Pursuant to Section 10 of the Environmental Impact Assessment Ordinance, the Director of Environmental Protection (the Director) grants this Environmental Permit to CLP Power Hong Kong Limited (the "Permit Holder") to construct and operate the designated project described in Part B subject to the conditions described in or attached to Part C. The issue of this Environmental Permit is based on the documents, approvals or permissions described below :

根 據 環 境 影 響 評 估 條 例 第 10條 的 規 定 ， 環 境 保 護 署 署 長 （ 署 長 ） 將 本 環 境 許 可 證 批 予 中 華 電 力 有 限 公 司 (許 可 證 持 有 人 )以 建 造 及 營 辦 B部 所 說 明 的 指 定 工 程 項 目 ， 但 須 遵 守 C部 所 說 明 或 附 載 的 條 件 。 本 環 境 許 可 證 的 發 出 ， 乃 以 下 表 所 列 的 文 件 、 批 准 或 許 可 作 為 根 據 ：

Nature of Designated Project
指 定 工 程 項 目 的 性 質 		Construction and operation of 132kV overhead pole line and underground cable, parts of which lie within the Ma On Shan Country Park and Conservation Areas in Tseng Lan Shue, Ho Chung and Pak Kong.


建 造 及 營 辦 132千 伏 桿 形 架 空 電 纜 及 地 底 電 纜 。 部 分 電 纜 位 於 馬 鞍 山 郊 野 公 園 和 井 欄 樹 、 蠔 涌 及 北 港 等 地 的 自 然 保 育 區 的 範 圍 內 。

Location of Designated Project
指 定 工 程 項 目 的 地 點 		The Project commences from Tseung Kwan O, running along the ridges to Pak Kong Village in Sai Kung. The two ends of the route are linked to the existing substations by underground cables. Underground cables would also be installed for crossing the Clear Water Bay Road at Pik Uk and the cultivation at Ho Chung.


這 工 程 項 目 由 將 軍 澳 沿 著 山 脈 一 直 伸 延 至 西 貢 北 港 村 。 通 道 的 兩 端 均 以 地 底 電 纜 連 接 至 現 有 的 變 電 站 。 鋪 設 之 地 底 電 纜 亦 會 跨 過 清 水 灣 道 壁 屋 及 蠔 涌 的 耕 地 。

Scale and Scope of Designated Project(s)
指 定 工 程 項 目 的 規 模 和 範 圍 		The Project involves the following works:

a) Excavation of footings (1.2m x 1.2m x 2.95m depth) for the overhead pole line by hand-dig method;

b) Trenching (approximately 0.6m to 1.2m wide and approximately 1.2 - 1.7m deep) for the underground cables by excavators and hand-dig method;

c) Construction of 38 twin poles and 14 single poles and 6 terminal poles as well as the overhanging of conductors about 6.3m wide and a minimum of 6.7m above ground between poles;

d) Building barriers to divert water flow to one side of the river channel at a time for the laying of underground cables across the two tributaries of the Ho Chung River;

e) Clearance of vegetation to form a temporary footpath for construction crew access;

f) Routine clearance of vegetation to maintain paths approximately 1m wide for maintenance crew access;

g) Clearance of all vegetation around each pole positions ( an area of approximately 3m diameter ) for construction purposes;

h) Pruning/felling of trees beneath and adjacent to the conductors to keep a minimum distance of 3.7m between tree canopy and the conductors for safety reasons; and

i) Re-establishment of trees and shrubs after the construction phase as part of the landscape restoration works.


