Pursuant to
Sections 10 and 12 of the Environmental Impact Assessment Ordinance (EIAO), the
Director of Environmental Protection (the Director) issued the Further
Environmental Permit (No. FEP-03/558/2018) on 17 January 2020. Pursuant to
Section 13 of the EIAO, the Director amends the Further Environmental Permit
(No. FEP-03/558/2018/A) based on the Application No. VEP-597/2021 and grants
this Environmental Permit (No. FEP-03/558/2018/B) to CASTLE PEAK POWER CO LTD (hereinafter referred to as the
“Permit Holder”). The amendments, described below, are incorporated into this
Environmental Permit (No. FEP-03/558/2018/B). This Further Environmental Permit
as amended is for the construction and operation of the designated project
described in Part B subject to the conditions specified in
Part C. The issue of this Further Environmental Permit is
based on the documents, approvals or permissions described below:-

FEP-03/558/2018)。根據環評條例第13條的規定，署長因應申請 (編號:
VEP- 597/2021) 修訂新的環境許可證 (編號:
FEP-03/558/2018/A)，並將本環境許可證 (編號:
FEP-03/558/2018/B) 批予青山發電有限公司 (下稱“許可證持有人”)。以下修訂已包含在本環境許可證內 (編號:
FEP-03/558/2018/B)。本經修訂的新的環境許可證作為建造及營辦 B部
所說明的指定工程項目，但須遵守 C部 所列明的條件。本新的環境許可證的發出，乃以下表所列的文件、批准或許可作為根據︰

The Project includes the construction and
operation of the following key

a subsea gas pipeline connecting the Floating
Storage and Regasification Unit (FSRU) facility with the Black Point Power
Station (BPPS); and 一條海底天然氣管道，從海上液化天然氣接收站，連接至龍鼓灘發電廠；及 -
a Gas Receiving
Station (GRS) located entirely within the BPPS. 完全位於龍鼓灘發電廠範圍內的天然氣接收站。 |
C部 （許可證條件）
一般條件
1.1 The Permit
Holder and any person working on the Project shall comply with all conditions
set out in this Permit. Any non-compliance by any person may constitute a
contravention of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) and may become the subject of appropriate action
being taken under the EIAO.
許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況，可能違反《環境影響評估條例》（環評條例）（第499章）的規定，而當局可根據條例採取適當行動。
1.2 The
Permit Holder shall ensure full compliance with all legislation from time to
time in force including, without limitation to, the Gas Safety Ordinance (Cap.
51), Dangerous Goods Ordinance (Cap. 295), Air Pollution Control Ordinance
(Cap. 311), Waste Disposal Ordinance (Cap. 354), Water Pollution Control
Ordinance (Cap. 358), Noise Control Ordinance (Cap. 400) and Marine Parks
Ordinance (Cap. 476). This Permit does not of itself constitute any ground of defence against any proceedings instituted under any
legislation or imply any approval under any legislation.
許可證持有人須經常確保完全符合現行法例的規定，包括但不限於《氣體安全條例》(第51章)、《危險品條例》(第295章)、《空氣污染管制條例》(第311章)、《廢物處置條例》(第354章)、《水污染管制條例》(第358章)、《噪音管制條例》(第400章)及《海岸公園條例》(第476章)。本許可證本身不會就根據任何法例提出的法律程序構成任何抗辯理由，或根據任何法例默示任何批准。
1.3 The Permit
Holder shall make copies of this Permit together with all documents referred to
in this Permit and the documents referred to in Part A
of this Permit readily
available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this
Permit. Any reference to the Permit shall include all documents referred to in
the Permit and also the relevant documents in the Register.
許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件及本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 ／辦事處查閱。凡提述本許可證，須包括本許可證所述的所有文件及登記冊內的相關文件。
1.4 The
Permit Holder shall give a copy of this Permit to the person(s) in charge of
the site(s) and ensure that such person(s) fully understands all conditions and
all requirements incorporated in the Permit. The site(s) refers to site(s) of
construction and operation of the Project and shall mean the same hereafter.
許可證持有人須把本許可證的複本交予有關工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辦工程項目的工地，下文所提及的工地亦屬同一意思。
1.5 The
Permit Holder shall display conspicuously a copy of this Permit on the Project
site(s) at all vehicular site entrances/exits or at a convenient location for
public’s information at all times. The Permit Holder shall ensure that the most
updated information about the Permit, including any amended Permit, is
displayed at such locations. If the Permit Holder surrenders a part or the
whole of the Permit, the notice he sends to the Director shall also be
displayed at the same locations as the original Permit. The suspended, varied
or cancelled Permit shall be removed from display at the Project site(s).
許可證持有人須在工程項目工地的所有車輛進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證（包括任何經修訂的許可證）的最新資料。許可證持有人如交回許可證的部分或全部，必須把其送交署長的通知書，在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下，不再展示。
1.6 The
Permit Holder shall construct and operate the Project in accordance with the project description in Part B of this Permit.
許可證持有人須依據本許可證B部的工程項目說明，建造及營辦工程項目。
1.7 The Permit Holder shall ensure that the
Project is designed, constructed and operated in accordance with the
information and relevant recommendations described in the approved EIA Report
(Register No. AEIAR-218/2018), the application documents for environmental
permits, other relevant documents in the Register, the information and
mitigation measures described in this Permit, mitigation measures to be
recommended in the submissions that shall be deposited with or approved by the
Director as a result of permit conditions contained in this Permit, and
mitigation measures to be recommended under on-going surveillance and
monitoring activities during all stages of the Project. Where recommendations
referred to in the documents of the Register are not expressly referred to in
this Permit, such recommendations are nevertheless to be implemented unless
expressly excluded in this Permit or otherwise agreed by the Director.
許可證持有人須確保工程項目的設計、建造及營辦，按照下述資料及措施辦理：核准環評報告（登記冊編號：AEIAR-218/2018）所說明的資料及各項建議、環境許可證申請文件、登記冊內的其他相關文件、本許可證所說明的資料及緩解措施、根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施、以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或另獲署長同意。
1.8 All
submissions, as required under this Permit, shall be rectified and resubmitted
in accordance with the comments, if any, made by the Director within one month
of the receipt of the Director’s comments or otherwise as specified by the
Director.
所有按本許可證規定提交的文件，須在接獲署長的意見（如有者）後1個月內（除非署長另行指定），根據署長的意見加以修正並再向署長提交。
1.9 All
submissions approved by the Director, all submissions deposited without
comments by the Director, and all submissions rectified in accordance with
comments by the Director under this Permit shall be construed as part of the
permit conditions described in Part C of this
Permit. Any variation of the submissions shall be approved by the Director in
writing or as prescribed in the relevant permit conditions. Any non-compliance
with the submissions may constitute a contravention of the Environmental Impact
Assessment Ordinance (Cap. 499). All submissions or any variation of the
submissions shall be certified by the Environmental Team (ET) Leader and
verified by the Independent Environmental Checker (IEC) referred to in
Conditions 2.1 and 2.2 below before
submitting to the Director under this Permit.
署長批准的所有提交文件、署長沒有給予意見的所有存放文件及根據本許可證規定由署長給予意見修正的所有提交文件，均須詮釋為本許可證C部說明的許可證條件的一部分。提交文件如有任何修訂，均須獲署長的書面批准，或符合有關許可證條件訂明的規定。如有不符合提交文件的情況，則可能違反《環境影響評估條例》（第499章） 的規定。所有提交文件或提交文件的任何修訂本，均須按下文條件第2.1及2.2項所述由環境小組組長核證及獨立環境查核人核實，然後才按本許可證規定向署長提交。
1.10 The
Permit Holder shall release all finalised
submissions, as required under this Permit, to the public by depositing copies
in the EIAO Register Office, or in any other places, or any internet websites
as specified by the Director, or by any means as specified by the Director, for
public inspection. For this purpose, the Permit Holder shall provide sufficient
copies of the submissions.
許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是把有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取署長指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的複本。
1.11 All
submissions to the Director required under this Permit shall be delivered
either in person or by registered mail to the EIAO Register Office (currently
at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized
submissions required under this Permit shall be prepared in Hyper Text Markup
Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF
version 1.3 or later), unless otherwise agreed by the Director and shall be
submitted at the same time as the hard copies.
本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處（現址為：香港灣仔軒尼詩道130號修頓中心27樓）。所有按本許可證規定提交的文件定稿的電子版本，均須以超文本標示語言 (HTML) （第4.0或較後版本）和便攜式文件格式 (PDF) （第1.3或較後版本）製作，除非另獲署長同意，並須與硬複本同時提交。
1.12 The Permit Holder shall notify the Director in writing the commencement date of
construction of the Project no later than 1
month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any
change of the commencement date of construction.
許可證持有人須在工程項目的建造展開前至少1個月以書面方式把建造工程的開展日期通知署長。建造工程的開展日期如有任何更改，許可證持有人必須立即以書面方式通知署長。
1.13 For
the purpose of this Permit, “commencement of construction” does not include
works related to site clearance and preparation, or other works as agreed by
the Director.
為執行本許可證，「建造工程的展開」不包括工地清理和預備的工程，或署長同意的其他工程。
1.14 The Permit Holder shall notify the Director
in writing the commencement date of operation of the Project no later than 1
month prior to the commencement of operation of the Project. The Permit Holder
shall notify the Director in writing immediately if there is any change of the
commencement date of operation.
許可證持有人須在工程項目的營辦展開前至少1個月以書面方式把工程項目開始營辦日期通知署長。開始營辦日期如有任何更改，許可證持有人必須立即以書面方式通知署長。

