Pursuant to Section 10 of the Environmental Impact
Assessment Ordinance (the Ordinance), the Director of Environmental Protection
(the Director) granted the Environmental Permit (No. EP-007/1998) to MASS
TRANSIT RAILWAY CORPORATION (thereinafter referred to as the "Permit
Holder") on 25 September 1998. Pursuant to Section 13 of the Ordinance,
the Director amends the Environmental Permit No.EP-007/1998/C based on the
Application No. VEP-214/2006. The amendments described below, are incorporated
into this Environmental Permit (EP-007/1998/D). This Environmental Permit as
amended is for the construction and operation of the designated projects
described in Part B of this Permit subject to the
conditions described in and attached to Part C of this Permit.

MTRC Tseung Kwan O Extension - Phases I & II
include the construction and operation of: (a) A new Tseung
Kwan O Line by means of a junction east of Tseung Kwan O Station providing
two services; one from Po Lam Station and one from Area 86 Station in the
south of Tseung Kwan O New Town (Area 86), to Tseung Kwan O Station. The
Tseung Kwan O Line will run in tunnel, westward through Tiu Keng Leng and Yau
Tong Stations to connect with the existing Eastern Harbour Crossing. (b) A diversion of
the existing Kwun Tong Line from the existing Lam Tin Station, to the Yau
Tong and Tiu Keng Leng Stations, where cross platform interchanges will be
provided with the Tseung Kwan O Line services. (c) Interchange
facilities between the Tseung Kwan O Line and the diverted Kwun Tong Line at
Yau Tong and Tiu Keng Leng Stations, with appropriate tunnel configurations
in the Black Hill Tunnels. (d) Six new stations
along the railway alignment, ie. Yau Tong Station, Tiu Keng Leng Station,
Tseung Kwan O Station, Hang Hau Station, Po Lam Station and the Station in
Area 86. (e) A railway depot,
to be provided in Area 86, for stabling trains and maintenance required for
the operation of the Tseung Kwan O Line. (f) Ancillary
buildings including traction substations and ventilation buildings. |
Part C (PERMIT CONDITIONS)
C部 (許可證條件)
1.
General Conditions
一般條件
1.1
The Permit Holder shall ensure full compliance with all
conditions of this permit. Any non-compliance with this permit may constitute a
contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and
shall be definite ground for enforcement action or permit cancellation where
applicable.
許可證持有人必須確保完全符合本環境許可證的全部條件。如有不符合本許可證的情況,可能構成違反環境影響評估條例(第499章)的規定,並可按適用情況作為採取執法行動或取消許可證的確切理由。
1.2
This permit shall not remove the responsibility of the
Permit Holder to comply with any legislation currently in force such as Noise
Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water
Pollution Control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466),
Waste Disposal Ordinance (Cap.354) and others.
本許可證並不免除許可證持有人須符合現行生效的法例的責任,例如:噪音管制條例(第400章);空氣污染管制條例(第311章);水污染管制條例(第358章);海上傾倒物料條例(第466章);廢物處置條例(第354章);及其他條例。
1.3
The Permit Holder shall make copies of this permit
available at all times for inspection by the Director at all sites covered by
this permit.
許可證持有人須複印本許可證的副本,以供署長任何時間內在本許可證所涵蓋的所有工地查閱。
1.4
The Permit Holder shall give a copy of this permit to the
person(s) in charge of the site(s).
許可證持有人須將本許可證的一份副本交予有關工地的負責人。
1.5
The Permit Holder shall display a copy of this permit on
the construction site(s) at all vehicular site entrances/exits or at a
convenient location for public information at all times. The Permit Holder
shall ensure that the most updated information about the environmental permit,
including any amended permit, is displayed at such locations. If the Permit
Holder surrenders a part or the whole of the permit, the notice he sends to the
Director shall also be displayed at the same locations as the original permit.
