Application for Approval of EIA Report

I
refer to your application of 6 April 2002 for approval of the above EIA report
under Section 6(2) of the EIA Ordinance and our previous letter of 7th
May 2002 advising you on the suitability of the EIA report for public
inspection.
After
the public inspection period and the consultation with the Advisory Council on
the Environment, I now advise you that under section 8(3) of the Ordinance, the
captioned EIA report as exhibited under section 7(1) is approved with the
attached conditions.
Under
section 15 of the Ordinance, the approved EIA report will be placed on the EIA
Ordinance¡¦s Register. The approved EIA report and the approval conditions will
also be placed on the EIA Ordinance¡¦s Website (www.info.gov.hk/epd/eia). All
the recommendations of the approved EIA report must be properly implemented.
Any subsequent change to the approved EIA report must be agreed with the
Director in writing, and will be placed on the Register as directed by the
Director.
The
approval of the EIA report shall not remove any person¡¦s responsibility to
comply with other legislation or to obtain other Government¡¦s approvals.

Conditions of Approval under Section 8(3) of the EIA Ordinance (the Ordinance)
The EIA Report as exhibited under Section 7(1) of the Ordinance is approved by the Director on the condition that the following requirements shall form part of the approved EIA Report :
1. The project proponent shall develop a robust Environmental Monitoring and Audit programme to improve the effectiveness of the sedimentation tanks and appropriate additional measures (such as filter system) should be incorporated.
2. The project proponent shall liaise with Agriculture, Fisheries and Conservation Department and other Government departments to develop a plan on the beneficial use of the materials resulting from vegetation clearance so as to reduce the amount to be taken to landfills. The proposal shall be incorporated into the Waste Management Plan to be submitted for the Director¡¦s approval.
