PART A (MAIN PERMIT)

Pursuant to Section 10 and 12 of the Environmental Impact Assessment Ordinance (the EIAO), the Director of Environmental Protection (the Director) grants this Further Environmental Permit to the Veolia Hong Kong Holding Limited (hereinafter referred to as the “Permit Holder”) to construct and operate the designated project described in Part B subject to the conditions specified in Part C. The issue of this Further Environmental Permit is based on the documents, approvals or permissions described below:

 

根據《環境影響評估條例》(環評條例)第10及12條的規定，環境保護署署長 (署長) 將本新的環境許可證批予威立雅香港控股有限公司(下稱 “許可證持有人”)，以建造及營辦B部所說明的指定工程項目，但須遵守C部所說明的條件。本新的環境許可證的發出，乃以下表所列的文件、批准或許可作為根據：－

Hereunder is the description of the designated project mentioned in Part A of this further environmental permit (hereinafter referred to as the “Permit”):

下列為本新的環境許可證(下稱 “許可證”) A部所提述的指定工程項目的說明：

The location of the Project is shown in Figure 1 of this Permit.

Scale and Scope of Designated Project

指定工程項目的規模和範圍

 

The Project mainly consists of the followings:-

工程項目主要範圍包括以下各項：－

 

Construction and operation of a landfill extension of about 70 hectares with a target void space of at least 19 million cubic metres on the eastern side of the existing NENT Landfill, including the followings:-

(i)              Site formation and preparation;

(ii)            Installation of liner system;

(iii)          Installation of leachate collection, treatment and disposal facilities;

(iv)           Installation of gas collection, utilization and management facilities;

(v)            Utilities provisions and drainage diversion;

(vi)           Landfilling operation;

(vii)         Restoration and aftercare in subsequent stages; and

(viii)       Measures to mitigate environmental impacts as well as environmental monitoring and auditing to be implemented.

 

在現有新界東北堆填區的東面建造及營辦目標容量約1900萬立方米、佔地約70公頃的堆填區擴建工程，包括：－

(i)             工地平整及預備工程；

(ii)           裝設防滲漏層系統；

(iii)         裝設滲濾污水收集、處理及排放設施；

(iv)          裝設堆填氣體收集、應用及管理設施；

(v)           提供公用設施及排水渠改道；

(vi)          堆填區的營運；

(vii)        繼後的修復及修復後的護理工程；以及

(viii)      環境影響緩解措施及執行環境監察及審核。

 

PART C (PERMIT CONDITIONS)

C部 (許可證條件)

 

1                        General Conditions
一般條件

1.1                 The Permit Holder and any person working on the Project shall comply with all conditions of this Permit.  Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject of appropriate action being taken under the Ordinance.

許可證持有人及任何從事工程項目的人士必須符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況，可能違反環評條例(第499章)的規定，而當局可根據條例採取適當行動。

1.2                 The Permit Holder shall ensure full compliance with all legislation from time to time in force including without limitation to the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358) and Waste Disposal Ordinance (Cap.354).  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

許可證持有人須經常確保完全符合現行法例的規定，包括但不限於噪音管制條例 (第400章)；空氣污染管制條例 (第311章)；水污染管制條例 (第358章)；以及廢物處置條例 (第354章)。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由，或根據任何法例默示任何批准。

1.3                 The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件及本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證，須包括本許可證所述的所有文件及登記冊內的相關文件。

1.4                 The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit.  The site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

許可證持有人須把本許可證的複本交予有關工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造及營辦工程項目的工地，下文所提及的工地亦屬同一意思。

1.5                 The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular entrances/exits or at a convenient location for public information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部，必須把其送交署長的通知書，在備有原有許可證的相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目的工地除下，不再展示。

1.6                 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

許可證持有人須依據本許可證B部的工程項目說明，建造及營辦工程項目。

1.7                 The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the EIA Report, other relevant documents in the Register; and the information or mitigation measures described in this Permit, and mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project.  Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目的設計、建造及營辦，按照下述資料及措施辦理：環評報告內載的資料及各項建議；登記冊內的其他相關文件；本許可證內載的資料或緩解措施；根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施；以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確提及，則仍須實施這些建議，除非獲本許可證明確豁除或默示修訂。

1.8                 All submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise specified by the Director.

所有按本許可證規定提交的文件，須在接獲署長的意見 (如有者) 起計一個月內或按署長另行指定，根據署長的意見作出修正並再向署長提交。

1.9                 All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit.  Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions.  Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499).  All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Conditions 2.1 and 2.2 of the Environmental Permit No. EP-292/2007 before submitting to the Director under this Permit.

