Pursuant to Section 10 of the Environmental
Impact Assessment Ordinance (the Ordinance),
the Director of Environmental Protection (the Director) granted the Environmental
Permit (No. EP-041/2000) to the KOWLOON – CANTON RAILWAY CORPORATION
(thereinafter referred to as the “Permit Holder”)
on 21 January 2000. Pursuant to Section 13 of the Ordinance, the
Director amends the Environmental Permit No.EP-041/2000 based on the
Application No. VEP-074/2002. The
amendments described below, are incorporated into this Environmental Permit
(EP-041/2000/A). This Environmental
Permit as amended is for the construction and operation of the designated
projects described in Part B of this Permit subject to the conditions described
in and attached to Part C of this Permit.

1.
General
Conditions
1.1
The Permit Holder shall ensure full
compliance with all conditions of this environmental permit (the Permit). Any
non-compliance may constitute a contravention of the Environmental Impact
Assessment Ordinance (Cap.499) and shall be definite ground for enforcement
action or permit cancellation where applicable.
1.2
The Permit Holder shall ensure full
compliance with all legislation currently in force such as the Noise Control
Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution
control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste
Disposal Ordinance (Cap.354), and others.
This Permit does not of itself constitute any ground of defense against
any proceedings instituted under any legislation.
1.3
The Permit Holder shall make copies of this
Permit together with all documents referred to in this Permit or the documents
referred to in Part A of the Permit readily available at all times for inspection
by the Director at all the sites/offices covered by this Permit. Any reference to the Permit shall
include the documents referred to in the Permit and also the relevant documents
in the Register.
1.4
The Permit Holder shall give a copy of this
Permit to the person(s) in charge of the site(s) and ensure that such person(s)
fully understands all conditions and all requirements incorporated by the Permit.
1.5
The Permit Holder shall display a copy of
this Permit on the construction site(s) at all vehicular site entrances/exits
or at a convenient location for public information at all times. The Permit Holder shall ensure that the
most updated information about the Permit, including any amended permit, is
displayed at such locations. If the Permit Holder surrenders a part or the
whole of the Permit, the notice he sends to the Director shall also be
displayed at the same locations as the original Permit.
1.6
The Permit Holder shall construct and operate
the Project as described in Part B of this Permit.
1.7
The Permit Holder shall ensure that the
Project is designed, constructed and operated in accordance with the
information and recommendations described in the EIA Report (Register No.
AEIAR-026/1999) and other relevant documents in the Register, the information
or mitigation measures described in this Permit, or mitigation measures to be deposited with or
approved by the Director as a result of the permit conditions or on going
surveillance and monitoring measures during all stages of the Project. Where recommendations referred to in the
documents of the Register are not expressly referred to in this Permit, such
recommendations are nevertheless to be implemented unless expressly excluded or
impliedly amended in this Permit.
1.8
All deposited submissions as required under
this Permit, shall be rectified in accordance with the comments, if any, made
by the Director, within one month of the receipt of the Director’s comments or
otherwise specified by the Director.
1.9
All
submissions approved by the Director, all submissions deposited without
comments by the Director, or all submissions rectified in accordance with
comments by the Director under this permit shall be construed as part of the
permit conditions described in Part C of this Permit. Any variation of the submissions shall be approved by the
Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions
may constitute a contravention of the Environmental Impact Assessment Ordinance
(Cap.499). All submissions or
their variations shall be verified and certified by the Independent Environmental
Checker (IEC) referred to in Condition 2.1 below, before submitting to the
Director under this Permit.
1.10 The Permit
Holder shall release all finalized submissions, as required under this Permit,
to the public by depositing copies in the Environmental Impact Assessment
Ordinance Register Office, or in any other places, or any internet websites as
specified by the Director, or by any other means as specified by the Director
for public inspection. For this
purpose, the Permit Holder shall provide sufficient copies of the submissions.
1.11 The Permit
Holder shall notify the Director the commencement date of construction of the
Project at least two weeks prior to the commencement of construction of the
Project. The Permit Holder shall notify the Director immediately if there is
any change of the commencement date of the construction.
1.12 All
submissions to the Director required under this Permit shall be delivered
either in person or by registered mail to the Environmental Impact Assessment
Ordinance’s Register Office at 27/F, Southern Centre, 130 Hennessy Road,
Wanchai, Hong Kong.
2.
Submissions
or Measures before Commencement of Construction of the Project or Certain
Sections of the Project
2.1
Before the commencement of construction of
the Project, the Permit Holder shall employ an Independent Environmental Checker
(IEC) with at least 7 years experience in environmental monitoring and auditing
(EM&A) or environmental management. The IEC shall be responsible for duties defined in the
EM&A Manual, and shall audit the overall EM&A programme including the
implementation of all environmental mitigation measures, submissions relating
to EM&A, and any other submission required under this Permit. In addition, the IEC shall be
responsible for verifying and certifying the environmental acceptability of
permanent and temporary works, relevant design plans and submissions under this
Permit.
