Pursuant to Sections 10 and
12 of the Environmental Impact Assessment Ordinance (EIAO), the Director of
Environmental Protection (the Director) grants this environmental permit to the
MTR Corporation Limited (hereinafter referred to as the “Permit Holder”)
to operate the designated project described in Part B
subject to the conditions specified in Part C. The issue
of this environmental permit is based on the documents, approvals or
permissions described below :
根據《環境影響評估條例》(環評條例)第10及12條的規定,環境保護署署長(署長)將本環境許可證批予香港鐵路有限公司(下稱 “許可證持有人”)以營辦B部所說明的指定工程項目,但須遵守C部所列明的條件。本環境許可證是依據下列文件、批准或許可而簽發:

PART C (PERMIT CONDITIONS)
C部(許可證條件)
1.
General Conditions
一般條件
1.1
The
Permit Holder shall ensure full compliance with all conditions of this
environmental permit (the Permit). Any non-compliance may constitute a
contravention of the Environmental Impact Assessment Ordinance (Cap.499) and
shall be definite ground for enforcement action or permit cancellation where
applicable.
許可證持有人必須確保完全符合本環境許可證(下稱許可證)規定的全部條件。如有不符合本許可證的情況,可能構成違反「環境影響評估條例(第499章)」的規定,並可按適用情況作為採取執法行動或取銷其許可證的確切理由。
1.2
The
Permit Holder shall ensure full compliance with all legislation currently in
force such as the Noise Control Ordinance (Cap.400), Air Pollution Control
Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at
Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354), and others.
This Permit does not of itself constitute any ground of defense against any
proceedings instituted under any legislation.
本許可證並不免除許可證持有人須符合現行生效的法例的責任,例如「噪音管制條例(第400章)」、「空氣污染管制條例(第311章)」、「水污染管制條例(第358章)」、「海上傾倒物料條例(第466章)」、「廢物處置條例(第354章)」;及其他法例。本許可證本身不能作為依任何法律提起的法律程序中抗辯的理由。
1.3
The
Permit Holder shall make copies of this Permit together with all documents
referred to in this Permit or the documents referred to in Part
A of the Permit readily available at all times for inspection by the
Director at all offices covered by this Permit. Any reference to the Permit
shall include the documents referred to in the Permit and also the relevant
documents in the Register.
許可證持有人須複印本許可證以及本許可證所載的有關文件或本許可證A部所指的所有文件的副本,以供署長任何時間內在本許可證所涵蓋的所有辦事處查閱。對本許可證的引用須包括本許可證所指的文件以及環境影響評估條例登記冊辦事處存放的相關文件。
1.4
The
Permit Holder shall give a copy of this Permit to the person(s) in charge of
the operation of the Project and ensure that such person(s) fully understands
all conditions and all requirements incorporated in the Permit.
許可證持有人須把本許可證的一份複本交予營辦本工程項目的負責人,並確保這些人士完全明白本許可證內載的所有條件與規定。
1.5
The
Permit Holder shall operate the Project in accordance with the project
description in Part B of this Permit.
許可證持有人須依據本許可證B部的工程項目的說明營辦本工程項目。
1.6
The Permit
Holder shall ensure that the Project is operated in accordance with the
information and all recommendations described in the EIA Report (Register No. AEIAR-026/1999) and other relevant documents in
the Register, taking full account of information or mitigation
measures, and variations of work described in the previous varied Permit of the
Project, or mitigation measures to be deposited with or approved by the
Director. Where recommendations referred to in the documents of the Register
are not expressly referred to in this Permit, such recommendations are
nevertheless to be implemented unless expressly excluded or impliedly amended
in this Permit.
許可證持有人須確保工程項目的營辦遵照環評報告(登記編號AEIAR-026/1999)內載的資料和建議,及在登記冊內的其他文件,及在登記冊內的其他文件,並充分考慮本許可證所說明的資料或緩解措施和在早前的工程項目更改許可證內說明的工程更改,或由許可證條件所導致須存放於或由署長核準的緩解措施。當在登記冊內所載建議並沒有明確在本許可證內指出,此等建議並應同樣實施。除非,此等建議已在本許可証內已明確指出並不包括內或明確修訂。
1.7
All
submissions approved by the Director, all submissions deposited without
comments by the Director, or all submissions rectified in accordance with
comments by the Director under this permit shall be construed as part of the
permit conditions described in Part C of this Permit. Any
variation of the submissions shall be approved by the Director in writing or as
prescribed in the relevant permit conditions. Any non-compliance with the
submissions may constitute a contravention of the Environmental Impact
Assessment Ordinance (Cap.499).