所有提交署長並獲批准的文件、所有提交署長存放而沒有收到署長意見的文件或根據本許可證提交並已依照署長的意見作出修訂的所有文件，將詮釋為本許可證C部說明的許可證條件的一部分。對提交文件所作的任何修訂，均須獲署長的書面批准，或符合有關許可證條件訂明的規定。如有不符合提交文件的情況，可能違反環評條例 (第499章) 的規定。所有提交文件或提交文件的任何修訂本，均須按環境許可證編號EP-292/2007的條件第2.1及2.2項所述由環境小組組長核證及獨立環境查核人核實，然後才按本許可證規定向署長提交。

1.10             The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是把有關文件複本存放於環評條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取署長指定的任何方法，以供公眾查閱。為此，許可證持有人須提供足夠數量的複本。

1.11             All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).  Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.

本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環評條例登記冊辦事處(現時地址為香港灣仔軒尼詩道130號修頓中心27樓)。所有按本許可證規定提交的文件定稿的電子版本，均須以超文本標示語言 (HTML) (第4.0或較後版本) 及便攜式文件格式 (PDF) (第4.0或較後版本) 製作，除非另獲署長同意，並須與硬複本同時提交。

1.12             The Permit Holder shall notify the Director in writing the commencement date of construction of the Project no later than one month prior to the commencement of construction of the Project.  The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

許可證持有人須在工程項目的建造工程展開前，至少提早一個月以書面方式把建造工程的施工日期通知署長。建造工程的展開日期如有任何更改，許可證持有人必須立即以書面方式通知署長。

1.13             For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation or other works as agreed by the Director.

為執行本許可證，「建造工程的展開」不包括有關工地清理及預備的工程，或署長同意的其他工程。

2                        Special Conditions
特定條件

Submissions or Measures before Commencement of Construction
建造工程展開前須提交的文件或採取的措施

 

Management Organization of Main Construction Companies
主要建造公司的管理架構

2.1                 The Permit Holder shall, no later than two weeks before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

許可證持有人須在工程項目的建造工程展開前，至少提早兩個星期把主要建造公司及 / 或以任何形式與建造工程相關的合營企業的管理架構，以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

Setting up of Community Liaison Group
成立社區聯絡小組

 

2.2                 To enhance transparency and communication with the public, the Permit Holder shall, within 3 months before commencement of construction of the Project, set up a Community Liaison Group involving relevant stakeholders and shall take a proactive approach to disseminate information to the local community, promote community cooperation and participation and implement suitable local environmental enhancement works.  All relevant information of the project including the detailed design, the progress of construction and operation and environmental monitoring and audit results shall be provided to the Community Liaison Group.  The Permit Holder shall inform the Director in writing the membership and terms of reference of the Community Liaison Group.  The Permit Holder shall make the minutes of the Community Liaison Group meetings and all papers and documents available to the public through a website.

為提高透明度和加強與公眾的溝通，在工程項目的建造工程展開前3個月內，許可證持有人須成立包括有關持份者的社區聯絡小組，並須採取積極主動的做法，向當地社區傳遞信息、推廣社區合作和參與，並進行適當的地區環境改善工程。工程項目的所有相關資料，包括詳細設計、建造進度、營辦、環境監察及審核結果須提供予社區聯絡小組。許可證持有人須將社區聯絡小組的成員名單及職權範圍以書面通知署長，並須把社區聯絡小組的所有會議記錄及相關文件，上載網站供公眾閱覽。

Submission of EM&A Manual
提交環監手冊

2.3                 The Permit Holder shall, no later than one month before the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of an updated EM&A Manual for the Project.  Before submission to the Director, the EM&A Manual shall be certified by the ET and verified by the IEC as conforming to the information and recommendations contained in the EIA Report. The EM&A Manual shall include the latest information on the EM&A requirements for ecological, landscape, water and landfill gas hazard.  All measures recommended in the approved EM&A Manual shall be fully and properly implemented according to the requirements and time schedule(s) set out in the EM&A Manual.