2.2
An Environmental Team (ET) shall be
established before the commencement of construction and the ET shall not be in
any way an associated body of the Contractor. The ET shall be supervised by the
IEC. The ET leader shall be
responsible for the implementation of the EM&A programme in accordance with
the EM&A requirements as contained in the EM&A Manual which forms part
of the approved EIA Report.
2.3
The Permit Holder shall submit to the
Director for approval 3 sets of Waste Management Plan at least 4 weeks before
the commencement of construction of the Project. The Plan shall describe the arrangements for avoidance,
reuse, recovery and recycling, storage, collection, treatment and disposal of
different categories of waste to be generated from the construction activities
and shall take into account the recommended mitigation measures contained in the
EIA Report. The Plan shall
incorporate site specific factors, such as the designation of areas for
segregation and temporary storage of reusable and recyclable materials. The Plan shall be verified and
certified by the IEC as being in conformity to the information and
recommendations described in the EIA Report. All measures in the approved Waste Management Plan shall be
fully implemented throughout the construction period.
2.4
The Permit Holder shall submit to the
Director for approval 3 sets of Landscape Master Plan, of scale 1 to 1000 or
other appropriate scale as agreed by the Director, no later than 6 months after
the commencement of construction of the Project. The Plan shall show the detailed landscape proposals during
the construction and operation stages of the Project, and shall include an implementation
programme of landscape works. The Plan
shall be verified and certified by the IEC as being in conformity to the
information and recommendations described in the EIA Report. The Permit Holder shall provide
additional copies of the Plan to the Director upon request from the Director. All measures recommended in the approved
Plan shall be fully implemented in accordance with the details and time
schedule set out in the Plan.
2.5
The Permit Holder shall submit to the
Director for approval 3 sets of drawings with an explanatory statement showing
the environmental mitigation measures to the rectifier station (ie. R14 refers
to in the EIA Report) and design of the associated ventilation at least six
weeks before commencement of construction of the Project. The submission shall be verified and
certified by the IEC as being in conformity to the findings and recommendations
described in the EIA Report. The
Permit Holder shall provide additional copies of the submission to the Director
upon request from the Director.
2.6
The Permit Holder shall submit to the
Director for approval 3 sets of monitoring proposal for the monitoring of any
adverse impacts on the condition of the Tsui Shing Lau Pagoda due to
construction works of the Project at least 4 weeks before the commencement of
construction of the Project. The
submission shall be verified and certified by the IEC as being in conformity to
the findings and recommendations described in the EIA Report. The Permit Holder shall provide
additional copies of the submission to the Director upon request from the Director.
All measures recommended in the approved
monitoring proposal shall be fully implemented in accordance with the details
and time schedule set out in the approved Proposal.
3.
Submissions
or Measures during the Construction Period
3.1
All designs and measures described in the
submissions deposited or approved under Conditions 2.3 to 2.6 shall be fully
implemented.
3.2
Measures described in Appendix A to mitigate
environmental impacts from site runoff and drainage shall be fully implemented
throughout the construction period.
3.3
Measures described in Appendix B to mitigate
environmental impacts from construction noise shall be fully implemented
throughout the construction period.
3.4
Measures described in Appendix C to mitigate
environmental impacts from landscape and visual shall be fully implemented
throughout the construction period.
3.5
The Permit Holder shall submit to the
Director for approval 3 sets of an Environmental Management Plan (the Plan)
within two months of the commencement of construction. The Plan shall be verified and
certified by the IEC as being in conformity to the information and
recommendations described in the EIA Report. The approved Plan shall be released to the public as
described in Condition 1.10. The
Permit Holder shall deposit additional copies of the submission to the Director
upon request from the Director. The
approved Plan shall be fully implemented throughout the construction period
after the Plan is approved by the Director. Failure to implement the approved Plan shall be a ground for
enforcement action, or may render this permit liable for suspension,
cancellation, or variation.
4.
Submissions
or Measures before Operation of the Project
4.1
The Permit Holder shall submit to the
Director for approval 3 sets of performance test proposal to demonstrate that
the operation of the Project would meet the following specifications :
(a) re-radiated noise from
viaduct structure is at least 10dB(A) below the noise criteria of 65dB(A) Lmax
at 25m, at 50kph; and
(b) noise level at 2m from the
transformer bays in the rectifier will be less than 66dB(A).
The
performance test proposal shall be verified and certified by the IEC.
4.2
The Permit Holder shall deposit with the
Director 3 sets of performance test report as referred to in Condition 4.1
above, at least two months prior to the commencement of operation of the Project. The performance test report shall be
verified and certified by the IEC.
5.
Submissions
or Measures during Operation of the Project
5.1
Measures described in Appendix D to mitigate
environmental impacts from run-off and drainage shall be implemented throughout
the operation period.
6.
Environmental
Monitoring and Auditing Requirements
6.1
The EM&A programme shall be implemented
as set out in the EM&A Manual, which forms part of the EIA Report. Any change to the programme shall be
justified and certified by the IEC as being in conformity to the requirements
set out in the EM&A Manual before submission to the Director for approval.
6.2
Samples and measurements for air quality,
water quality, and noise, shall be taken in accordance with the requirements of
the EM&A Manual by:
(a) conducting baseline
monitoring on air quality and noise as set out in the EM&A Manual;
(b) conducting impact monitoring
on air quality and noise as set out in the EM&A Manual;
(c) in cases where specified
criteria in the EM&A Manual are exceeded, carry out remedial actions in
accordance with the Event/Action Plan, as set out in the EM&A Manual; and
(d) logging and keeping records
of the details of (a) to (c) above, within 3 working days of the collection of
data or completion of remedial action, for the purposes of preparing and
submitting the EM&A Reports and to make available the information for
inspection on site.
6.3
One hard copy of the Baseline Monitoring
Report shall be submitted to the Director 4 weeks before the commencement of any
major construction works that would affect the monitoring results. The submission shall be verified and
certified by the IEC. Additional copies of the submission
shall be provided to the Director upon request from the Director.
6.4
One hard copy of monthly EM&A Report
shall be submitted to the Director within 10 working days from the end of the
reporting month. The submission
shall be verified and certified by the IEC. Additional copies of the submission shall be provided to the
Director upon request from the Director.
6.5
An electronic copy of each of the Baseline
Monitoring Report and monthly EM&A Report shall be submitted to the
Director, at the same time as the submission of hard copies required under
Conditions 6.3 and 6.4, to enable public inspection of the documents via the
Environmental Impact Assessment Ordinance Internet Website. The electronic copy shall be prepared
in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable
Document Format (PDF version 4.0 or later), unless otherwise agreed by the
Director. For the HTML version, a
content page capable of providing hyperlink of each section and sub-section of the
EM&A Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and
tables in the EM&A Reports shall be provided in the main text from where
the respective references are made.
All graphics in the report shall be interlaced Graphics Interchange
Format (GIF) unless otherwise agreed by the Director. The content of the electronic copies of the monthly EM&A
Reports must be the same as the hard copies.
6.6
All
environmental monitoring and audit data as submitted under this Permit shall be
true and correct. The true extent
of the environmental impacts shall be presented in the monthly EM&A Reports
and in the monitoring data as described in Condition 6.7 of the Permit.
6.7
All
environmental monitoring data as described in Condition 6.2 above shall be made
available to the public via internet access in the form of a website, in the
shortest possible time and in no event later than 2 weeks after the relevant
environmental monitoring data are collected. The Permit Holder shall notify the
Director in writing within 2 weeks after the commencement of works the internet
address where the environmental monitoring data are to be placed. The internet
address and the environmental monitoring data shall be made available to the
public via the EIAO Internet Website and the EIAO Register Office.
6.8
The
internet website as described in Condition 6.7 above shall enable user friendly
public access to the monitoring data and with features capable of:-
(a)
providing
access to all environmental monitoring data collected since the commencement of
works;
(b)
searching
by data;
(c)
searching
by types of monitoring data (air quality, water quality and noise); and
(d)
hyperlinks
to relevant monitoring data after searching.
6.9
The actions described in the Event/Action
Plans of the EM&A Manual shall be carried out, in accordance with the time
frame set out in the Event/Action Plans, or as agreed by the Director.
Notes:
1.
This Permit consists of three parts, namely,
PART A (Main Permit), PART B (Description of Designated Project) and PART C
(Permit Conditions).
2.
The permit holder may apply under Section 13
of the Ordinance to the Director for a variation of the conditions of this Permit.
The Permit Holder shall replace the original permit displayed on the
construction site by the amended permit.
3.
A person who assumes the responsibility for
the whole or a part of the designated project may, before he assumes
responsibility of the designated project, apply under Section 12 of the
Ordinance to the Director for a further environmental permit.
4.
Under section 14 of the Ordinance, the
Director with the consent of the Secretary for the Environment and Food, may
suspend, vary or cancel this Permit. The Permit shall be removed from the
display on the construction site.
5.
If this Permit is cancelled or surrendered
during the construction or operation, an environmental permit must be obtained
under the Ordinance before the construction or operation of the project could
be continued. It is an offence under section 26(1) of the Ordinance to
construct or operate a designated project without an environmental permit.
6.
Any person who constructs or operates the
Project contrary to the conditions in the permit, and is convicted of an
offence under the Ordinance, is liable:-
(i) on
a first conviction on indictment to a fine of $ 2 million and to imprisonment
for 6 months;
(ii) on
a second or subsequent conviction on indictment to a fine of $ 5 million and to
imprisonment for 2 years;
(iii) on
a first summary conviction to a fine at level 6 and to imprisonment for 6
months;
(iv) on
a second or subsequent summary conviction to a fine of $ 1 million and to
imprisonment for 1 year; and
(v) in
any case where the offence is of a continuing nature, the court or magistrate
may impose a fine of $ 10,000 for each day on which he is satisfied the offence
continued.