許可證持有人須在有關建造工地的所有車輛進出口或一處方便的地點展示本許可證的副本,以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於環境許可證的最新資料,包括經修改的許可證。如果許可證持有人交回許可證的部分或全部,須於翌日將其送交署長的通知書,在備有原本許可證的各處相同地點展示。
1.6
The Permit Holder shall construct and operate the Project
in accordance with the project descriptions in Part B of this permit.
許可證持有人須依據本許可證B部的工程項目說明來建造及營辦指定工程項目。
1.7
The Permit Holder shall ensure that the Project are
designed, constructed and operated in accordance with the information and
recommendations contained in the Phases I & II EIA reports mentioned in Part
A of this permit.
許可證持有人須確保工程項目的設計、建造及營辦,符合本許可證A部所提述的第一期及第二期環評報告所載的資料及建議。
1.8
All finalised submissions, as required under this part of
the permit, shall be released to the public if requested by the Director, by
depositing copies in the Environmental Impact Assessment Ordinance Register
Office or any other places or by any other means as specified by the Director
for public inspection. For this purpose, the Permit Holder shall provide
sufficient copies of submissions.
所有按本許可證本部規定提交的文件定稿,在署長要求下須公開給公眾人士知道,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何地方或以任何其他方法,以供公眾查閱。為此,許可證持有人須提供足夠數量的文件副本。
2 Submissions
or Measures before Commencement of Construction
展開建造工程前提交的文件或採取的措施
2.1
The Permit Holder shall employ an Environmental Manager
with at least 7 years of experience in environmental monitoring and auditing
(EM&A) or environmental management. The Environmental Manager shall verify
the overall environmental performance of the Project, including implementation
of all environmental mitigation measures, submissions relating to environmental
monitoring and auditing, and any other submissions required under this permit.
許可證持有人須聘用一名至少具有7年環境監察及審核或環境管理經驗的環境經理。環境經理須核證工程項目的整體環境表現,包括實施所有環境緩解措施,提交與環境監察和審核有關的文件,以及本許可證規定提交的其他文件。
2.2
Before commencement of construction of the Project, an
Environmental Team shall be established. The Environmental Team shall be headed
by the Environmental Manager and shall be responsible for the overall
implementation and management of the EM&A programme in accordance with the
EM&A requirements as contained in the EM&A Manual (ie. Phase I EIA
Report, Volume III) and section 8 of the Phase II EIA Report.
在工程項目施工前,須設立一個環境小組。環境小組須由環境經理領導,及須根據環境監察及審核手冊(即第一期環評報告第三冊)及第二期環評報告第8節所載的環境監察及審核規定,負責全面實施和管理環境監察及審核計劃。
2.3
The Permit Holder shall deposit with the Director 3
copies of noise management plan consisting of 1 to 1000 scale layout plan(s)
and/or explanatory statement(s) showing the noise mitigation measures to be
adopted during construction of the corresponding sections of the Project. The
layout plan(s) and/or explanatory statement(s) shall be verified by the
Environmental Manager as conforming to the information and recommendations
contained in sections
許可證持有人須向署長存放3份噪音管理計劃,其中載有1:1000比例的圖則及/或解釋說明文件,顯示工程項目在各相關路段施工時須採取的噪音緩解措施。圖則及/或解釋說明文件在存放前須先經由環境經理核證,以能符合第一期環評報告第二冊第
2.4
Before commencement of construction works in Hang Hau
Section, noise insulation and air-conditioning shall be provided for the NTWJWA
Leung Sing Tak Primary School (NHAH9) as highlighted in Figure A.
在坑口段施工前,須為圖A所示的新界婦孺福利會梁省德小學(NHAH9)提供隔音及空調設備。
2.5
Before commencement of construction works in Po Lam
Section, noise insulation and air-conditioning shall be provided for King Lam
Catholic Primary School (NPOL2), STFA Leung Kit Wah Primary School (NPOL6) and
STFA Cheng Yu Tung Secondary School (NPOL9) as highlighted in Figure B.