在工程項目的建造工程展開前，許可證持有人須至少提早一個月把工程項目經更新的環監手冊的四份硬複本及一份電子版本，提交署長批核。環監手冊須由環境小組核證及獨立環境查核人核實，證明其符合環評報告所載資料及建議，然後才提交署長。環監手冊須載有與生態、景觀、水及堆填氣體風險相關的環監規定的最新資料。核准環監手冊所建議的所有措施，須根據環監手冊載列的規定及時間表徹底妥善執行。

Preservation of Cultural Landscape Features
保存具特色的文化景觀

2.4                 The Permit Holder shall, no later than four weeks before commencement of construction of the Project, deposit a report documenting the implementation of the following mitigation measures for preservation of the cultural landscape features located within the Project area.  The report shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report :-

在工程項目的建造工程展開前，許可證持有人須至少提早四個星期存放一份報告，證明為保存工程項目範圍內具特色的文化景觀而實施以下的緩解措施。此報告須由環境小組組長核證並由獨立環境查核人核實，證明其符合核准的環評報告所載的資料及建議：

(a)           Carry out survey and mapping works to identify sections of boulder path BP1 and BP2 as shown in Figure 2 attached to the Permit that fall within the Project area, and preservation by detailed record for sections of boulder paths that fall within the Project area; and

進行測量及繪圖的工作，以鑑辨載於許可證圖2的石板路BP1段和BP2段是位於工程項目範圍內；並詳細記錄如何保存位於工程項目範圍內的石板路段；以及

(b)           Preservation by detailed record for graves G2, G4, G5, G6, G7, G8, G14, G15, G25, G26, G27 as shown in Figure 2 attached to the Permit.

詳細記錄如何保存載於許可證圖2的墳墓G2、G4、G5、G6、G7、G8、G14、G15、G25、G26及G27。

Ecological Mitigation Measures
生態緩解措施

2.5                 The Permit Holder shall, no later than one month before the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a detailed vegetation survey covering the affected habitats located within the Project area for the purpose of updating, identifying and recording the location and number, health condition and suitability for transportation of the affected individual plant species in order to provide details for the transplantation scheme.  The survey shall cover the four plant species of conservation importance including the Aquilaria sinensis, Rhododendron simsii, Endospermum chinense, and Arundina graminifolia at the locations shown in the attached Figure 3. The detailed vegetation survey shall be prepared by a qualified botanist or ecologist and shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report.

在工程項目的建造工程展開前，許可證持有人須至少提早一個月，把詳盡的種植調查報告的四份硬複本和一份電子版本提交署長批核。這份調查報告須涵蓋工程項目範圍內的受影響生境，就受影響的個別植物品種的位置、數目、健康狀況及是否適宜移植而更新、鑑辨及記錄資料，藉此為移植計劃制訂詳情。調查報告須臚列四個具重要存護價值的植物品種，當中包括載於附圖3所示位置的牙香樹、紅杜鵑、黃桐及竹葉蘭。詳細的種植調查報告須由合資格的植物學家或生態學家擬備，並須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的環評報告所載的資料及建議。

2.6                 The Permit Holder shall, no later than six month before the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a detailed methodology for capture surveys and translocation on the endemic freshwater crab Somanniathelphusa zanklon affected by the Project area and monitoring requirements on the establishment of the Somanniathelphusa zanklon community in the translocated site.  The submission shall be prepared by a qualified botanist or ecologist and shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report.

在工程項目的建造工程展開前，許可證持有人須至少提早六個月，就有關工程項目範圍內受影響的區域性淡水束腰蟹(Somanniathelphusa zanklon)的詳細捕撈調查和遷徙方法，以及就在遷徙地點設立束腰蟹(Somanniathelphusa zanklon)羣落而實施的監測規定，把四份硬複本和一份電子版本報告提交署長批核。提交的報告須由合資格的植物學家或生態學家擬備，並須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的環評報告所載的資料及建議。

2.7                 The transplantation shall be carried out according to the transplantation scheme approved under Condition 2.5 before commencement of construction of the Project.

 在工程項目的建造工程展開前，移植植物的工作須根據條件第2.5項所核准的移植計劃展開。

2.8                 The capture surveys, translocation and monitoring on the endemic freshwater crab Somanniathelphusa zanklon shall be carried out according to the submission approved under Condition 2.6 before commencement of construction of the Project.

