PART A (MAIN PERMIT)
A部 (許可證主要部分)

Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this environmental permit to the REGIONAL HIGHWAY ENGINEER/NEW TERRITORIES, HIGHWAYS DEPARTMENT (the "Permit Holder") to construct and operate the designated project described in Part B subject to the conditions described in or attached to Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below :

根據環境影響評估條例第10條的規定﹐環境保護署署長(署長) 將本環境許可證批予 路政署助理署長/新界 以建造及營辦 B部 所說明的指定工程項目﹐但須遵守 C部所說明或附載的條件。本環境許可證的發出﹐乃以下表所列的文件、批准或許可作為根據﹕-

B 部 (指定工程項目的說明)

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (the Permit):

下列為本環境許可證(下稱許可證) A部 所提及的指定工程項目的說明:

PART C (PERMIT CONDITIONS)

1. General Conditions

1.1 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499) and shall be definite ground for enforcement action or permit cancellation where applicable.

1.2 This Permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354), and others.

1.3 The Permit Holder shall make copies of this Permit available at all times for inspection by the Director at all the sites covered by this Permit.

1.4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s).

1.5 The Permit Holder shall display a copy of this Permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the environmental permit, including any amended Permit, is displayed at such locations. If the Permit holder surrenders a part or the whole of the Permit, the notice he sends to the Director of Environmental Protection shall also be displayed at the same locations as the original permit.

1.6 A copy of the EIA Report shall be kept in the Engineer's office and another copy shall be kept in the Contractor's office on site for reference.

1.7 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

1.8 The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and recommendations contained in the EIA Report.

1.9 All deposited submissions, as required under this Permit, shall be rectified in accordance with the comments, if any made by the Director within one month of the receipt of the Director’s comments or otherwise specified by the Director.

1.10 All finalised submissions, as required under this Permit, shall be released to the public if requested by the Director, by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of submissions.

2. Submissions or Measures before Commencement of Construction

2.1 An Environmental Subcontractor shall be established before the commencement of construction of relevant works of the Project. The Environmental Subcontractor shall be headed by a team leader who has at least 7 years experience in environmental monitoring and auditing or environmental management. Pursuant to the EM&A Manual, the Environmental Subcontractor shall be responsible for the implementation of the EM&A programme. The Engineer shall be responsible for ensuring the incorporation and implementation of mitigation measures recommended in the EIA Report.

2.2 An Independent Environmental Auditor be employed before the commencement of construction of relevant works of the Project. The Independent Environmental Auditor shall have at least 7 years experience in environmental monitoring and auditing or environmental management. The Independent Environmental Auditor shall audit the overall EM&A programme including the implementation of all environmental mitigation measures, submissions relating to the environmental monitoring and auditing, and any other submission required under this Permit.

2.3 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale design drawings and explanatory statements showing the mitigation measures relevant to the Conservation Area before the commencement of construction of the relevant works of the Project. The submission shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the information and recommendations contained in the EIA report. Any changes to the designs shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the information and recommendations contained in the EIA report. All measures detailed in the submission shall be fully implemented. Additional copies of the design drawings may be required by the Director.

2.4 The Permit Holder shall submit to the Director for approval 3 sets of landscape plan(s) of a scale 1 to 1000 and explanatory statements showing landscape proposals to mitigate landscape and visual impacts on the Conservation Area at least one month before the commencement of landscape works. The explanatory statements shall also include a management and maintenance schedule indicating how the proposed landscape works will be managed and maintained. Before submission, the plans and statements shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the information and recommendations contained in the EIA report. Additional copies may be required by the Director.

3. Submissions or Measures for Construction and Operation of the Project

3.1 Temporary sound-absorptive noise barriers shall be erected at the site boundary or around noisy equipment during construction of the Project.

3.2 In accordance with the information and recommendations contained in the EIA report and with reference to Annex A and the submission under condition 2.3, measures to mitigate the impacts from construction noise shall be implemented.

3.3 In accordance with the information and recommendations contained in the EIA report and with reference to Annex B and the submission under condition 2.3 and 2.4, measures to mitigate the landscape and visual impacts during construction and operation of the Project shall be implemented.