在寶林段施工前,須為圖B所示的景林天主教小學(NPOL2)、順德聯誼會梁潔華小學(NPOL6)和順德聯誼會鄭裕彤中學(NPOL9)提供隔音及空調設備。
2.6
The Permit Holder shall deposit with the Director 3
copies of waste management plan for all construction sites before commencement
of construction of the Project. The waste management plan shall follow the
waste management hierarchy and shall include mitigation measures as detailed in
sections
在工程項目施工前,許可證持有人須向署長存放3份有關所有建造工地的廢物管理計劃。廢物管理計劃須依據第一期環評報告第二冊第
2.7
A survey of all construction sites (including the access
routes to the sites) shall be conducted to determine and map the distribution
and abundance of vegetation types; and to locate trees and other vegetation
which shall be retained or replanted. The Permit Holder shall submit for the
approval of the Director 3 copies of survey report(s) together with layout
drawings at 1:1000 scale for any construction site(s) showing all vegetation to
be retained or replanted before commencement of construction works at the
construction site(s). The survey report(s) and the layout drawings shall be
verified by the Environmental Manager before submission. Additional copies may
be required by the Director.
須就所有建造工地進行勘察(包括通往工地的道路)以確定各類植物的分布和數量並記錄於圖上,及找出哪些樹木及植物須予保留或再種植。在建造工地施工前,許可證持有人須就所建造工地向署長提交3份勘察報告連同1:1000比例的圖則,以顯示所有須給與保留或再種植的植物,以待批准。勘察報告及圖則在提交前須先經由環境經理核證。署長可要求額外的副本。
2.8
The Permit Holder shall submit for the approval of the
Director 3 copies of compensatory replanting plan for all construction sites
before commencement of compensatory replanting works of the Project. The
compensatory replanting plan shall include native species and shall be verified
by Environmental Manager before submission as conforming to the findings and
recommendations of the survey report(s) and layout drawings as approved under
Condition 2.7 above. Additional copies may be required by the Director.
許可證持有人為工程項目進行補償性再種植工作前須就所有建造工地,向署長提交3份補償性再種植計劃,以待批准。補償性再種植計劃須涵蓋本地品種並在提交前先經由環境經理核證,以證明符合上文第2.7項條件所核准的勘察報告及圖則所載的資料科及建議。署長可要求額外的副本。
2.9
Before commencement of construction works at any
construction site(s), fences shall be erected along the boundaries of the construction
site(s) to avoid any adverse impact to the surrounding environment due to
uncontrolled construction activities.
在任何建造工地施工前,須沿該建造工地邊界豎立柵欄,以免由於不能控制的建造作業對周圍環境造成不良影響。
2.10
The Permit Holder shall submit for the approval of the
Director 3 copies of visual and landscape drawings at 1:1000 scale showing that
all aboveground structures are designed to visually integrate into the
surrounding areas and the potential visual impacts are reduced by the planting
of vegetation in the spaces around these structures before commencement of
construction of the structures. The visual and landscape drawings shall be
verified by the Environmental Manager before submission. Additional copies may
be required by the Director.
在展開建造構築物的工程前,許可證持有人須向署長提交3份1:1000比例的視覺及景觀美化圖則,以顯示所有地面上構築物的設計在視覺上能融合周圍環境,並且已在這些構築物周圍空間種植,以減低視覺美觀方面可能造成的影響,以待批准。視覺及景觀美化圖則在提交前須先經由環境經理核證。署長可要求額外的副本。
2.11
Before commencement of construction of the tunnel
sections adjacent to Sai Tso Wan Landfill and Tseung Kwan O Stage I Landfill,
the Permit Holder shall deposit with the Director 3 sets of landfill gas safety
plan containing a brief description of the construction method and the
corresponding monitoring procedures, precautionary measures and emergency
procedures for landfill gas potentially arising from the construction works of
the concerned tunnel sections. The landfill gas safety plan shall show that the
hazards associated with landfill gas during construction have been adequately
addressed and the requirements of BS 6164:
在毗鄰茜草灣堆填區和將軍澳第一期堆填區的隧道分段施工前,許可證持有人須向署長存放3份堆填區沼氣安全計劃,概述建造方法以及相應的監察程序、預防措施和緊急程序,以處理有關隧道各段施工時可能洩出的堆填區沼氣。堆填區沼氣安全計劃須顯示,堆填區沼氣對施工期構成的風險已獲妥善解決,而堆填區風險也符合BS 6164:19/90標準的規定。堆填區沼氣安全計劃在存放前須經由環境經理核證。堆填區沼氣安全計劃不可包括其他污染管制條例所涵蓋的措施。署長可要求額外的副本。
2.12
Before commencement of construction of the tunnel
sections adjacent to Sai Tso Wan Landfill and Tseung Kwan O Stage I Landfill,
the Permit Holder shall deposit with the Director 3 sets of design drawings at
1:1000 scale and/or design report(s) showing:
在毗鄰茜草灣堆填區和將軍澳第一期堆填區的隧道分段的建造工程展開前,許可證持有人須向署長存放3套1:1000比例的設計圖則及/或設計報告,以展示:
(a) gas resistant membrane enclosures
have been incorporated into the design of the concerned tunnel sections to
prevent landfill gas and leachate from entering the tunnels;
有關隧道分段的設計已包括建造防止氣體滲漏的膜層包圍,以防止堆填區沼 氣和滲濾污水滲入隧道內;
(b) ventilation systems of the
concerned tunnel sections, including any passenger platform or the like where passenger may have access to, have been
designed such that under no circumstances during operation, the methane and/or carbon dioxide
concentrations shall exceed 0.5% by volume.
在有關隧道分段,包括所有乘客月台或乘客可出入的同類地方,均已設計安 裝抽氣系統,使營辦期間在任何情況下,甲烷及/或二氧化碳濃度均不可超逾 0.5%(以容積計)。
The design drawings and/or design report(s) shall be verified by the
Environmental Manager before deposit. Additional copies may be required by the
Director.
設計圖則及/或設計報告在存放前須先由環境經理核實。署長可要求額外數量的文本。
2.13
Before commencement of construction of the railway
station and depot in Area 86, the Permit Holder shall deposit with the Director
3 sets of design drawings at 1:1000 scale and/or design report(s) showing :
在第86區火車站和車廠施工前,許可證持有人須向署長存放3套1:1000比例的設計圖則及/或設計報告,以顯示:
(a) the building compartments of the
railway station/ depot in Area 86, that are enclosed or below grade,
have been designed to prevent the accumulation of landfill gas;
在第86區火車站/車廠的密封或在地面之下的建築物間隔,在設計上能防止堆 填區沼氣聚積;
(b) the conduits entering building
compartments, voids, enclosed areas or the like in the railway station/depot in Area 86 have been designed to
prevent the ingress of landfill gas through junctions;
and
進入第86區火車站/車廠的間隔、空間、密封地區或類似地方的喉管,設計上 能防止堆填區沼氣從接駁位滲入;及
(c) air quality within building
compartments shall be maintained in a safe and healthy condition and, under no circumstances, the
methane and carbon dioxide concentrations shall exceed 0.5% by volume.
建築物間隔內的空氣質素將會維持於安全及健康水平,且在任何情況下,甲 烷及二氧化碳濃度不可超逾0.5%(以容積計)。
The design drawings and/or design report(s) shall be verified by the
Environmental Manager before deposit. Additional copies may be required by the
Director.
設計圖則及/或設計報告在存放前須先經由環境經理核證。署長可要求額外的副本。
2.14
The Permit Holder shall submit for the approval of the
Director 3 copies of construction phase leachate monitoring programme and
contingency plan for treatment and/or disposal of leachate contaminated
drainage water potentially arising from construction stage before commencement
of construction for the tunnel sections adjacent to the Sai Tso Wan Landfill
and the Tseung Kwan O Stage I Landfill. The construction phase leachate
monitoring programme and contingency plan shall be verified by the Environmental
Manager before submission. Additional copies may be required by the Director.
