A DESIGNATED PROJECT

Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) grants this environmental permit to Castle Peak Power Company Limited (hereinafter referred to as the “Permit Holder”) to construct and operate the designated project(s) described in Part B subject to the conditions specified in Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:
根據《環境影響評估條例》(環評條例)第10條的規定,環境保護署署長(署長)將本環境許可證批予青山發電有限公司(下稱“許可證持有人”)以建造及營辦B部所說明的指定工程項目,但須遵守 C部所列明的條件。本環境許可證的發出,乃以下表所列的文件、批准或許可作為根據:

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as the “Permit”):

C部 (許可證條件)
1. General Conditions
一般條件
1.1 The Permit Holder and any person working on the Phase 1 of the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (EIAO) (Cap. 499) and may become the subject of appropriate action being taken under the EIAO.
許可證持有人及任何從事第一期工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況,可能違反《環境影響評估條例》(「環評條例」) (第499章) 的規定,而當局可根據環評條例採取適當行動。
1.2 The Permit Holder shall ensure full compliance with all legislation from time to time in force including, without limitation to, the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466) and Waste Disposal Ordinance (Cap. 354). This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.
許可證持有人須經常確保完全符合現行法例的規定,包括但不限於《噪音管制條例》(第400章);《空氣污染管制條例》(第311章);《水污染管制條例》(第358章);《海上傾倒物料條例》(第466章)以及《廢物處置條例》(第354章)。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由,或根據任何法例默示任何批准。
1.3 The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit. Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.
許可證持有人須印製本許可證的複本,連同本許可證所述的所有文件或本許可證A部所述文件,以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地/辦事處查閱。凡提述本許可證,須包括本許可證所述的所有文件及登記冊內的相關文件。
1.4 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit. The site(s) refers to site(s) of construction and operation of the Phase 1 of the Project and shall mean the same hereafter.
許可證持有人須把本許可證的複本交予有關工地的負責人,並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造第一期工程項目的工地,下文所提及的工地亦屬同一意思。
1.5 The Permit Holder shall display conspicuously a copy of this Permit on the Phase 1 project site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations. If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit. The suspended, varied or cancelled Permit shall be removed from display at the Phase 1 project site(s).
許可證持有人須在第一期工程項目工地的所有車輛進出口或一處方便地點,顯眼地展示本許可證的複本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證(包括任何經修訂的許可證)的最新資料。許可證持有人如交回許可證的部分或全部,必須把其送交署長的通知書,在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從第一期工地除下,不再展示。
1.6 The Permit Holder shall construct and operate the Phase 1 of the Project in accordance with the project descriptions in Part B of this Permit.
許可證持有人須依據本許可證B部的工程項目說明,建造第一期工程項目。
1.7 The Permit Holder shall ensure that the Phase 1 of the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report (Register No.: AEIAR-150/2010), the application documents including all attachments (Application No.: AEP-391/2010), other relevant documents in the Register; and the information or mitigation measures described in this Permit, and mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Phase 1 of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.
許可證持有人須確保第一期工程項目的設計、建造及營辦,按照下述資料及措施辦理:環評報告(登記冊編號:AEIAR-150/2010)所說明的資料及建議;申請文件包括所有附件(申請編號:AEP-391/2010);登記冊內的其他相關文件;本許可證所說明的資料或緩解措施;根據本許可證內載的條件給予署長存放或提交署長而獲批准的文件所建議的緩解措施;以及在第一期工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊內的文件所述建議如沒有在本許可證明確表示,則仍須實施這些建議,除非獲本許可證明確豁除或默示修訂。
1.8 All submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.
所有按本許可證規定存放的文件,須在接獲署長的意見(如有者)後1個月內(除非署長另行指定),根據署長的意見加以修正並再向署長提交。
1.9 All submissions approved by the Director, all submissions deposited without comments by the Director, and all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499). All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to Conditions 2.1 and 2.2 below, before submitting to the Director under the Permit.
所有提交署長並獲批准的文件、所有提交署長存放而沒有收到署長意見的文件、和根據本許可證提交並已依照署長的意見作出修訂的所有文件,將詮釋為本許可證C部所說的許可證條件的一部分。對提交文件所作的任何修訂,均須獲得署長的書面批准,或符合有關許可證條件所述。凡與所提交的文件有不符合的情況,均可能構成違反《環境影響評估條例》(第499章)。所有文件或其任何修訂,按本許可證規定提交署長前,須由下述條件第2.1及2.2項所述環境小組組長核證及獨立環境查核人核實。
1.10 The Permit Holder shall release all finalised submissions as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any means as specified by the Director, for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of the submissions.
許可證持有人須把所有根據本許可證規定而提交的文件定稿向公眾發放,方法是把上述文件的副本存放在環境影響評估條例登記冊辦事處,或署長指定的任何其他地方或互聯網網站,或依照署長指定的任何其他方法,供公眾查閱。因此,許可證持有人須提供足夠數量的文件複本。
1.11 The Permit Holder shall notify the Director in writing the commencement date of construction of the Phase 1 of the Project at least two weeks before the commencement of construction of the Phase 1 of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.
許可證持有人須在第一期工程項目的建造工程展開前,至少提早2個星期以書面方式把建造第一期工程項目的施工日期通知署長。施工日期如有任何更改,許可證持有人必須立即以書面方式通知署長。
1.12 All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalised submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.
按本許可證的規定向署長提交的所有文件,須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處(現址為香港灣仔軒尼詩道130號修頓中心27樓)。所有按本許可證規定提交的文件定稿的電子版本,均須以超文本標示語言 (HTML) (第4.0或較後版本) 和便攜式文件格式 (PDF) (第4.0或較後版本) 製作,除非另獲署長同意,並須與硬複本同時提交。
1.13 For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation, or other works as agreed by the Director.
為執行本許可證,「建造工程的展開」不包括有關工地清理及預備的工程,或署長同意的其他工程。
1.14 The Permit Holder shall notify the Director in writing the commencement date of operation of the Phase 1 of the Project no later than one month prior to the commencement of operation of the Phase 1 of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the operation.
許可證持有人須在第一期工程項目的營辦展開之前,提早不少於1個月以書面方式通知署長第一期工程項目開始營辦日期。開始營辦日期如有任何更改,許可證持有人必須立即以書面方式通知署長。
2. Submissions or Measures before Commencement of Construction of the Phase 1 of the Project
第一期工程項目的建造工程展開前須提交的文件或採取的措施
Employment of Environmental Monitoring and Audit (EM&A) Personnel
聘用環境監察及審核人員
2.1 An Environmental Team (ET) shall be established by the Permit Holder no later than one month before the commencement of construction of the Phase 1 of the Project with the following requirements:
根據以下規定,在第一期工程項目的建造工程展開前,許可證持有人須至少提早一個月成立一個環境小組:
(i) The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years’ experience in environmental monitoring and auditing (EM&A) or environmental management.
環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核或環境管理方面至少有7年經驗。
(ii) The ET and the ET Leader shall be responsible for the duties defined in the EM&A Manual submitted and approved under Condition 2.3 of this Permit.
環境小組及環境小組組長須負責按本許可證條件第2.3項批准的環境監察與審核手冊內載的職務。
(iii) The ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the EM&A Manual.
環境小組組長須負責按工程項目的環境監察與審核手冊內載的規定,執行環境監察與審核計劃。
(iv) The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances which may affect the environmental impact assessment and each and every non-compliance with the recommendations of the approved EIA Report (Register No. AEIAR-150/2010) or this Permit. The ET Leader shall notify the Independent Environmental Checker specified in Condition 2.2 below within one working day of the occurrence of any such instance or circumstance or change of circumstances.
環境小組組長須保存一本記錄冊,同時記載可能會影響環評的每宗事件、每種情況或每次情況變化,以及每宗不符合批准的環評報告 (登記冊編號:AEIAR-150/2010) 的建議或本許可證的情況。根據以下條件2.2所列明,環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。
(v) The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the approved EIA Report (Register No. AEIAR-150/2010) or this Permit or by the Director or his authorized officers.
存放環境小組組長的記錄冊的地方,須可供協助督導執行批准的環評報告 (登記冊編號:AEIAR-150/2010) 的建議或本許可證的所有人士、署長或獲授權人員隨時查閱。
(vi) Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.
環境小組組長如未能在記錄冊保存記錄、未能執行環境監察及審核手冊 所列明的環境小組組長職務或未能符合本條件的規定,署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補,或在聘用新環境小組組長後仍未能在記錄冊保存同時的記錄,或會導致許可證遭暫時吊銷、取消或更改。
(vii) The ET shall not be in any way an associated body of the Contractor(s) or IEC for the Phase 1 of the Project.
環境小組不得與第一期工程項目的承辦商或獨立環境查核人有任何聯繫。
2.2 An Independent Environmental Checker (IEC) shall be employed by the Permit Holder no later than one month before the commencement of construction of the Phase 1 of the Project with the following requirements:
根據以下規定,在第一期工程項目的建造工程展開前,許可證持有人須至少提早一個月聘用一名獨立環境查核人:
(i) The IEC shall be a person who has at least 7 years’ experience in environmental monitoring and audit (EM&A) or environmental management.
獨立環境查核人須在環境監察與審核或環境管理方面至少有7年經驗。
(ii) The IEC shall be responsible for duties defined in the EM&A Manual submitted and approved under Condition 2.3 of this Permit, and shall audit the overall EM&A programme described in the EIA Report (Register No. AEIAR-150/2010), including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit.
獨立環境查核人須執行根據本許可證條件第2.3項批准的環境監察與審核手冊所列明的職務,以及審核環評報告(登記冊編號:AEIAR-150/2010)所說明整體環境監察及審核計劃,包括所有環境緩解措施的實施、環境監察與審核手冊規定提交的文件,以及本許可證所要求提交的文件。
(iii) The IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.
獨立環境查核人須負責核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件。
(iv) The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit.
獨立環境查核人須核實本許可證條件第2.1項所述的記錄冊。
(v) The IEC shall notify the Director by fax, within 24 hours of each and every occurrence, change of circumstances or non-compliance with the EIA Report (Register No. AEIAR-150/2010) or this Permit, which might affect the monitoring or control of adverse environmental impact. Where the IEC fails to notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.