這 工 程 項 目 涉 及 以 下 工 程 ：

a) 以 手 挖 方 式 挖 掘 地 腳 (1.2米 X1.2米 X2.95米 深 )， 供 安 裝 架 空 電 纜 電 線 杆 ；

b) 以 挖 土 機 及 手 挖 方 式 掘 坑 (約 0.6米 至 1.2米 闊 和 約 1.2米 至 1.7米 深 )， 供 鋪 設 地 底 電 纜 ；

c) 建 造 38支 雙 杆 、 14支 單 杆 和 6支 終 端 杆 ， 以 及 在 杆 與 杆 之 間 高 於 地 面 至 少 6.7米 處 懸 掛 約 6.3米 闊 的 電 導 體 ；

d) 築 建 障 礙 物 把 水 流 導 引 至 另 一 邊 河 道 ， 以 便 鋪 設 貫 穿 蠔 涌 河 兩 條 支 流 的 地 底 電 纜 ；

e) 清 除 植 物 以 開 闢 一 條 臨 時 行 人 徑 ， 方 便 工 地 人 員 出 入 ；

f) 定 期 清 除 植 物 以 保 持 約 1米 闊 的 行 人 徑 ， 方 便 維 修 保 養 人 員 出 入 ；

g) 清 除 每 支 電 杆 位 置 附 近 (約 直 徑 3米 的 範 圍 )的 所 有 植 物 ， 以 便 進 行 建 造 工 程 ；

h) 修 剪 ／ 砍 伐 電 導 體 下 面 或 附 近 的 樹 木 ， 使 樹 蔭 和 電 導 體 之 間 保 持 至 少 3.7米 的 距 離 ， 以 策 安 全 ； 及

i) 在 建 造 工 程 完 成 後 重 植 林 木 ， 作 為 景 觀 修 復 工 程 的 一 部 分 。


PART C (PERMIT CONDITIONS)
C部 (許 可 證 條 件 )


1. General Conditions
一 般 條 件

1.1 The Permit Holder shall ensure full compliance with all conditions of this Environmental Permit. Any non?compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and shall be definite ground for enforcement action or permit cancellation where applicable.
許 可 證 持 有 人 必 須 確 保 完 全 符 合 本 環 境 許 可 證 的 全 部 條 件 。 如 有 不 符 合 本 許 可 證 的 情 況 ， 可 能 構 成 違 反 環 境 影 響 評 估 條 例 (第 499章 )的 規 定 ， 並 可 按 適 用 情 況 作 為 採 取 執 法 行 動 或 取 消 許 可 證 的 確 切 理 由 。

1.2 This Permit shall not remove the responsibility of the Permit Holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466), the Waste Disposal Ordinance (Cap. 354) and others.
本 許 可 證 並 不 免 除 許 可 證 持 有 人 須 符 合 現 行 生 效 的 法 例 的 責 任 ， 例 如 ： 噪 音 管 制 條 例 (第 400章 )； 空 氣 污 染 管 制 條 例 (第 311章 )； 水 污 染 管 制 條 例 (第 358章 )； 海 上 傾 倒 物 料 條 例 (第 466章 )； 廢 物 處 置 條 例 (第 354章 )； 及 其 他 條 例 。

1.3 The Permit Holder shall make copies of this Permit available at all times for inspection by the Director at all sites covered by this Permit.
許 可 證 持 有 人 須 複 印 本 許 可 證 的 副 本 ， 以 供 署 長 任 何 時 間 內 在 本 許 可 證 所 涵 蓋 的 所 有 工 地 查 閱 。

1.4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s).
許 可 證 持 有 人 須 將 本 許 可 證 的 一 份 副 本 交 予 有 關 工 地 的 負 責 人 。

1.5 The Permit Holder shall display a copy of this Permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the Environmental Permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.
許 可 證 持 有 人 須 在 建 造 工 地 的 所 有 車 輛 進 出 口 或 一 處 方 便 地 點 ， 展 示 本 許 可 證 的 副 本 ， 以 供 公 眾 在 任 何 時 間 內 閱 覽 。 許 可 證 持 有 人 須 確 保 在 這 些 地 點 展 示 關 於 環 境 許 可 證 的 最 新 資 料 ， 包 括 經 修 改 的 許 可 證 。 如 果 許 可 證 持 有 人 交 回 許 可 證 的 部 分 或 全 部 ， 須 將 其 送 交 署 長 的 通 知 書 ， 在 備 有 原 本 許 可 證 的 各 處 相 同 地 點 展 示 。

