Pursuant to Section 10 of
the Environmental Impact Assessment Ordinance (the Ordinance), the Director of
Environmental Protection (the Director) granted the environmental
permit (No. EP-420/2011) to the Antiquities and Monuments
Office, Leisure and Cultural Services Department ( hereinafter referred as the ¡§Permit Holder¡¨ )
on 14 September 2011. Pursuant
to Section 13 of the EIAO, the Director amends the Environmental Permit No. EP-420/2011 based on the Application No. VEP-400/2013. The amendments, described below, are
incorporated into this Environmental Permit (No.EP-420/2011/A).
This Environmental Permit as amended is for construction of the designated
project described in Part B of this Permit subject to the conditions specified in or attached to Part C of
this Permit. The issue of this
environmental permit is based on the documents, approvals or permissions

demolish later-added reinforced concrete structures, false ceiling
panels, concrete and cement based screed floor at the Study Hall and restore the
floor to its original design and materials in the existing layout; ©î¨ø®Ñ«Ç¤º«á¥[ªº¾d©T¥Û«Ëµ²ºc¡B°²¤Ñªá¡B¥Û«Ë¤Î¤ôªd¾Q¦a¡A¥H¤Î´_צa±©ó즳§G§½ªº³]p¤Îª«®Æ¡F (ii)
repair, replace and reconstruct the timber roof structure including purlins, battens, rafters, truss beams and
other timber support, etc, restore and reconstruct the traditional
Chinese tiled roofs. Repair and
restore the existing plasterwork to the main ridges and gable walls and other

General Conditions
¤@¯ë±ø¥ó
1.1 The
Permit Holder and any person working on the Project shall comply with all
conditions set out in this Permit. Any
non-compliance by any person may constitute a contravention of the
Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject
of appropriate action being taken under the Ordinance.
³\¥iÃÒ«ù¦³¤H¥²¶·¿í¦u¥»³\¥iÃÒªº¥þ³¡±ø¥ó¡C¥ô¦ó¤H¤h¦p¦³¤£¿í¦u¥»³\¥iÃÒªº±¡ªp¡A«h¥i¯àºc¦¨¹H¤ÏÀô¹Ò¼vÅTµû¦ô±ø¨Ò( ²Ä499³¹) ªº³W©w¡A¦Ó·í§½¥i®Ú¾Ú±ø¨Ò±Ä¨ú¾A·í¦æ°Ê¡C

The Permit Holder shall
ensure full compliance with all legislation from time to time in force
including without limitation to the Noise Control Ordinance (Cap. 400), Air
Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap.
358) and Waste Disposal Ordinance (Cap. 354). This Permit does not of itself constitute
any ground of defence against any proceedings instituted under any legislation
or imply any approval under any legislation.

The Permit Holder shall make
copies of this Permit together with all documents referred to in this Permit or
the documents referred to in Part
A of the Permit readily available at all times for inspection by
the Director or his authorised officers at all sites/offices covered by this
Permit. Any reference to the Permit
shall include all documents referred to in the Permit and also the relevant
documents in the Register.

The Permit Holder shall give
a copy of this Permit to the person(s) in charge of the site(s) and ensure that
such person(s) fully understands all conditions and all requirements
incorporated by the Permit. The
site(s) refers to site(s) of construction of the Project and shall mean the
same hereafter.
³\¥iÃÒ«ù¦³¤H¶·§â¥»³\¥iÃÒªº¤@¥÷°Æ¥»¥æ¤©¬ÛÃö¤u¦aªºt³d¤H¡A¨Ã½T«O³o¨Ç¤H¤h§¹¥þ©ú¥Õ¥»³\¥iÃÒ¤º¸üªº©Ò¦³±ø¥ó»P³W©w¡C¤u¦a¬O«ü¥»¤uµ{¶µ¥Øªº«Ø³y¤u¦a¡A¤U¤å©Ò´£¤Îªº¤u¦a¥çÄݦP¤@·N«ä¡C

The Permit Holder shall
display conspicuously a copy of this Permit on the Project site(s) at all
vehicular site entrances/exits or at a convenient location for public
information at all times. The
Permit Holder shall ensure that the most updated information about the Permit,
including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or
the whole of the Permit, the notice he sends to the Director shall also be
displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit
shall be removed from display at the Project site(s).

The Permit Holder shall construct
the Project in accordance with the project descriptions in Part
B of this Permit.
³\¥iÃÒ«ù¦³¤H¶·¨Ì¾Ú¥»³\¥iÃÒB³¡ªº¤uµ{¶µ¥Ø»¡©ú¡A«Ø³y¥»¤uµ{¶µ¥Ø¡C
1.7
The Permit Holder shall ensure that the Project is designed and
constructed in accordance with the information and recommendations described in
the Project Profile (Register No. : PP-422/2010) in the Register, and the
information and mitigation measures described the approved Bat Survey Report
and in this Permit. Where
recommendations referred to in the documents of the Register are not expressly
referred to in this Permit, such recommendations are nevertheless to be
implemented unless expressly excluded or impliedly amended in this Permit.

The Permit Holder shall notify the
Director in writing the commencement date of construction of the Project no
later than 2 weeks prior to commencement of construction of the Project. The Permit Holder shall notify the
Director in writing immediately if there is a change of the commencement date
of the construction.
³\¥iÃÒ«ù¦³¤H¶·¦b¤uµ{¶µ¥Ø¬I¤u«e¦Ü¤Ö¨âÓ¬P´Á¡A¥H®Ñ±³qª¾¸pªø¬I¤u¶}©lªº¤é´Á¡C¦p¶}©l¬I¤uªº¤é´Á¦³¥ô¦ó§ó§ï¡A³\¥iÃÒ«ù¦³¤H¥²¶·¥ß§Y¥H®Ñ±³qª¾¸pªø¡C

For
the purpose of this Permit, ¡§commencement of construction¡¨ does not include
works related to site clearance and preparation or other works as agreed by the
Director.

2.
Specific Conditions
¯S©w±ø¥ó
2.1 Roof
restoration works at the rear annex of the Study Hall shall be completed by 31
May 2013. Other restoration works
for the rear annex of the Study Hall shall be carried out in the dry season. Restoration works for the rear annex shall
commence only after it is confirmed that no bat is using the rear annex by the
post-exclusion bat survey in accordance with the Bat Survey Report, approved
under condition 2 of the Permission to Apply Directly for Environmental Permit
(DIR) (No: DIR-207/2010). A letter
confirming the absence of bats shall be deposited to the Director prior to the
commencement of any construction works in the rear annex. To minimize the glaring impact on bats,
no lighting shall face directly towards the bat boxes installed in the Study
Hall when undertaking restoration works.
Bat boxes shall be provided at locations as indicated in Figure 2 during construction of the
Project.
«á¼Óªº«Î³»×´_¤uµ{¶·¦b2013¦~5¤ë
2.2 Only hand-held powered tools and hand-held manual tools shall be used for carrying out
the restoration works for the
Study Hall.
¬I¦æ®Ñ«Çªº×´_¤uµ{¡A¥u¥i¨Ï¥Î¥iÄ⦡ªº¹q°Ê¤Î¤â°Ê¤u¨ã¡C
2.3 The permit holder shall
conduct bat survey throughout the construction phase as recommended in the
approved Bat Survey Report.
Within 2 months after completion of construction, the permit holder shall
submit a Bat Survey Monitoring Report as
per the requirements in section 7.3 of the Bat Survey Report.
³\¥iÃÒ«ù¦³¤H¶·®Ú¾Ú¤wÀò¼f§åªº½¿½»½Õ¬d³ø§iªº«Øij¡A¦b¬I¤u´Á¶¡¶i¦æ½¿½»½Õ¬d¡C§¹¦¨«Ø³y¤uµ{«áªº¨âӤ뤺¡A³\¥iÃÒ«ù¦³¤H¶·®Ú¾Ú½¿½»½Õ¬d³ø§iªº7.3±ø´£¥æ½¿½»ºÊ¹î³ø§i¡C
2.4 The
Permit Holder shall employ an independent environmental checker to audit the
implementation of all mitigation measures, the carrying out of the monitoring
programme, and the submissions under Condition 2.1 and 2.3, as recommended in
the Project Profile ( Register No. PP-422/2010 ) and the approved Bat Survey
Report.

obtain independent legal advice on the legal implications under the Ordinance,
and the following notes are for general information only.

2.
If there is a breach of any
conditions of this Permit, the Director or his authorized officer may, with the
consent of the Secretary for the Environment, order the cessation of associated
work until the remedial action is taken in respect of the resultant environmental
damage, and in that case the Permit Holder shall not carry out any associated
works without the permission of the Director or his authorized officer.

3.
The Permit Holder may apply
under Section 13 of the Ordinance to the Director for a variation of the
conditions of this Permit. The Permit Holder shall replace the original permit
displayed on the construction site by the amended permit.

4.
A person who assumes the
responsibility for the whole or a part of the designated project may, before he
assumes responsibility of the designated project, apply under Section 12 of the
Ordinance to the Director for a further environmental permit.

Under Section 14 of the
Ordinance, the Director may with the consent of the Secretary for the
Environment, suspend, vary or cancel this Permit. The suspended, varied or
cancelled Permit shall be removed from display at the construction site.
®Ú¾Ú¥»±ø¨Ò²Ä14±øªº³W©w¡A¸pªø¥i¦bÀô¹Ò§½§½ªøªº¦P·N¤U¼È®É¦Q¾P¡B§ó§ï©Î¨ú®ø¥»³\¥iÃÒ¡C¾D¼È®É¦Q¾P¡B§ó§ï©Î¨ú®øªºÀô¹Ò³\¥iÃÒ¥²¶·±q¤uµ{¶µ¥Øªº¤u¦a°£¤U¡A¤£¦A®i¥Ü¡C

If this Permit is cancelled
or surrendered during construction of the Project, another environmental permit
must be obtained under the Ordinance before construction or operation of the
Project could be continued. It is
an offence under Section 26(1) of the Ordinance to construct or operate a
designated project listed in Part I of Schedule 2 of the Ordinance without a
valid environmental permit.

Any person who constructs the Project contrary to the conditions
in the Permit, and is convicted of an offence under the Ordinance, is liable ¡X
¦p¥ô¦ó¤H¦b¹H¤Ï¥»³\¥iÃÒªº±ø¥ó¤U«Ø³y¤uµ{¶µ¥Ø¡A®Ú¾Ú¸Ó±ø¨Ò¡A§YÄݹHªk ¡X
(i)
on
a first conviction on indictment to a fine of $2 million and to imprisonment
for 6 months;
¤@¸g´`¤½¶Dµ{§Çº¦¸©w¸o¡A¥i³B»@´Ú200¸U¤¸¤ÎºÊ¸T6Ó¤ë¡F
(ii)
on
a second or subsequent conviction on indictment to a fine of $5 million and to
imprisonment for 2 years;
¤@¸g´`¤½¶Dµ{§Ç²Ä¤G¦¸©Î¨ä«á¨C¦¸©w¸o¡A¥i³B»@´Ú500¸U¤¸¤ÎºÊ¸T2¦~¡F
(iii)
on
a first summary conviction to a fine at level 6 and to imprisonment for 6
months;
¤@¸g´`²©öµ{§Çº¦¸©w¸o¡A¥i³B²Ä6¯Å»@´Ú¤ÎºÊ¸T6Ó¤ë¡F
(iv)
on
a second or subsequent summary conviction to a fine of $1 million and to
imprisonment for 1 year; and
¤@¸g´`²©öµ{§Ç²Ä¤G¦¸©Î¨ä«á¨C¦¸©w¸o¡A¥i³B»@´Ú100¸U¤¸¤ÎºÊ¸T1¦~¡F¥H¤Î
(v)
in
any case where the offence is of a continuing nature, the court or magistrate
may impose a fine of $10,000 for each day on which he is satisfied the offence
continued.

The Permit Holder may appeal
against any condition of this Permit under Section 17 of the Ordinance within
30 days of receipt of this Permit.