在工程項目的建造工程展開前，有關區域性淡水束腰蟹(Somanniathelphusa zanklon)的捕撈調查、遷徙及監測工作須根據條件第2.6項所核准的報告進行。

Submission of Detailed Landfill Gas Hazard Assessment Report
提交詳盡的堆填氣體風險評估報告

2.9                 The Permit Holder shall, within one month before the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a detailed landfill gas hazard assessment, which shall include a review of the preliminary qualitative risk assessment in the approved EIA Report, preparation of a detailed qualitative risk assessment, preparation of detailed design of gas protection measures and the establishment of maintenance and monitoring programmes to ensure the continued performance of the proposed control measures.  The submissions shall be certified by the ET Leader and verified by the IEC. Additional copies of the submission shall be provided upon request by the Director.

在工程項目的建造工程展開前一個月內，許可證持有人須把詳盡的堆填氣體風險評估報告的四份硬複本和一份電子版本提交署長批核，報告內容須包括檢討核准環評報告所載的初步定質風險評估、擬備詳盡的定質風險評估、擬備堆填氣體保護措施的詳情，並設立維修及監測計劃，以確保擬議的保護措施持續切實執行。提交的報告須由環境小組組長核證及獨立環境查核人核實。如署長要求，許可證持有人須把報告的額外複本送交署長。

Measures and Submissions to be Implemented during Construction of the Project
工程項目建造期間須採取的措施及提交的文件

 

Submission of Waste Management Plan
提交廢物管理計劃

 

2.10             The Permit Holder shall, within one month after the commencement of construction of the Project, deposit with the Director four hard copies and one electronic copy of a Waste Management Plan (WMP) for the construction stage of the Project.  The WMP shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report.  The WMP shall describe the arrangements for avoidance, reuse, recovery and recycling, storage, collection, treatment and disposal of different categories of waste to be generated from the construction activities and shall include the recommended mitigation measures on waste management in the approved EIA Report.  The WMP shall indicate the disposal location(s) of all surplus excavated spoil and other waste. A trip ticket system shall be included in the WMP.  Surplus excavated spoil and other wastes shall only be disposed of at designated disposal locations unless otherwise approved by the Director.  All measures recommended in the approved WMP shall be fully and properly implemented by the Permit Holder and any person working on the Project throughout the construction period.

在建造工程展開後一個月內，許可證持有人須向署長存放有關工程項目建造階段的廢物管理計劃的四份硬複本和一份電子版本。計劃須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的環評報告所載的資料及建議。計劃須說明如何安排避免產生、再使用、回收、循環再造、貯存、收集、處理及棄置建造作業所產生的各類廢物，並須包括核准的環評報告所建議的廢物管理緩解措施。計劃須顯示所有剩餘挖出棄土及其他廢物的棄置地點。計劃亦須包括運載記錄制度。除非另獲署長批准，剩餘挖出棄土及其他廢物，只可在指定的棄置地點棄置。在整段建造工程進行期間，許可證持有人及任何從事工程項目的人士，均須徹底妥善執行核准的廢物管理計劃所建議的各項措施。

2.11             The Permit Holder shall, within six months after the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a landscape plan(s) showing details of landscape measures including phased plantation of 26.83 hectares of woodland, 19 hectares of shrubland and 17.55 hectares grassland during construction, operation and restoration stages of the Project. The plan(s), of scale 1 to 1000 or other appropriate scale as agreed by the Director, shall include details on locations, size, number and species of planting, fire prevention measures including provision of firebreak and plantation of fire tolerant species, implementation programme, maintenance and management schedules.  The submission shall be certified by the ET Leader and verified by the IEC as conforming to the information, requirements and recommendations set out in the approved EIA Report. All measures recommended in the approved landscape plan(s) shall be fully and properly implemented in accordance with the details and programme set out in the submission.

Submission of Contingency Plan on Accidental Leakage of Leachate

2.12             The Permit Holder shall, within four weeks before the commencement of operation of the Project, submit to the Director for approval four hard copies and one electronic copy of a contingency plan on accidental leakage of leachate.  The contingency plan shall cover design contingency plan for both groundwater contamination and surface water contamination.  The submission shall be verified by the IEC as conforming to the information and recommendations contained in the approved EIA Report.  All design features and measures recommended in the approved plan shall be fully and properly implemented.