3.4 In accordance with the information and recommendations contained in the EIA report and with reference to Annex C and the submission under condition 2.3, measures to mitigate the direct and indirect ecological impacts during the construction of the Project.

3.5 All mitigation measures described in EIA Report and the EM&A Manual or in the submissions arising from Section 2 above shall be properly constructed and implemented. Any changes to the measures shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the finding and recommendations contained in the EIA report. The audited changes shall be documented in the immediately following monthly EM&A report.

4. Environmental Monitoring and Audit During Construction Period

4.1 The EM&A programme relevant to the Conservation Area during the construction of the Project shall be implemented as set out in the EM&A Manual. Any changes to the programme shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the requirements set out in the EM&A Manual of the EIA Report before submission to the Director for approval.

4.2 Samples and measurements for noise, ecology and landscape / visual monitoring shall be taken during the construction of the Project in accordance with the requirements of the EM&A Manual by :

1. conducting baseline noise and landscape / visual monitoring at the specified locations and frequencies;
2. conducting impact monitoring on noise, ecology and landscape / visual during construction at the specified locations and frequencies;
3. in cases where specified criteria for construction noise in the EM&A Manual are exceeded, carrying out remedial actions in accordance with the Event/Action Plan, as set out in the EM&A Manual; and
4. logging and keeping records of the details of (a) and (b) above, within 3 working days of the collection of data or completion of remedial action, for the purposes of preparing and submitting the EM&A Reports and to make available the information for inspection on site.

 

 
 
 

4.4 Ten copies of monthly EM&A Report for construction, audited by the Independent Environmental Auditor and approved by the Engineer shall be submitted to the Director within 10 working days from the end of the reporting month or by other means as specified by the Director. Additional copies of the monthly EM&A Report may be required by the Director.

4.5 The submitted reports as required in this part of the permit shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.

4.6 The actions described in the Event/Action Plans / Contingency Plans of the EM&A Manual shall be carried out, in accordance with the time frame set out in the Event/Action Plans / Contingency Plans, or as agreed by the Director.

5. Environmental Monitoring and Audit During Post Project / Operation Period

5.1 The EM&A programme relevant to the Conservation Area during the operation of the Project shall be implemented as set out in the EM&A Manual. Any changes to the programme shall be audited by the Independent Environmental Auditor and approved by the Engineer as conforming to the requirements set out in the EM&A Manual of the EIA Report before submission to the Director for approval.

5.2 Samples and measurements for noise, ecology and landscape / visual monitoring shall be taken during the operation of the Project in accordance with the requirements of the EM&A Manual by :

1. conducting impact monitoring on noise, ecology and landscape / visual during post project / operation period at the specified locations and frequencies;
2. in cases where specified noise criteria in the EM&A Manual are not met, carrying out remedial actions in accordance with the post project / operation noise monitoring programme, as set out in the EM&A Manual; and
3. logging and keeping records of the details of (a) and (b) above, within 3 working days of the collection of data or completion of remedial action, for the purposes of preparing and submitting the EM&A Reports and to make available the information for inspection on site.

 

 
 
 

5.4 The submitted reports as required in this part of the permit shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.

Notes:

1. This environmental permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).
2. The permit holder may apply under section 13 of the Ordinance to the Director for a variation of the conditions of this environmental permit. The permit holder shall replace the original permit displayed on the construction site by the amended permit.
3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under section 12 of the Ordinance to the Director for a further environmental permit.
4. Under section 14 of the Ordinance, the Director with the consent of the Secretary for Planning, Environment and Lands, may suspend, vary on cancel this Permit. The Permit shall then be removed from the display on the construction site.
5. If this Permit is cancelled or surrendered during the construction or operation of the Project, an environmental permit must be obtained under the Ordinance before the construction or operation of the Project could be continued. It is an offence under section 26(1) of the Ordinance to construct or operate a designated project without an environmental permit.
6. The conditions in this Permit cover the part of the Project that falls within the conservation area (the Conservation Area) as indicated on the extract of the Kam Tin South Outline Zoning Plan (S/YL-KTS/1) (Figure 1). The measures described in this Permit are to protect the Conservation Area.

