A DESIGNATED PROJECT

Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (EIAO), the Director of
Environmental Protection (the Director) grants this environmental
permit to the Airport Authority Hong Kong (hereinafter referred to
as the “Permit Holder”) to construct and operate the designated project
described in Part B subject to the conditions
specified in Part C. The issue of this environmental permit is based on the
documents, approvals or permissions described below:
根據《環境影響評估條例》(環評條例) 第10條的規定，環境保護署署長(署長)將本環境許可證批予香港機場管理局(下稱“許可證持有人”)以建造及營辦B部所說明的指定工程項目，但須遵守C部所列明的條件。本環境許可證是依據下列文件、批准或許可而簽發﹕

The Project mainly includes: 工程項目主要包括以下各項： (i)
construction of a third runway,
related taxiway systems and navigation aids, and airfield facilities; 興建第三條跑道、相關滑行道系統及導航設備和飛行區設施； (ii)
construction of the third
runway aprons and passenger concourses; 興建第三條跑道的停機坪及客運廊； (iii)
land formation of about 650
ha to the north of the existing Airport island including a portion over the
contaminated mud pits ; 在現有機場島北面拓地約650公頃，包括部分位於污染泥料卸置坑的土地； (iv)
expansion of part of the
midfield freighter apron on the existing Airport island; 擴建現有機場島部分中場範圍貨運停機坪； (v)
expansion of the existing
passenger Terminal 2 on the existing Airport island; 擴建現有機場島現有二號客運大樓； (vi)
extension of the automated
people mover from the existing Airport island to the passenger concourses of

extension of the baggage
handling system from the existing Airport island to the aprons of the third

improvement of the road
network in the passenger and cargo areas and new landside transportation
facilities including new car parks on the existing Airport island; 改善客運和貨運範圍的道路網絡及新建非禁區運輸設施，包括現有機場島的新停車場； (ix)
reuse of treated sewage
effluent from a treatment plant; 再使用從處理廠流出並經處理的污水； (x)
Modifications to existing marine facilities including the underwater
aviation fuel pipelines and 11kV submarine cable between Hong Kong
International Airport and the off-airport fuel receiving facilities, sea
rescue facilities and aids to navigation; and 對現有海洋設施進行修改，這些設施包括位於香港國際機場與機場外燃料接收設施之間的海底航油管道和11千伏海底電纜、海上救援設施及導航設備；以及 (xi)
any other modification, reconfiguration, and/or improvement of the existing