聘用環境監察及審核（環監）人員
2.1
An
Environmental Team (ET) shall be established by the Permit Holder no later than
3 months
before commencement of construction of the Project. The ET shall not be in any
way an associated body of the Contractor or the Independent Environmental
Checker (IEC) for the Project. The ET shall be headed by an ET Leader and
supported by relevant specialists including risk
assessment expert(s), qualified
ecologist(s) and experienced marine mammal observer(s). The ET Leader shall be a
person who has at least 7 years of experience in environmental monitoring and
auditing (EM&A) or environmental management. The ET Leader shall be
employed on a full time basis to work on the Project onsite, unless otherwise
agreed by the Director. The ET and the ET Leader shall be responsible for the
implementation of the EM&A programme in
accordance with the EM&A requirements as contained in the updated EM&A
Manual approved under Condition 2.5 of this Permit. The ET Leader shall keep a
contemporaneous log-book of each and every instance or circumstance or change
of circumstances, which may affect the compliance with the recommendations of
the approved EIA Report (Register No. AEIAR-218/2018) and this Permit. The ET
Leader shall notify the IEC within one working day of the occurrence of any
such instance or circumstance or change of circumstances. The ET Leader’s
log-book shall be kept readily available for inspection by all persons
assisting in supervision of the implementation of the recommendations of the
approved EIA Report (Register No. AEIAR-218/2018) and this Permit or by the
Director or his authorized officers. Failure to maintain records in the
log-book, failure to discharge the duties of the ET Leader as defined in the
updated EM&A Manual or failure to comply with this Condition would entitle
the Director to require the Permit Holder by notice in writing to replace the
ET Leader. Failure by the Permit Holder to make replacement or further failure
to keep contemporaneous records in the log-book despite the employment of a new
ET Leader may render the Permit liable to suspension, cancellation or
variation.
許可證持有人須在工程項目的建造工程展開前最少3個月成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領，並獲相關的專家（包括風險評估專家、合資格的生態學家及具備經驗的海洋哺乳動物觀察員）支援。環境小組組長須在環境監察及審核（「環監」） 或環境管理方面至少有7年經驗。除非另獲署長同意，環境小組組長須全職受聘在工程項目工地工作。環境小組及環境小組組長須按本許可證條件第2.5項核准的更新環監手冊內載的環監規定，執行環監計劃。環境小組組長須保存一本記錄冊，同時記載可能會影響核准環評報告（登記冊編號：AEIAR-218/2018）的建議及本許可證的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方，須可供協助督導執行核准環評報告（登記冊編號：AEIAR-218/2018）的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行更新環監手冊所列明的環境小組組長職務或未能符合本條件的規定，署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補，或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄，或會導致許可證遭暫時吊銷、取消或更改。
2.2
An IEC shall be employed by the Permit Holder no
later than 3 months before
commencement of construction of the Project. The IEC shall not be in any way an
associated body of the Contractor or the ET for the Project. The IEC shall be a
person who has at least 7 years of experience in EM&A or environmental
management. The IEC shall be employed on a full time basis to work on the
Project onsite, unless otherwise agreed by the Director. The IEC shall be responsible
for duties defined in the updated EM&A Manual approved under Condition 2.5 of this Permit, and shall audit the overall
EM&A performance, including the implementation of all environmental
mitigation measures, submissions required in the updated EM&A Manual, and
any other submissions required under this Permit. In addition, the IEC shall be
responsible for verifying the environmental acceptability of permanent and
temporary works, relevant design plans and submissions under this Permit. The
IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit. The
IEC shall notify the Director by fax or email, within one working day of
receipt of notification from the ET Leader of each and every occurrence, change
of circumstances or non-compliance with the approved EIA Report (Register No. AEIAR-218/2018) and this Permit,
which may affect the monitoring or control of adverse environmental impacts
from the Project. In the case where the IEC fails to so notify the Director of
the same, fails to discharge the duties of the IEC as defined in the updated
EM&A Manual or fails to comply with this Condition, the Director may
require the Permit Holder by notice in writing to replace the IEC. Failure to
replace the IEC as directed or further failure to so notify the Director
despite employment of a new IEC may render the Permit liable to suspension,
cancellation or variation. Notification by the Permit Holder is the same as
notification by the IEC for the purpose of this Condition.
許可證持有人須在工程項目的建造工程展開前最少3個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。除非另獲署長同意，獨立環境查核人須全職受聘在工程項目工地工作。獨立環境查核人須執行按本許可證條件第2.5項核准的更新環監手冊所列明的職務，以及審核整體環監工作的表現，包括實施所有環境緩解措施、提交更新環監手冊規定的文件，以及提交本許可證所要求的任何其他文件。此外，獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件，並須核實本許可證條件第2.1項所述的記錄冊。在每次出現事故、情況變化或不符合核准環評報告（登記冊編號：AEIAR-218/2018）及本許可證的情況，而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時，獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真或電郵方式通知署長。獨立環境查核人如未能通知署長有關情況、未能執行更新環監手冊所列明的獨立環境查核人職務或未能符合本條件的規定，署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人，或在聘用新獨立環境查核人後仍未能通知署長有關情況，則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件，許可證持有人的通知等同獨立環境查核人的通知。