1. 一 般 條 件

1.1 許 可 證 持 有 人 必 須 確 保 完 全 符 合 本 環 境 許 可 證 的 全 部 條 件 。 如 有 不 符 合 本 許 可 證 的 情 況 ， 可 能 構 成 違 反 環 境 影 響 評 估 條 例 (第 499章 )的 規 定 ， 並 可 按 適 用 情 況 作 為 採 取 執 法 行 動 或 取 消 許 可 證 的 確 切 理 由 。

1.2 本 許 可 證 並 不 免 除 許 可 證 持 有 人 須 符 合 現 行 生 效 的 法 例 的 責 任 ， 例 如 ： 噪 音 管 制 條 例 (第 400章 )； 空 氣 污 染 管 制 條 例 (第 311章 )； 水 污 染 管 制 條 例 (第 358章 )； 海 上 傾 倒 物 料 條 例 (第 466章 )； 廢 物 處 置 條 例 (第 354章 )； 及 其 他 條 例 。

1.3 許 可 證 持 有 人 須 複 印 本 許 可 證 的 副 本 ， 以 供 署 長 任 何 時 間 內 在 本 許 可 證 所 涵 蓋 的 所 有 工 地 查 閱 。

1.4 許 可 證 持 有 人 須 將 本 許 可 證 的 一 份 副 本 交 予 有 關 工 地 的 負 責 人 。

1.5 許 可 證 持 有 人 須 在 有 關 建 造 工 地 的 所 有 車 輛 進 出 口 或 一 處 方 便 的 地 點 展 示 本 許 可 證 的 副 本 ， 以 供 公 眾 在 任 何 時 間 內 閱 覽 。 許 可 證 持 有 人 須 確 保 在 這 些 地 點 展 示 關 於 環 境 許 可 證 的 最 新 資 料 ， 包 括 經 修 改 的 許 可 證 。 如 果 許 可 證 持 有 人 交 回 許 可 證 的 部 分 或 全 部 ， 須 將 其 送 交 署 長 的 通 知 書 ， 在 備 有 原 本 許 可 證 的 各 處 相 同 地 點 展 示 。

1.6 工 程 師 辦 事 處 須 存 放 一 份 環 評 報 告 ， 位 於 工 地 的 承 建 商 辦 公 室 須 放 另 一 份 環 評 報 告 ， 以 供 參 考 。

1.7 許 可 證 持 有 人 須 依 據 本 許 可 證 B部 的 工 程 項 目 說 明 來 建 造 及 營 辦 有 關 工 程 項 目 。

1.8 許 可 證 持 有 人 須 確 保 工 程 項 目 的 設 計 、 建 造 及 營 辦 ， 符 合 環 評 報 告 所 載 的 資 料 及 建 議 。

1.9 所 有 按 本 許 可 證 規 定 存 放 的 文 件 ， 須 在 收 到 署 長 的 意 見 (如 有 者 )後 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 加 以 修 正 。

1.10 所 有 按 本 許 可 證 規 定 提 交 的 文 件 定 稿 ， 在 署 長 要 求 下 須 公 開 給 公 眾 人 士 知 道 ， 方 法 是 將 有 關 文 件 副 本 存 放 於 環 境 影 響 評 估 條 例 登 記 冊 辦 事 處 或 署 長 所 指 定 的 任 何 其 他 地 方 或 採 取 其 指 定 的 任 何 其 他 方 法 ， 以 供 公 眾 查 閱 。 因 此 ， 許 可 證 持 有 人 須 提 供 足 夠 數 量 的 文 件 副 本 。

2. 展 開 建 造 工 程 前 提 交 的 文 件 或 採 取 的 措 施

2.1 在 展 開 有 關 建 造 工 程 前 ， 須 確 定 一 名 環 境 分 包 承 建 商 。 環 境 分 包 承 建 商 須 由 一 名 在 環 境 監 察 及 審 核 或 環 境 管 理 方 面 至 少 有 7年 經 驗 的 組 長 擔 任 主 管 。 根 據 工 程 項 目 的 環 境 監 察 及 審 核 手 冊 ， 環 境 分 包 承 建 商 須 負 責 有 關 環 境 監 察 及 審 核 計 劃 的 實 施 。 工 程 師 須 確 保 收 納 和 實 施 環 評 報 告 所 建 議 的 緩 解 措 施 。