1.6 A copy of the EIA Report shall be kept in the Permit Holder's site representative's office and another copy shall be kept in the Contractor's office on site for reference.
許 可 證 持 有 人 工 地 代 表 的 辦 事 處 須 存 放 一 份 環 境 評 估 報 告 ， 而 另 一 份 則 須 存 放 於 承 建 商 的 辦 事 處 ， 以 供 參 閱 。

1.7 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.
許 可 證 持 有 人 須 依 據 本 許 可 證 B部 的 工 程 項 目 說 明 建 造 及 營 辦 工 程 項 目 。

1.8 The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and recommendations contained in the EIA report (Register No. AEIAR-023/1999) and the application (No. AEP-050/1999).
許 可 證 持 有 人 須 確 保 工 程 項 目 的 設 計 、 建 造 及 營 辦 ， 符 合 環 境 評 估 報 告 (登 記 冊 編 號 AEIAR-023/1999)和 申 請 書 (編 號 AEP-050/1999)所 載 的 資 料 及 建 議 。

1.9 The Permit Holder shall notify the Director one week prior to the commencement and completion of the project works.
許 可 證 持 有 人 須 在 工 程 項 目 展 開 及 完 成 之 前 一 周 通 知 署 長 。


2. Measures before Commencement of Construction
2. 展 開 建 造 工 程 前 採 取 的 措 施

2.1 An Environmental Team (ET) shall be established before the commencement of construction of the Project. The ET shall be headed by a team leader who has at least 7 years' experience in environmental monitoring and auditing (EM&A) or environmental management. The ET leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual.
在 展 開 建 造 工 程 之 前 須 先 成 立 一 個 環 境 小 組 。 環 境 小 組 須 由 一 名 在 環 境 監 察 及 審 核 或 環 境 管 理 方 面 至 少 有 7年 經 驗 的 環 境 小 組 組 長 掌 管 。 環 境 小 組 組 長 須 按 環 境 監 察 及 審 核 手 冊 內 載 的 環 境 監 察 及 審 核 規 定 ， 負 責 有 關 環 境 監 察 及 審 核 計 劃 的 實 施 。

2.2 The Permit Holder shall employ an Independent Checker (Environment) (IC(E)) before the commencement of construction of the Project described in Part B of this Permit. The IC(E) shall have at least 7 years' experience in EM&A or environmental management. The IC(E) shall audit the overall EM&A programme including the implementation of all environmental mitigation measures, submissions relating to EM&A, and any other submission required under this Permit.
在 展 開 本 許 可 證 B部 所 載 的 建 造 工 程 之 前 ， 許 可 證 持 有 人 須 聘 用 一 名 獨 立 環 境 查 核 人 。 該 名 獨 立 環 境 查 核 人 須 在 環 境 監 察 及 審 核 或 環 境 管 理 方 面 至 少 有 7年 經 驗 。 獨 立 環 境 查 核 人 須 審 核 整 體 的 環 境 監 察 及 審 核 計 劃 ， 包 括 實 施 所 有 環 境 緩 解 措 施 、 提 交 有 關 環 境 監 察 及 審 核 的 文 件 ， 以 及 提 交 本 許 可 證 所 要 求 的 任 何 其 他 文 件 。

2.3 The Permit Holder shall conduct a rescue excavation at the archaeological site in Ho Chung Valley, where underground cables will be laid. No laying of cables across Ho Chung Valley shall be allowed until the rescue excavation is completed to the satisfaction of the Director.
許 可 證 持 有 人 須 在 蠔 涌 谷 的 考 古 地 點 (即 將 鋪 設 地 底 電 纜 的 地 方 )進 行 搶 修 挖 掘 。 待 搶 修 挖 掘 工 程 完 成 並 使 署 長 滿 意 後 ， 方 可 鋪 設 貫 穿 蠔 涌 谷 的 電 纜 。


