤é¤º¡A¦V¸pªø´£¥æ¸Ó¶µÃB¥~¤u¦a½Õ¬dµ²ªGªº³ø§i¡A¨Ã¦bµ²ªGÅã¥Ü»Ý¶i¦æÃB¥~°£¦Ã¤uµ{®É´£¨Ñ¤@¥÷¸É±Ïp¹º¡A¥H«Ý§åã¡C2.10 The Permit Holder shall submit to the Director for approval, at a time to be specified by the Director, detailed plans for site closure assessment and post remediation monitoring for the decontamination works.

2.11 The Permit Holder shall audit and report the cleanup progress monitoring results and post-remediation monitoring results within 21 days of their collection to the Director for information and vetting.
³\¥iÃÒ«ù¦³¤H¶·¦b¦¬¨ì²M²z¶i«×ºÊ¹îµ²ªG¤Î¹ê¬I¸É±Ï¤u§@«á¶i¦æºÊ¹îªºµ²ªGªº
21¤Ñ¤º¡A¥[¥H¼f®Ö©M§@¥X³ø§i¡A¥H¨Ñ¸pªøª¾±x©M¼f¾\¡C2.12 In addition to the monitoring required for decontamination works mentioned in Special Condition 2.11 above, the Permit Holder shall carry out an EM&A programme as outlined in Chapter 10 of the EIA Report and detailed in the stand-alone EM&A Manual submitted together with the EIA Report. The Actions described in the Action Plan of the EM&A Manual shall be carried out in accordance with the time frame set out in the Action Plan or agreed by the Director. Details of the EM&A during decommissioning are described in Section 3 below.

2.11¶µ©Ò´£zªº°£¦Ã¤uµ{©Ò»ÝºÊ¹î¤§¥~¡A³\¥iÃÒ«ù¦³¤H¶·«öÀôµû³ø§i²Ä10³¹©Ò·§z¥H¤Î»PÀôµû³ø§i¤@¨Ö´£¥æªº¿W¥ßÀô¹ÒºÊ¹î©M¼f®Ö¤â¥U©Ò¸Ô¸ü¡A¹ê¬I¤@¶µÀô¹ÒºÊ¹î©M¼f®Öp¹º¡CÀô¹ÒºÊ¹î¤Î¼f®Ö¤â¥U¦æ°Êp¹º©Ò¸üªº¤u§@¡A¶·¨Ì·Ó¦æ°Êp¹º©Òq©Î«ö¸pªø¦P·Nªº®É¶i¦æ¡C¦³Ãö¸Ñ°£¹B§@¤uµ{ªºÀô¹ÒºÊ¹î¤Î¼f®Öªº²Ó¸`¡A¦b¤U¦C²Ä3±ø¸üz¡C2.13 Before commencement of the decommissioning work, the Permit Holder shall deposit with the Director 5 copies of the waste management plan as set out in Section 8.4 and Table 8.6 in the EIA Report to avoid or minimize potential impacts associated with waste arising. The waste management plan shall set out clearly those waste management measures that are not covered by the Waste Disposal Ordinance or other pollution control ordinance. The waste management plan shall be properly implemented.

3. Environmental Monitoring and Audit during Decommissioning

3.1 The requirements as set out in the EM&A Manual, or the following EM&A requirements, whichever is more stringent, shall be complied with.

The IC(E) shall verify the overall environmental performance of the Project, including all the implementation of environmental mitigation measures, submissions relating to environmental monitoring and auditing, and any other submissions required under this part of the permit.

Annex B: Measures for Good Housekeeping and Engineering Practice

As mentioned in Section 8.3 and Table 12.3 in the EIA Report, site run-off and drainage shall be prevented or minimized in accordance with the guidelines stipulated in the Environmental Protection Department¡¦s Practice Note for Professional Persons, Construction Site Drainage (ProPECC PN 1/94). To mitigate environmental impacts from site run-off, the following shall be implemented:
