Pursuant to Section 10 of the Environmental Impact
Assessment Ordinance (the Ordinance), the Director of Environmental Protection
(the Director) granted the Environmental Permit (EP-071/2000) to the Hongkong Electric Co., Ltd
(hereinafter referred to as the “Permit Holder”) on 8 August 2000. Pursuant to
Section 13 of the Ordinance, the Director amends the Environmental Permit (No.
EP-071/2000/C) based on the Application No. VEP-580/2020. The amendments,
described below, are incorporated into this Environmental Permit (No.
EP-071/2000/D). This Environmental Permit as amended is for the construction
and operation of the designated project(s) described in Part
B of this Permit subject to the conditions described in or attached to Part C of this Permit.
根據環境影響評估條例（條例）第10條的規定，環境保護署署長(署長)於2000年8月8日將環境許可證（EP-071/2000）批予香港電燈有限公司（下稱"許可證持有人"）。根據條例第13條的規定，署長因應更改環境許可證的申請編號VEP-580/2020修訂環境許可證編號EP-071/2000/C。以下修訂已包含在本環境許可證內（EP-071/2000/D）。本經修訂的環境許可證作為建造及營辦本許可證B部所說明的指定工程項目，但須遵守本許可證C部所說明或附載的條件。

The projects include the reclamation works for the formation of a 22ha
Lamma Extension site to the south of the existing Lamma Power Station;
construction and operation of a gas-fired power plant with 5 units (one (1) 335MW
class and four (4) 380MW class gas-fired combined cycle units) on the Lamma Extension
site and the associated transmission cable from the power plant to the
landing point at Telegraph Bay; and construction and operation of about 90km
submarine gas pipeline to supply gas from a regional LNG terminal in Shenzhen
to the power plant. 工程項目包括：在現有南丫島發電廠之南進行平整22公頃南丫島擴建廠址的填海工程；建造及營辦位於南丫島擴建廠址的一座燃氣發電（1台335兆瓦級別及4台380兆瓦級別燃氣聯合循環機組），和接連發電廠及鋼線灣的相關輸電纜；以及敷設及營辦一條約90公里長的海底氣體管道，將天然氣從設於深圳的液化天然氣站輸送至南丫島發電廠。 |
C部 (許可證條件)
1.
General Conditions
一般條件
1.1
The Permit Holder shall ensure full compliance with all conditions of this
environmental permit. Any non-compliance may constitute a contravention of the Environmental
Impact Assessment Ordinance (Cap. 499) and may become subject of appropriate
action to be taken under the Ordinance.
許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況，可能構成違反環境影響評估條例(第499章)的規定，而當局可根據條例採取適當行動。
1.2
The Permit Holder shall ensure full compliance with all legislation from
time to time in force including without limitation the Noise Control Ordinance
(Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution Control
Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal
Ordinance (Cap.354). This Permit does not of itself constitute any ground of
defense against any proceedings instituted under any legislation.
許可證持有人須經常確保完全符合現行法例的規定，包括(但不限於)噪音管制條例(第400章)；空氣污染管制條例(第311章)；水污染管制條例(第358章)；海上傾倒物料條例(第466章)及廢物處置條例(第354章)。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由。
1.3
The Permit Holder shall make copies of this Permit together with all
documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for
inspection by the Director or his authorized officers at all sites covered by
this Permit. Any reference to the Permit shall include all documents referred
to in the Permit and also the relevant documents in the Register.
許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件或本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地查閱。凡引用本許可證，須包括本許可證所述的所有文件和登記冊內的相關文件。
1.4
The Permit Holder shall give a copy of this Permit to the person(s) in
charge of the site(s) and ensure that such person(s) fully understands all
conditions and all requirements incorporated by the Permit. The site(s) refers
to the site(s) of the construction, operation and/or decommissioning of the
Project(s) and shall mean the same hereinafter.
許可證持有人須將本許可證的一份複本交予有關工地的負責人，並確保
這些人士完全明白本許可證的所有條件與規定。工地是指工程項目建造、 營辦及/或解除運作的工地，下文所述工地亦指同一意思。
1.5
The Permit Holder shall display a copy of this Permit at all vehicular
site entrances/exits or at a convenient location for public information at all
times. The Permit Holder shall ensure that the most updated information about
the Permit, including any amended Permit, is displayed at such locations. If
the Permit Holder surrenders a part or the whole of the Permit, the notice he
sends to the Director shall also be displayed at the same locations as the
original Permit. The suspended, varied or cancelled Permit shall be removed
from the display at the construction site(s).
許可證持有人須在有關建造工地的所有車輛進出口或一處方便地點，展示
本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證(包括任何經修訂的許可證)的最新資料。如果許 可證持有人交回許可證的部分或全部，須將其送交署長的通知書，在備有原本許可證的各處相同地點展示。遭暫時吊銷、更改或取消的許可證必須從建造工地除下，不再展示。
1.6
A copy of the EIA Report shall be kept in the Engineer's office and
another copy shall be kept in the Contractor's office on site for reference.
一份環評報告的複本須存放在工程師辦事處，而另一份複本則存放在承辦商駐工地辦事處，以供參閱。
1.7
The Permit Holder shall construct and operate the Project(s) in accordance
with the project descriptions in Part B of this
Permit.
許可證持有人須依據本許可證B部的工程項目說明，建造及營辦工程項目。
1.8
The Permit Holder shall ensure that the Project(s) is designed,
constructed and operated in accordance with the information and recommendations
contained in the EIA Report. (Register No. AEIAR-010/1999); the application
documents for environmental permits; other relevant documents in the Register;
and the information or mitigation measures described in this Permit, or
mitigation measures to be recommended in submissions that shall be deposited
with or approved by the Director as a result of permit conditions contained in
this Permit, or mitigation measures to be recommended under on-going
surveillance and monitoring activities during all stages of the Project(s).
Where recommendations referred to in the documents of the Register are not
expressly referred to in this Permit, such recommendations are nevertheless to
be implemented unless expressly excluded or impliedly amended in this Permit.
許可證持有人須確保工程項目的設計、建造及營辦，按照下述資料及措施辦理：環評報告（登記冊編號：AEIAR-010/1999）內載的資料和建議；環境許可證的申請文件；登記冊內的其他相關文件；及本許可證所說 明的資料或緩解措施，或根據本許可證內載的條件須向署長存放或獲署長 批准的提交文件所建議的緩解措施；或在工程項目各階段進行的持續監察和監測工作所建議的緩解措施。如登記冊文件所述建議沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或默示修訂。
1.9
All deposited submissions, as required under this Permit, shall be
rectified and re-submitted in accordance with the comments, if any, made by the
Director, within one month of the receipt of the Director's comments or
otherwise as specified by the Director.
所有按本許可證規定存放的文件，須在接獲署長的意見（如有者）後一個月內（除非署長另行指定），根據署長的意見加以修正並再向署長提交。
1.10
The Permit Holder shall release all finalized submissions, as required under
this Permit, to the public, if requested by the Director, by depositing copies
in the Environmental Impact Assessment Ordinance Register Office or any other
places, or any internet websites as specified by the Director, or by any other
means as specified by the Director for public inspection. For this purpose, the
Permit Holder shall provide sufficient copies of submissions.
如署長提出要求，許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是將有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取其指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的複本。
1.11
The Permit Holder shall notify the Director in writing the commencement
date of construction of the Project(s) no later than one month before the
commencement of any construction activities of the Project(s). The Permit
Holder shall notify the Director in writing immediately if there is any change
of the commencement date of the Project(s).
許可證持有人須在展開建造工程的任何建造作業之前，至少提早1個月以書面方式把工程項目的施工日期通知署長。如施工日期有任何更改，許可證持有人必須立即以書面方式通知署長。
1.12
The Permit Holder shall notify the Director in writing the commissioning
date of the Project(s) no later than three months before the commissioning of
the first unit. The Permit Holder shall notify the Director in writing
immediately if there is any change of the commissioning date of the Project(s).
在第一台機組投入生產前，許可證持有人須至少提早3個月以書面方式把工程項目的投產日期通知署長。如投產日期有任何更改，許可證持有人必須立即以書面方式通知署長。
1.13
All submissions to the Director required under this Permit shall be
delivered either in person or by registered mail to the Environmental Impact
Assessment Ordinance Register Office (currently at 27/F, Southorn
Centre, 130 Hennessy Road, Wanchai, Hong Kong).
本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處（現址為：香港灣仔軒尼詩道130號修頓中心27樓）。
2. Submissions
or Measures before Commencement of Construction
建造工程展開前提交的文件或採取的措施
2.1 An Environmental Team (ET) shall
be established at least 6 months before the commencement of construction of the
Project(s). The ET shall be headed by a team leader who has at least seven
years' experience in environmental monitoring and auditing (EM&A) or
environmental management. The ET Leader shall be responsible for the
implementation of the EM&A programmes in
accordance with the EM&A requirements as contained in the EIA report, and
the approved EM&A manuals submitted under Conditions 2.4 and 4.2 of this
Permit. In addition, the ET Leader shall be responsible for certifying the
environmental acceptability of permanent and temporary works, relevant design
plans and submissions.
在建造工程展開前，須至少提早6個月成立一個環境小組。環境小組須由一名在環境監察及審核或環境管理方面至少有7年經驗的環境小組組長帶領。環境小組組長須依據環評報告和按本許可證條件第2.4及4.2項提

2.2 The Permit Holder shall employ
an Independent Environmental Checker (IEC) at least two months before the
commencement of construction of the Project(s). The IEC shall have at least 7
years' experience in EM&A or environmental management. The IEC shall audit
the overall EM&A programmes including the
implementation of all environmental mitigation measures, submissions relating
to EM&A, and other submissions required under this Permit. In addition, the
IEC shall be responsible for verifying the environmental acceptability of
permanent and temporary works, relevant design plans and submissions under this
Permit.
在建造工程展開前，許可證持有人須至少提早2個月聘用一名獨立環境查核人。該名獨立環境查核人須在環境監察及審核或環境管理方面至少有7年經驗。獨立環境查核人須審核整體環境監察及審核計劃，包括各項環境緩解措施的實施、有關環境監察及審核的提交文件和本許可證規定提交的其他文件。此外，獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和本許可證規定提交的文件。
2.3 All submissions for approval and
deposition under Section 2 of this Permit shall be certified by the ET Leader
and verified by the IEC as conforming to the information and recommendations
contained in the EIA report before submission to the Director.
根據本許可證第2節規定提交待署長批准和向署長存放的所有文件，須由環境小組組長核證及獨立環境查核人核實，證明其符合環評報告所載資料及建議，然後才向署長提交。
2.4 At least two weeks before
commencement of the construction of the Project(s), the Permit Holder shall
submit an EM&A manual for the construction of the Project(s) to the
Director for approval. No construction works shall commence before the Director
has approved the EM&A manual. The EM&A manual approved under this
condition shall hereinafter be referred to as the "EM&A Manual
(Construction Phase)".
在建造工程展開前，許可證持有人須至少提早2星期把建造工程的環境監察及審核手冊，提交署長批准。在環境監察及審核手冊未經署長批准前，不得展開任何建造工程。根據本條件獲准的環境監察及審核手冊下稱"環境監察及審核手冊（建造階段)"。
2.5 The Permit Holder shall, within
one month after the commencement of construction of the Project(s), inform the
Director in writing the management organization of the main construction
companies and/or any form of joint ventures associated with the construction of
the Project(s). The submitted information shall include at least the
organization chart, names of responsible persons and their contact details.
須在建造工程展開後1個月內，許可證持有人須把主要建造公司及/或與 工程項目相關任何形式的合營企業的管理架構，以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。
Specific Submissions for the
Reclamation Works & Gas-fired
Power Plant
填海工程及燃氣發電廠的指定提交文件
2.6 The Permit Holder shall, no
later than two weeks before the commencement of the dredging or reclamation
works at the Lamma Extension site, deposit with the Director the plan(s)
showing:-
在南丫島擴建廠址的挖泥或填海工程展開前，許可證持有人須至少提早2星期向署長存放圖則。圖則須顯示：
(i)
the
locations, the dimensions, and sequences scheduled for dredging and reclamation
works;
挖泥及填海工程的位置、範圍和預定次序；
(ii)
the routing of all construction related marine
vessels. The routing shall avoid disturbance to the finless porpoise at the
southern waters; and
所有與建造工程相關的船隻的航行路線。有關航線須避免對南面水 域的江豚造成滋擾；及
(iii)
the dimensions, the locations, the method of
installation, and the method of removal of silt curtains.