在個別及每次出現事故、情況變化或不符合環評報告 (登記冊編號:AEIAR-150/2010) 或本許可證的情況,而可能會妨礙工程項目所造成的不良環境影響的監察或控制工作時,獨立環境查核人須在接獲環境小組組長通知後24小時內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況,未能執行環境監察及審核手冊所列明的獨立環境查核人職務或未能符合本條件的規定,署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人,或在聘用新獨立環境查核人後仍未能通知署長有關情況,則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件,許可證持有人的通知等同獨立環境查核人的通知。
(vi) The IEC shall not be in any way an associated body of the Contractor or the ET for the Phase 1 of the Project.
獨立環境查核人不得與第一期工程項目的承辦商或環境小組有任何聯繫。
Updating of the Environmental Monitoring and Audit Manual
環境監察及審核手冊更新
2.3 The Permit Holder shall, no later than two weeks before the commencement of the works, submit to the Director for approval four hard copies and one electronic copy of an updated EM&A Manual for the Phase 1 of the Project. The updated EM&A Manual shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report (Register No. AEIAR-150/2010). The updated EM&A Manual shall include the updated structure and responsibilities of EM&A personnel engaged for the Phase 1 of the Project and the updated environmental monitoring and audit requirements of this Permit.
許可證持有人須於第一期工程展開前,至少提早2個星期呈交工程項目最新的環境監察與審核手冊的4份硬複本和1份電子複本,供署長作批准。最新的環境監察與審核手冊須由環境小組組長核證及獨立環境查核人核實,證明符合獲批准的環評報告 (登記冊編號:AEIAR-150/2010) 所載的資料和建議。更新的環境監察與審核手冊須包括從事第一期工程項目環境監察與審核工作之人事的最新架構和職務,及本許可證的最新環境監察及審核規定。
2.4 The updated EM&A programme shall include the verification of predictions in the approved EIA report (Register No. AEIAR-150/2010) against the criteria adopted in the approved EIA report (Register No. AEIAR-150/2010) and the effectiveness of proposed measures in the approved EIA report (Register No. AEIAR-150/2010). All measures recommended in the approved EM&A Manual shall be fully and properly implemented in accordance with the requirements and time schedule(s) set out in the EM&A Manual.
更新的環境監察與審核計劃須包括核實批准的環評報告(登記冊編號:AEIAR-150/2010)內的預報,對比該環評報告(登記冊編號:AEIAR-150/2010)內採用的標準,及在報告(登記冊編號:AEIAR-150/2010)內建議措施的成效。所有在批准的環境監察與審核手冊建議的措施,須符合環境監察與審核手冊內的規定和時間表,全面及妥善地執行。
3. Submissions or Measures for the Construction of the Phase 1 of the Project
就第一期工程項目的建造工程提交的文件或採取的措施
Management Organization of Main Construction Companies
主要建造公司的管理架構
3.1 The Permit Holder shall, no later than two weeks before the commencement of construction of the Phase 1 of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures appointed for the Project. The information, to be submitted, shall include at least an organization chart, names of responsible persons and their contact details.
第一期工程項目的建造工程展開後,許可證持有人須至少提早2個星期,把主要建造公司及/或以任何形式聘用作工程項目的合營企業的管理架構,以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。
Submarine Natural Gas Pipeline & Gas Receiving Station
海底天然氣輸氣管及天然氣接收站
3.2 The alignment for the submarine natural gas pipeline for the Phase 1 of the Project shall be adopted as shown in Figure 1 of this Permit. The pipeline shall be of diameter from 32 to 42 inches (i.e. about 813 to 1067mm). The length of the pipeline in the Hong Kong Special Administrative Region waters shall be around 5km.
第一期工程項目的海底天然氣輸氣管須採用本許可證圖1所示的路線。輸氣管的直徑須介乎32吋至42吋之間(即約813毫米至1067毫米)。設於香港特別行政區水域的輸氣管長度須約為5公里。
3.3 The location of the Gas Receiving Station (GRS) for the Phase 1 of the Project shall be constructed and operated within the site boundary of the BPPS, as shown in Figure 1 of this Permit. No reclamation shall be implemented for this First Phase GRS.
第一期工程項目的天然氣接收站須在本許可證圖1所示的龍鼓灘發電廠工地邊界內的位置建造及營辦。許可證持有人不得就第一期天然氣接收站進行任何填海工程。
Submission of Waste Disposal Plan & Waste Management Plan
提交廢物處置計劃及廢物管理計劃
3.4 The Permit Holder shall prepare and seek the agreement of the Marine Fill Committee (MFC) of the Civil Engineering & Development Department and other relevant authorities on the Waste Disposal Plan (WDP) for contaminated marine sediment generated by the Phase 1 of the Project, and submit the WDP to the Director at least two weeks before commencement of construction of the Phase 1 of the Project. The WDP shall contain the location of the disposal site(s) / disposal option(s) as agreed by the MFC and other relevant authorities. The WDP shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report (Register No. AEIAR-150/2010). A total of no more than 0.253Mm3 bulk volume marine sediment, with 0.029Mm3 of Category L uncontaminated sediments and 0.06Mm3 and 0.164Mm3 of Category Mfail and Mpass contaminated sediments respectively, are allowed to be dredged during the construction stage of the Phase 1 of the Project. The Permit Holder shall inform the Director if the estimated amounts are to be increased, and obtain the agreement from the MFC and other relevant authorities regarding the disposal of the additional marine sediment from the Phase 1 of the Project.

3.5 The Permit Holder shall, no later than one month after the commencement of construction of the Phase 1 of the Project, deposit with the Director four hard copies and one electronic copy of the Waste Management Plan (WMP) for the construction stage of the Phase 1 of the Project. The WMP shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report (Register No. AEIAR-150/2010). The WMP shall describe the arrangements for avoidance, reuse, recovery and recycling, storage, collection, treatment, the estimated rate of construction and demolition (C&D) materials generation and disposal, and the recommended mitigation measures on waste management as set out in Section 7.4 of the approved EIA Report (Register No. AEIAR-150/2010). The WMP shall indicate the disposal arrangements and locations of C&D materials and other wastes. A trip ticket system shall be included in the WMP. All measures recommended in the WMP shall be fully and properly implemented by the Permit Holder and any person working on the Phase 1 of the Project throughout the construction period.

3.6 The submarine natural gas pipeline trenches for the Phase 1 of the Project shall be constructed by grab dredging and jetting methods only, and the location for dredging and jetting operations shall follow Table 1 and Figure 2 of this Permit. Silt curtains (stand type and/or cage type) at various locations and other mitigation measures such as the types and numbers of plant for relevant marine works (as described in Table 1 below) shall be deployed during the dredging/jetting works for the Phase 1 of the Project. Details of silt curtain installation shall be submitted to the IEC for verification prior to the commencement of dredging/jetting works.