2.3
To
enhance transparency and communication with the public, the
Permit Holder shall, no later than 2 weeks before the commencement of construction of the Project, set
up a Stakeholders
Liaison Group comprising relevant experts and stakeholders to
facilitate communications, enquiries and complaints handling on environmental
issues related to the Project. The Permit
Holder shall disseminate information to the Stakeholders Liaison Group and promote cooperation and participation of the stakeholders.
Relevant information of the Project including the detailed design,
construction progress, operation plan and environmental monitoring and audit
results shall be provided to the Stakeholders Liaison Group. The Permit Holder shall inform
the Director in writing the membership and terms of reference of the Stakeholders Liaison Group. The Permit Holder
shall make the papers and documents prepared for the group and minutes of the group meetings
available to the public through a website.
為提高透明度和加強與公眾溝通，許可證持有人須在工程項目的建造工程展開前最少2個星期成立由相關專家和持份者組成的持份者聯絡小組，以便就與工程項目有關的環境問題進行溝通、查詢及處理投訴。許可證持有人須向持份者聯絡小組傳遞信息、推動持份者合作和參與。工程項目的相關資料，包括詳細設計、施工進度、營辦計劃、環境監察及審核結果，均須提供予持份者聯絡小組。許可證持有人須將持份者聯絡小組的成員名單及職權範圍以書面通知署長，並須把為小組擬備的所有文件及小組的會議記錄上載至網站供公眾閱覽。

2.4
The Permit Holder shall, no later than 1 month before
the commencement of construction of the Project, inform the Director in writing
the management organization of the ET, the IEC, and the main construction
companies and/or any form of joint ventures associated with the construction of
the Project. The information shall include at least an organization chart,
names of responsible persons and their contact details.
許可證持有人須在工程項目的建造工程展開前最少1個月把環境小組、獨立環境查核人及主要建造公司及／或以任何形式與工程項目建造工程相關的合營企業的管理架構以書面通知署長。有關資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

2.5
The Permit Holder shall update the EM&A Manual
to include the latest EM&A requirements in accordance with the information
and recommendations described in the approved EIA Report (Register No. AEIAR-218/2018) and by taking into account any specific site
conditions that may be changed before the construction of the Project. The
Permit Holder shall, no later than 3 months before the commencement of construction of the Project, submit 3
hard copies and 1 electronic copy of the updated EM&A Manual to the
Director for approval. The updated EM&A Manual shall include but not limited to the ecological
monitoring on marine mammals, Event/Action Plan for the ecological monitoring,
environmental monitoring for commissioning hydrotest for the subsea gas
pipelines and
Implementation Schedule for the recommended measures in the approved
EIA Report (Register No.
AEIAR-218/2018). The updated EM&A Manual shall be certified by the ET Leader and
verified by the IEC as conforming to the information and recommendations
contained in the approved EIA Report
(Register No. AEIAR-218/2018), and taking into account any specific
requirements with respect to the latest site conditions of the Project. All
measures recommended in the updated EM&A Manual approved under this
Condition shall be fully and properly implemented in accordance with the
requirements and time schedule(s) set out in the updated EM&A Manual. The
EM&A Manual approved under this Condition shall hereinafter be referred to
as the “updated EM&A Manual”.