在營辦工程項目展開前的四個星期內，許可證持有人須把滲濾污水意外應變計劃的四份硬複本及一份電子版本提交署長批核。應變計劃須包括為地下水和地面水的污染制訂應急方案。提交的計劃須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的環評報告所載的資料及建議。核准圖則所建議的所有設計特點及措施須徹底妥善執行。

  Implementation of Surface Water Drainage System

  設置地面排水系統

 

2.13             A temporary surface water drainage system shall be provided to manage runoff during the construction and operational stages.  The system shall consist of the following features:-

在工程項目的建造及營辦階段，須安裝臨時地面排水系統以管理調控徑流。系統須有以下特點：

(a)       channels constructed around the perimeter of the site area to collect surface water from the areas of higher elevations to those of lower elevations and ultimately to the point of discharge. 

在地盤周邊建造排水道，以收集由高地流向低地的地面水，並最後排放至排水口位置。

(b)       use of a silt fence around the soil stockpile areas to prevent sediment from entering the system. Regular cleaning will be carried out to prevent blockage of the passage of water flow in silt fence.

在泥土堆積處圍建淤泥圍欄，以防止沉積物進入排水系統，並須定期進行清潔，防止淤泥圍欄蔽塞以致水流無法暢通。

(c)       Intermediate drainage system will be installed for filled cell/phase to prevent the clean surface water run-off from the filled phases coming into contact with the waste mass in active cell and to prevent excessive surface water infiltration through the intermediate cover, thus contribute to increasing volume of leachate.  The intermediate drainage system will collect the clean surface water run-off and divert it to the permanent discharge channels connected to the public drainage system.

在已覆蓋的堆填範圍裝設輔助排水系統，以防止來自已覆蓋的堆填範圍的潔淨地面水徑流與運作中的堆填範圍的廢物接觸，並防止過量的地面水滲入中期覆蓋層，以致滲濾污水量上升。輔助排水系統會收集潔淨地面水徑流，並分流至與公共排水系統相連的永久排水道。

(d)       In addition, surface flow from the haul road (especially near the wheel washing facility) shall be collected to a dry weather flow interceptor and conveyed to the on-site leachate treatment plant for further treatment.

此外，在運輸路線上的地面水流（尤其鄰近車輪清洗設施）須引向旱季截流管，然後轉排往場內的滲濾污水處理廠作進一步處理。

Measures to Minimize Surface Gas and Odour Emissions

盡量減少地面氣體和氣味排放的措施

 

2.14             To minimize surface gas emissions, the inactive tipping areas shall be covered with impermeable plastic sheet and a landfill gas extraction system shall be in operation.

為盡量減少地面氣體的排放，須以防滲膠布覆蓋不常用的堆填範圍，並使用堆填氣體抽取系統。

2.15             To minimize odour emissions, the exposed area of the leachate storage lagoons and tanks at the on-site leachate treatment plant shall be installed with covers and deodourizers.  The covers shall be air tight to prevent release of odour from the facilities into atmosphere.  Foul air underneath the covers shall be drawn through deodourizers and be discharged after treatment.  The deodourizers shall be designed for odour removal efficiency of 99% or otherwise agreed by the Director.

為盡量減少氣味散逸，須在滲濾污水處理廠內的滲濾污水蓄水池及蓄水庫沒有遮蓋的地方裝設上蓋和除味器。上蓋須密不透氣，以免設施產生的氣味滲入空氣，而覆蓋下的臭氣須抽經除味器處理之後排放。除味器須設計為有99% 除味功能或署長同意的水平。

2.16             Site walk to Tong To Shan Tsuen shall be conducted once every three months and if resident is identified, the following additional measures shall be undertaken to further reduce odour emissions from the Project area : -

每三個月須實地巡查塘肚山村一次；如有居民遷入，須採取以下額外措施，以進一步減少氣味從工程項目範圍散逸：

(a)       thicker daily cover and alternative daily cover shall be applied at active tipping area during Phase 3 of the Project;

在工程項目第三期進行期間，在堆填範圍增加每天覆蓋層的厚度和鋪設替代覆蓋層；

(b)       early morning odour patrol at Tong To Shan Tsuen shall be arranged to ensure the effectiveness of the measures.