A set of monitoring stations shall be arranged along the jetting path for each of the two monitoring days. Monitoring shall be conducted every four hours of turbidity, and duplicate water samples shall be taken and analyzed at all monitoring stations. The IEC shall be on site to inspect the works during the first two days of jetting, and shall review the associated monitoring results in order to verify that the jetting is proceeding in accordance with the EIA modeling predictions. 3.7 Dredged materials shall be transported by barge to the disposal sites as agreed by the MFC and other relevant authorities under Condition 3.4. Disposal vessels shall be fitted with tight bottom seals in order to prevent leakage of material during transport.

3.8 All vessel operators working on the Phase 1 of the Project shall be given a briefing, alerting them to the possible presence of dolphins in the area, and developing and implementing guidelines for safe vessel operations in the presence of cetaceans. If high speed vessels are used, they shall be required to slow down to below 10 knots when passing through the marine works area. The vessel operators shall be required to use predefined and regular routes, as recommended by the ET Leader.
許可證持有人須為所有參與第一期工程項目的船隻營辦商舉行簡介會,提醒他們區內可能存有海豚,並制定發現鯨目動物時的船隻作業安全指引,由船隻營辦商執行。倘若採用高速船隻,當船隻駛經第一期工程項目的海事工程範圍時,須把船速減至10海里以下。船隻營辦商須採用環境小組組長建議的既定及定期的航行路線。
3.9 A marine mammal exclusion zone with a radius of 250m from dredgers / jetting laybarge shall be implemented. A designated observer(s) shall scan the exclusion zone for at least 30 minutes prior to the start of dredging / jetting. If dolphins or other cetaceans are observed in the exclusion zone, dredging shall be delayed until they have left the exclusion zone.
在挖泥機/水力噴注躉船方圓250米範圍內須實施海洋哺乳動物禁區。在展開挖泥/水力噴注工程前,須由一名指定的觀察員觀察工地範圍方圓250米的禁區至少30分鐘,倘若在禁區發現鯨目動物,便須延遲進行挖泥工程,直至鯨目動物離開禁區為止。

3.10 In order to ensure that the seabed affected by the pipeline has been restored to its original configuration to prevent impacts to fishing operations due to changes in seabed profile, geophysical surveys shall be conducted in the pre-construction and post-construction phases of the pipeline works. The survey result shall be verified by the IEC, and deposited to the Director for record prior to the commencement of operation of the Phase 1 of the Project.
為確保受輸氣管影響的海牀已修復至原貌,從而避免因海牀地形轉變影響捕漁作業,許可證持有人須在輸氣管工程竣工後進行地質測量。測量結果須由獨立環境查核人核實,並須在第一期工程項目開始營辦前向署長存放測量結果,以作記錄。