7.
The Permit Holder may appeal against any
condition of this Permit under Section 17 of the Ordinance within 30 days of
receipt of this Permit.
The
following shall be implemented at all parts of all works areas and construction
sites, and throughout the full duration of the construction contract(s):-
(a)
Perimeter channels to intercept storm runoff
from outside of the site. These
should be constructed in advance of earth works;
(b)
Sand/silt removal facilities such as sand
traps, silt traps and sediment basins and regular maintenance of these
facilities to ensure proper functioning and efficient operation at all
times. The design of silt removal
facilities should be based on the guidelines in ProPECC Practice Note 1/94
issued by the Director;
(c)
Careful programming of the works to minimize
soil excavation works during rainy seasons (April to September). If excavation of soil cannot be avoided
during the rainy season, or at any time of year when rainstorms are likely, exposed
slope surfaces should be covered with tarpaulin or other effective means;
(d)
Open stockpiles of construction materials on
site be covered with tarpaulin or similar fabric during rainstorms;
(e)
Dikes or embankments for flood protection
around the boundaries of earthwork areas;
(f)
All fuel/oil tanks and chemical storage
tanks/areas be provided with locks and be sited on sealed areas, within bunds
of a capacity equal to 110% of the storage capacity of the largest tank, to
prevent spilled fuel oils from reaching the receiving water bodies;
(g)
Wheel washing facilities at each of the site
entrance and regular maintenance of these facilities to ensure proper
functioning and efficient operation at all times;
(h)
Oil interceptors be provided in the drainage
system downstream of any oil/fuel pollution sources associated with
construction. Regular maintenance
of the oil interceptors to prevent the release of oil and grease into the storm
water drainage system after accidental spillage. The interceptor shall have a bypass to prevent flushing
during periods of heavy rain.
(i)
Temporary and permanent drainage pipes and
culverts be provided to facilitate runoff discharge. The temporary and permanent drainage pipes and culvert be
adequately designed for the controlled release of storm flows. All these measures be regularly
inspected and maintained to ensure good working conditions at all times and
particularly following rainstorms.
Temporarily diverted drainage be reinstated to its original condition
when construction works has finished or the temporary diversion is no longer
required; and
Portable
chemical toilets and sewage holding tanks by a licensed contractor to handle
the construction sewage generated by workers from both the construction areas
and dispersed along the alignment. Regular waste disposal and maintenance of these facilities by
a licensed contractor to ensure proper functioning.
Measures to Mitigate Environmental
Impacts from Construction Noise
The
construction programme should be scheduled to avoid overlapping of construction
work of the Project with that of the West Rail within the site boundary of the
Project as to minimize cumulative impact.
Throughout
the construction period of the Project, mitigation measures for specific
construction activities at specific locations shall be implemented in
accordance with Table 7.9 of the EIA Report. Corresponding mitigation measures for each construction
activity to result in the lowest worst case maximum cumulative construction
noise level indicated in Table 7.9 the EIA Report during each construction
phase shall be used. Mitigation
measures M1 to M4 the table are defined as follows:-
M1: Use of Quiet Plant and
Working Methods
Throughout the full duration of the
construction contract(s), models of plant which comply with
the BS 5228 Part 1 or EPD’s “Technical Memorandum on Noise from Construction Work in
Designated Areas” shall be used.
M2: Temporary and Movable Noise Barriers
Throughout the full duration of the construction contract(s),
hoarding(s) of height 3-5 metres along the site boundary and temporary purpose
built or movable noise barrier(s) shall be provided within a few metres of
stationary plant (air compressor, water pump, concrete pump, generator, poker
vibrator, etc.) and within about 5 m of mobile equipment (excavator, lorry,
roller, dump truck, concrete lorry mixer and mobile cranes, etc.) such that the
line of sight is blocked by the barriers viewed from the noise sensitive
receivers (NSRs). Where high-rise Noise Sensitive Receivers (over 5 storeys)
may be affected, the use of cantilevered top cover(s) shall be provided,
whenever practicable. The surface
density of the barrier(s) / hoarding(s) shall not be less than 7kg/m2.
M3: Delocalization
of Equipment in Critical Areas and Reducing the Number of Plant Operating in
Critical Areas Close to NSRs
The number of items of plant operating at the same time at the
specified locations shall be minimized for each construction activity.
M4: Limiting Operation Time of Construction
Equipment On-Site
When carrying out site clearance and
formation works near the TWGH’s Kwok Yat Wai College and when carrying out
track laying works near the Tin Shui Wai Catholic Primary School, the operation
time of dump trucks at the vicinity is reduced to less than 15 minutes within
any 30-minute interval.