Liner System to Control Seepage of Leachate

利用防漏墊層系統控制滲濾污水的滲漏

 

2.17             A composite liner system consisting of a layer of at least 2.0 mm thick high density polyethylene (HDPE) with a hydraulic conductivity of at least 1xE-9 meters per second and a layer of at least 6.0 mm thick bentonite matting with a hydraulic conductivity of at least 1xE-11 meters per second shall be provided over the entire area of the Project.

在整個工程項目範圍內須鋪設組合防漏墊層系統，其中包括一層最少為2.0 毫米厚的高密度聚乙烯，其水力傳導性最多為每秒1xE-9 米，以及一層最少為6.0 毫米厚的膨潤土墊，其水力傳導性最多為每秒1xE-11米。

2.18             Hydroseeding shall be applied on the surface of stockpiled soil and on temporary soil covers for inactive tipping areas to prevent soil erosion during rainy season.

Measures to Mitigate the Potential Loss of Groundwater Yields to Ping Yeung and Wo Keng Shan areas

2.19             The Permit Holder shall implement the following measures as necessary in the event circumstances arise when significant changes in groundwater yields are identified by the monitoring programme at Ping Yeung and Wo Keng Shan areas as specified in the EM&A Manual during implementation of the Project : -

在工程項目實施期間，如按環監手冊所訂明的監測計劃下，發現坪洋及禾徑山地區的地下水集水量有重大改變，許可證持有人須按需要採取下列措施：

(a)           Provision of adequate water supply for irrigation purposes for the operational lifetime of the landfill extension, that is, 10 to 12 years following commencement of operation of the Project;

在堆填區擴建部分的營運期間提供足夠的供水作灌溉用途；

(b)           Installation of a network of monitoring stations to keep track of the stream flow volumes.  Should monitoring of stream flow indicate insufficient quantities to provide sufficient water for irrigation downstream, water shall be supplied from an external source;

設立監測站網絡，以追查河溪的流量。如河溪流量的監測結果顯示流量不足，沒有足夠的水量供下游灌溉，便須由外在水源供水；

(c)           Diversion of flow from other catchments shall be considered: the surface runoff generated in the catchments with abandoned agricultural lands could be collected and conveyed to the active agricultural lands;

須考慮從其他集水區引流：可收集在集水區內已荒廢農地的地面徑流，並把其引導到常耕農地；

(d)           Formation of new extraction wells that extend deeper down within the aquifer;

(e)           Provision of Piped Water Supply; and

(f)            Artificial recharge by surface spreading, spray irrigation or pumping water directly into the ground via vertical shafts.

Provision of Landfill Gas (LFG) Collection and Management System

2.20             A LFG collection and management system shall be implemented to eliminate any off-site migration of LFG.

須裝設堆填氣體收集和管理系統，以減少堆填氣體遷移到堆填區外。

2.21             Landfill gas protection measures shall be implemented at all new buildings on site to prevent the ingress of landfill gas and mitigate any potential risks posed by landfill gas migration in accordance with the recommendations of the approved detailed landfill gas hazard assessment submitted under Condition 2.9.

須按照條件第2.9項所提交並已核准的詳細堆填氣體危險評估報告的建議，在堆填區內各幢新樓宇採取堆填氣體保護措施，以防堆填氣體侵入並緩解堆填氣體遷移所造成的潛在危險。

Measures and Submissions to be Implemented during Restoration Stage of the Project

在工程項目修復階段須採取的措施和提交的文件

 

2.22             The Permit Holder shall, within two months after the commencement of the restoration stage the Project, deposit with the Director four hard copies and one electronic copy of as-built drawings of scale 1 to 1000 with an explanatory statement showing the location, size, number, and species of planting in the Project area.  The submissions shall be certified by the ET Leader and verified by the IEC. Additional copies of the submission shall be provided upon request by the Director.  

許可證持有人須在工程項目修復階段展開後的兩個月內，向署長存放比例為1：1000        竣工圖的四份硬複本和一份電子版本，並附上顯示工程項目範圍內的種植地點、面積、數目和品種的註釋。文件須由環境小組組長核證及獨立環境查核人核實。如署長   要求，則須提交額外複本。

 

3                        Environmental Monitoring and Audit (EM&A) Requirements
環境監察及審核規定

3.1                 The EM&A programme shall be implemented in accordance with the procedures and requirements as set out in the EM&A Manual of the Project.  Any changes to the EM&A programme shall be justified by the ET Leader and verified by the IEC as conforming to the requirements set out in the EM&A Manual and shall seek the prior approval from the Director before implementation.