在毗鄰茜草灣堆填區及將軍澳第一期堆填區的隧道各分段施工前,許可證持有人須向署長提交3份施工期滲濾污水監察計劃,以及施工期的排水可能受滲濾污水污染的處理及/或排放的應變計劃,以待批准。施工期滲濾污水監察計劃和應變計劃在提交前須先經由環境經理核證。署長可要求額外的副本。
2.15
All deposited submissions as arising from Conditions 2.3,
2.6, 2.11, 2.12, & 2.13 above shall be rectified in accordance with the
comments, if any, made by the Director within one month of the receipt of the
Director's comments or otherwise specified by the Director.
因上文第2.3、2.6、2.11、2.12及2.13項條件規定而存放的所有文件,須在接獲署長意見後1個月內依據其意見(如有者)作出更改,或按其指定的其他方式處理。
3 Measures
during the Construction Period
建造工程期間的措施
3.1
All design and/or construction measures described in the
submissions approved or deposited under section 2 above shall be implemented
during construction of the Project.
工程項目施工時,須根據上文第2條所核准或存放的文件所載實施所有設計及/或施工期措施。
3.2
Noise insulation and air-conditioning shall be provided
for the proposed schools at southern part of Area 55 (N1) and at eastern part
of Area 56 (N2), and the proposed clinic in Area 56 (N3) as highlighted in
Figure C before they are in use if they are in use before completion of
construction works in Tseung Kwan O Section.
如在將軍澳段竣工前,如圖C所示的第55區南部建議的學校(N1)和第56區東部建議的學校(N2),以及第56區建議的診所(N3)已告啟用,則須在啟用前為有關學校/診所提供隔音及空調設備。
3.3
In accordance with the information and recommendations
contained in the Phase I & II EIA Reports and with reference to Annex A,
measures to mitigate water quality impacts from site run-off and drainage
during construction shall be implemented.
須參照附件A按第一期及第二期環評報告所載資料及建議,在建造工程期間實施措施以緩解工地徑流及排水所導致的水質影響。
3.4
For excavation of seriously contaminated sediment as
defined under EPD's Technical Circular No.
就工程項目動工挖掘在《環保署技術通告第

Plywood containing tropical hardwoods shall not be used
for hoarding or formwork at all construction sites.
所有建造工地不得使用由熱帶硬木製成的夾板作為圍板或土地平整材料。
3.6
The areas where the two protected species, namely Lilium
brownii and Pecteilis susannae, are located as highlighted in Figure D shall not
be disturbed.
不可干擾如圖D所示已植有兩個受保護品種淡紫百合及白蝶蘭的地方。
3.7
Soil erosion shall be reduced by minimising vegetation
disturbance on site; and by providing 95% vegetation cover, established by
hydroseeding and/or planting over any exposed ground lying at all construction
sites within six months of the last construction activity on that construction
site or part of that construction site where the exposed ground lies.
為減低土壤侵蝕,應儘量減少干擾工地的植物;此外,對建造工地的任何外露地面,在該建造工地或該工地土壤外露的部分進行最後一次建造作業後6個月內,應利用噴草及/或種植方法,使95%的地面有栽種植物覆蓋。
3.8
The following specific mitigation measures shall be
implemented for the construction sites in:
須在下列建造工地實施下述特定的緩解措施:
(a) Yau Tong Section -

(i) The station box shall be
integrated into the rock-cut slopes adjacent to slopes. Soil-cut slopes in the existing amenity open
space shall be minimised to reduce the visual impact and then planted-up
to re-establish the vegetation cover that have been removed.

3.9
During construction of the tunnel sections adjacent to
Sai Tso Wan Landfill and Tseung Kwan O Stage I Landfill, the landfill gas
monitoring procedures, precautionary measures and emergency procedures shall be
implemented in accordance with the landfill gas safety plan deposited under
Condition 2.11 above. The monitoring results shall be verified by the
Environmental Manager and reported to the Director on monthly basis. Any
changes to the procedures and/or measures shall be verified by the
Environmental Manager before implementation. The verified changes shall be
documented in the immediate monthly EM&A report.