C部 (許可證條件)
1. GENERAL CONDITIONS
一般條件
1.1 The Permit
Holder and any person working on the Project shall comply with all conditions
set out in this Permit. Any non-compliance by any person may constitute a
contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and
may become the subject of appropriate action being taken under the Ordinance.
許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況，可能違反《環境影響評估條例》（第499章）的規定，而當局可根據條例採取適當行動。
1.2 The Permit Holder shall ensure
full compliance with all legislation from time to time in force including,
without limitation to, the Noise Control Ordinance (Cap. 400), Air Pollution
Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358),
Waste Disposal Ordinance (Cap. 354) and Dumping at Sea Ordinance (Cap. 466).
This Permit does not of itself constitute any ground of defence against any
proceedings instituted under any legislation or imply any approval under any
legislation.
許可證持有人須經常確保完全符合現行法例的規定，包括但不限於《噪音管制條例》（第400章）；《空氣污染管制條例》（第311章）；《水污染管制條例》（第358章）；《廢物處置條例》（第354章）；以及《海上傾倒物料條例》（第466章）。本許可證本身不會就根據任何法例提出的法律程序構成任何抗辯理由，或根據任何法例默示任何批准。
1.3 The Permit Holder shall make
copies of this Permit together with all documents referred to in this Permit
and the documents referred to in Part A of the Permit
readily available at all times for inspection by the Director or his authorised
officers at all sites/offices covered by this Permit. Any reference to the
Permit shall include all documents referred to in the Permit and also the
relevant documents in the Register.
許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件及本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證，須包括本許可證所述的所有文件及登記冊內的相關文件。
1.4 The Permit Holder shall give a
copy of this Permit to the person(s) in charge of the site(s) and ensure that
such person(s) fully understands all conditions and all requirements
incorporated in the Permit. The site(s) refers to site(s) of construction and
operation of the Project and shall mean the same hereafter.
許可證持有人須把本許可證的複本交予有關工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辦工程項目的工地，下文所提及的工地亦屬同一意思。
1.5 The Permit Holder shall display
conspicuously a copy of this Permit on the Project site(s) at all site
entrances/exits or at a convenient location for public’s information at all
times. The Permit Holder shall ensure that the most updated information about
the Permit, including any amended Permit, is displayed at such locations.
If the Permit Holder surrenders a part or the whole of the Permit, the notice
he sends to the Director shall also be displayed at the same locations as the
original Permit. The suspended, varied or cancelled Permit shall be
removed from display at the Project site(s).
許可證持有人須在工程項目的工地的所有進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證（包括任何經修訂的許可證）
的最新資料。許可證持有人如交回許可證的部分或全部，必須把其送交署長的通知書，在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下，不再展示。
1.6 The Permit Holder shall
construct and operate the Project in accordance with the project description in
Part B of this Permit.
許可證持有人須依據本許可證B部的工程項目說明，建造及營辦工程項目。
1.7 The Permit
Holder shall ensure that the Project is designed, constructed and operated in
accordance with the information and recommendations described in the approved
EIA Report (Register No. AEIAR-185/2014), the application documents for Environmental Permit (Application No.
AEP-489/2014), other relevant
documents in the Register, the information and mitigation measures described in
this Permit, mitigation measures to be recommended in the submissions that shall
be deposited with or approved by the Director as a result of permit conditions
contained in this Permit, and mitigation measures to be recommended under
on-going surveillance and monitoring activities during all stages of the
Project. Where recommendations referred to in the documents of the Register are
not expressly referred to in this Permit, such recommendations are nevertheless
to be implemented unless expressly excluded or amended in this Permit.
許可證持有人須確保工程項目的設計、建造及營辦，按照下述資料及措施辦理：核准環評報告（登記冊編號: AEIAR-185/2014）所說明的資料及各項建議、環境許可證申請文件（申請書編號:
AEP-489/2014）；登記冊內的其他相關文件；本許可證所說明的資料及緩解措施；根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施；以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或修訂。
1.8 All deposited submissions, as
required under this Permit, shall be rectified and resubmitted in accordance
with the comments, if any, made by the Director within one month of the receipt
of the Director’s comments or otherwise as specified by the Director.
所有按本許可證規定提交的存放文件，須在接獲署長的意見（如有者）後1個月內（除非署長另行指定），根據署長的意見加以修正並再向署長提交。
1.9 All submissions approved by the
Director, all submissions deposited without comments by the Director, and all
submissions rectified in accordance with comments by the Director under this
Permit shall be construed as part of the permit conditions described in Part C of this Permit. Any variation of the submissions
shall be approved by the Director in writing or as prescribed in the relevant
permit conditions. Any non-compliance with the submissions may constitute a
contravention of the Environmental Impact Assessment Ordinance (Cap. 499). All submissions
or any variation of the submissions shall be certified by the Environmental
Team (ET) Leader and verified by the Independent Environmental Checker (IEC)
referred to in Conditions 2.2 and 2.3 below before submitting to the Director under this Permit.
署長批准的所有提交文件、署長沒有給予意見的所有存放文件及根據本許可證規定由署長給予意見修正的所有提交文件，均須詮釋為本許可證C部說明的許可證條件的一部分。提交文件如有任何修訂，均須獲署長的書面批准，或符合有關許可證條件訂明的規定。如有不符合提交文件的情況，則可能違反《環境影響評估條例》（第499章） 的規定。所有提交文件或提交文件的任何修訂本，均須按下文條件第2.2及2.3項所述由環境小組組長核證及獨立環境查核人核實，然後才按本許可證規定向署長提交。
1.10 The Permit Holder shall release all
finalized submissions, as required under this Permit, to the public by
depositing copies in the Environmental Impact Assessment Ordinance Register
Office, or in any other places, or any internet websites as specified by the
Director, or by any other means as specified by the Director for public
inspection. For this purpose, the Permit Holder shall provide sufficient copies
of the submissions.
許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是把有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取署長指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的複本。
1.11 All submissions to the Director required
under this Permit shall be delivered either in person or by registered mail to
the Environmental Impact Assessment Ordinance Register Office (currently at
27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong). Electronic copies of all finalized
submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in
Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by
the Director and shall be submitted at the same time as the hard copies.
本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處（現址為：香港灣仔軒尼詩道130號修頓中心27樓）。所有按本許可證規定提交的文件定稿的電子版本，均須以超文本標示語言 (HTML) （第4.0或較後版本)和便攜式文件格式 (PDF) （第1.3或較後版本)製作，除非另獲署長同意，並須與硬複本同時提交。
1.12 The Director shall be notified in writing the
commencement dates of construction and operation of the Project no later than
one month prior to the respective commencement of construction and operation of
the Project. The Director shall be notified in writing immediately if there is
any change of the commencement dates of the construction and operation.