2.2 在 展 開 有 關 建 造 工 程 前 ， 須 聘 請 一 名 獨 立 的 環 境 審 核 人 。 該 名 獨 立 環 境 審 核 人 須 在 環 境 監 察 及 審 核 或 環 境 管 理 方 面 至 少 有 7年 經 驗 。 獨 立 環 境 審 核 人 須 審 核 整 體 的 環 境 監 察 及 審 核 計 劃 ， 包 括 各 項 環 境 緩 解 措 施 的 實 施 ， 與 環 境 監 察 及 審 核 有 關 的 提 交 文 件 ， 以 及 許 可 證 規 定 提 交 的 任 何 其 他 文 件 。

2.3 在 展 開 本 工 程 項 目 各 有 關 工 程 的 建 造 工 程 之 前 ， 許 可 證 持 有 人 須 向 署 長 存 放 3套 1： 1000比 例 的 設 計 圖 則 及 解 釋 說 明 ， 顯 示 與 自 然 保 育 區 有 關 的 緩 解 措 施 。 有 關 文 件 須 由 獨 立 的 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 內 載 的 資 料 及 建 議 。 設 計 的 任 何 更 改 ， 須 由 獨 立 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 內 載 的 資 料 及 建 議 。 提 交 文 件 詳 載 的 各 項 措 施 須 完 全 執 行 。 署 長 可 要 求 設 計 圖 則 的 額 外 副 本 。

2.4 在 展 開 景 觀 美 化 工 程 至 少 一 個 月 之 前 ， 許 可 證 持 有 人 須 向 署 長 提 交 3套 1： 1000比 例 的 景 觀 美 化 圖 則 及 解 釋 說 明 ， 顯 示 緩 解 對 自 然 保 育 區 內 景 觀 及 視 覺 影 響 的 美 化 建 議 ， 以 待 批 准 。 解 釋 說 明 須 包 括 一 個 管 理 及 維 修 的 時 間 表 ， 指 出 如 何 管 理 及 維 修 建 議 的 美 化 工 程 。 圖 則 在 提 交 前 須 由 獨 立 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 內 載 的 資 料 及 建 議 。 署 長 可 要 求 額 外 副 本 。

3. 建 造 及 營 運 工 程 項 目 期 間 提 交 的 文 件 或 採 取 的 措 施

3.1 在 建 造 工 程 項 目 期 間 ， 須 在 工 地 界 線 或 高 噪 音 設 備 四 周 豎 立 臨 時 的 吸 音 的 隔 音 屏 障 。

3.2 按 照 環 評 報 告 內 載 的 資 料 及 建 議 ， 以 及 參 照 附 件 A及 按 照 第 2.3項 條 件 所 提 交 的 文 件 ， 須 實 施 緩 減 建 築 噪 音 影 響 的 措 施 。

3.3 按 照 環 評 報 告 內 載 的 資 料 及 建 議 ， 以 及 參 照 附 件 B及 按 照 第 2.3及 2.4項 條 件 所 提 交 的 文 件 ， 在 建 造 及 營 運 工 程 項 目 期 間 ， 須 實 施 措 施 以 緩 解 景 觀 及 視 覺 的 影 響 。

3.4 按 照 環 評 報 告 內 載 的 資 料 及 建 議 ， 以 及 參 照 附 件 C及 按 照 第 2.3項 條 件 所 提 交 的 文 件 ， 在 建 造 工 程 項 目 期 間 須 實 施 措 施 以 緩 解 直 接 及 間 接 的 生 態 影 響 。

3.5 所 有 在 環 評 報 告 及 環 境 監 察 及 審 核 手 冊 內 或 按 上 文 第 2條 提 交 的 文 件 內 所 說 明 的 緩 解 措 施 ， 必 須 妥 善 建 造 及 執 行 。 有 關 措 施 的 如 有 任 何 更 改 ， 須 先 由 獨 立 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 內 載 的 結 果 及 建 議 。 經 審 核 的 更 改 須 立 即 在 下 一 份 每 月 環 境 監 察 及 審 核 報 告 中 記 載 。

