Application for Permission to Apply Directly for Environmental Permit

Conditions Imposed under Section 5(12) of the EIA Ordinance

for Permission to Apply Directly for Environmental Permit

 

 

1.      All measures described in the Project Profile submitted by the applicant on 22 August 2002 shall be fully implemented.

 

2.      A proposal on the control of site run-off prepared based on the relevant measures stipulated in the WSD’s “Conditions of Working within Water Gathering Grounds” and EPD’s guidelines on “Construction Site Drainage” shall be submitted before commencement of works. The proposal shall also include a Contingency Plan dealing with unexpected circumstances of pollution of Shek Pik Reservoir and the stream courses flowing into the reservoir. The applicant shall closely supervise the construction works on-site to ensure that all measures in the proposal are implemented. An action plan listing out the responsibilities of the Engineer, the contractor and the related personnel in the project to avoid or minimize the water quality impact shall be formulated. Regular environmental audit of construction works shall be implemented.

 

3.      No site canteen shall be erected on the works site.

 

4.      A qualified horticulturist responsible for the transplantation of Enkianthus quinqueflorus and the determination of appropriate native species for compensation in case of failure of transplantation shall be employed to implement the transplantation or planting works as appropriate, and to monitor and maintain the trees during the maintenance period.

 

5.      Disturbance or diversion of natural stream courses shall not be allowed in the course of the slope upgrading works.

 

6.      Application for tree felling, if required, shall be submitted to the responsible government departments for approval. The tree felling application shall be accompanied with justification and comprehensive tree survey.

 

 

 

Note

Under Section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director’s decision.
