Conditions Imposed under Section 5(12) of the EIA Ordinance
1. All measures and environmental monitoring and audit (EM&A) programme described in the Project Profile (No. PP-420/2010) submitted by the applicant on 13 August 2010 shall be fully implemented.
2. To minimize the potential impact on the bats, the Project works at the Residence of Ip Ting-sz shall only be carried out from November to March during which the bats will leave the Residence for hibernation at other places and the works shall only be commenced after confirming that all bats have left the Residence.
3. No direct discharge or dumping activity shall be carried out to the nearby Lin Ma Hang Stream, which is a Site of Special Scientific Interest.
4. An independent checker shall be employed to audit the implementation of all mitigation measures and EM&A programme recommended in the Project Profile and to confirm in writing in the monthly audit report full implementation of the mitigation measures and EM&A programme.
Note
Under Section 17 of the EIA Ordinance, the applicant may appeal to the Appeal Board against any of the above conditions within 30 days of the receipt of this notice of the Director’s decision.