2.7 The Permit Holder shall deposit with
the Director a Waste Management Plan no later than two weeks prior to the
commencement of construction of the Project(s). The Plan shall describe the
arrangements for avoidance, reuse, recovery and recycling, storage, collection,
treatment and disposal of different categories of waste to be generated from
the construction activities and shall take into account the recommendations of
the EIA report. Such a management plan shall include the designation of areas
for segregation and temporary storage of reusable and recyclable materials.
在建造工程展開前，許可證持有人須至少提早2星期向署長存放一份廢物 管理計劃。計劃須說明建造作業所產生各類廢物的避免產生、再使用、回收、循環再造、貯存、收集、處理和棄置安排，並須考慮環評報告的建議。這管理計劃須包括劃定用以分隔和臨時貯存可再用和再造物料的地方。
2.8 The Permit Holder shall deposit
with the Director three sets of Landscape Plan no later than three months
before commencement of the landscape works of the Project(s). The Plan shall
include an explanatory statement and drawings in 1:1000 scale or other
appropriate scale outlining the visual and landscape mitigation measures.
在景觀美化工程展開前，許可證持有人須至少提早3個月向署長存放3套 景觀美化圖則。圖則須包括一份解釋說明和1:1000比例或其他合適比例 的圖則，以描述各視覺及景觀緩解措施。
Specific Submissions for
Transmission System
輸電系統的指定提交文件
2.9 The Permit Holder shall
deposit with the Director three sets of layout drawings no later than three
months prior to the commencement of construction of the transmission system, of
a scale 1 to 500 or other appropriate scale showing the works boundaries,
co-ordinates of the transmission cables and the locations of mitigation
measures recommended in Section 10.3, Part C of the
EIA Report.
在輸電系統建造工程展開前，許可證持有人須至少提早3個月向署長存放 3套1:500比例或其他合適比例的設計圖則，顯示工地界線、輸電纜的坐標和環評報告C部第10.3節所建議的緩解措施的地點。
2.10. The Permit Holder shall deposit with the Director three
sets of plans showing location of the fences along the boundary of construction
sites for cable landing points N4 and N5 and the connecting cable trough as
described in Figures B1 and B2 at the Appendix B attached
with this Permit, no later than three months prior to the commencement of
construction of the transmission system at these locations. The fences are
installed to prevent tipping, vehicle movements, and encroachment of personnel
into adjacent wooded areas, particularly where the rare, uncommon and
restricted plant species are located.
在輸電系統建造工程展開前，許可證持有人須至少提早3個月向署長存放3套圖則，顯示沿電纜着陸點N4及N5的建造工地界線和相關電纜槽豎設圍欄的地點（如本許可證附錄B圖 B1及B2所示）。安裝圍欄的目的，是防止垃圾傾倒、車輛行駛或任何人士闖入鄰近的林木地帶，尤其珍貴稀有的受保護植物品種所在地。
2.11 The Permit Holder shall deposit with the
Director three sets of Landscape Plan outlining the visual and landscape
mitigation measures, and the amenity facilities for the landing points N2, N4
and N5 areas, and for the cable trough area between N4 and N5, no later than
three months prior to the commencement of the landscaping works at these areas.
在景觀美化工程展開前，許可證持有人須至少提早3個月向署長存放3套景觀美化圖則，描述在着陸點N2、N4及N5區和着陸點N4與N5之間的電纜槽區執行的視覺及景觀緩解措施和建造的美化市容設施。

2.12 The Permit Holder shall deposit with the Director
a report demonstrating the measures as described in Section 4.7.5, Part B of the EIA report to prevent
methane (CH4) leakage from the fuel gas supply system no later than
three months prior to the commencement of the pipeline construction works.

3. Measures
During the Construction Period

3.1 All designs or construction measures described in
the submissions approved or deposited under Section 2 of this Permit shall be
properly implemented.
根據本許可證第2節獲准或存放的提交文件說明的所有設計或建造措施，均須妥善執行。
Reclamation Works and
Gas-fired Power Plant

3.2 Silt
curtains enclosing the dredging and reclamation works areas shall be installed
as described in the plan(s) submitted under Condition 2.6 (iii) above prior to
the commencement of dredging and reclamation works at the Lamma Extension site.
The silt curtains shall be maintained in good working condition.
在南丫島擴建廠址的挖泥及填海工程展開前，須依據上文條件第2.6(iii)項 規定提交的圖則所說明，安裝用以圍封挖泥及填海工地的隔泥網。隔泥網 須保持運作良好。
3.3 The
following dredging scenario shall be allowed during reclamation works:
進行填海工程期間，挖泥工作須符合以下條件：
(i)
a maximum
of 5 grab dredgers and each with a grab size of not less than 10 m3
operating concurrently;
最多只可同時使用5艘抓斗式挖泥船，而各抓斗容量不得少於10 立方米；
(ii)
during the ebb
phase of the tidal cycle, a total rate of dredging of no more than 52,667 m3
per day; and
潮退期間，總挖泥率不得超逾每天52,667立方米﹔及
(iii)
during the flood phase of the tidal cycle, a total rate
of dredging of no more than 40,667 m3 per day.

3.4 Combined
dredging and sand filling for site formation of the power plant shall not be
permitted to take place concurrently at any one time. Sand filling for site
formation of the power plant shall take place behind seawalls which shall
protrude above the water surface.
在平整發電廠工地的任何時間內，均不得同時進行挖泥和填砂作業。為平整發電廠工地進行的填砂作業須在突出水面的海堤後面進行。
3.5 No
storm drain outlets shall be facing Hung Shing Ye
Bay.
雨水渠的出口不得朝向洪聖爺灣。
3.6 Rubble
mound seawalls shall be constructed along the southern and western edges of the
reclamation for the power plant to enhance recolonisation
of marine organisms.
石堆海堤須沿發電廠填海區的南端和西端築建，以方便海洋生物重新聚居。
3.7 Artificial
reefs of a volume not less than 400m3 shall be deployed in locations
to be decided upon consultation with the Director within 2 years after
construction of the rubber mound seawalls as described in Condition 3.6 above
to serve the purpose of habitat enhancement measures. The actual volume shall
be decided based on the findings of the ecological monitoring programme as stipulated in the EM&A Manual
(Construction Phase) approved under Condition 2.4 above.