4. 建 造 期 間 的 環 境 監 察 及 審 核

4.1 須 按 環 境 監 察 及 審 核 手 冊 關 於 建 造 工 程 項 目 期 間 與 自 然 保 育 區 相 關 部 分 所 訂 明 的 要 求 ， 執 行 環 境 監 察 及 審 核 計 劃 。 有 關 計 劃 如 有 任 何 更 改 ， 須 由 獨 立 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 的 環 境 監 察 及 審 核 手 冊 所 訂 明 的 規 定 ， 然 後 才 提 交 署 長 批 准 。

4.2 須 按 照 環 境 監 察 及 審 核 手 冊 內 對 噪 音 、 生 態 及 景 觀 /視 覺 監 測 的 規 定 ， 在 工 程 項 目 建 造 期 間 進 行 抽 樣 及 測 量 ：

1. 在 指 定 地 點 進 行 指 定 次 數 的 噪 音 及 景 觀 /視 覺 基 線 監 測 ；
2. 在 建 造 期 間 在 指 定 地 點 進 行 指 定 次 數 的 噪 音 、 生 態 及 景 觀 /視 覺 影 響 監 測 ；
3. 如 果 超 逾 了 環 境 監 察 及 審 核 手 冊 就 建 築 噪 音 所 指 定 的 標 準 ， 須 按 照 環 境 監 察 及 審 核 手 冊 載 明 的 文 件 ／ 行 動 計 劃 ， 採 取 補 救 行 動 ； 及
4. 在 收 集 數 據 或 完 成 補 救 行 動 3個 工 作 天 內 記 錄 上 列 (a)至 (b)項 的 詳 情 ， 用 作 擬 備 和 提 交 環 境 監 察 及 審 核 報 告 ， 並 備 妥 有 關 資 料 以 便 在 工 地 查 閱 。

4.3 在 任 何 會 影 響 監 察 結 果 的 大 型 工 程 展 開 之 前 ， 須 向 署 長 提 交 10份 由 獨 立 環 境 審 核 人 審 核 並 由 工 程 師 批 准 關 於 噪 音 及 景 觀 /視 覺 監 測 的 基 線 監 察 報 告 。 署 長 可 要 求 基 線 監 察 報 告 的 額 外 副 本 。

4.4 在 須 提 交 報 告 月 份 結 束 後 的 10個 工 作 天 內 或 按 署 長 指 定 的 其 他 方 法 ， 須 向 署 長 提 交 10份 由 獨 立 環 境 審 核 人 審 核 並 由 工 程 師 批 准 關 於 建 造 工 程 的 每 月 環 境 監 察 及 審 核 報 告 。 署 長 可 要 求 每 月 環 境 監 察 及 審 核 報 告 的 額 外 副 本 。

4.5 本 許 可 證 本 部 分 所 規 定 提 交 的 報 告 ， 須 在 接 到 署 長 意 見 後 的 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 作 出 修 改 。

4.6 環 境 監 察 及 審 核 手 冊 的 事 件 ／ 行 動 計 劃 /應 變 計 劃 所 說 明 的 行 動 ， 須 按 照 事 件 ／ 行 動 計 劃 /應 變 計 劃 所 訂 明 的 時 限 或 如 署 長 所 同 意 執 行 。

5. 在 工 程 項 目 建 造 完 成 後 /營 運 期 間 的 環 境 監 察 及 審 核

5.1 須 按 環 境 監 察 及 審 核 手 冊 關 於 營 運 工 程 項 目 期 間 與 自 然 保 育 區 相 關 部 分 所 訂 明 的 要 求 ， 執 行 環 境 監 察 及 審 核 計 劃 。 有 關 計 劃 如 有 任 何 更 改 ， 須 由 獨 立 環 境 審 核 人 審 核 ， 並 由 工 程 師 批 准 ， 以 確 定 符 合 環 評 報 告 的 環 境 監 察 及 審 核 手 冊 所 訂 明 的 規 定 ， 然 後 才 提 交 署 長 批 准 。