許可證持有人須在建造及營辦工程項目展開前，至少提早1個月以書面方式把建造及營辦工程的開展日期通知署長。建造及營辦工程的開展日期如有任何更改，許可證持有人必須立即以書面方式通知署長。
1.13 For the purpose of this Permit, “commencement of
construction” does not include works related to site investigation,
clearance
and preparation, or other works as agreed by the Director.
為執行本許可證，「建造工程的展開」不包括有關工地磡探、清理和預備的工程，或署長同意的其他工程。
2 SPECIFIC CONDITIONS
特定條件
Setting up of Community and Professional Liaison Groups
成立社區及專業人員聯絡小組
2.1
To enhance
transparency and communication with the public, the Permit Holder shall, no later than 3 months before the commencement of construction
of the Project, set up Community and Professional Liaison Groups respectively comprising members of affected parties including local
residents and
relevant professional/experts to facilitate communications, enquiries and complaints handling on all
environmental issues related to the Project. The Permit Holder shall take a
proactive approach to disseminate information to the groups, promote community cooperation and participation
and implement suitable local environmental enhancement works. All relevant information of the Project including the detailed design, the progress
of construction and operation and environmental monitoring and audit results
shall be provided to the groups. The Permit Holder shall inform the
Director in writing the membership and terms of reference of the two groups. The
Permit Holder shall make the minutes of the groups’ meetings and all papers and documents available to
the public through a website.
為提高透明度和加強與公眾溝通，許可證持有人須在展開工程項目的建造工程前最少3個月成立分別由受影響人士（包括當區居民及相關的專業人員／專家）組成的社區及專業人員聯絡小組，以便就所有與工程項目有關的環境問題進行溝通、查詢及處理投訴。許可證持有人須採取積極主動的做法，向相關小組傳遞信息、推廣社區合作和參與，並進行適當的地區環境改善工程。工程項目的所有相關資料，包括詳細設計、建造及營辦工程的進度、環境監察及審核結果，均須提供予有關小組。許可證持有人須將兩個小組的成員名單及職權範圍以書面通知署長，並須把小組的會議記錄及所有文件上載至網站供公眾閱覽。
The Permit Holder shall
also, no later than 3 months before the commencement of construction of the
Project, formulate and deposit a detailed Complaint Management Plan (The Plan)
with the Director. The Plan shall
include a dedicated complaint hotline and an email channel for timely response
to complaints.
許可證持有人亦須在展開工程項目的建造工程前最少3個月制定及向署長存放詳細的投訴管理計劃（計劃）。計劃須包括專設投訴熱線及電郵渠道，以期適時回應投訴。
Employment of Environmental Team
聘用環境小組
2.2
A full time on-site Environmental
Team (ET) shall be established by the Permit Holder no later than one month before the commencement of
construction of the Project. The ET shall not be in any way an associated
body of the Contractor or the Independent Environmental Checker (IEC) for the
Project. The ET shall be headed by a full time on-site ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and
auditing (EM&A) or environmental management. The ET and the ET Leader
shall be responsible for the implementation of the EM&A programme in
accordance with the EM&A requirements as contained in the updated EM&A Manual of the Project. The ET Leader shall keep a
contemporaneous log-book of each and every instance or circumstance or change
of circumstances, which may affect the compliance with the recommendations of
the approved EIA Report (Register No.
AEIAR-185/2014) and this Permit. The
ET Leader shall notify the IEC within one working day of the occurrence of any
such instance or circumstance or change of circumstances. The ET Leader’s
log-book shall be kept readily available for inspection by all persons
assisting in supervision of the implementation of the recommendations of the approved EIA Report (Register No. AEIAR-185/2014) and this Permit or by the Director or his authorized
officers. Failure to maintain records in the log-book, failure to
discharge the duties of the ET Leader as defined in the updated EM&A Manual or failure to comply with this Condition would entitle
the Director to require the Permit Holder by notice in writing to replace the
ET Leader. Failure by the Permit Holder to make replacement,
or further failure to keep contemporaneous records in the log-book despite the
employment of a new ET
Leader may render the Permit liable to suspension, cancellation or variation.
許可證持有人須在展開工程項目的建造工程前最少1個月成立一個長駐工地的環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名全職駐工地的環境小組組長帶領。環境小組組長須在環境監察及審核（「環監」）
或環境管理方面至少有7年經驗。環境小組及環境小組組長須按工程項目的更新環監手冊內載的環監規定，執行環監計劃。環境小組組長須保存一本記錄冊，同時記載可能會影響核准環評報告（登記冊編號: AEIAR-185/2014）的建議及本許可證的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放環境小組組長的記錄冊的地方，須可供協助督導執行核准環評報告（登記冊編號: AEIAR-185/2014）的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行更新環監手冊所列明的環境小組組長職務或未能符合本條件的規定，署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補，或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄，或會導致許可證遭暫時吊銷、取消或更改。
Employment of IEC
聘用獨立環境查核人
2.3
A full time on-site IEC with a supporting team shall be established by the Permit Holder no later than one month before
the commencement of construction of the Project. The IEC and his team shall not be in any way an associated body of the
Contractor or the ET for the Project. The IEC shall be a person who has
at least 7 years of experience in EM&A or environmental management.
The IEC shall be responsible for duties defined in the updated EM&A Manual and shall audit the overall
EM&A performance, including the implementation of all environmental
mitigation measures, submissions required in the updated EM&A Manual, and any other submissions
required under this Permit. In addition, the IEC shall be responsible for
verifying the environmental acceptability of permanent and temporary works,
relevant design plans and submissions under this Permit. The IEC shall
verify the log-book(s) mentioned in Condition 2.2. The IEC shall notify the Director by fax,
within one working day of receipt of notification from the ET Leader of each
and every change of circumstances or non-compliance with the recommendations of
the approved
EIA Report (Register No. AEIAR-185/2014) and this Permit, which might affect the monitoring or
control of adverse environmental impacts from the Project. In case the
IEC fails to so notify the Director of the same, fails
to discharge the duties of the IEC as defined in the updated EM&A Manual or fails to comply with this
Condition, the Director may require the Permit Holder by notice in writing to
replace the IEC. Failure to replace the IEC as directed or further
failure to so notify the Director despite employment of a new IEC may render
the Permit liable to suspension, cancellation or variation. Notification
by the Permit Holder is the same as notification by the IEC for the purpose of
this Condition.
許可證持有人須在展開工程項目的建造工程前最少1個月設立一名全職駐工地的獨立環境查核人及其支援小組。獨立環境查核人及其支援小組不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。獨立環境查核人須執行更新環監手冊所列明的職務，以及審核整體環監工作的表現，包括實施所有環境緩解措施、提交更新環監手冊規定的文件，以及提交本許可證所要求的任何其他文件。此外，獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件，並須核實條件第2.2項所述的記錄冊。在每次出現情況變化或不符合核准環評報告（登記冊編號: AEIAR-185/2014）的建議及本許可證的情況，而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時，獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況、未能執行更新環監手冊所列明的獨立環境查核人職務或未能符合本條件的規定，署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人，或在聘用新獨立環境查核人後仍未能通知署長有關情況，則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件，許可證持有人的通知等同獨立環境查核人的通知。
Submissions to be made before or during the Construction of the Project

Submission of Management Organizations
提交管理架構
2.4
The Permit Holder shall, no later than 1 month before the commencement of construction of the
Project, inform the Director in writing with the following
information:
許可證持有人須在展開工程項目的建造工程前最少1個月把以下資料以書面通知署長：
(i)
the management organization of
the main construction companies and/or any form of joint ventures associated
with the construction of the Project;
主要建造公司及／或以任何形式與工程項目建造工程相關的合營企業的管理架構；
(ii)
the management organization of
the ET;
環境小組的管理架構；

2.6 The Permit Holder shall advance the preparation works for the designation of the marine park as recommended in the approved EIA report (Register No. AEIAR-185/2014) including a study on the details of the designation containing at least the following information/specifications, on the understanding that the designation of the marine park shall be completed before the operation of the Project:

The Permit Holder shall, no later than 3 months before the commencement
of reclamation related marine works of the Project, submit 3 hard copies and 1
electronic copy of a marine park proposal including the proposed size and
management plan of the marine park as recommended in the approved EIA report (Register No. AEIAR-185/2014) to the Director for approval.
許可證持有人須在展開工程項目中與填海有關的海事工程前最少3個月將海岸公園建議[包括核准環評報告（登記冊編號：AEIAR-185/2014）建議的海岸公園面積及管理計劃]的3份硬複本及1份電子版本提交署長批准。
The Permit Holder shall consult the Director of Agriculture, Fisheries and
Conservation in preparing the proposal and submit it to the Advisory Council on the Environment
(ACE) for comment prior to the submission to the Director for approval.

2.8
The Permit Holder shall establish an independent Marine Ecology
Enhancement Fund (The Fund) which shall have substantial resources to meet its
conservation objectives in a long-term and sustainable manner. The Permit
Holder shall, no later than 3 months before the commencement of reclamation related marine works
of the Project, submit 3 hard copies and 1 electronic copy of a detailed Marine
Ecology Conservation Plan (The Plan) to the Director for approval. The Plan shall be formulated for the conservation of
marine life particularly the Chinese White Dolphins (CWD) within the Hong Kong
and the Pearl River Estuary (PRE) waters.
The Plan shall cover the relevant marine parks and other important
marine habitats in Hong Kong to enhance their carrying capacity, “dolphin
friendly” activities, the recovery of fisheries resources, and scientific
research for the overall benefits of marine mammals, particularly CWD, in the
PRE during the construction and the operation of the Project. A management committee shall also be set
up for The Fund with members from different stakeholders including relevant
academics, green groups and dolphin experts for effective implementation of The
Plan.
許可證持有人須成立獨立的改善海洋生態基金（「基金」），「基金」的資源須足以達到長遠和具持續性的保育目標。許可證持有人須在展開工程項目中與填海有關的海事工程前最少3個月將詳細海洋生態保育計劃（計劃）的3份硬複本及1份電子版本提交署長批准。所制訂的計劃須保護海洋生物，特別是在香港及珠江口水域出沒的中華白海豚。計劃須涵蓋有關的海岸公園及香港其他重要的海洋生境，以加強其承載能力，並發起「海豚友善」活動、恢復漁業資源，以及在工程項目建造及營辦期間珠江口的海洋哺乳類動物（特別是中華白海豚）的整體福祉進行科學研究。此外，亦須成立「基金」管理委員會，由不同持份者組成，包括相關學者、環保團體及海豚專家，以便有效推行計劃。

2.9
To minimize the chance of
vessel collision and disturbance to the CWD, the Permit Holder shall, no later than 3 months
before the commencement of construction of the Project, submit 3
hard copies and 1 electronic copy of Marine Travel Routes and Management Plan (The Plan) of construction and associated vessels
moving to and from the Project site during the construction stage, to the Director for approval. The Plan shall include at
least the following information/specifications:
為盡量減少船隻與中華白海豚碰撞及對其造成滋擾的機會，許可證持有人須在展開工程項目的建造工程前最少3個月將在施工期間往來工程項目場地的工程及相關船隻的海上交通路綫及管理計劃（計劃）的3份硬複本及1份電子版本提交署長批准。計劃須包括下列資料／規格：
(i) detailed technical guidelines to avoid adverse water quality impacts for compliance of contractors over the operation of barges and construction vessels to be deployed in the project area;
為免造成負面水質影響，在操作用於工程項目範圍的躉船及工程船隻方面供承辦商遵守的詳細技術指引；
(ii) practices or measures to keep stationary and moving construction-related vessels, including construction plants, construction vessels, delivery barges, and passenger vessels for staff, to a practical minimum;

(iii) speed limit of 10 knots for construction vessels within hotpots of the CWD;

(iv) predefined and regular routes for construction vessels covering waters both inside and outside the works area; and

Submission of Marine Travel Routes and Management Plan for High Speed Ferries of SkyPier

2.10
The Permit Holder shall, no later than 3 months
before the commencement of construction of the Project, submit 3
hard copies and 1 electronic copy of Marine Travel Routes and Management Plan (The Plan) for high speed
ferries (HSF) of the SkyPier, to the Director
for approval. The Plan shall
include the imposition of a speed limit within Hong Kong waters which are
hotspots of the CWD during the construction phase so as to minimize chances of
collision and disturbance to the CWD, and to cap the number of SkyPier HSF at the current level of operation (i.e. an
annual daily average of 99) prior to designation of the proposed marine
park. The Plan shall also
explore the feasibility of imposing a daily cap on the number of HSF leaving the SkyPier and imposing further speed
restriction at different spots along the marine routes after detailed study.
許可證持有人須在展開工程項目的建造工程前最少3個月將海天客運碼頭高速船的海上交通路綫及管理計劃（計劃）的3份硬複本及1份電子版本提交署長批准。計劃須包括在香港水域中華白海豚經常出沒的地方實施船速限制，以盡量減少施工階段船隻與中華白海豚碰撞及對其造成滋擾的機會；以及在指定建議的海岸公園前，把海天客運碼頭高速船航班數目上限定於現時運作水平（即每日平均99班）。計劃亦須在進行詳細研究後，探討就每日離開海天客運碼頭高速船航班數目設定上限，以及在海上線路的不同地點實施進一步船速限制的可行性。

2.11 The Permit Holder shall, no later than 3 months before the commencement of reclamation related marine works or works involving deployment of silt curtains of the Project, submit 3 hard copies and 1 electronic copy of Marine Mammal Watching Plan (The Plan) to the Director for approval. The Plan shall include regular inspection of silt curtains, visual inspection of the waters around silt curtains and the works areas, and a response plan to cope with any unpredicted incidents such as any marine mammal including, but not limited to, CWD is found within the waters surrounded by silt curtains or the works areas.

2.12 The Permit Holder shall, no later than 3 months before the commencement of construction works at areas with potential to affect coral colonies, deposit 3 hard copies and 1 electronic copy of Coral Translocation Plan (The Plan) with the Director. The Plan shall include at least the following information/specifications:
許可證持有人須在可能影響珊瑚群落的區域展開建造工程前最少3個月向署長存放珊瑚移植計劃（計劃）的3份硬複本及1份電子版本。計劃須包括下列資料／規格：
(i) a detailed baseline survey to be carried out before the commencement of the construction works at areas with potential to affect coral colonies to further confirm the exact number and locations of coral colonies; and
在珊瑚群落可能受影響的區域開展建造工程前進行的詳細基線調查，以進一步確定可能受影響範圍內珊瑚群落的確實數目和位置；以及

Fund (The Fund). The Permit Holder

Project, submit

of a detailed
Fisheries Management Plan (The Plan) to the Director for approval. The Plan shall be prepared in
collaboration with fishermen for supporting the fishing industry and enhancing
fisheries resources in the western Hong Kong waters especially the Lantau waters.
A management committee shall be set up for The Fund with members from
fishermen and relevant stakeholders for effective implementation of The Plan.

copies and 1 electronic copy of Egretry Survey Plan (The Plan) with the Director. The Plan
shall include at least the following information/specifications:
許可證持有人須在可能干擾沙洲鷺鳥林的地區展開建造工程前最少1個月向署長存放鷺鳥林調查計劃（計劃）的3份硬複本及1份電子版本。計劃須包括下列資料／規格：
(i)
the pre-construction survey to be carried out at least once per month in the breeding season between April and July,
prior to the commencement of HDD works at areas
with potential to
disturb the Sha Chau Egretry to update the latest boundary of the Egretry with a view to confirming the daylighting
location. The daylighting
point shall be kept to the minimum in size and be situated as far away from the
latest egretry boundary as practicable; and

works involving
deployment of silt curtains of the Project, deposit 3
hard copies and 1 electronic copy of a silt curtain deployment plan (The Plan) with the Director. The Plan
shall include at
least the following information/specifications:
許可證持有人須在展開涉及為工程項目敷設淤泥屏障的海事工程前最少3個月向署長存放淤泥屏障敷設計劃（計劃）的3份硬複本及1份電子版本。計劃須包括下列資料／規格：
(i)
the construction programme and details on the
design, operation and maintenance of silt curtain(s) to be deployed during the
construction;
施工計劃及施工期間敷設淤泥屏障的設計、運作及保養詳情；
(ii)
a pilot test on the efficiency of the silt curtain system shall be
conducted during the early stage of construction to confirm the silt curtain
removal efficiency; and

the pilot test shall be conducted during the
highest current speed condition, covering both flood and ebb tides, and include
measurement of current speed and direction, turbidity and suspended solids.

2.16
The Permit Holder shall, no later than 3 months before the commencement of construction of the Project, deposit 3
hard copies and 1 electronic copy of a Spill Response Plan (The Plan) detailing
the actions to be taken in the event of accidental spillage of oil, unexpected release of large
amount of suspended solids or other hazardous chemicals
during the construction and operation of the Project, with the Director.
The Plan shall include vessels operating for the Project, with specific provisions for
protecting water quality
and marine ecology as well as for the neighbouring
residents.

detailed plan
(The Plan) containing at least a layout arrangement and monitoring programme
on Deep
Cement Mixing (DCM) during the
construction to the Director for
approval. The Plan shall include monitoring locations, monitoring frequency, event and action plan for DCM
process, and mitigation measures to
be taken to avoid adverse water quality impacts and disturbance to marine mammals.

The Permit Holder shall, no later than 3 months
before the commencement of construction works on the formed land of the Project, deposit 3 hard copies and 1 electronic copy of
landscape and visual plan (The Plan) with the Director to specify quality criteria on
the overall landscape and visual environment of the Project with broad-brush
targets to be achieved for greening and planting as benchmarked against
international standards and best practices. The Plan,
with drawings in the scale of 1:1000 or other appropriate scales showing the
landscape and visual mitigation measures of the Project, shall include at least
the following information:

The Permit Holder shall, no later than 3 months before
the commencement of construction of the Project, deposit 3 hard
copies and 1 electronic copy of a Waste Management Plan (The Plan)
for the construction of the Project with the Director. The Plan shall describe
the arrangements for avoidance, minimization, recovery, recycling, reuse, storage,
collection, treatment and disposal of different categories of waste to be
generated from the construction activities and shall include the recommended
mitigation measures on waste management in the approved EIA report
(Register No. AEIAR-185/2014).
許可證持有人須在展開工程項目的建造工程前最少3個月向署長存放工程項目施工階段的廢物管理計劃（計劃）的3份硬複本及1份電子版本。計劃須說明就避免產生、盡量減少、回收、循環再用、重用、貯存、收集、處理及處置由建造活動所產生的各類廢物而作出的安排，並須在核准環評報告（登記冊編號：AEIAR-185/2014）中載述廢物管理的建議緩解措施。
The Permit Holder shall maximize the use of
construction and demolition (C&D) materials for the land formation work
during the construction phase of the Project, and shall critically review the
scheduling of the surcharge operations to avoid, or otherwise, minimize
generation of residual C&D materials requiring disposal during and at the
end of the land formation work. The
Plan
shall indicate the disposal location(s) of all surplus excavated spoil and
other wastes. A trip ticket system shall also
be
included in the plan. Surplus excavated spoil and other wastes
shall only be disposed of at designated disposal locations unless otherwise
approved by the Director.
許可證持有人須在工程項目施工階段盡量將拆建物料用於拓地工程，並須嚴謹檢討加載運作的時間表，以避免或盡量減少產生在拓地工程期間或完結時須棄置的剩餘拆建物料。計劃須指明所有剩餘挖出廢土及其他廢物的棄置位置。該計劃亦須納入運載記錄制度。除非獲署長另行批准，否則剩餘的挖出廢土及其他廢物只可在指定的棄置地點處置。

The Permit Holder shall, no

deposit 3 hard copies and 1 electronic copy of Supplementary Contamination
Assessment Plan (CAP) with the Director.

2.21
The Permit Holder shall, no later than 3 months before the operation of the third runway of the Project, submit 3
hard copies and 1 electronic copy of the procedures to the Director for approval. The procedures shall describe at least
the following mitigation measures recommended in the approved EIA report
(Register No. AEIAR-185/2014):
許可證持有人須在開始運作工程項目的第三條跑道前最少3個月將有關程序的3份硬複本及1份電子版本提交署長批准。有關程序須至少說明核准環評報告（登記冊編號：AEIAR-185/2014）所建議的下列緩解措施：
(i)
putting the existing south runway on standby where possible at night between
2300 hours and 0659 hours;

requiring departures to take the southbound route via West Lamma Channel during east flow at night between 2300 hours
and 0659 hours, subject to acceptable operational and safety consideration;

2.22
The Permit Holder shall, no later than 3 months after a full year of operation of the Project, submit 3 hard copies and 1 electronic copy of an updated Noise Exposure
Forecast (NEF) 25 contour with actual operational data to the Director
for approval. Thereafter the Permit Holder
shall review the operational data annually and update the NEF25 contour if there
are major deviations from the assumptions adopted in the approved EIA report (Register No. AEIAR-185/2014).
許可證持有人須在開始營運工程項目一年後的3個月內，將經更新的飛機噪音預測等量線25的3份硬複本及1份電子版本連同實際營運數據一併提交署長批准。其後，許可證持有人應每年審核營運數據，如有與核准環評報告（登記冊編號：AEIAR-185/2014）所採用的假設有重大偏差時須更新飛機噪音預測等量線25。
Submission of Aircraft Noise Monitoring Plan

2.23
The Permit Holder shall, no later than 3 months before the operation of
the Project, submit an Aircraft Noise Monitoring Plan (The Plan) to the
Director for approval. The Plan shall
include monitoring aircraft noise at representative locations in Tung Chung, Ma
Wan, Tsing Yi, Tsuen Wan,
Ting Kau, Siu Lam and Tuen Mun. The Plan shall
make use of the available aircraft noise and flight track monitoring data
including measured noise levels in terms of dB(A) and
their distribution, flight tracks, aircraft fleet mix data and other relevant
information at these locations. The Plan shall also include an action
plan, as approved by Director-General of Civil Aviation, to review the noise
data to assess the effectiveness of the mitigation measures and to take
appropriate action with reference to the prevailing internationally recognized
standards in aircraft noise mitigation.

In preparing The Plan, the Permit Holder shall confirm with the
Director-General of Civil Aviation on the implementation of restrictions on
specific aircraft types to follow the guidelines laid down by the International
Civil Aviation Organization to tackle the problem of aircraft noise problems at
source.
在擬備計劃時，許可證持有人須與民航處處長確認對特定機種實施限制的事宜，以跟隨國際民航組織所訂的指引，藉以從源頭處理飛機噪音問題。
Submission of Airport Operation related

2.24
The Permit Holder shall, no later than 3 months before
the operation of the Project, deposit 3 hard
copies and 1 electronic copy of an Airport Operation related Emissions Control Plan with the Director, detailing the measures to be taken to minimize and
control the emissions due to the airport operation including but not limited to
adopting fuel-efficient airside vehicles, promoting increased use of electric
vehicles and electric ground services equipment, banning all idling vehicles on
the airside and utilizing clean diesel and gasoline at the airfield.

2.25
The Permit Holder shall, no later than 3 months
before the commencement of operation of the Project, deposit 3
hard copies and 1 electronic copy of a Waste Management
Plan (The
Plan) for the operation of the Project with the Director. The Plan shall describe the arrangements for avoidance, minimization,
recovery, recycling, reuse, storage, collection,
treatment and disposal of different categories of waste to be generated from
the operation activities and shall include the recommended
mitigation measures on waste management in the approved EIA
report (Register No. AEIAR-185/2014).
許可證持有人須在開始營辦工程項目前最少3個月向署長存放營辦工程項目的廢物管理計劃（計劃）的3份硬複本及1份電子版本。計劃須說明就避免產生、盡量減少、回收、循環再用、重用、貯存、收集、處理及處置由營辦活動所產生的各類廢物而作出的安排，並須包括核准環評報告(登記冊編號：AEIAR-185/2014)內有關廢物管理的建議緩解措施。
The Permit Holder shall incorporate the
infrastructural design of the Project, suitable facilities to effect
separation, storage, recovery, recycling and reuse of different categories of
waste generated during the operation phase of the Project.

2.26 The Permit Holder shall implement
the following measures for marine works:

a maximum of 10 % fines content shall be adopted
for sand blanket and 20 % fines content for marine filling below +2.5 mPD prior to substantial completion of seawall;

(ii)
an advance seawall of at least 200m shall be
constructed prior to commencement of marine filling activities;

2.27
The Permit Holder shall implement the following measures during the
construction of the approach lights with locations as shown in Figure 3 of this Permit:

silt curtains shall be installed around the piling activities to
properly enclose the piling and associated works in accordance with the Silt Curtain
Deployment Plan under Condition 2.15;

(ii)
ground improvement at piling locations within the Contaminated Mud Pits

(iii)
steel casings shall be installed to enclose the excavation area prior to

The Permit Holder shall implement the following measures for the HDD and
site investigation works at Sha Chau
and its surrounding water:

no effluent shall be discharged at Sha Chau and its surrounding water; and

The Permit Holder shall implement the following plans:

The Permit Holder shall implement the following measures at Sha Chau:

Survey Plan under Condition 2.14;

The Permit Holder shall implement the following construction methods and

including the diversion of the aviation fuel pipeline to the Aviation Fuel
Receiving Facility;

use of DCM method for ground improvement at CMP areas instead of
conventional seabed dredging for land formation works;

2.33 The Permit Holder shall implement the following measures:

(i) construction and operation of a new greywater treatment plant with a handling capacity of at least 700m3/day. The treated greywater shall be reused during the operation of the Project;

(ii) upgrading of the existing gravity sewer by constructing a new gravity sewer with a diameter of at least 1,200 mm adjacent to the existing gravity sewer (1,050 mm in diameter) as shown in Figure 4 of this Permit and start diverting the sewage flow arising from the airport to the Siu Ho Wan Sewage Treatment Works within 3 years after the operation of the Project;

ENVIRONMENTAL MONITORING AND
AUDIT REQUIREMENTS

3.1 The
Permit Holder shall, no later than 3 months before the commencement of
construction of the Project, submit 10 hard copies and 1 electronic copy of an
updated EM&A Manual to the Director for approval. The updated EM&A Manual shall
include at least the following information:
許可證持有人須在展開工程項目的建造工程前最少3個月向署長提交經更新環監手冊的10份硬複本及1份電子版本，以作批核。經更新環監手冊須至少包括以下資料：
(i) clear and enforceable action and limit levels and the associated event action plans with clear rationale for CWD, air, noise, water quality and waste monitoring, and with provisions for stopping the relevant parts of works if the respective limit levels are exceeded during the construction of the Project;
就中華白海豚、空氣、噪音、水質及廢物監察制訂明確、可執行的行動及極限水平和具清晰理據的相應事件行動計劃，以及在工程項目施工期間超出相關極限水平時停止相關工程部分的條文；

3.2 The Permit Holder shall implement the EM&A programme in accordance
with the procedures and requirements as set out in the updated EM&A Manual. Any
changes to the programme shall be justified by the ET Leader and verified by
the IEC as conforming to the information and requirements contained in the updated EM&A Manual before submission to the Director for approval.
許可證持有人須按照經更新環監手冊所載的程序及規定執行環監計劃。計劃如有任何更改，須由環境小組組長提出理據並由獨立環境查核人核實，證明其符合經更新環監手冊所載的資料及規定，然後才提交署長批准。
3.3 The Permit Holder shall take samples, measurements and necessary remedial actions in accordance with the
requirements of the updated EM&A Manual by:
許可證持有人須按照經更新環監手冊所載的規定，透過以下方法進行取樣、測量及所需的補救行動：
(i)
conducting
baseline environmental monitoring;
進行環境基線監測；
(ii)
conducting
impact monitoring;

(iii)
carrying
out remedial actions described in the Event/Action Plans of the updated EM&A Manual in accordance with the
time frame set out in the Event/Action Plans, or as agreed by the Director, in
case where specified criteria in the updated EM&A Manual are exceeded; and

(iv)
logging and keeping records of the details of (i) to (iii) above for all parameters within 3 working days

of preparing and submitting the monthly EM&A Reports and to make available
the information for inspection on site.

3.4 The Permit Holder shall submit 4 hard

Monitoring Reports to the
Director at least 2 weeks before the commencement of construction of the
Project. The submissions shall be certified by the ET Leader and verified
by the IEC as having complied with the requirements as set out in the updated EM&A Manual before
submission to the Director. Additional copies of the Baseline Monitoring
Reports shall be provided upon request
by the Director.
許可證持有人須在展開工程項目的建造工程前，最少2個星期向署長提交有關基線監測報告的4份硬複本及1份電子版本。提交文件須由環境小組組長核證及獨立環境查核人核實，證明其符合經更新環監手冊所載的規定，然後才提交署長。如署長要求，則須提交基線監測報告的額外複本。
3.5 The Permit
Holder shall submit 4 hard
copies and 1 electronic copy of Monthly EM&A Reports for the construction
stage of the Project to the Director, within 2 weeks after the end of the
reporting month. The monthly EM&A Reports shall include a summary of
all non-compliance (exceedances) of the environmental
quality performance limits (Action and Limit Levels). The submissions
shall be certified by the ET Leader and verified by the IEC as having complied
with the requirements as set out in the updated EM&A Manual
before submission to the Director. Additional copies of the
Monthly EM&A Reports shall be provided upon request by the Director.