Gas Pipeline

3.8 The
following rates of dredging for the trenches and of pipeline jetting shall be
adopted respectively:

(i)
a single
small grab dredger with a maximum daily rate of working of 2,400 m3
; and
採用1艘小型抓斗式挖泥船，每天最高挖泥率為2,400立方米；及
(ii)
maximum
forward speed of the jetting machine shall be 7 m per minute

3.9 To
avoid disruption to the Neophocaena phocaenoides (finless porpoise) population in the southwestern
coastal waters of Lamma Island, pipeline jetting works located off the coast of
southwest Lamma shall not be carried out during spring time from March to May.
為免對南丫島西南岸水域的江豚構成影響，春季期間（3月至5月）不得在南丫島西南岸對開水域進行管道射流工程。
3.10 Pipeline
jetting shall only be carried out in the open sea which is far away from
sensitive receivers as recommended in the application document for variation of
an environmental permit (the Application VEP-174/2005) and indicated in the Figure C1 at the Appendix C of this Permit during the
initial jetting operation. Water quality monitoring shall be conducted during
the pipeline jetting. Before the commencement of pipeline jetting, the Permit
Holder shall deposit with the Director a water quality monitoring and audit programme for the pipeline jetting. The water quality
monitoring and audit programme shall include the
water quality monitoring and audit procedures and requirements, the
Event/Action Plans and the reporting requirements. The water quality monitoring
and audit programme shall be properly implemented.
Any changes to the water quality monitoring and audit programme
shall seek prior approval from the Director before implementation. The actions
described in the Event/Action Plans of the water quality monitoring and audit programme shall be fully and properly carried out in
accordance with the time frame as set out in the Event/Action Plans, or as
agreed by the Director.
須按更改環境許可證的申請文件（申請書編號：VEP-174/2005）所建議及本許可證附錄C圖 C1所示，初期管道射流工程只可在遠離敏感受體的開闊水域進行。在管道射流工程期間，須進行水質監測。在管道射流工程展開前，許可證持有人須就該工程向署長存放水質監測及審核計劃。計劃須包括水質監測及審核的程序及規定、事件/行動計劃及匯報要求。水質監測及審核計劃須妥善實施。如計劃有任何更改，須事先獲署長同意，然後才可實施。水質監測及審核計劃的事件/行動計劃所說明的行動，須按照事件/行動計劃所訂明的時限或如署長所同意，完全及妥善執行。
4. Submissions
or Measures before Commissioning of the Project(s)

4.1 All submissions for
approval and deposition under Section 4 of this Permit shall be certified by
the ET Leader and verified by the IEC as conforming to the information and
recommendations contained in the EIA report before submission to the Director.
根據本許可證第4節獲准及存放的所有提交文件，均須由環境小組組長核證及獨立環境查核人核實，證明其符合環評報告所載資料及建議，然後才向署長提交。
4.2 At least three months
before commissioning of the first unit, the Permit Holder shall submit an
EM&A manual for the operation phase of the Project(s) to the Director for
approval. No operation of any of the new gas-fired
unit shall commence before
the Director has approved the EM&A manual. The EM&A manual approved
under this condition shall hereinafter be referred to as the "EM&A
Manual (Operational Phase)".
在第一台機組投產前，許可證持有人須至少提早3個月把工程項目營辦階段的環境監察及審核手冊提交署長批准。在環境監察及審核手冊獲署長批准前，不得把任何新設的燃氣機組投產。根據本條件規定獲准的環境監察及審核手冊，下稱"環境監察及審核手冊（營辦階段）"。
4.3 The Permit Holder shall deposit
with the Director, no later than three months prior to the commissioning of the
first unit, a Commissioning Schedule for all the units under
the Project(s). The Commissioning Schedule shall include timing(s) and detail(s) on the
shifting(s) of the base load operation from the existing coal-fired and
oil-fired units of Lamma Power Station to the new gas-fired units.
在第一台機組投產前，許可證持有人須至少提早3個月向署長存放本工程項目下的所有燃氣機組的投產時間表。投產時間表須包括由南丫島發電廠的現有燃煤及燃油機組轉換至新設燃氣機組作基底負荷運行的時間表和詳情。
4.4 At least three months
before the commissioning of the first unit, the Permit Holder shall submit to
the Director for approval an Emergency Plan, to include possible scenarios and
the necessary remedial measures, for handling such situation(s) due to a sudden
interruption in natural gas supply.
在第一台機組投產前，許可證持有人須至少提早3個月把一份應變計劃提交署長批准。計劃須包括可能發生的設想及相應的補救措施，以處理萬一天然氣供應突然中斷時出現的緊急情況。
4.5 At least three months
before commissioning of the first unit, the Permit Holder shall deposit with
the Director a Greenhouse Gas (GHG) Management Plan which shall include the
following:-
在第一台機組投產前，許可證持有人至少提早3個月向署長存放一份溫室氣體管理計劃。計劃須包括：
(i)
a
Life Cycle Management Programme for hydrofluorocarbon gases (HFCs), perfluorocarbons
(PFCs), and sulphur hexafluoride (SF6).
The Programme shall include measures and requirements
as described in Section 4.7.5, Part B of the EIA report to minimise
leakage from systems or equipment containing HFCs, PFCs and SF6;