在毗鄰茜草灣堆填區及將軍澳第一期堆填區的隧道分段施工時,須根據上文第2.11項條件所存放的堆填區沼氣安全計劃實施堆填區沼氣監察程序、預防措施及緊急程序。監察結果須按月經由環境經理核證再向署長匯報。任何程序及/或措施上的更改,須在實施前先經由環境經理核證。核證的更改須隨即在下一月份的環境監察及審核報告中註明。
3.10
During construction of the railway station and depot in
Area 86, the precautionary and safety measures shall comply with Chapter 8 of
the "Guidance Notes for Landfill Gas Hazards Assessment" published by
EPD.
在第86區的車站及車廠施工時,須採取環保署發表的《堆填區沼氣危險評估指引》第8章所載的預防和安全措施。
3.11
During construction of the tunnel sections adjacent to
Sai Tso Wan Landfill and Tseung Kwan O Stage I Landfill, the monitoring
programme and contingency plan for leachate contaminated drainage water during
construction stage as approved under Condition 2.14 above shall be implemented.
The monitoring results shall be verified by the Environmental Manager and
reported to the Director on monthly basis. Any changes to the monitoring
programme and contingency plan shall be verified by the Environmental Manager
and approved by the Director before implementation.
在毗鄰茜草灣堆填區及將軍澳第一期堆填區的隧道分段施工時,須實施根據上文第2.14項條件所核准的監察計劃及應變計劃以監察及處理施工時受滲濾污水污染的排水。監察結果先經由環境經理核證再按月向署長匯報。監察計劃和應變計劃如有任何更改須先經由環境經理核證,並獲署長批准方可實施。
3.12
During construction of the Project, the noise, waste and
visual design and/or mitigation measures contained in the submissions under
Conditions 2.3, 2.6 & 2.10 above shall be implemented. Any changes to the
measures shall be verified by the Environmental Manager as complying with the
environmental performance requirements contained in the Phases I & II EIA
Reports before implementation. The verified changes shall be documented in the
immediate monthly EM&A report.

4 Environmental
Monitoring & Audit (EM&A) before and during Construction
展開建造工程前及建造工程期間的環境監察及審核
4.1
The EM&A programme shall be implemented as set out in
the EM&A requirements detailed in the EM&A Manual (ie. Phase I EIA
Report, Volume III) and Section 8 of the Phase II EIA Report. Any changes to
the EM&A programme shall be justified by the Environmental Manager as
conforming to the EM&A requirements before submission to the Director for
approval.
須按環境監察及審核手冊(即第一期環評報告第三冊)和第二期環評報告第8節所訂立的環境監察及審核規定,實施環境監察及審核計劃。環境監察及審核計劃如有任何更改,須先經由環境經理提供充分理由以證明符合環境監察及審核規定,才可提交署長以待批准。
4.2
Samples and measurements for noise and air quality
monitoring shall be taken in accordance with the EM&A requirements by :
須按照環境監察及審核規定對噪音及空氣質素監察進行採樣及測量 :
(a) conducting baseline noise and
air quality monitoring at the specified locations and frequencies;
在指定地點進行指定次數的噪音及空氣質素基線監察;
(b) conducting impact monitoring on
noise and air quality at the specified locations and frequencies;

(c) in cases where specified
criteria in the EM&A Manual are exceeded, carrying out remedial actions
in accordance with the Event Contingency Plans, as set out in the EM&A
Manual; and

(d) logging and keeping records of
the details of (a) to (c) above, within 3 working days of the collection of data or completion of
remedial action, for the purposes of preparing and submitting the
EM&A Reports and to make available the information for inspection on site.

4.3
5 copies of Baseline Monitoring Report verified by the
Environmental Manager shall be submitted to the Director before the
commencement of any major construction works that would affect the monitoring
results. Additional copies may be required by the Director.