3. Measures during the Construction Period
3. 建 造 期 間 採 取 的 措 施

3.1 No excavation shall be carried out where rare tree species Acmena acuminatissima and the protected tree Tutcheria championii are located, as shown in Figure 2 of this Environmental Permit.
挖 掘 工 程 不 得 於 稀 有 樹 木 品 種 俏 蒲 桃 和 受 保 護 樹 木 石 筆 木 的 地 方 (見 環 境 許 可 證 的 圖 2)進 行 。

3.2 The Permit Holder shall carry out duct laying works at the existing stream at Ho Chung between September and April only.
許 可 證 持 有 人 須 於 九 月 至 四 月 期 間 ， 才 可 在 蠔 涌 溪 流 進 行 管 道 鋪 設 工 程 。

3.3 After cable duct construction, the Permit Holder shall reinstate the affected stream bed of Ho Chung River to its original conditions using natural substratum.
在 電 纜 管 道 建 成 後 ， 許 可 證 持 有 人 須 用 天 然 底 土 修 復 受 影 響 的 蠔 涌 溪 流 河 床 ， 使 其 回 復 原 貌 。

3.4 The Permit Holder shall paint all the pole structures in a colour of low chromatic intensity.
許 可 證 持 有 人 須 把 所 有 杆 柱 髹 上 較 淡 的 色 彩 。

3.5 The Permit Holder shall ensure that all runoff from the construction site is routed through oil/grit separators and/or sediment basins/traps before discharge into nearby receiving waters.
許 可 證 持 有 人 須 確 保 建 造 工 地 流 出 的 所 有 徑 流 ， 均 先 流 經 油 污 ／ 砂 礫 分 隔 器 及 ／ 或 沉 澱 池 ／ 沉 積 物 捕 集 裝 置 ， 才 排 放 出 附 近 的 接 收 水 體 。

3.6 Before trenching works to be carried out in stream bed, the Permit Holder shall build filter stand to prevent sediment flowing down to lower sections of Ho Chung River. The Permit Holder shall confine the works in the River by barriers.
在 河 床 進 行 掘 坑 工 程 前 ， 許 可 證 持 有 人 須 設 濾 架 ， 以 防 止 沉 積 物 流 入 蠔 涌 河 下 游 部 分 ； 許 可 證 持 有 人 須 利 用 障 礙 物 局 限 河 道 的 工 作 在 指 定 範 圍 內 進 行 。

3.7 The Permit Holder shall provide portable toilet for the on-site construction workforce.
許 可 證 持 有 人 須 為 駐 工 地 建 築 工 人 提 供 流 動 洗 手 間 。

3.8 The Permit Holder shall ensure that all stockpile areas are covered and intercepting drains are provided to prevent stormwater runoff from washing across exposed soil surfaces or stockpiled areas.
許 可 證 持 有 人 須 確 保 貯 料 區 用 物 被 覆 蓋 和 設 有 截 流 渠 ， 以 免 雨 水 徑 流 沖 刷 外 露 泥 土 面 層 或 貯 料 區 。

3.9 The Permit Holder shall ensure that the selected routing of the maintenance footpaths will not disturb any animal burrows.
許 可 證 持 有 人 須 保 證 維 修 保 養 行 人 徑 的 選 擇 路 線 並 不 會 干 擾 有 動 物 出 沒 的 洞 穴 。


4. Environmental Monitoring and Audit during Construction
4. 建 造 期 間 的 環 境 監 察 及 審 核

4.1 The Environmental Monitoring and Audit (EM&A) requirements shall be implemented as set out in the EM&A Manual submitted to the Director on 22 October 1999 and the monthly EM&A Reports unless the changes are justified in the monthly EM&A Reports submission, verified by the IC(E) and approved by the Director before being implemented.
環 境 監 察 及 審 核 的 規 定 ， 須 按 於 1999年 10月 22日 提 交 署 長 的 環 境 監 察 及 審 核 手 冊 及 每 月 的 環 境 監 察 及 審 核 報 告 訂 明 的 要 求 執 行 ， 除 非 在 執 行 前 ， 擬 議 的 更 改 在 提 交 的 每 月 環 境 監 察 及 審 核 報 告 已 獲 得 充 分 理 由 支 持 並 經 由 獨 立 環 境 查 核 人 核 證 ， 以 及 獲 得 署 長 批 准 。