existing peak lopping oil-fired gas turbines to gas-fired for reducing GHG
emissions during emergency use or peak lopping operations.

4.6 The Permit Holder shall
deposit with the Director a noise control study report to address the potential
cumulative noise impacts arising from the gas-fired
power plant and other
existing and planned noise source at the Lamma Power Station. The Report shall
demonstrate that the noise performance of individual plants and the Lamma Power
Station as a whole shall meet the recommendations and assumptions set out in
Section 6.3.5, Part B of the EIA Report. It shall
be submitted to the Director no later than three months prior to the
commissioning of the first unit.
許可證持有人須向署長存放一份噪音管制研究報告，以提述燃氣發電廠及南丫島發電廠其他現有及經規劃的噪音源可能產生的累積噪音影響。 報告須展示個別廠房及南丫島發電廠整體的噪音表現，須符合環評報告 B部第6.3.5節所載的建議及假設。這份報告須在第一台機組投產前至少提早3個月向署長提交。
4.7 The Permit Holder shall
deposit with the Director no later than three months prior to the commissioning
of the first unit a Waste Management Plan for the operation of the Project(s).
The Plan shall describe the arrangements for avoidance, reuse, recovery and
recycling, storage, collection, treatment and disposal of different categories
of waste to be generated from the operation of the Project(s) and shall take
into account the recommendations in Section 8.5, Part B of the EIA report.

4.8 The Permit Holder shall investigate
the practicality of lowering the residual chlorine concentrations to a level
below 0.3 mg/L. The Permit Holder shall also investigate the practicality of
using alternative biocides in the Project(s). The investigation report
including design measures to prevent formation of foam at the cooling water
outfalls, shall be deposited with the Director no later than three months prior
to the operation of the first unit.

4.9 The Permit Holder shall
deposit with the Director no later than three months prior to the commissioning
of the first unit a Land Contamination Avoidance Plan which shall take into
account the recommendations in Section 9.4, Part B of the EIA report.

4.10 The Permit Holder shall deposit with
the Director a Safety Management Plan to address fuel gas hazards no later than
three months prior to the commissioning of the first unit.

4.11 The Permit Holder shall deposit with
the Director a review report on the Hazard Assessment to address non-fuel gas
hazards included in the EIA Report proposing the required alternative
mitigation measures at least three months before the installation works of the
first unit.

5. Submissions
and Measures during the Operation Period

5.1 All
designs or construction measures described in the submissions approved or
deposited under Section 4 of this Permit shall be properly implemented.

Gas-fired Power Plant
燃氣發電廠
5.2 All five gas-fired combined cycle
units at the Lamma Extension under the Project(s) shall be fuelled by natural
gas only, except for the situation(s) as allowed in the Emergency Plan as
approved under Condition 4.4 above.
南丫島擴建發電廠內本工程項目下的合共5台燃氣聯合循環機組只可用天然氣作為燃料，但根據上文條件第4.4項獲准的應變計劃所容許的情況則屬例外。
5.3 After commissioning of the first
unit, the Permit Holder shall undertake annual revisions and update of its GHG
emissions inventory covering all existing facilities and new extension, for at
least the six GHGs specified under the Kyoto Protocol (carbon dioxide (CO2),
CH4, nitrous oxide (N2O), HFCs, PFCs and SF6).
The inventory shall be established and maintained in accordance with the latest
Intergovernmental Panel on Climate
Change (IPCC) Guidelines or any other guidelines issued by Government,
with details documented for regular reviews and updates. The inventory shall be
reported on an annual basis, including actual figures and targets for the
previous and current year, as well as the next year's forecast. Discrepancies
for actual versus target figures and actions for improvement or enhancement
shall be explained. An annual report of GHG emissions inventory shall be
deposited with the Director within three months after the end of the reporting
period.