The Permit Holder shall, no later than 1 month
before the commencement of construction of the Project, deposit with the Director 3 hard copies and 1 electronic copy of a location
plan of the Project with a scale of 1:1000 or other appropriate scale as agreed
with the Director. The location plan shall include but not limited to the details of the works areas and boundaries, vertical and horizontal alignments of the subsea pipeline, and locations of the key environmental
mitigation measures. The Project shall be constructed in accordance with the information as contained in the deposited location plan.

works and key environmental mitigation measures for the Project.
The Project shall be constructed in accordance with the information as contained in the deposited construction works schedule.

The Permit Holder shall, no later than 1
month before the
commencement of construction of the Project, submit 3
hard copies and 1 electronic copy of a pipeline construction
plan of the Project to the Director for
approval. The pipeline construction plan shall include but
not limited to a detailed schedule, sequence and programme of different work fronts for carrying out the
dredging and jetting works and cofferdam construction works for laying the subsea gas pipeline of the Project. The programming of
the dredging and jetting works shall take into account the peak calving season
of Chinese White
Dolphin and
peak occurrence season of Finless Porpoise, with a view to minimizing
the impacts to marine ecology as far as practicable. The dredging and
jetting works shall
be carried out in accordance with the information as contained in the approved pipeline construction plan.
許可證持有人須在工程項目的建造工程展開前最少1個月向署長提交工程項目的管道施工計劃的3份硬複本及1份電子版本，以供審批。管道施工計劃須包括但不限於為工程項目鋪設海底氣體管道而進行挖泥及沖噴工程以及圍堰建造工程的不同工作範圍的詳細時間表、次序和計劃。挖泥及沖噴工程計劃須考慮到中華白海豚繁殖高峰期及江豚出沒高峰期，以致在可行情況下盡量減少對海洋生態的影響。挖泥及沖噴工程須按照核准管道施工計劃所載的資料進行。
Submission of Pipeline Laying Method Plan

2.9 The Permit Holder shall, no later
than 1 month before the commencement of construction of the Project, deposit
with the Director 3 hard copies and 1 electronic copy of a pipeline laying
method plan of the Project. The pipeline laying method plan shall include but
not limited to the detailed design of the pipeline trenches for laying and
burying the subsea gas pipeline, methods for laying and burying the subsea gas
pipeline, dredging and jetting rate for laying the subsea gas pipeline, types
and numbers of dredging and jetting plants for construction of the Project. No
more than one Trailing Suction Hopper Dredger shall be used for construction of
the subsea gas pipeline. No more than two jetting machines shall be used for
construction of the subsea gas pipeline. The subsea gas pipeline shall be
constructed in accordance with the information as contained in the deposited
pipeline laying method plan.
許可證持有人須在工程項目的建造工程展開前最少1個月向署長存放工程項目管道鋪設方案的3份硬複本及1份電子版本。管道鋪設方案須包括但不限於用以鋪設及埋設海底氣體管道的喉管坑道的詳細設計、鋪設及埋設海底氣體管道的方法、鋪設海底氣體管道的挖泥及沖噴速度、為工程項目施工所使用的挖泥及沖噴機器的類別及數目。不得使用多於一艘抓吸式裝料斗挖泥船來建造海底氣體管道，海底氣體管道亦不得使用多於兩部沖噴機來建造。海底氣體管道須按照已存放的管道鋪設方案所載的資料建造。

2.10
The
Permit Holder shall, no later than 1 month before the commencement of marine
works including construction
of the subsea gas pipeline, deposit with the Director 3 hard copies and 1
electronic copy of a silt curtain deployment plan. The silt curtain deployment plan shall
include but not limited to the details of the design, installation, testing, operation and maintenance of the
silt curtains to be deployed during construction of the Project to avoid and
minimize the water quality impact due to the dredging and jetting works for
laying and burying the subsea gas pipeline. Pilot tests on the
efficiency of silt curtain system shall be conducted during the early stage of
construction to confirm the removal efficiency of the silt curtains. The deposited silt curtain deployment plan shall be fully and properly implemented during construction of
the Project.
許可證持有人須在海事工程（包括建造海底氣體管道）展開前最少1個月向署長存放淤泥屏障鋪設計劃的3份硬複本及1份電子版本。淤泥屏障鋪設計劃須包括但不限於擬在工程項目施工期間鋪設淤泥屏障的設計、安裝、測試、運作及保養詳情，以避免及減少為鋪設及埋設海底氣體管道而進行挖泥及沖噴工程對水質造成的影響。在施工初期須對淤泥屏障系統的效率進行測試，以確認淤泥屏障的清除效率。工程項目施工期間須徹底及妥善地執行已存放的淤泥屏障鋪設計劃。
Submission of Waste Management Plan

2.11
The
Permit Holder shall, no later than 1 month before the commencement of
construction of the Project, deposit with the Director 3 hard copies and 1
electronic copy of a waste management plan (WMP) for the construction of the
Project. The WMP shall describe the arrangements for avoidance, reuse, recovery
and recycling, storage, collection, treatment and disposal of different
categories of waste to be generated from the construction activities and shall
include the recommended mitigation measures on waste management in the approved
EIA Report (Register No. AEIAR-218/2018). The WMP shall describe the disposal
arrangements and locations of the dredged marine sediments and construction and
demolition materials arising from the construction of the Project. Marine
dumping permit system and trip ticket system shall be described in the WMP. The
deposited WMP shall be fully and properly implemented during construction of
the Project.
許可證持有人須在工程項目的建造工程展開前最少1個月向署長存放工程項目施工階段的廢物管理計劃的3份硬複本及1份電子版本。計劃須說明就避免產生、重用、回收、循環再用、貯存、收集、處理及處置由建造活動所產生的各類廢物而作出的安排，並須在核准環評報告（登記冊編號：AEIAR-218/2018）中載述廢物管理的建議緩解措施。計劃須說明挖出的海泥及因工程項目施工所產生的拆建物料的處置安排和位置。計劃中須說明傾物入海許可證制度和運載記錄制度。工程項目施工期間須徹底及妥善地執行已存放的廢物管理計劃。