4.2 Samples and measurements for water quality monitoring shall be taken during laying of underground cables across the Ho Chung River in accordance with the requirements of the EM&A Manual by:

a) conducting baseline water quality monitoring at specified locations and frequencies;

b) conducting water quality monitoring at specified locations and frequencies;

c) in cases where specified criteria in the EM&A Manual are exceeded, carrying out remedial actions in accordance with the action/event plan, as set out in the EM&A Manual; and

d) logging and keeping detailed records of (a) and (b) above, within 3 working days after collection of data or completion of remedial action, for the preparation and submission of the EM&A Reports and to make available the information for inspection on site.

在 貫 穿 蠔 涌 河 鋪 設 地 下 電 纜 期 間 ， 水 質 監 測 的 樣 本 及 量 度 結 果 ， 須 按 照 環 境 監 察 及 審 核 手 冊 的 規 定 抽 取 或 進 行 ：

a) 在 指 定 地 點 進 行 指 定 次 數 的 水 質 基 線 監 測 ；

b) 在 指 定 地 點 進 行 指 定 次 數 的 水 質 監 測 ；

c) 如 果 超 逾 了 環 境 監 察 及 審 核 手 冊 所 指 定 的 準 則 ， 須 按 照 手 冊 載 明 的 行 動 ／ 事 件 計 劃 ， 採 取 補 救 行 動 ； 及

d) 在 收 集 數 據 或 完 成 補 救 行 動 3個 工 作 天 內 記 錄 上 述 a)至 c)項 的 詳 情 ， 用 作 擬 備 及 提 交 環 監 及 審 核 報 告 ， 並 備 存 有 關 資 料 使 在 工 地 也 可 查 閱 。

4.3 Four copies of the Baseline Monitoring Report certified by the ET Leader, and verified by the IC(E) shall be submitted to the Director before the commencement of any major construction works that would affect the monitoring results.
在 任 何 會 影 響 監 測 結 果 的 大 型 建 造 工 程 展 開 前 ， 須 向 署 長 提 交 4份 由 環 境 小 組 組 長 證 明 和 獨 立 環 境 查 核 人 核 證 的 基 線 監 測 報 告 。

4.4 Four copies of monthly EM&A Reports certified by the ET Leader, and verified by the IC(E) shall be submitted to the Director within 10 working days from the end of the reporting month.
在 須 提 交 報 告 的 月 份 結 束 後 的 10個 工 作 天 內 ， 須 向 署 長 提 交 4份 由 環 境 小 組 組 長 證 明 和 獨 立 環 境 查 核 人 核 證 的 每 月 環 境 監 察 及 審 核 報 告 。

4.5 The submitted reports as required in this part of the Permit shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.
所 有 按 本 許 可 證 本 部 所 規 定 提 交 的 報 告 ， 須 在 接 到 署 長 的 意 見 起 計 一 個 月 內 或 按 署 長 另 行 指 定 ， 根 據 署 長 的 意 見 作 出 修 改 。

4.6 The actions described in the action/event plans of the EM&A Manual shall be properly carried out, in accordance with the time frame set out in the action/event plans, or as agreed by the Director.
環 境 監 察 及 審 核 手 冊 的 行 動 ／ 事 件 計 劃 所 說 明 的 行 動 ， 須 按 照 行 動 ／ 事 件 計 劃 內 訂 明 的 時 限 ， 或 署 長 同 意 的 時 限 執 行 。


5. Measures during Operation of the Project
5. 營 辦 期 間 所 採 取 的 措 施

5.1 At each pole location, the Permit Holder shall re-vegetate the ground with native trees/shrubs species to reinstate the landscape back to the original conditions and to maintain the re-established vegetation for two years after the commissioning of the Project.
許 可 證 持 有 人 須 在 每 個 電 纜 杆 地 面 位 置 重 新 種 植 本 土 樹 木 /灌 木 品 種 ， 藉 此 回 復 原 有 景 觀 ， 並 在 工 程 項 目 啟 用 後 兩 年 間 ， 保 養 重 新 種 植 的 植 物 。