5.4 After commissioning of the first
unit, the Permit Holder shall deposit with the Director annual inventory
reports on the CH4 emissions reduction and the achieved results of
the procedural controls of CH4 emissions as described in Condition
2.12 of this Permit. The reports shall be deposited with the Director within
three months after the end of the reporting period.
在第一台機組投產後，許可證持有人須如本許可證條件2.12項所說明，向署長存放有關甲烷排放減量和甲烷排放程序管制所取得成效的每年排放報告。在提交報告期限結束後3個月內，須向署長存放有關報告。
Updating of Commissioning
Schedule

5.5 The Permit Holder shall, no later than 3 months before the
commissioning of last unit of the Project, deposit with the Director an updated
version of the Commissioning Schedule prepared under Condition 4.3 of this
Permit. The updated Commissioning Schedule shall include the timing(s) and
detail(s) on the shifting(s) of the base load operation from the existing
coal-fired and oil-fired units of Lamma Power Station
to the new gas-fired units; demonstrate that it complies with the air emission
scenarios for the Lamma Power Station and the Project
contained in the Application VEP-580/2020; and be certified by the ET Leader
and verified by the IEC before submission to the Director.

6. Environmental
Monitoring and Audit (EM&A)

6.1 Samples and measurements
shall be taken in accordance with the requirements of the EM&A Manual
(Construction Phase) submitted under Condition 2.4 of this Permit by:

(i)
conducting
baseline environmental monitoring as set out in the EM&A Manual
(Construction Phase); and

conducting impact environmental monitoring as set out in
the EM&A Manual (Construction Phase).

6.2 The remedial actions described
in the Event/Action Plans of the EM&A Manual (Construction Phase) shall be
fully and properly carried out, in accordance with the time frame(s) set out in
the Event/Action Plans, or as agreed by the Director.

6.3 Records of the details of
Conditions 6.1 and 6.2 above shall be logged and kept, within 3 working days of
the collection of data or completion of remedial action, for the purpose of
preparing and submitting the EM&A Reports and making the information
available for inspection on site.

6.4 All environmental
monitoring and audit data submitted under this Permit shall be true, valid and

6.5 Two hard copies and one
soft copy of the Baseline Monitoring Report shall be submitted to the Director
at least 2 weeks before the commencement of any major construction works which
would affect the monitoring results. The submissions shall be certified by the
ET Leader and verified by the IEC. Additional copies of the submission shall be
provided to the Director upon request from the Director.

Operational Phase

6.7 Samples and measurements
shall be taken in accordance with the requirements of the EM&A Manual
(Operational Phase) submitted under Condition 4.2 of this Permit by :

conducting

preparing and submitting the EM&A Reports and making the information
available for inspection on site.

6.10 All environmental monitoring and audit
data submitted under this Permit shall be true, valid and correct.

6.11 Two hard copies and one soft copy of
the Baseline Monitoring Report shall be submitted to the Director at least 2
weeks before the commissioning of the first unit which would affect the
monitoring results. The submissions shall be certified by the ET Leader and
verified by the IEC. Additional copies of the submission shall be provided to
the Director upon request from the Director.
在任何影響監察結果的第一台機組投入生產前，須至少提早

7. Electronic
Reporting of EM&A Information (For both Construction Phase and Operational
Phase)

7.1 To facilitate public inspection
of the Baseline Monitoring Report and monthly EM&A Reports via the EIAO
Internet Website and at the EIAO Register Office, electronic copies of these Reports
shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later)
and in Portable Document Format (PDF version 4.0 or later), unless otherwise
agreed by the Director and shall be submitted at the same time as the hard
copies as described in Conditions 6.5. 6.6, 6.11 & 6.12. For the HTML
version, a content page capable of providing hyperlink to each section and
sub-section of these Reports shall be included in the beginning of the
document. Hyperlinks to all figures, drawings and tables in these Reports shall
be provided in the main text from where the respective references are made. All
graphics in these Reports shall be in interlaced GIF format unless otherwise
agreed by the Director. The content of the electronic copies of these Reports
must be the same as the hard copies.