At all parts of all works
areas and construction sites, and throughout the full duration of the construction
contract(s), the following mitigation measures shall be implemented:-
(a)
Any topsoil encountered during construction
should be carefully stockpiled and provision be made for its reuse in suitable
planting areas;
(b)
Use of 3-5 metre high hoarding(s) at the
perimeter of the designated LRT reserve to screen the majority of the work site
from view; and
(c)
Tree and
shrub planting within the railway reserve to soften the visual impact of the
viaduct, and make use of climbing plants to soften the appearance of viaduct
column as per the approved Landscape Master Plan(s).
To
mitigate the environmental impacts from site runoff and drainage during the
operational phase, the following shall be implemented:
(a) A
surface water drainage system shall be provided to collect the track runoff. Where oil and lubricating fluids can be
spilt, the tract drainage channels discharge shall pass through oil/grit
interceptors/chambers, or a sub-soil drainage system to remove oil, grease and
sediment before being pumped to the public stormwater drainage system.
(b) Silt
traps and oil interceptors shall be cleaned and maintained regularly to ensure
proper functioning and efficient operation.
(c) Oily
contents of the oil interceptors shall be transferred to an appropriate
disposal facility, or to be collected for reuse, if possible.

1. 一般條件
1.1 許可證持有人必須確保完全符合本環境許可證(下稱許可證)規定的全部條件。如有不符合本許可證的情況,可能構成違反「環境影響評估條例(第499章)」的規定,並可按適用情況作為採取執法行動或取銷其許可證的確切理由。
1.2 本許可證並不免除許可證持有人須符合現行生效的法例的責任,例如「噪音管制條例(第400章)」、「空氣污染管制條例(第311章)」、「水污染管制條例(第358章)」、「海上傾倒物料條例(第466章)」、「廢物處置條例(第354章)」;及其他法例。本許可證本身不能作為依任何法律提起的法律程序中抗辯的理由。
1.3 許可證持有人須複印本許可證以及本許可證所載的有關文件或本許可證A部所指的所有文件的副本,以供署長任何時間內在本許可證所涵蓋的所有工地/工地辦事處查閱。對本許可證的引用須包括本許可證所指的文件以及環境影響評估條例登記冊辦事處存放的相關文件。
1.4 許可證持有人須將本許可證的一份副本交予工地的負責人並進行所有必需的安排,以確保此類負責人完全理解本許可證包含的所有條件和所有要求。
1.5 許可證持有人須在建造工地所有車輛的出入口或其他方便的位置,展示本許可證的副本,以供公眾在任何時間內閱覽。持有人須確保在這些地點展示關於環境許可證的最新資料,包括經修改的許可證。如果許可證持有人交回許可證的部分或全部,須將其送交署長的通知書展示在張貼原本許可證的各處相同地點。
1.6 許可證持有人須按照本許可證B部所述的工程項目來建造和營運工程項目。