3.6 All environmental monitoring and audit
data submitted under this Permit shall be true, valid and correct.

3.7 To ensure a high degree of
transparency regarding the monitoring data and results in view of the public
concern about the Project, all environmental monitoring and audit data and
results and all submissions and all performance test data and results required
by this Permit shall be made available by the Permit Holder to the public
through a dedicated website to be set up by the Permit Holder under Condition
4.2 below, in the shortest practicable time and in no event later than 2 weeks
after such information is available.

ELECTRONIC REPORTING OF
EM&A INFORMATION

4.1 To
facilitate public inspection of the Baseline Monitoring Report and Monthly
EM&A Reports via the EIAO Internet Website and at the EIAO Register Office,
electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in
Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by
the Director and shall be submitted at the same time as the hard copies as
described in Conditions 3.4 and 3.5 above. For the HTML
version, a content page capable of providing hyperlink to each section and
sub-section of these Reports shall be included in the beginning of the
document. Hyperlinks to all figures, drawings and tables in these Reports shall
be provided in the main text from where the respective references are
made. All graphics in these Reports shall be in interlaced GIF, JPEG or PDF format unless
otherwise agreed by the Director. The content of the electronic copies of
these Reports must be the same as the hard copies.

4.2 The
Permit Holder shall, within 6 weeks after the commencement of construction of
the Project, set up a dedicated Internet website and notify the Director in
writing the Internet address where the environmental monitoring data and
project information is to be placed. All environmental monitoring data
described in Condition 4.1 above shall be made available to the public via the
abovementioned dedicated Internet website in the shortest possible time and in
any event no later than 2 weeks after the relevant environmental monitoring
data are collected or become available, unless otherwise agreed with the
Director. All finalized submissions and plans shall be made available to the
public via the dedicated Internet website in the shortest possible time and in
any event no later than 2 weeks after the submissions and plans are approved by
or deposited with the Director, unless otherwise agreed with the Director.

The Internet website as described in Condition 4.2 above
shall enable user-friendly public access to the environmental monitoring data
and project information including the Project Profile and this Permit.
The Internet website shall have features capable of:

Permit consists of three parts, namely, Part A
(Main Permit), Part B (Description of Designated
Project) and Part C (Permit Conditions). Any person relying on this permit shall obtain independent legal advice on the legal implications under the EIAO,
and the following notes are for general information only.

2. If
there is a breach of any condition of this Permit, the Director or his
authorized officer may, with the consent of the Secretary for the Environment,
order the cessation of associated work until the remedial action is taken in
respect of the resultant environmental damage, and in that case the Permit
Holder shall not carry out any associated works without the permission of the
Director or his authorized officer.
如違反本許可證的任何條件，署長或獲授權人員徵得環境局局長的同意後勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。
3. The
Permit Holder may apply under Section 13 of the EIAO to the Director for a
variation of the conditions of this Permit. The Permit Holder shall replace the
original permit displayed on the Project site by the amended permit.
許可證持有人可根據環評條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證替換在建造工地內展示的原有許可證。
4. A
person who assumes the responsibility for the whole or a part of the Project
may, before he assumes responsibility of the Project, apply under Section 12 of
the EIAO to the Director for a further environmental permit.
承擔工程項目整項或部分工程的責任的人，在承擔責任之前，可根據環評條例第12條的規定向署長申請新的環境許可證。
5. Under
Section 14 of the EIAO, the Director may with the consent of the Secretary for
the Environment suspend, vary or cancel this Permit. The suspended, varied or cancelled Permit
shall be removed from display at the Project site.
根據環評條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的環境許可證必須從工程項目工地除下，不再展示。
6. If
this Permit is cancelled or surrendered during the construction or operation of
the Project, another environmental permit must be obtained under the EIAO
before the Project could be continued.
It is an offence under Section 26(1) of the EIAO to construct or operate
a designated project listed in Part 1 and 2 of Schedule 2 of the EIAO without a
valid environmental permit.
如果本許可證在工程項目建造或營辦期間取消或交回，則在繼續營辦工程項目之前，必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦環評條例附表2第1及2部所列明的指定工程項目，即屬犯罪。
7. Any
person who constructs or operates the Project contrary to the conditions in the
Permit, and is convicted of an offence under the EIAO, is liable:
如任何人在違反本許可證的條件下建造或營辦工程項目，根據環評條例，即屬犯罪—
(i)
on a first conviction on indictment to a fine of $2
million and to imprisonment
for 6 months;
一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；
(ii)
on a second or subsequent conviction on indictment to a
fine of $5 million and to imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；
(iii)
on a first summary conviction to a fine at level 6 and
to imprisonment for 6 months;
一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；
(iv)
on a second or subsequent summary conviction to a fine
of $1 million and to imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；及
(v)
in any case where
the offence is of a continuing nature, the court or magistrate may impose a
fine of $10,000 for each day on which he is satisfied the offence continued.
在任何情況下如該罪行屬持續性質，則法院或裁判官可就其信納該罪行持續的每天另處罰款10,000元。
8. The
Permit Holder may appeal against any condition of this Permit under Section 17
of the EIAO within 30 days of receipt of this Permit.
許可證持有人可在接獲本許可證後30天內，根據環評條例第17條就本許可證的任何條件提出上訴。
9. The
Notes are for general reference only and that the Permit Holder should refer to
the EIAO for details and seek independent legal advice.