7.2 All environmental monitoring
data as described in Condition 7.1 above shall be made available to the public
via internet access in the form of a website, in the shortest possible time and
in no event later than two weeks after the relevant environmental monitoring
data are collected or become available, unless otherwise agreed with the
Director. The Permit Holder shall notify the Director in writing within six
weeks after the commencement of works the internet address where the
environmental monitoring data are to be placed. The internet
address and the relevant environmental monitoring data shall be made available
to the public via the EIAO Internet Website and the EIAO Register Office.
上文條件第7.1項規定的所有環境監察數據，均須盡快以設立網站方式供公眾透過互聯網接達，在任何情況下均不得遲於有關環境監察數據收集或可供瀏覽後的兩星期，除非署長另行指示。許可證持有人須在工程展開後6個星期內，以書面通知署長將存放環境監察數據的網址所在。網址和相關的環境監察數據，須透過環評條例互聯網網站和環境影響評估條例登記冊辦事處，供公眾查閱。
7.3 The internet website as
described in Condition 7.2 above shall enable user friendly public access to
the monitoring data and with features capable of :
上文條件第7.2項所說明的互聯網網站，除非另獲署長同意，必須方便用戶使用，讓公眾容易接達監察數據，並提供下述功能：
(i)
providing
access to environmental monitoring data collected since the commencement of
works;
在工程展開後，接達所收集的環境監察數據；
(ii)
searching
by date;
按日期作出搜尋；
(iii)
searching
by types of monitoring data (air quality, water quality and noise, etc.); and
按監察數據類別（空氣質素、水質及噪音等）作出搜尋；及
(iv)
hyperlinks
to relevant monitoring data after searching;
在搜尋後對相關監察數據作出超文本連結。
or otherwise as agreed by the Director.

This Permit consists of three parts, namely, Part A
(Main Permit), Part B (Description of Designated
Project) and Part C (Permit Conditions). Any person relying on this permit should
obtain independent legal advice on the legal implications under the Ordinance,
and the following notes are for general information only.
本許可證共有3部，即A部 （許可證主要部分)；B部 （指定工程項目的說明） 及C部 （許可證條件）。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。
2.
If
there is a breach of any conditions of this Permit, the Director or his
authorized officer may, with the consent of the Secretary for the Environment,
Transport and Works, order the cessation of associated work until the remedial
action is taken in respect of the resultant environmental damage, and in that
case the Permit Holder shall not carry out any associated works without the
permission of the Director or his authorized officer.
如違反本許可證的任何條件，署長或獲授權人員可在環境運輸及工務局局長的同意下勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。
3.
The
Permit Holder may apply under Section 13 of the Environmental Impact Assessment
Ordinance (the “Ordinance”) to the Director for a variation of the conditions
of this Permit. The Permit Holder shall replace the original permit displayed
on the Project site by the amended permit.
許可證持有人可根據環境影響評估條例（「條例」）第13條的規定向署長申請更改本許可證的條件。許可證持有人須以經修訂的許可證替換在工程項目的工地內展示的原有許可證。
4.
A person
who assumes the responsibility for the whole or a part of the Project may,
before he assumes responsibility of the Project, apply under Section 12 of the
Ordinance to the Director for a further environmental permit.
承擔工程項目整項或部分工程的責任的人，在承擔責任之前，可根據條例第12條的規定向署長申請新的環境許可證。
5.
Under
Section 14 of the Ordinance, the Director may with the consent of the Secretary
for the Environment, Transport and Works, suspend, vary or cancel this Permit.
The suspended, varied or cancelled Permit shall be removed from display at the
Project site.
根據條例第14條的規定，署長可在環境運輸及工務局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下，不再展示。
6.
If this
Permit is cancelled or surrendered during construction or operation of the
Project, another environmental permit must be obtained under the Ordinance
before the Project could be continued. It is an offence under Section 26 (1) of
the Ordinance to construct or operate a designated project listed in Schedule 2
of the Ordinance without a valid environmental permit.
如本許可證在工程項目建造或營辦期間取消或交回，則在繼續進行工程項目之前，必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造條例附表2所列明的指定工程項目，即屬犯罪。
7.
Any person
who constructs or operates the Project contrary to the conditions in the
Permit, and is convicted of an offence under the Ordinance, is liable:
如任何人在違反本許可證的條件下建造或營辦工程項目，根據條例，即屬犯罪：
(i)
on a first conviction on indictment to a fine of $2
million and to imprisonment for 6 months;
一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；
(ii)
on a second or subsequent conviction on indictment to a
fine of $5 million and to imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；
(iii)
on a first summary conviction to a fine at level 6 and to
imprisonment for 6 months;
一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；
(iv)
on a second or subsequent summary conviction to a fine of $1 million and
to imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；以及
(v)
in any case where the offence
is of a continuing nature, the court or magistrate may impose a fine of $10,000
for each day on which he is satisfied the offence continued.
在任何情況下如該罪行屬連續性質，法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。
8.
The Permit
Holder may appeal against any condition of this Permit under Section 17 of the
Ordinance within 30 days of receipt of this Permit.
許可證持有人可在接獲本許可證後30天內，根據條例第17條就本許可證的任何條件提出上訴。
9.
The Notes
are for general reference only and that the Permit Holder should refer to the
EIA Ordinance for details and seek independent legal advice.