1.7 許可證持有人須確保工程項目將依據「環境影響評估報告」(登記編號AEIAR-026/1999)內載的資料和建議及在登記冊內的其他文件,或在許可證內載的資料或緩解措施,或由許可證條件所導致須存放於或由署長核準的緩解措施,或在工程項目各階段所進行的拯救或監測措施,進行設計、建造及運作。當在登記冊內所載建議並沒有明確在本許可證內指出,此等建議並應同樣實施。除非,此等建議已在本許可証內已明確指出並不包括內或明確修訂。
1.8 按本許可證的規定所有文件,須在收到署長的意見(如有者)後一個月內進行修訂或按署長另行指定,加以修正。
1.9 所有根據本許可證規定提文經署長批准的文件、署長沒有意見的文件或已導從署長意見修訂的文件均為本許可證C部所述許可證條件的組成部分。對文件所作的任何變更應經署長書面或依照相關許可證條件規定的其他方式批准。與文件的任何不符將被視為違反環境影響條例(第499章)。在提交文件申請批准前,所作的變更應經獨立環境查核人(見下述第2.2條)核實,確認其符合環境影響評估報告內所載的資料和建議。
1.10 許可證持有人須根據署長要求,公開所有按本許可證規定提交的文件定稿給公眾人士查閱,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何其他地方或互聯網網站,或採取指定的任何其他方法,以供公眾查閱。為此,許可證持有人須提供足夠數量的文件副本。
1.11 許可證持有人須最少在建造工程項目展開之前二周將項目建造工程開始日期通知署長。建造工程開始日期如有任何變更,許可證持有人須立即通知署長。
1.12 本許可證要求提交署長的所有文件應由專人送達或以掛號郵寄方式,送交香港灣仔軒尼詩道130號修頓中心27樓環境影響評估條例登記冊辦事處。
2. 在展開工程項目或工程項目特定部分建造工程前提交的文件或採取的措施
2.1 許可證持有人須在項目工程施工前聘請一獨立環境查核員。獨立環境查核員應至少具有七年環境監察與審核(環境監察及審核)或環境管理經驗。獨立環境查核員應負責環境監察及審核手冊內規定的職責,並審核整體環境監察及審核計劃,其中包括環境緩解措施的實施、環境監察及審核所需要提交的文件及本許可證要求的其他文件。另外,環境查核人負責驗證及核實永久及臨時工作,有關設計圖則及本許可證要求提交的文件的環境可接受性。
2.2 在工程項目有關工程施工前須成立一個環境小組。環境小組不得是與承建商有任何關聯的機構。環境小組應由一名獨立環境查核人監督。環境小組組長負責根據作為已批准環境影響評估報告一部分的「環監及審核手冊」所載的環監及審核規定,實施監察及審核計劃。
2.3 許可證持有人須最少在工程項目展開建造之前四周,向署長提交三套廢物管理計劃,供署長批准。提交的文件須說明建造活動所產生不同類型廢物的避免、重複利用、恢復與回收、儲存、收集、處理及棄置安排,並應考慮環境影響評估報告內載有的緩解措施。管理計劃應包括工地的特定因素,例如指定可重複利用及可再生物料的隔離與臨時儲存區等。提交的管理計劃須由獨立環境查核員核實,確認其符合環評報告內載的資料及建議。提交管理計劃內載有的所有建議措施在整個建造期內應得到全面實施。
2.4 許可證持有人須在工程項目展開建造後六個月內,向署長提交三套1:1000比例或其他適當比例的景觀設計總圖。提交的文件須說明建造及營運期內的詳細景觀建議,並應包括景觀工程實施計劃。提交的文件須由獨立環境查核員核實,以確保符合環評報告內載的資料及建議。許可證持有人須根據署長要求,提供額外的副本。已批准計劃總圖內載的所有建議措施應根據總圖內規定的細節及時間表,全面實施。
2.5 許可證持有人須最少在項目建造工程開始前六周,向署長提交三套圖則並附解釋說明式比例尺,以說明對整流站(即R14,見環境影響評估報告)採取的環境緩解措施以及有關通風系統的設計。提交的文件須由獨立環境查核員核實,以確保符合環評報告內載的規定及建議。許可證持有人須根據署長要求,提供額外的副本。
2.6 許可證持有人須最少在項目建造工程開始前四周,向署長提交三套監督建議措施,供署長批准,以監督因項目建造工程而對聚星樓造成的不良影響。提交的文件須由獨立環境查核員核實,以確保符合環評報告內載的規定及建議。許可證持有人須根據署長要求,提供額外的副本。已批准監督建議措施應根據已批准建議內規定的細節及時間表,加全面實施。
3. 建造工程期間提交的文件或採取的措施
3.1 許可證持有人須按上文第2.3條到2.6條規定存備的提交文件所載,全面實施工程項目的所有相關設計或建造措施。
3.2 許可證持有人須實施附錄A規定的措施,以減輕建造期間,工地徑流及排水的影響。
3.3 許可證持有人須實施附錄B規定的措施,以減輕建造期間,工地施工噪音的影響。
3.4 許可證持有人須實施附錄C規定的措施,以減輕建造期間,對景觀及視覺環境造成的影響。
3.5 許可證持有人須在工程項目開始施工後兩個月內,向署長提交三套環境管理計劃,供署長批准。提交的計劃須由獨立環境查核員核實及証明,以確保符合環評報告內所載的資料及建議。已獲批准的環境管理計劃須跟據本許可証第1.10條件提交給公眾人士查閱。許可證持有人須根據署長要求,提供額外的副本,獲批准後,計劃須於建造期間完全執行。基於執行上的失誤,會導致執法行動,或本許可証被暫吊消,取消或更改。
