Conditions Imposed under Section 5(12) of the Ordinance
for Permission to Apply Directly for Environmental Permit
1. All measures described in the Project Profile submitted by the applicant on 26 September 2002, together with those requirements mentioned in the following conditions, shall be fully implemented.
2. The applicant shall employ an experienced ecologist to carry out the proposed mitigation measures to minimize impacts on Romer’s Tree Frogs at the moist vegetated area below slope no. 15NW-C/C3. The ecologist shall have at least 3 years of direct experience in surveying and handling Romer’s Tree Frogs and caring for captive Romer’s Tree Frogs.
3. To reduce the potential stress and facilitate proper implementation of the proposed mitigation measures on the Romer’s Tree Frogs, the experienced ecologist, on behalf of the applicant, shall prepare a detailed translocation manual for Romer’s Tree Frogs to be followed under the project. The manual shall cover the following aspects:
(i) Detailed schedule for the baseline survey and translocation of Romer’s Tree Frogs;
(ii) Detailed arrangements for collecting Romer’s Tree Frogs, the preparation of the holding facilities, work schedule and set-up required;
(iii) Transportation arrangements between the project site and the holding facilities;
(iv) Methods for determining the acceptable range of water quality and details of potential mitigation measures to be implemented in case of water quality deterioration during the slope upgrading works;
(v) Methods for determining the acceptability of the moist vegetated area for release of the captive Romer’s Tree Frogs after completion of the slope upgrading works;
(vi) Contingency measures if establishment of Romer’s Tree Frogs at the moist vegetated area is found to be infeasible or unsuccessful; and
(vii) Detailed arrangements for the monitoring of Romer’s Tree Frogs after release.
4. The manual stated above shall be submitted to the Director for agreement at least 2 months before commencement of the baseline survey.
5. The mitigation measures for the Romer’s Tree Frogs shall be implemented in accordance with the submitted Project Profile and the detailed translocation manual.
Under section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director’s decision.