3.11 The marine-based pipeline shall be coated externally with an anti-corrosion and wrap, and shall have an outer layer of steel reinforced concrete weight coating. The protection proposed for the pipelines and the typical cross sections of the trench designs shall be as follows and as shown in Figure 3 of this Permit:
海底輸氣管的外層須以防鏽塗層包裹,而最外層則須為鋼筋水泥的加重層。輸氣管的建議保護措施及坑道設計的典型剖面圖須如下及如本許可證圖3所示:
(i) Type 1: 1.5m burial with 0.5m sand bedding and 1.5m Armour Rock Protection;

(ii) Type 2: 5m natural fill burial with 1m Armour Rock Protection; and

3.12 The first major piece of equipment in the GRS for connecting the offshore pipeline shall be an Emergency Shutdown (ESD) valve, which can be closed in order to isolate the GRS from the source of gas in the event of an emergency.
在連接離岸輸氣管方面,天然氣接收站的首部重要設備是緊急關閉活門,該活門可在遇上緊急情況下關閉,以分隔天然氣接收站與供氣源頭。
4. Measures for the Operation of the Phase 1 of the Project

4.1 To mitigate the air quality impact, the GRS shall be designed and operated in accordance with the following parameters:
為減低對空氣質素的影響,天然氣接收站需按照以下的因素設計及運作:
(i) The maximum number of gas heaters shall not be more than seven, and no more than six gas heaters shall be operated simultaneously. The total amount of NOx and CO emissions emitted from the heaters in operation shall not be more than 8.22kg and 5.14kg per hour respectively;
氣體加熱器的數目不得超過7個及不多於6個氣體加熱器同時運作,而所有運作中加熱器的氮氧化物及一氧化碳排放率量的總和各自不得超過每小時8.22千克及5.14千克;
(ii) The stack height shall not be less than 15m above ground;

(iii) The exhaust gas velocity of the gas heaters shall not be less than 10ms-1 under full load operation;

(iv) The exhaust gas temperature of the gas heaters shall not be less than 280℃ under full load operation; and

(v) The design and operation of the GRS shall be certified by the ET Leader and verified by the IEC as conforming to the environmental performance contained in the approved EIA Report (Register No. AEIAR-150/2010), such that the air quality impact arising from different loading operation of the GRS shall not exceed the air quality levels as predicted in the approved EIA Report (Register No. AEIAR-150/2010).
天然氣接收站的設計及運作須由環境小組組長核證及獨立環境查核人核實,以確保符合批准的環評報告 (登記冊編號:AEIAR-150/2010) 的環境表現,並當氣體加熱器以不同負荷運作時,相關的空氣質素影響須不超出環評報告 (登記冊編號:AEIAR-150/2010) 所預報的空氣質素標準。
5. Environmental Monitoring and Audit (EM&A) Requirements
環境監察及審核 (「環監」) 規定
5.1 The EM&A programme shall be implemented as set out in the EM&A Manual approved under Condition 2.3. Any changes to the EM&A programme shall be justified by the IEC as conforming to the requirements set out in the EM&A Manual and shall be submitted to the Director for approval.
環境監察與審核計劃須按照本許可證條件第2.3項所批准的環境監察與審核手冊執行。計劃如有更改,須由獨立環境查核人核實,證明其符合環境監察與審核手冊內載的規定,然後才提交署長批准。
5.2 Two hard copies of the Baseline Monitoring Report and one electronic copy in the formats as specified in Condition 6.1 below shall be submitted to the Director at least two weeks before the commencement of any construction works of the Phase 1 of the Project. Additional copies of the submission shall be provided to the Director upon request from the Director.
在任何第一期工程建造展開前,須至少提早2個星期向署長提交基線監測報告的2份硬複本及1份電子版本,其格式須按照條件第6.1項的規定。如署長要求,則須把提交文件的額外複本送交署長。
5.3 Two hard copies and one electronic copy of monthly EM&A Reports shall be submitted to the Director within 2 weeks after the end of the reporting month. Additional copies of the submission shall be provided to the Director upon request from the Director.
在規定提交報告的月份結束後2個星期內,許可證持有人須向署長提交每月環境監察及審核報告的2份硬複本及1份電子版本。如署長要求,則須把提交文件的額外複本送交署長。
5.4 All environmental monitoring and audit results submitted under this Permit shall be true, valid and correct.
根據本許可證提交的所有環境監察與審核數據,均須有效及真實無誤。
5.5 The actions described in the Event/Action Plans of the EM&A Manual shall be fully and properly carried out, in accordance with the time frame(s) set out in the Event/Action Plan, or as agreed by the Director.
許可證持有人須按照環境監察與審核手冊內的事件 / 行動計劃所訂明的時限或署長所同意的時限,徹底並妥善執行事件 / 行動計劃所說明的行動。
6. Electronic Reporting of EM&A Information
環境監察及審核資料的電子匯報
6.1 To facilitate public inspection of the Baseline Monitoring Report and monthly EM&A Reports via the EIA Ordinance Internet Website and at the EIA Ordinance Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 5.2 and 5.3 of this Permit. For the HTML version, a content page capable of providing hyperlink to each section and sub-section of the EM&A Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in the EM&A Reports shall be provided in the main text from where the respective references are made. All graphics in the report shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these Reports shall be the same as the hard copies.