環境監察及審核計劃，須按照工程項目的環監手冊所載程序及規定執行。環境監察及審核計劃如有更改，須由環境小組組長核證及獨立環境查核人核實，證明其符合環監手冊所載的規定，並在實施前先行取得署長的批准。

3.2                 Four hard copies and one electronic copy of Baseline Monitoring Report shall be submitted to the Director at least two weeks before the commencement of construction.  The submissions shall be certified by the ET Leader and verified by the IEC.  Additional copies of the Baseline Monitoring Report shall be provided upon request by the Director.

在建造工程展開前，須至少提早兩個星期向署長提交基線監測報告的四份硬複本和一份電子版本。文件須由環境小組組長核證及獨立環境查核人核實。如署長要求，須把報告的額外複本送交署長。

3.3                 Four hard copies and one electronic copy of Monthly EM&A Reports for the construction stage shall be submitted to the Director, within 2 weeks after the end of the reporting month.  The submission shall be certified by the ET Leader and verified by the IEC before submission to the Director.  Additional copies of the Monthly EM&A Reports shall be provided upon request by the Director.

在須提交報告的月份結束後兩個星期內，須向署長提交建造期內每月環境監察及審核報告的四份硬複本和一份電子版本。提交的報告須由環境小組組長核證和獨立環境查核人核實。如署長要求，須把報告的額外複本送交署長。

3.4                 The actions described in the Event/Action Plans of the EM&A Manual shall be fully and properly carried out, in accordance with the time frame(s) as set out in the Event/Action Plan, or as agreed by the Director.

環監手冊的事件／行動計劃所說明的行動，須按照事件／行動計劃所訂明的時限或如署長所同意執行。

3.5                 All environmental monitoring and audit data submitted under this Permit shall be true, valid and correct.

根據本許可證提交的所有環境監察及審核數據均須真實無誤。

3.6                 To ensure a high degree of transparency regarding the monitoring data and results, all environmental monitoring and audit data and results and all submissions and all performance test data and results required by this Permit shall be made available by the Permit Holder to the public through a dedicated web site to be set up by the Permit Holder under Condition 4.2 below, in the shortest practicable time and in no event later than 2 weeks after such information is available.

為確保監察數據及結果具高透明度，許可證持有人須在可行情況下，盡快把所有環境監察及審核數據及結果，以及本許可證要求的所有提交文件及所有性能測試數據及結果，存於許可證持有人按下文條件第4.2項設立的特定網站內，供公眾閱覽，在任何情況下均不得遲於有關資料可供閱覽後的兩個星期。

3.7                 Records of measurements and remedial actions taken under Condition 3.4 of this Permit shall be logged and kept within 3 working days of the collection of data or completion of remedial action, shall be included in the EM&A Reports and shall be available for inspection on site or as requested by the Director.

在收集數據或完成補救行動3個工作天內，須記錄及備存按本許可證條件第3.4項進行測量工作及補救行動的詳情，並納入環境監察及審核報告內，以及備妥有關資料以便在工地查閱，或按署長所要求執行。

4                        Electronic Reporting of EM&A Information
環境監察及審核資料的電子匯報

4.1                 To facilitate public inspection of the EM&A Manual, Baseline Monitoring Report and the Monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in the Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 3.2 and 3.3 of this Permit.  For the HTML version, a content page capable of providing hyperlink of each section and sub-section of these Reports shall be included in the beginning of the document.  Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made.  All graphics in these Reports shall be interlaced Graphics Interchange Format (GIF) unless otherwise agreed by the Director.  The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱環監手冊、基線監測報告及每月環境監察及審核報告，以超文本標示語言 (HTML) (第4.0或較後版本) 及便攜式文件格式 (PDF) (第4.0或較後版本) 製作的報告的電子版本，除非另獲署長同意，須與本許可證條件第3.2及3.3項所說明的硬複本同時提交。關於HTML的版本方面，可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意，報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容，必須與硬複本的內容一致。

4.2                 The Permit Holder shall set up a dedicated web site and notify the Director in writing the internet address where the environmental monitoring and project data is to be placed within six weeks after the commencement of construction of the Project. All environmental monitoring results described in Condition 4.1 above, all submissions and all performance test data and results required by this Permit and all minutes of meetings, documents and papers for the Community Liaison Group as described in Condition 2.2 shall be made available to the public via this dedicated web site to be set up by the Permit Holder in the shortest time practicable and in no event later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director.