4. 項目營運前要求提交的文件或採取的措施
4.1 許可證持有人應向署長提交三套性能測試建議書,以證明項目營運將滿足下列規定:
(a) 高架結構的再輻射噪音最少比25m,50kph條件下65dB(A)Lmax噪音標準低10dB(A);以及
(b) 整流站內距變壓器位2米處的噪音水平小於66dB(A)。
性能測試建議書應經獨立環境查核人核實認證。
4.2 環境許可證持有人應最少在項目營運開始前兩個月,向署長提交三套上述4.1節規定的性能測試報告。性能測試報告須經獨立環境查核人核實認證。
5. 項目營運期間要求提交的文件或採取的措施
5.1 許可證持有人須實施附錄D規定的措施,以減輕營運期間,徑流及排水的影響。
6. 環境監察與審核要求
6.1 環境監察與審核計劃應根據作為環境影響評估報告一部分的環境監察與審核手冊內載有的規定實施。對計劃所作的任何變更應在提交署長申請審批前,由獨立環境查核人出具充分理由,並由獨立環境查核人認證,確認其符合環境監察與審核手冊內的有關規定。
6.2 空氣質素、水質及噪音採樣與測量應透過以下各項根據環境監察與審核手冊的規定進行:
(a) 根據環境監察與審核手冊的規定對空氣質素和噪音進行基線監察;
(b) 根據環境監察與審核手冊的規定對空氣質量和噪音進行影響監察;
(c) 在超出環境監察與審核手冊規定標準的情況下,根據環境監察與審核手冊內載有的事件/行動計劃採取補救措施;以及
(d) 在數據收集或補救措施完成後三個工作日內,填寫並記錄上述(a)至(c)項的細節,以準備和提交環境監察與審核報告,並準備有關資料以備現場檢查。
6.3 許可證持有人應在影響監察結果的大型建造工程開始前四周,向署長提交一份基線監察報告的硬副本。提交的文件須經獨立環境查核人核實認證。許可證持有人須根據署長要求,提供額外的副本。
6.4 許可證持有人應在報告月份結束之日起十個工作日內,向署長提交一份環境監察與審核月報告硬副本。提交的文件須經獨立環境查核人核實認證。許可證持有人須根據署長要求,提供額外的副本。
6.5 許可證持有人應在根據上述第6.3條及6.4條要求提交基線監察報告及環境監察與審核月報告硬副本的同時,向署長提交各報告的電子副本,以便公眾透過環境影響評估條例互聯網網站查閱。除非署長另有規定,電子副本的格式應為超文本標記語言(HTML)格式及便攜文件格式(PDF 4.0版或以上)。對於HTML格式的副本,應在文件開始處包含可提供環境監察與審核報告各章節超級鏈接的目錄頁。應在正文內作出引用的地方,提供連接環境監察與審核報告中插圖、圖則及圖表的超級鏈接。除非經環保署長另外批准,報告內的所有圖片均應為交叉圖形交換格式(GIF)。環境監察與審核月報告電子副本的內容必須與硬副本完全相同。
6.6 環境監察與審核手冊內規定的事件/行動計劃應根據事件/行動計劃內規定的時間,或署長批准的其他時間實施。
6.7 上述第6.2條規定的所有環境監察數據應在盡可能短的時間內,且在任何情況下,在相關環境監察數據收集後不遲於兩周的時間內,以互聯網網站的形式公佈,以便公眾查閱。許可證持有人應在建造工程開始後兩周內以書面形式通知署長放置環境監察數據的互聯網網址。互聯網網址及環境監察數據應通過環境影響評估條例互聯網網站及環境影響評估條例登記冊辦事處向公眾提供。
6.8 上述第6.7條規定的互聯網網站應能使公眾方便地接達監察數據,並應具有下列功能:
(a) 接達自工程開始以來收集的所有環境監察數據;
(b) 按數據搜索;
(c) 按監察數據類型(空氣質素、水質及噪音)搜索;以及
(d) 提供搜索後與相關監察數據的超級鏈接。
6.9 環境監察與審核手冊內規定的事件/行動計劃應事件/行動計劃內規定的時間,或根據署長批准的其他時間實施。
註:
1. 本環境許可證共有3部,即:A部(許可證主要部分)、B部(指定工程項目的說明)以及C部(許可證條件)。
2. 許可證持有人可以根據環境影響評估條例第13條的規定向署長申請修改本環境許可證的條件。許可證持有人須以修改後的許可證,替換在建造工地內展示的原有許可證。
3. 承擔整項或部分的指定工程項目責任人,可以在承擔指定工程項目責任之前,根據條例第12條的規定向署長申請新的環境許可證。
4. 根據條例第14節的規定,署長可在經環境食物局局長長同意後暫時吊銷、更改或取銷環境許可證。該許可證必須從建造工地除下,不再展示。
5. 如果本許可證在工程項目建造及營運期間取消或交回,則在繼續進行工程項目建造或營運之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有環境許可證的情況下建造或營運指定工程項目,即屬犯罪。
6. 任何人建造或營運工程項目時違反本許可証所列出的條件是違反環境影響評估條例,即屬犯罪-
(i) 一經循公訴程序首次定罪,可處罰款$2,000,000及監禁6個月;