All submissions or their variations shall be verified and certified by
the Independent Environmental Checker (IEC), with at least 7 years experience
in environmental monitoring and auditing or environmental management, before
submitting to the Director under this Permit.
所有根據本許可證規定提文經署長批准的文件、署長沒有意見的文件或已導從署長經意見修訂的文件均為本許可證C部所述許可證條件的組成部分。對文件所作的任何變更應經署長書面或依照相關許可證條件規定的其他方式批准。與文件的任何不符將被視為違反環境影響條例(第499章)。在提交文件申請批准前,所作的變更應由具有七年環境監察與審核或環境管理經驗的獨立環境查核人核實,確認其符合環境影響評估報告內所載的資料和建議。
1.8
The Permit Holder shall release all finalized submissions, as
required under this Permit, to the public by depositing copies in the Environmental
Impact Assessment Ordinance Register Office, or in any other places as
specified by the Director, or by any other means as specified by the Director
for public inspection. For this purpose, the Permit Holder shall provide
sufficient copies of the submissions.
許可證持有人須根據署長要求,公開所有按本許可證規定提交的文件定稿給公眾人士查閱,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何其他地方或互聯網網站,或採取指定的任何其他方法,以供公眾查閱。為此,許可證持有人須提供足夠數量的文件副本。
1.9
All
submissions to the Director required under this Permit shall be delivered
either in person or by registered mail to the Environmental Impact Assessment
Ordinance’s Register Office at 27/F, Southern Centre, 130 Hennessy Road,
Wanchai, Hong Kong.
本許可證要求提交署長的所有文件應由專人送達或以掛號郵寄方式,送交香港灣仔軒尼詩道130號修頓中心27樓環境影響評估條例登記冊辦事處。
2.
Measures during Operation of
the Project
項目營運期間採取的措施
2.1
The Permit Holder shall properly
implement and maintain the Landscape Master Plan as approved under the Permit
No. EP-041/2000 or under subsequent varied Permit. The Plan shall show the
detailed landscape proposals during the operation stage of the Project, and
shall include an implementation programme of landscape works. All measures
recommended in the approved Plan shall be fully implemented in accordance with
the details and time schedule set out in the Plan.
許可證持有人須妥善執行及保養在許可證編號EP-041/2000或其後更改許可證下批准的景觀設計總圖。總圖須說明營運期內的詳細景觀建議,並應包括景觀工程實施計劃。已批准計劃總圖內載的所有建議措施應根據總圖內規定的細節及時間表,全面實施。
2.2 The
Permit Holder shall properly implement and maintain the environmental
mitigation measures to the rectifier station (ie. R14 refers to in the EIA
Report) and design of the associated ventilation as approved under the Permit
No. EP-041/2000 or under subsequent varied Permit.
許可證持有人須妥善執行及保養在許可證編號EP-041/2000或其後更改許可證下批准的對整流站(即R14,見環境影響評估報告)採取的環境緩解措施以及有關通風系統的設計。
2.3 The
operation of the Project shall meet the following specifications
本工程項目的營辦須滿足下列規定:
(a)
re-radiated noise from viaduct structure
is at least 10dB(A) below the noise criteria of 65dB(A) Lmax at 25m,
at 50kph; and
高架結構的再輻射噪音最少比25m,50kph條件下65dB(A)Lmax噪音標準低10dB(A);以及
(b)
noise level at 2m from the transformer
bays in the rectifier will be less than 66dB(A).
整流站內距變壓器位2米處的噪音水平少於66dB(A)。
2.4 Measures
described in Appendix A to mitigate environmental
impacts from run-off and drainage shall be implemented throughout the operation
period.
許可證持有人須實施附錄A規定的措施,以減輕營運期間,徑流及排水的影響。
2.5 Any
change to the design or measures relevant to the operation of the Project shall
be justified and certified by the IEC with at least 7 years experience in
environmental monitoring and auditing or environmental management before
submission to the Director for approval.
對於有關工程項目運作期間的設計或措施所作的任何變更應在提交署長申請審批前,須由具有七年環境監察與審核或環境管理經驗的獨立環境查核人提出具充分理由,並由獨立環境查核人認證。

This Permit consists of three parts, namely, Part A (Main Permit), Part B
(Description of Designated Project) and Part C
(Permit Conditions). Any person relying on this permit should obtain
independent legal advice on the legal implications under the Ordinance, and the
following notes are for general information only.
本許可證共有3部,即A部(許可證主要部分);B部(指定工程項目的說明)及C部(許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見,下述註解只供一般參考之用。
2.
If
there is a breach of any conditions of this Permit, the Director or his
authorized officer may, with the consent of the Secretary for the Environment,
order the cessation of associated work until the remedial action is taken in
respect of the resultant environmental damage, and in that case the Permit
Holder shall not carry out any associated works without the permission of the
Director or his authorized officer.
