ENVIRONMENTAL PERMIT TO CONSTRUCT AND OPERATE A DESIGNATED PROJECT
建造及營辦指定工程項目的環境許可證
PART A (MAIN PERMIT)
Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to the AGRICULTURE AND FISHERIES DEPARTMENT (the "Permit Holder") to construct and operate the designated project described in Part B subject to the conditions described in and attached to Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:
根據環境影響評估條例第10條的規定﹐環境保護署署長(署長) 將本環境許可證批予漁農處(許可證持有人)以建造及營辦B部所說明的指定工程項目﹐但須遵守C部所說明或附載的條件。

PART C (PERMIT CONDITIONS)
1. General Conditions
1.1 The Permit Holder shall ensure full compliance with all conditions of this permit. Any non-compliance with this permit may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or permit cancellation where applicable.
1.2 This permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution Control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), Waste Disposal Ordinance (Cap.354) and others.
1.3 The Permit Holder shall make copies of this permit available at all times for inspection by the Director at all sites covered by this permit.
1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the site(s).
1.5 The Permit Holder shall display a copy of this permit at the dredging and relocation sites, or at the nearest convenient locations for the public's information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the permit, the notice he sends to the Director shall also be displayed at the same locations for displaying the original permit.
1.6 The Permit Holder shall construct and operate the project in accordance with the project descriptions in Part B of this permit, the details in the Project Profile and the conditions of the Director's permission.
2. Specific Conditions
2.1 The Permit Holder shall before commencement of dredging at the Project site submit details on the silt curtain(s) to be used, including dimensions, exact locations and method of installation and removal, to the Director for approval. The silt curtain shall be erected at the site in such manner as approved by the Director before commencement of dredging and shall be maintained in good condition throughout the dredging operation.
2.2 The Permit Holder shall revise the Environmental Monitoring and Audit Manual for the Project in accordance with the Director's comments and submit the Manual to the Director before commencement of dredging.
2.3 There shall be no mariculture activities at the Project site during dredging. The Permit Holder shall before commencement of dredging remove all the fish rafts from the project site to the approved temporary relocation sites at Silver Mine Bay , Peng Chau and Chi Ma Wan, as shown in Figure 1. The Permit Holder shall only arrange the fish rafts to be moved to Mong Tong Wan in case of emergency, for instance in the event of typhoon. The Permit Holder shall inform the Director within 24 hours of such emergency move.
2.4 The relocated raft areas at Silver Mine Bay, Peng Chau and Chi Ma Wan respectively shall not exceed 23,000m2, 1,100m2, and 2,500m2 unless prior approval is obtained from the Director.
2.5 The Permit Holder shall before commencement of dredging submit to the Director a 4-week pre-project baseline study report in the agreed format. Water quality parameters shall be measured at the designated monitoring stations as agreed by the Director.
2.6 Dredging shall only proceed in Cheung Sha Wan Fish Culture Zone.
2.7 Sediments to be dredged from the seabed of Cheung Sha Wan shall not exceed 1 metre in depth and a total in-situ volume of 0.15 million m3.
2.8 Only one 8-metre grab dredger shall be used at any time throughout the course of dredging.
2.9 Closed grabs shall be used for all dredging.
2.10 Barges and grab dredgers shall be fitted with tight-fitting seals to their bottom openings to prevent leakage of materials.
2.11 Freeboard shall be installed on barges during dredging operation to ensure that decks would not be washed by waves.
2.12 Dredged materials shall be carried out by hopper barges and transported via tug boats for disposal at areas approved by the Director.
2.13 The Permit Holder shall ensure full compliance with the requirements specified in the Environmental Monitoring and Audit Manual, as approved by the Director.
2.14 During dredging, the water quality at both dredging and relocation sites shall be monitored in accordance with the specifications contained in the Environmental Monitoring and Audit Manual. A post-project monitoring programme lasting for 4 weeks shall be undertaken in the same manner as that for the impact monitoring of the dredging works.
2.15 The relocated fish rafts shall be returned to their original position in Cheung Sha Wan Fish Culture Zone not later than 4 weeks following the completion of dredging works and not later than 4 months after the initial relocation, unless otherwise approved by the Director.
2.16 The installed silt curtain(s) shall be removed in the manner as proposed under condition 2.1 of this permit not later than 4 weeks following the completion of the dredging works.
2.17 All finalised submissions, as required under this part of the permit, shall be released to the public if requested by the Director, by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the permit Holder shall provide sufficient copies of submissions.
Notes