5.2 須 按 照 環 境 監 察 及 審 核 手 冊 內 對 噪 音 、 生 態 及 景 觀 /視 覺 監 測 的 規 定 ， 在 工 程 項 目 營 運 期 間 進 行 抽 樣 及 測 量 ：

1. 在 工 程 項 目 建 造 完 成 後 /營 運 期 間 在 指 定 地 點 進 行 指 定 次 數 的 噪 音 、 生 態 及 景 觀 /視 覺 影 響 監 測 ；
2. 如 果 未 能 符 合 環 境 監 察 及 審 核 手 冊 所 指 定 的 噪 音 標 準 ， 須 按 照 環 境 監 察 及 審 核 手 冊 對 工 程 項 目 建 造 完 成 後 /營 運 的 噪 音 監 測 計 劃 所 訂 明 的 規 定 ， 採 取 補 救 行 動 ； 及
3. 在 收 集 數 據 或 完 成 補 救 行 動 3個 工 作 天 內 記 錄 上 列 (a)至 (b)項 的 詳 情 ， 用 作 擬 備 和 提 交 環 境 監 察 及 審 核 報 告 ， 並 備 妥 有 關 資 料 以 便 在 工 地 查 閱 。

5.3 在 須 提 交 報 告 期 間 結 束 後 的 10個 工 作 天 內 或 按 署 長 指 定 的 其 他 方 法 ， 須 向 署 長 提 交 10份 由 獨 立 環 境 審 核 人 審 核 並 由 工 程 師 批 准 關 於 營 運 工 程 項 目 的 環 境 監 察 及 審 核 報 告 。 署 長 可 要 求 每 月 環 境 監 察 及 審 核 報 告 的 額 外 副 本 。

5.4 本 許 可 證 本 部 分 所 規 定 提 交 的 報 告 ， 須 在 接 到 署 長 意 見 後 的 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 作 出 修 改 。

註 :

1. 本 環 境 許 可 證 共 有 3部 ， 即 ： A部 （ 許 可 證 主 要 部 分 ） ； B部 （ 指 定 工 程 項 目 的 說 明 ） ； 及 C部 （ 許 可 證 條 件 ） 。
2. 許 可 證 持 有 人 可 根 據 環 境 影 響 評 估 條 例 第 13條 的 規 定 向 署 長 申 請 更 改 本 環 境 許 可 證 的 條 件 。 許 可 證 持 有 人 須 將 經 修 改 的 許 可 證 ， 替 換 在 建 造 工 地 內 展 示 的 原 有 許 可 證 。
3. 承 擔 指 定 工 程 項 目 的 整 項 或 部 分 工 程 的 責 任 的 人 ， 在 承 擔 指 定 工 程 項 目 責 任 之 前 ， 可 根 據 條 例 第 12條 的 規 定 向 署 長 申 請 新 的 環 境 許 可 證 。
4. 根 據 條 例 第 14條 的 規 定 ， 署 長 可 在 規 劃 環 境 地 政 局 局 長 的 同 意 下 暫 時 吊 銷 、 更 改 或 取 消 環 境 許 可 證 。 該 許 可 證 必 須 從 建 造 工 地 除 下 ， 不 再 展 示 。
5. 如 果 本 許 可 證 在 工 程 項 目 建 造 或 營 辦 期 間 取 消 或 交 回 ， 則 在 繼 續 進 行 建 造 或 營 辦 工 程 項 目 之 前 ， 必 須 先 根 據 條 例 規 定 取 得 環 境 許 可 證 。 根 據 條 例 第 26(1)條 的 規 定 ， 任 何 人 在 沒 有 環 境 許 可 證 的 情 況 下 建 造 或 營 辦 指 定 工 程 項 目 ， 即 屬 犯 罪 。
6. 許 可 證 條 件 涵 蓋 錦 田 南 分 區 計 劃 大 綱 圖 摘 錄 部 分 (S/YL-KTS/1)(圖 1)所 顯 示 自 然 保 育 區 內 會 進 行 的 工 程 項 目 的 一 部 分 。 本 許 可 證 載 出 措 施 ， 用 以 保 護 自 然 保 育 區 。