3.1
Dredging
and jetting rate for construction of the subsea gas pipeline shall not be
higher than the maximum allowable working rate as specified in the pipeline laying method plan deposited under Condition 2.9.
建造海底氣體管道的挖泥和沖噴速度不得超過按條件第2.9項規定存放的管道鋪設方案所訂明的最高容許工作速度。
3.2
Dredging
and jetting works for construction of the subsea gas pipeline shall only be
carried out in accordance with the types and numbers of dredging and jetting
machines as
specified in the pipeline
laying method plan deposited under Condition
2.9.
為建造海底氣體管道而進行挖泥及沖噴工程時，必須按條件第2.9項規定存放的管道鋪設方案所訂明的挖泥及沖噴機器的類別及數目進行。
3.3
Silt
curtains shall be
properly installed, tested, operated and maintained during construction of the subsea gas pipeline
in accordance with the silt curtain deployment plan deposited under Condition
2.10. Cage-type silt curtain shall be installed enclosing the grab dredger and jetting
machine during construction of the subsea gas pipeline. No silt curtain installation shall encroach onto the existing
marine parks and
the proposed Southwest Lantau Marine Park and South Lantau Marine Park.
在建造海底氣體管道期間，須按條件第2.10項規定存放的淤泥屏障鋪設計劃妥善安裝、測試、運作和保養淤泥屏障。在建造海底氣體管道期間，須裝設籠式淤泥屏障將抓斗挖泥機及沖噴機圍封。任何裝設的淤泥屏障不得侵入現有海岸公園及擬議的大嶼山西南海岸公園和南大嶼海岸公園。

3.4
No
working vessels for construction of the Project shall
enter into, transit through, stop over or anchor within the existing marine
parks and the
proposed Southwest Lantau Marine Park and South Lantau Marine Park, unless otherwise agreed by the Director.
除非另獲署長同意，任何工程項目的施工船隻不得進入、穿過、中途停留或碇泊於現有海岸公園及擬議的大嶼山西南海岸公園和南大嶼海岸公園內。
3.5
Working vessels for construction of the Project
shall not be operated at a speed higher than 10 knots when moving within the
areas frequented by Chinese White Dolphin or Finless Porpoise, including the
waters near Sha Chau and Lung Kwu Chau Marine Park,
the waters at the west of Lantau Island and the waters between Soko Islands and Shek Kwu Chau. The working vessels shall be equipped with
tracking devices to record their operating speeds and marine travel routes
during construction of the Project. The records shall be submitted weekly to
the ET Leader and IEC for review of the acceptability of operating speeds and
marine travel routes. The records shall be included in the monthly EM&A Reports.
The Director may in consultation with AFCD require the Permit Holder by notice
in writing to decrease the operating speeds of the working vessels, to change
the marine travel routes of the working vessels and to increase the submission
frequency of the records to the ET leader and IEC.
工程項目的施工船隻在中華白海豚或江豚經常出沒的範圍內（包括沙洲及龍鼓洲海岸公園附近的水域、大嶼山以西的水域及索罟群島與石鼓洲之間的水域）行駛時，不得以超過每小時10海里的速度運行。施工船隻須裝設跟蹤裝置，以記錄其在工程項目施工期間的運行速度和海上航行路線。有關記錄須每周提交給環境小組組長及獨立環境查核人，以檢視運行速度和海上航行路線的可接受程度。有關記錄亦須載入每月環監報告內。署長與漁護署協商後，可以書面要求許可證持有人減低施工船隻的運行速度、改變施工船隻的海上航行路線和增加提交有關記錄給環境小組組長及獨立環境查核人的次數。
3.6
No
construction works for the section of subsea
gas pipeline between North of Tai O and Fan Lau shall be carried out in the
months of May and June in order to avoid the peak calving season of Chinese
White Dolphin. Construction works for the subsea gas pipeline shall be carried
out in accordance with the construction programme
described in
the pipeline construction plan approved under Condition 2.8.
就大澳以北與分流之間的一段海底氣體管道，不得在5月及6月份進行任何建造工程，以避開中華白海豚繁殖高峰期。海底氣體管道的建造工程須按條件第2.8項的核准管道施工計劃所說明的施工計劃進行。
3.7
No dredging and jetting works
for the section of subsea gas pipeline between South of Soko
Islands and the jetty shall be carried out from 1900 hours to 0700 hours of the
following day. Construction works for the subsea gas pipeline shall be carried
out in accordance with the construction programme
described in
the pipeline construction plan approved under Condition 2.8.
就索罟群島以南與碼頭之間的海底氣體管道，不得在1900時至翌日0700時期間進行挖泥及沖噴工程。海底氣體管道的建造工程須按條件第2.8項的核准管道施工計劃所說明的施工計劃進行。
3.8
A marine mammal exclusion zone
of not less than 250m radius from the dredging and jetting works shall be
implemented during the construction work for the subsea gas pipeline. No
dredging or jetting works shall be carried until the marine mammal exclusion zone
is confirmed by an experienced marine mammal observer as clear of marine
mammals for 30 minutes continuously. Use of passive acoustic monitoring device shall
be explored to assist the marine mammal observer to monitor and detect the
marine mammals. The Director may in consultation with AFCD require the Permit
Holder by notice in writing to enlarge the marine mammal exclusion zone for the
dredging and jetting works.
在海底氣體管道的建造工程進行期間，須圍繞挖泥及沖噴工程不少於250米半徑範圍實施海洋哺乳動物管制區。待具備經驗的海洋哺乳動物觀察員確認海洋哺乳動物管制區連續30分鐘都沒有海洋哺乳動物出現後，才可進行挖泥或沖噴工程。須研究使用被動聲音監測裝置，協助海洋哺乳動物觀察員監測及偵察海洋哺乳動物。署長與漁護署協商後，可以書面要求許可證持有人為挖泥及沖噴工程擴大海洋哺乳動物管制區。