1. This Environmental Permit consists of three parts, namely, Part A (Main Permit), Part B (Description of Designated Project) Part C (Permit Conditions). Any person relying on this Permit should obtain independent legal advice on the legal implications under the Ordinance, and that the following notes are for general information only.

2. If there is a breach of any conditions of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.
如違反本許可證的任何條件,署長或獲授權人員可在環境局局長的同意下勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人未經署長或獲授權人員同意,不得進行任何相關工程。
3. The Permit Holder may apply under Section 13 of the Environmental Impact Assessment Ordinance (the “Ordinance”) to the Director for a variation of the conditions of this Environmental Permit. The Permit Holder shall replace the original Permit displayed on the construction site, by the amended Permit.
許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須以經修訂的許可證替換在工程項目的工地內展示的原有許可證。
4. A person who assumes responsibility for the whole or a part of the Phase 1 of the Project may, before he assumes responsibility of the Phase 1 of the Project, apply under Section 12 of the Ordinance to the Director for a further Environmental Permit.
承擔第一期工程項目整項或部分第一期工程項目的責任的人,在承擔責任之前,可根據條例第12條的規定向署長申請新的環境許可證。
5. Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment, suspend, vary or cancel this Permit. The suspended, varied or cancelled Permit shall be removed from display at the Phase 1 project site.
根據條例第14條的規定,署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從第一期工程項目的工地除下,不再展示。
6. If this Permit is cancelled or surrendered during the construction or operation of the Phase 1 of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued. It is an offence under Section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of Schedule 2 of the Ordinance without a valid environmental permit.
如本許可證在第一期工程項目建造或營辦期間取消或交回,則在繼續進行工程項目之前,必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定,任何人在沒有有效環境許可證的情況下建造或營辦條例附表2第I部所列明的指定工程項目,即屬犯罪。
7. Any person who constructs or operates the Phase 1 of the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable:

(i) on a first conviction of indictment to a fine of $2 million and imprisonment for 6 months;
一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;
(ii) on a second or subsequent conviction on indictment to a fine of $5 million and imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;
(iii) on a first summary conviction to a fine at level 6 and imprisonment for 6 months;
一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;
(iv) on a second or subsequent summary conviction to a fine of $1 million and imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及
(v) in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied that the offence continued.

8. The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

9. The Notes are for general reference only and that the Permit Holder should refer to the EIA Ordinance for details and seek independent legal advice.