如違反本許可證的任何條件,署長或獲授權人員在徵得環境局局長的同意後,可勒令停止相關工程,直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下,許可證持有人在未經署長或獲其授權人員同意,不得進行任何相關工程。
3.
The
Permit Holder may apply under Section 13 of the Environmental Impact Assessment
Ordinance (the “Ordinance”) to the Director for a variation of the conditions
of this Permit. The Permit Holder
shall replace the original permit displayed on the Project site by the amended
permit.
許可證持有人可根據環境影響評估條例(“條例”)第13條的規定,向署長申請更改本環境許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。
4.
A
person who assumes the responsibility for the whole or a part of the Project
may, before he assumes responsibility of the Project, apply under Section 12 of
the Ordinance to the Director for a further environmental permit.
承擔工程項目整項或部分工程的負責人,在承擔責任之前,可根據條例第12條向署長申請新的環境許可證。
5.
Under
Section 14 of the Ordinance, the Director may with the consent of the Secretary
for the Environment, suspend, vary or cancel this Permit. The suspended, varied
or cancelled Permit shall be removed from display at the Project site.
根據條例第14條,署長可在環境局局長的同意下暫時吊銷、更改或取消本環境許可證。遭暫時吊銷、更改或取消的環境許可證,必須從工程項目工地除下,不再展示。
6.
If
this Permit is cancelled or surrendered during operation of the Project,
another environmental permit must be obtained under the Ordinance before the
Project could be continued. It is an offence under Section 26 (1) of the
Ordinance to operate a designated project listed in Schedule 2 of the Ordinance
without a valid environmental permit.
如果本許可證在工程項目營辦期間取消或交回,則在繼續營辦工程項目之前,必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條,任何人在沒有有效環境許可證的情況下營辦條例附表2所列明的指定工程項目,即屬犯罪。
7.
Any
person who operates the Project contrary to the conditions in the Permit, and
is convicted of an offence under the Ordinance, is liable :
任何人在違反本許可證的條件下營辦工程項目或解除工程項目,並且根據環評條例定罪,即可遭受 —
(i) on a first conviction on
indictment to a fine of $2 million and to imprisonment for 6 months;
一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;
(ii) on a second or subsequent conviction on indictment to a fine of $5
million and to imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;
(iii) on a first summary conviction to a fine at level 6 and to imprisonment
for 6 months;
一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;
(iv) on a second or subsequent summary conviction to a fine of $1 million
and to imprisonment for 1 year; and
一經循簡易程序第二次或其後每次定罪,可處罰款100萬元及監禁1年;及
(v) in any case where the
offence is of a continuing nature, the court or magistrate may impose a fine of
$10,000 for each day on which he is satisfied the offence continued.
在任何情況下如該罪行屬持續性質,法院或裁判官可就其信納該罪行持續的每一天另處罰款10,000元。
8.
The
Permit Holder may appeal against any condition of this Permit under Section 17
of the Ordinance within 30 days of receipt of this Permit.
許可證持有人可在接獲本許可證後30天內,根據條例第17條就本許可證的任何條件提出上訴。
9.
The
Notes are for general reference only and that the Permit Holder should refer to
the EIA Ordinance for details and seek independent legal advice.

Measures to Mitigate Environmental Impacts from Site Runoff and
Drainage during Operation
附錄A
緩解營運期間,徑流及排水環境影響的措施
To mitigate the
environmental impacts from site runoff and drainage during the operational
phase, the following shall be implemented:
應實施下列措施,以緩解營運期內因地盤徑流及排水造成的環境影響:
(a) A surface water
drainage system shall be provided to collect the track runoff. Where oil and lubricating fluids can be
spilt, the tract drainage channels discharge shall pass through oil/grit
interceptors/chambers, or a sub-soil drainage system to remove oil, grease and sediment
before being pumped to the public stormwater drainage system.
應提供地面水排水系統以收集鐵軌徑流。在油污及潤滑液可能出現外溢的地方,鐵軌排水渠排出的污水應在泵入公共雨水排水系統前,流經油污/砂礫截流井/池,或地下排水系統,以清除油污、油脂及沉積物。
(b) Silt traps and
oil interceptors shall be cleaned and maintained regularly to ensure proper
functioning and efficient operation.
淤泥收集器及油污截流井應定期清潔及保養,以確保正常操作及效率。
(c) Oily contents of
the oil interceptors shall be transferred to an appropriate disposal facility,
or to be collected for reuse, if possible.
油污截流井內收集的油污應轉移到適當的處置設施或在可能時回收利用。