3.9
The Permit Holder shall
implement the waste management measures in accordance with the information as contained
in the waste management plan deposited under Condition 2.11.
許可證持有人須按條件第2.11項存放廢物管理計劃所載的資料實施廢物管理措施。
營辦工程項目須提交的文件和採取的措施
設立環境管理系統
4.1
The Permit Holder shall, before the operation of
the Project or otherwise agreed by the Director, develop and implement an environmental management system (EMS) for
the operation of the Project. The EMS is to ensure that the operation of the
Project is in an environmentally
friendly manner and in accordance with all relevant environmental legislation.
The EMS shall include but
not limited to regular environmental audit of the Project to ensure that it is properly
operated and maintained to avoid or minimize any environmental impact. The
Permit Holder shall engage an Environmental Manager to oversee and implement
the EMS. The Environmental Manager shall be a person who has at least 7 years
of experience in Environmental Monitoring and Audit (EM&A) or environmental
management. The EMS shall be certified under ISO 14000 within 1 year after the
operation of the Project, unless otherwise agreed by the Director.
許可證持有人須在營辦工程項目之前或另獲署長同意的時限，制訂及執行環境管理系統，以營辦工程項目。環境管理系統須確保工程項目能以環保方式營辦，並符合各相關的環保法例。環境管理系統須包括但不限於對工程項目進行定期環境審核，確保工程項目妥善地營辦及維持，以避免產生或盡量減少任何環境影響。許可證持有人須聘用一名環境經理，以監察及執行環境管理系統。環境經理須在環境監察及審核或環境管理方面至少有7年經驗。除非另獲署長同意，環境管理系統須在工程項目營辦後1年內獲ISO 14000標準認證。

4.2 The Permit Holder shall, no later than 3 months before the commencement of operation of the Project, deposit with the Director 3 hard copies and 1 electronic copy of a safety management plan for the operation of the Project. The safety management plan shall describe the safety management system (SMS) for the operation of the Project and shall include but not limited to information relating to the key safety design features, operation and maintenance procedures, emergency response procedures, marine safety arrangements and procedures and regular safety audit for the operation of the Project. The Permit Holder shall fully and properly implement the safety management measures in the deposited safety management plan during operation of the Project.
許可證持有人須在工程項目的營辦工程展開前最少3個月向署長存放安全管理計劃的3份硬複本及1份電子版本，以營辦工程項目。安全管理計劃須說明項目營運期間的安全管理系統，並包括但不限於以下資料：有關營辦工程項目的主要安全設計特點、運作及保養程序、緊急應變程序、海上安全安排及程序以及定期安全審核。許可證持有人須在營辦工程項目期間徹底及妥善地執行已存放的安全管理計劃內的安全管理措施。
4.3 The Permit Holder shall implement the SMS for the operation of the Project in accordance with the safety management plan deposited under Condition 4.2. The SMS is to ensure that the operation of the Project is in a safe manner and in accordance with all relevant legislation for gas safety and marine safety. The SMS shall include engagement of the relevant experts to oversee and implement the SMS and conduct of regular safety audit for the Project.
許可證持有人須按條件第4.2項存放的安全管理計劃執行安全管理系統，以營辦工程項目。安全管理系統須確保工程項目能以安全方式營辦，並符合氣體安全和海事安全的各項相關法例。安全管理系統須包括聘用相關的專家，以監察及執行安全管理系統並就工程項目進行定期安全審核。

4.4 Except the FSRU vessel, no other vessels for operation of the Project shall enter into, transit through, stop over or anchor within the existing or proposed marine parks, unless otherwise agreed by the Director.
除非另獲署長同意，否則除浮式儲存再氣化裝置船外，任何其他營辦工程項目的船隻均不得進入、穿過、中途停留或碇泊於現有或擬議的海岸公園內。

4.5 The Permit Holder shall implement measures to prevent accidental spillage or leakage of gas, oil and chemicals during operation of the Project and contingency measures to respond the accidental spillage or leakage in order to avoid and minimize the potential environmental impacts. The Permit Holder shall, no later than 3 months before the commencement of operation of the Project, deposit with the Director 3 hard copies and 1 electronic copy of an emergency response plan. The emergency response plan shall include but not limited to information relating to preventive measures to prevent accidental spillage or leakage of gas, oil and chemicals, contingency measures and procedures to handle the accidental spillage or leakage, rehearsal arrangements for the contingency measures and procedures and reporting arrangements for the accidental spill event.
許可證持有人須採取措施預防在營辦工程項目期間發生意外溢漏或洩漏氣體、油類及化學品，並採取應變措施處理意外溢漏或洩漏事故，以避免及減少對環境造成的潛在影響。許可證持有人須在工程項目的營辦工程展開前最少3個月向署長存放緊急應變計劃的3份硬複本及1份電子版本。緊急應變計劃須包括但不限於以下資料：防止意外溢漏或洩漏氣體、油類及化學品的預防措施、處理意外溢漏或洩漏事故的應變措施及程序、應變措施及程序的預演安排以及報告意外溢漏事故的安排。
就海洋生態及漁業採取的提升措施
4.6 The Permit Holder shall, no later than 3 months before the commencement of operation of the Project, submit 3 hard copies and 1 electronic copy of an environmental enhancement plan to the Director for approval. The environmental enhancement plan shall include but not limited to information relating to the environmental enhancement initiatives for marine ecology and conservation, fisheries resources and sustainable development of the fishing industry, the arrangements to support the environmental enhancement initiatives and to set up an independent management committee consisting of experts, representatives of the fishermen organizations and other stakeholders to oversee the implementation of the environmental enhancement initiatives, and the membership and terms of reference of the independent management committee.
許可證持有人須在工程項目的營辦工程展開前最少3個月向署長提交環境提升計劃的3份硬複本及1份電子版本，以供審批。環境提升計劃須包括但不限於以下資料：針對海洋生態和保育、漁業資源和漁業可持續發展的環境提升措施；支持環境提升措施的安排；以及成立一個由專家、漁民團體代表及其他持份者組成的獨立管理委員會以監察環境提升措施的實施情況的安排、委員會成員資料及職權範圍。