5.2 The Permit Holder shall arrange field measurements within 6 months after commissioning of the Project to verify compliance with the International Commission on Non-ionizing Radiation Protection (ICNIRP) guideline level. The exact time for measurement shall be agreed by the Director.
許 可 證 持 有 人 須 在 工 程 項 目 啟 用 後 6個 月 內 安 排 進 行 實 地 量 度 ， 以 證 明 符 合 國 際 非 電 離 輻 射 防 護 委 員 會 (ICNIRP)的 指 定 標 準 。 量 度 的 確 實 時 間 須 經 署 長 同 意 。

5.3 Within 2 years after the commissioning of the Project, the Permit Holder shall remove two pairs of existing 33kV powerline from within the Ma On Shan Country Park as shown in Figure 1.
在 工 程 項 目 啟 用 後 兩 年 內 ， 許 可 證 持 有 人 須 把 馬 鞍 山 郊 野 公 園 內 兩 對 現 有 的 33千 伏 輸 電 線 拆 去 ( 見 圖 1)。

註 ：

1. This Environmental Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).
本 環 境 許 可 證 共 有 3部 ， 即 ： A部 （ 許 可 證 主 要 部 分 ） ； B部 （ 指 定 工 程 項 目 的 說 明 ） ； 及 C部 （ 許 可 證 條 件 ） 。

2. The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Environmental Permit. The Permit Holder shall replace the original permit displayed on the construction site, by the amended Permit.
許 可 證 持 有 人 可 根 據 條 例 第 13條 的 規 定 向 署 長 申 請 更 改 本 環 境 許 可 證 的 條 件 。 許 可 證 持 有 人 須 將 經 修 改 的 許 可 證 ， 替 換 在 建 造 工 地 內 展 示 的 原 有 許 可 證 。

3. A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility for the designated project, apply under Section 12 of the Ordinance to the Director for a further Environmental Permit.
承 擔 指 定 工 程 項 目 的 整 項 或 部 分 工 程 的 責 任 的 人 ， 在 承 擔 指 定 工 程 項 目 責 任 之 前 ， 可 根 據 條 例 第 12條 的 規 定 向 署 長 申 請 新 的 環 境 許 可 證 。

4. Under Section 14 of the Ordinance, the Director with the consent of the Secretary for the Environment and Food, may suspend, vary or cancel this Environmental Permit. The Permit shall be removed from the display on the construction site.
根 據 條 例 第 14條 的 規 定 ， 署 長 可 在 環 境 食 物 局 局 長 的 同 意 下 暫 時 吊 銷 、 更 改 或 取 消 環 境 許 可 證 。 該 許 可 證 必 須 從 建 造 工 地 除 下 ， 不 再 展 示 。

5. If this Permit is cancelled or surrendered during the construction or operation, an Environmental Permit must be obtained under the Ordinance before the construction or operation of the Project could continue. It is an offence under Section 26(1) of the Ordinance to construct or operate a designated project without an Environmental Permit.
如 果 本 許 可 證 在 工 程 項 目 建 造 或 營 辦 期 間 取 消 或 交 回 ， 則 在 繼 續 進 行 建 造 或 營 辦 工 程 項 目 之 前 ， 必 須 先 根 據 條 例 規 定 取 得 環 境 許 可 證 。 根 據 條 例 第 26(1)條 的 規 定 ， 任 何 人 在 沒 有 環 境 許 可 證 的 情 況 下 建 造 或 營 辦 指 定 工 程 項 目 ， 即 屬 犯 罪 。

6. All submissions as required under this Permit shall be deposited in the Environmental Impact Assessment Ordinance Register office on the 27/F of Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong.
本 許 可 證 規 定 提 交 的 所 有 文 件 須 存 放 於 香 港 灣 仔 軒 尼 詩 道 130號 修 頓 中 心 27樓 環 境 影 響 評 估 條 例 登 記 冊 辦 事 處 。