許可證持有人須在工程項目的建造工程展開後6星期內，設立特定網站存放環境監察及工程項目的數據，並以書面通知署長網址所在。上文條件第4.1項說明的所有環境監察結果、本許可證要求的所有提交文件及所有性能測試數據及結果、所有會議記錄、上文條件第2.2項說明社區聯絡小組要求的文件，均須在可行情況下盡快透過由許可證持有人設立的特定網站供公眾閱覽，在任何情況下均不得遲於有關環境監察數據收集或可供閱覽後的兩個星期，除非另獲署長同意。

4.3                 The internet website as described in Condition 4.2 above shall enable user-friendly public access to the monitoring data and project data including the EIA Report, the environmental permit(s) and project profile of the Project. The internet website shall have features capable of : -

上文條件第4.2項說明的互聯網網站，必須方便用戶使用，讓公眾容易接達監察數據及工程項目資料，當中包括環境影響評估報告、環境許可證及工程項目簡介。除非另獲署長同意，互聯網網站須具備部件，提供下述功能：

(a)           providing access to all environmental monitoring data collected since the commencement of work and all submissions under this permit;

接達工程展開後及按本許可證提交文件後所收集的全部環境監察數據；

(b)           searching by date;

按日期搜尋；

(c)           searching by types of monitoring data; and

按監察數據類別搜尋；以及

(d)           hyperlinks to relevant monitoring data after searching;

Notes :

註：

 

1.              This Permit consists of three parts, namely, PART A (Main Permit), PART B (Description of Designated Project) and PART C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

 

本許可證共有3部，即A部（許可證主要部分）；B部 （指定工程項目的說明）及C部（許可證條件）。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。

 

2.              If there is a breach of any conditions of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment, Transport and Works, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

 

如違反本許可證的任何條件，署長或獲授權人員可在環境局局長的同意下勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。

 

3.              The Permit Holder may apply under Section 13 of the Ordinance to the Director for a variation of the conditions of this Permit.  The Permit Holder shall replace the original permit displayed on the construction site by the amended permit.

 

許可證持有人可根據環評條例第13條的規定向署長申請更改本許可證的條件。許可證持有人須把經修改的許可證替換在建築工地內展示的原有許可證。

 

4.              A person who assumes the responsibility for the whole or a part of the designated project may, before he assumes responsibility of the designated project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

 

承擔指定工程項目整項或部分指定工程的責任的人，在承擔責任之前，可根據環評條例第12條的規定向署長申請新的環境許可證。

 

5.              Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment and Food, suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the construction site.

 

根據環評條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消本許可證。遭暫時吊銷、更改或取消的許可證必須從建築工地除下，不再展示。

 

6.              If this Permit is cancelled or surrendered during construction or operation of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued.  It is an offence under section 26(1) of the Ordinance to construct or operate a designated project listed in Part I of schedule 2 of the Ordinance without a valid environmental permit.

 

如果本許可證在工程項目建造或營辦期間取消或交回，則在繼續進行工程項目之前，必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦環評條例附表2第I部所列明的指定工程項目，即屬犯罪。

 

7.              Any person who constructs or operates the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable:-

 

如任何人在違反本許可證的條件下建造或營辦工程項目，根據環評條例，即屬犯罪 －

 

(i)             on a first conviction on indictment to a fine of $ 2 million and to imprisonment for 6 months;

 

一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；

 

(ii)          on a second or subsequent conviction on indictment to a fine of $ 5 million and to imprisonment for 2 years;

 

一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；

 

(iii)        on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

 

一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；

 

(iv)         on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

 

一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；及

 

(v)           in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $ 10,000 for each day on which he is satisfied the offence continued.

 

在任何情況下如該罪行屬連續性質，法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

8.              The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

 

許可證持有人可在接獲本許可證後30天內，根據環評條例第17條就本許可證的任何條件提出上訴。

 

9.              The Notes are for general reference only and that the Permit Holder should refer to the EIA Ordinance for details and seek independent legal advice.