5.1 The Permit Holder shall implement the EM&A programme
in accordance with the procedures and requirements as set out in the updated
EM&A Manual under
Condition 2.5 of this Permit. Any change to the EM&A
requirements or programme
shall be justified by the ET Leader and verified by the IEC as conforming to
the relevant information and requirements set out in the updated EM&A Manual before submission to the Director for
approval.
許可證持有人須按本許可證條件第2.5項下更新環監手冊所載的程序及規定執行環監計劃。環監規定或計劃如有任何更改，須由環境小組組長提出充分理由，並由獨立環境查核人核實，證明其符合更新環監手冊所載的相關資料及規定，然後才提交署長批准。
5.2 The Permit Holder
shall take samples, measurements and necessary remedial actions in accordance
with the requirements of the updated EM&A Manual by:
許可證持有人須按更新環監手冊所載規定進行取樣、測量及所需的補救行動：
(i)
conducting baseline environmental monitoring;
進行環境基線監測；
(ii)
conducting impact environmental monitoring;
進行環境影響監測；
(iii)
carrying out remedial actions described in the Event/Action
Plans of the updated EM&A Manual in accordance with the time frame
set out in the Event/Action Plans, or as agreed by the Director, in case where
specified criteria in the updated EM&A Manual are exceeded;
and

(iv)
logging and keeping records of the details of (i) to (iii) above for all parameters within 3 working days
of the collection of data or completion of remedial action(s), for the purpose
of preparing and submitting the monthly EM&A Reports and to make available
the information for inspection on site.

5.3 The Permit Holder shall submit 3 hard copies and 1 electronic copy of relevant Baseline Monitoring Reports to the Director at least 2 weeks before the commencement of construction of the Project. The submissions shall be certified by the ET Leader and verified by the IEC as having complied with the requirements as set out in the updated EM&A Manual before submission to the Director. Additional copies of the Baseline Monitoring Report shall be provided upon request by the Director.
許可證持有人須在工程項目的建造工程展開前至少2個星期向署長提交有關基線監測報告的3份硬複本及1份電子版本。提交文件須由環境小組組長核證及獨立環境查核人核實，證明其符合更新環監手冊所載的規定，然後才提交署長。如署長要求，則須提交基線監測報告的額外複本。
5.4 The Permit Holder shall
submit 3 hard copies and 1 electronic copy of Monthly EM&A Reports to the
Director, within 2 weeks after the end of the reporting month. The monthly
EM&A Reports shall include an executive summary of all environmental audit
results, together with actions taken in the event of non-compliance
(exceedances) of the environmental quality performance limits (Action and Limit
Levels), complaints received and emergency events relating to violation of
environmental legislation (such as illegal marine dumping). The
submissions shall be certified by the ET Leader and verified by the IEC as
having complied with the requirements as set out in the updated EM&A Manual
before submission to the Director. Additional copies of the Monthly EM&A
Reports shall be provided upon request by the Director.
在每個提交報告的月份結束後2個星期內，許可證持有人須向署長提交每月環監報告的3份硬複本及1份電子版本。每月環監報告須包括各項環境審核結果，以及在發生不符合（超出）環境質素表現規限（行動及極限水平）情況時所採取的行動、接獲有關違反環境法例（例如非法海上傾倒物料）的投訴及發生相關緊急事件的行政摘要。提交的報告須由環境小組組長核證及獨立環境查核人核實，證明其符合更新環監手冊所載的規定，然後才提交署長。如署長要求，則須向署長提交每月環監報告的額外複本。
5.5 All environmental monitoring and audit data
submitted under this Permit shall be true, valid and correct.
根據本許可證提交的所有環監數據，均須有效及真實無誤。
5.6 To ensure a high degree of transparency
regarding the monitoring data and results in view of the public concern about
the Project, all environmental monitoring and audit data and results and all
submissions and all performance test data and results required by this Permit
shall be made available by the Permit Holder to the public through a dedicated
website to be set up by the Permit Holder under Condition 6.2 below, in the
shortest practicable time and in no event later than 2 weeks after such
information is available.
基於公眾對工程項目的關注，為確保監察數據和結果具高透明度，許可證持有人須盡快把各項環境監察及審核數據和結果、本許可證規定的所有提交文件及各項表現測試數據和結果，透過按下文條件第6.2項由許可證持有人設立的特定網站供公眾閱覽，在任何情況下均不得遲於這些資料可供閱覽後的2個星期。
環監資料的電子匯報
6.1 To facilitate public inspection of the Baseline
Monitoring Report and Monthly EM&A Reports via the EIAO Internet Website
and at the EIAO Register Office, electronic copies of these Reports shall be
prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in
Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by
the Director and shall be submitted at the same time as the hard copies as
described in Conditions 5.3 and 5.4 of this Permit. For the HTML version, a content page capable of
providing hyperlink to each section and sub-section of these Reports shall be
included in the beginning of the document. Hyperlinks to all figures, drawings
and tables in these Reports shall be provided in the main text from where the
respective references are made. All graphics in these Reports shall be in
interlaced GIF, JPEG or PDF format unless otherwise agreed by the Director. The
content of the electronic copies of these Reports must be the same as the hard
copies.
為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱基線監測報告及每月環監報告，以超文本標示語言(HTML)（第4.0或較後版本）及便攜式文件格式(PDF)（第1.3或較後版本）製作的報告的電子版本，除非另獲署長同意，須與本許可證條件第5.3及5.4項所說明的硬複本同時提交。關於HTML的版本方面，可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意，報告內所有圖形均須以交錯存取的GIF, JPEG或PDF格式制定。報告的電子版本內容，必須與硬複本的內容一致。
6.2 The Permit Holder shall, at least 2 weeks before the commencement of
construction of the Project, set up a dedicated Internet website and notify the
Director in writing the Internet address where the environmental monitoring
data and project information is to be placed. All environmental monitoring data
described in Condition 6.1 above shall be made available to the public via the
abovementioned dedicated Internet website. All finalized submissions and plans
shall be made available to the public via the dedicated Internet website in the
shortest possible time and in any event no later than 2 weeks after the
submissions and plans are approved by or deposited with the Director, unless
otherwise agreed with the Director. The Permit Holder shall maintain the dedicated
website for public access of the environmental monitoring data and reports
throughout the entire construction period and until 3 years after the last
EM&A Report is uploaded, or otherwise as agreed by the Director.
許可證持有人須在工程項目的建造工程展開前最少2個星期設立特定網站存放環境監察數據及工程項目資料，並以書面通知署長互聯網網址所在。上文條件第6.1項說明的所有環境監察數據，均須透過上述特定互聯網網站供公眾閱覽。所有提交文件及圖則定稿，均須盡快透過該特定互聯網網站供公眾閱覽，在任何情況下均不得遲於有關提交文件及圖則獲署長核准或向署長存放後的2個星期，除非另獲署長同意。許可證持有人須在工程項目整個施工期內及直至最後一份環監報告上載後3年，或署長同意的其他期間，維持該特定網站，供公眾接達有關環境監察數據及報告。
6.3 The Internet website as
described in Condition 6.2 above shall enable user-friendly public access to
the environmental monitoring data and project information including the Project
Profile of the Project, the EIA Report, and this
Permit. The Internet website shall have features capable of:
上文條件第6.2項說明的互聯網網站，必須方便用戶使用，讓公眾容易接達環境監察數據及工程項目資料，當中包括工程項目簡介、環評報告及本許可證。除非另獲署長同意，互聯網網站須具備部件，提供下述功能：
(i)
providing access to all environmental monitoring data of
this Project collected since the commencement of construction;
接達建造工程展開後所收集的全部環境監察數據；
(ii)
providing access to all finalized submissions as required
under this Permit;
接達本許可證規定的所有提交文件的定稿；
(iii)
searching by date;
按日期搜尋；
(iv)
searching by types of monitoring data; and