(ii) 一經循公訴程序第二次或其後每次定罪,可處罰款$5,000,000及監禁2年;
(iii) 一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;
(iv) 一經循簡易程序第二次或其後每次定罪,可處罰款$1,000,000及監禁1年;
(v) 而在任何情況下如該罪行屬於持續性質,則法院或裁判官可就其信納該罪行持續的每一天另處罰款$10,000。
7. 在接獲本許可証30天內,環境許可証持有人可根據環境影響評估條例第17條,對本許可証所列出的條件提出上訴。
緩解建造期間工地徑流及排水環境影響的措施
應在所有工程區及建造工地的各個工程部分以及在建造合約的整個有效期內,實施下列措施:-
(a) 周界引渠以截流工地外雨水的徑流。周界引渠應在土木工事之前建造;
(b) 砂/淤泥清除設施,如隔砂池、淤泥收集器及沉澱池等,並定期保養這些設施,以確保系統在所有時間內的正常操作和效率。淤泥清除設施應根據署長頒佈的PROPECC應用指引1/94進行設計;
(c) 認真編排工程計劃,以避免在雨季(四月至九月)進行挖掘工程。如無法避免在雨季或年內可能出現暴雨的時間進行挖掘工程,暴露的斜坡表面應利用防水帆布或其他有效的方法遮蓋;
(d) 現場露天存放的建築材料應在暴雨期間,利用防水帆布或類似織物遮蓋;
(e) 沿土方工程區四週設立護堤,以防水浸;
(f) 燃料/油槽及化學品存貯槽/存貯區應配有門鎖,並應位於封閉區內,同時應設置堤壆,堤壆的承載能力應為最大貯槽貯存容量的110%,以防洩漏的油料流入接收水域;
(g) 工地各入口應配備車輪清洗設施,並定期保養這些設施,以確保設施在所有時間內的正常操作和效率;
(h) 應在與工程項目有關的排水系統油/燃料污染源下游設置油污截流井。應定期保養油污截流井,以防意外洩漏後,油污及油脂流入雨水排水系統。截流井應設有溢流槽,以防暴雨期間沖水。
(i) 應提供臨時及永久排水管道和下水道以便徑流排放。排水管道及下水道應適當設計,以便控制雨水流量。所有這些設施應定期檢查保養,尤其在暴雨後,以確保設施在任何時間均處於良好工作狀態。在建造工程完成後或不再需要臨時改道時,應將臨時改道的排水管恢復到原來的狀態,以及
應由持牌營運商提供便攜式化學廁所及污水貯水池以處理由建造工地工人產生的污水以及散佈線路兩側的污水。應由持牌營運商定期進行廢物處置及設施保養,以確保正常操作。
緩解施工噪音環境影響的措施
應避免安排本工程項目的施工計劃與工程項目範圍內的西鐵工程的施工計劃重疊,以減小累積影響。
在整個項目建造期內,特定位置特定建造活動的緩解措施應根據環境影響評估報告內表7.9的規定實施。在各個施工期內,對於各項施工活動,應採取對應環境影響評估報告表7.9所述最低最差情況最大累積施工噪音水平的緩解措施。表中緩解措施M1至M4規定如下:
M1: 使用靜音設施及作業方法
在建造合約的整個有效期內,應使用符合BS 5228第1部分或環境保護署「指定區域施工噪音技術備忘錄」規定的設備型號。
M2: 臨時及移動式隔音屏障
在建造合約的整個有效期內,應在工地邊界距靜止設備(空氣壓縮機、水泵、混凝土泵、發電機、插入式震搗器等)數米的範圍內,以及距移動設備(挖土機、貨車、壓路機、卸土車、混凝土混合機及移動式起重機等)五米範圍內,設置3-5米高圍板,以阻擋由噪音最容易受影響範圍處觀看時的視線。在高層噪音最容易受影響範圍(五層以上)可能受到影響時,應在可能時使用懸臂頂蓋。屏障/圍板的表面密度不應小於7kg/m2。
M3: 重新確定關鍵區域內設備的地點,並減少在鄰近噪音容易受影響範圍的關鍵區域內操作的設備數目
對於各項施工活動,應盡可能減少在同一時間在規定地點操作的設備數目。
M4: 限制現場施工設備的操作時間
在東華三院郭一葦學校附近進行地盤清理及地盤平整工程期間,以及在天水圍天主教小學週圍進行鐵軌鋪設工程期間,卸土車在週圍的操作時間在每30分鐘的間隔內,應少於15分鐘。
緩解施工期間景觀及視覺環境影響的措施
應在建造合約的整個有效期內在所有工程區域及施工工地的所有部分實施以下緩解措施:-
(a) 施工期間遇到的任何表土應認真堆放,並重複用於適當的綠化區;
(b) 在指定輕鐵預留地四週設置3-5米高圍板,以遮檔大多數的工程工地;以及
(c) 根據經批准的景觀設計總圖,在鐵路預留地種植樹木及灌木,以軟化高架橋的視覺影響,並利用攀緣植物,軟化高架橋支柱的外觀。
緩解營運期間,徑流及排水環境影響的措施
應實施下列措施,以緩解營運期內因地盤徑流及排水造成的環境影響:
(a) 應提供地面水排水系統以收集鐵軌徑流。在油污及潤滑液可能出現外溢的地方,鐵軌排水渠排出的污水應在泵入公共雨水排水系統前,流經油污/砂礫截流井/池,或地下排水系統,以清除油污、油脂及沉積物。
(b) 淤泥收集器及油污截流井應定期清潔及保養,以確保正常操作及效率。
(c) 油污截流井內收集的油污應轉移到適當的處置設施或在可能時回收利用。