(v)
hyperlinking to relevant monitoring data after searching;

or otherwise as agreed by the Director.
Notes:

1. This Permit consists of three parts,
namely, Part A (Main Permit), Part B (Description
of Designated Project) and Part C (Permit Conditions). Any
person relying on this permit shall obtain independent legal advice on the
legal implications under the EIAO, and the following notes are for general
information only.
本許可證共有3部，即A部 (許可證主要部分)；B部 (指定工程項目的說明) 及C部 (許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。
2. If there is a breach of any condition
of this Permit, the Director or his authorized officer may, with the consent of
the Secretary for the Environment, order the cessation of associated work until
the remedial action is taken in respect of the resultant environmental damage,
and in that case the Permit Holder shall not carry out any associated works
without the permission of the Director or his authorized officer.
如違反本許可證的任何條件，署長或獲授權人員可在環境局局長的同意下勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。
3. The Permit Holder may apply under
Section 13 of the EIAO to the Director for a variation of the conditions of
this Permit. The Permit Holder shall replace the original permit displayed on
the Project site by the amended permit.
許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。
4. A person who assumes the responsibility
for the whole or a part of the Project may, before he assumes responsibility of
the Project, apply under Section 12 of the EIAO to the Director for a further
environmental permit.
承擔工程項目整項或部分工程的責任的人，在承擔責任之前，可根據條例第12條的規定向署長申請新的環境許可證。
5. Under Section 14 of the EIAO, the
Director may with the consent of the Secretary for the Environment suspend,
vary or cancel this Permit. The suspended, varied or cancelled Permit shall be
removed from display at the Project site.
根據條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的環境許可證必須從工程項目工地除下，不再展示。
6. If this Permit is cancelled or
surrendered during the construction or operation of the Project, another
environmental permit must be obtained under the EIAO before the Project could
be continued. It is an offence under Section 26(1) of the EIAO to construct or
operate a designated project listed in Part 1 and 2 of Schedule 2 of the EIAO
without a valid environmental permit.
如果本許可證在工程項目建造或營辦期間取消或交回，則在繼續進行工程項目之前，必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦條例附表2第I及第II部所列明的指定工程項目，即屬犯罪。
7. Hong Kong LNG Terminal Limited, as the
Permit Holder of Further Environmental Permit No. FEP-01/558/2018/A, is
responsible to construct and operate the “Hong Kong Offshore LNG Terminal –
Works associated with the double berth jetty at the LNG Terminal”.
作為新的環境許可證編號FEP-01/558/2018/A持有人，香港液化天然氣接收站有限公司負責建造及營辦“香港海上液化天然氣接收站 - 海上液化天然氣接收站的雙泊位碼頭的相關工程”。
8. The Hongkong Electric Co., Ltd, as the Permit
Holder of Further Environmental Permit No. FEP-02/558/2018/A, is responsible to construct and operate the “Hong Kong Offshore LNG Terminal
– Works associated with the subsea gas pipeline for Lamma
Power Station (LPS) and the associated Gas Receiving Station (GRS) in LPS”.
作為新的環境許可證編號FEP-02/558/2018/A持有人，香港電燈有限公司負責建造及營辦“香港海上液化天然氣接收站 - 連接至南丫發電廠的海底天然氣管道及位於南丫發電廠的天然氣接收站的相關工程”。
9. Any person who constructs or operates the
Project contrary to the conditions in the Permit, and is convicted of an
offence under the EIAO, is liable:
如任何人在違反本許可證的條件下建造或營辦工程項目，根據環評條例，即屬犯罪：
(i) on a first
conviction on indictment to a fine of $2 million and to imprisonment for 6
months;
一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；
(ii) on a second or subsequent
conviction on indictment to a fine of $5 million and to imprisonment for 2
years;
一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；
(iii) on a first summary conviction to a fine at
level 6 and to imprisonment for 6 months;
一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；
(iv)
on a second or subsequent summary conviction to a fine of
$1 million and to imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；及
(v) in any case where the offence is of a
continuing nature, the court or magistrate may impose a fine of $10,000 for
each day on which he is satisfied the offence continued.
在任何情況下如該罪行屬連續性質，法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。
10. The Permit Holder may appeal against any condition
of this Permit under Section 17 of the EIAO within 30 days of receipt of this
Permit.
許可證持有人可在接獲本許可證後30天內，根據條例第17條就本許可證的任何條件提出上訴。
11. The Notes are for general reference only and that the Permit
Holder should refer to the EIAO for details and seek independent legal advice.