在任何會影響監察結果的大型建造工程展開前,須先向署長提交5份經由環境經理核證的基線監察報告。署長可要求額外的副本。
4.4
One hard copy of monthly EM&A Reports verified by the
Environmental Manager shall be submitted to the Director within 10 working days
from the end of the reporting month. Additional copies may be required by the
Director. Electronic copy of the EM&A Reports shall be made available to
the public via internet access in the website of the Mass Transit Railway
Corporation within 5 working days after the hard copy is submitted. The content
of the electronic copy of the EM&A Reports must be the same as the hard
copy.

4.5
The submitted reports as required in Conditions 4.3 and
4.4 above shall be rectified in accordance with the comments made by the
Director within one month of receipt of the Director's comments, or otherwise
specified by the Director.
根據上文第4.3及4.4項條件規定所提交的報告,須在接獲署長意見1個月內或署長另指的時間內,根據署長的意見作出修改。
4.6
The actions described in the Event Contingency Action
Plans of the EM&A Manual shall be properly carried out, in accordance with
the time frame set out in the Event Contingency Plans, or as agreed by the
Director.
環境監察及審核手冊內的事故應變計劃所載述的行動,須根據事故應變計劃所訂明的時限或按署長同意的時間內妥善進行。
4.7
All finalised submissions, as required under this section
of the permit shall be released to the public by depositing copies in the
Environmental Impact Assessment Ordinance Register Office or any other places
or by any other means as specified by the Director for public inspection. For
this purpose, the Permit Holder shall provide sufficient copies of submissions.
所有按許可證本條規定提交的文件定稿,須公開給公眾人士知道,方法是將有關文件副本存放於環境影響評估條例登記冊辦事處或署長所指定的任何地方或以其他方法,以供公眾查閱。為此,許可證持有人須提供足夠數量的文件副本。
5 Submissions
or Measures before Commencement of Operation

5.1
Before population intake of development at Area 86 or any
noise sensitive uses within

Prior to the operation of the ventilation systems, the
Permit Holder shall deposit with the Director 3 copies of audit report verified
by the Environmental Manager certifying the satisfactory completion of the
recommended noise mitigation measures for the ventilation systems contained in
section

5.3
The Permit Holder shall submit for approval of the
Director 3 sets of emergency spillage action plan for the railway depot in Area
86 before commencement of operation of the railway depot. The emergency spillage
action plan should ensure that any accidental spillage will be dealt with
immediately and will not impact on any water bodies and shall be verified by
the Environmental Manager before submission. Measures covered by other
pollution control Ordinances shall not be included in the emergency spillage
action plan.
在鐵路車廠投入運作前,許可證持有人須向署長提交3套第86區鐵路車廠的意外溢洩行動計劃,以待批准。意外溢洩行動計劃應確保任何意外溢洩事件會即時處理及不會影響任何水體。計劃提交前須經由環境經理核證。意外溢洩行動計劃不得包括其他污染管制條例所涵蓋的措施。
5.4
Before commencement of operation of the Project, the
Permit Holder shall deposit with the Director an audit report verified by the
Environmental Manager certifying that the satisfactory completion of all design
measures in relation to landfill hazards as described in Conditions 2.12 and
2.13 above.
在工程項目投入運作前,許可證持有人須向署長存放一份經環境經理核實的審核報告,證明上文第2.12及2.13項條件所說明與堆填區風險有關的各項設計措施,已經圓滿竣工。
5.5
Before commencement of operation of the Project, an
operation manual, maintenance manual and emergency plan shall be developed. The
operation manual and/or maintenance manual shall include the following:
在工程項目投入運作前,須制訂運作手冊、保養手冊及應急計劃。運作手冊及/或保養手冊須包括:
(a) requirements for the periodic
calibration and maintenance of the landfill gas monitoring equipment;
規定定期校準及保養堆填區沼氣監測設備;
(b) requirements for monitoring to
ensure the landfill gas, during inoperative period, will not be accumulated to such a concentration
to render the ignition a fire or explosion before resuming normal train
operation;
規定進行監測,以確保在非運作期間,堆填區沼氣不會積聚至可於火車恢復 正常運作前觸發火警或爆炸的濃度水平;
(c) requirements for periodic
condition surveys for the occurrence of cracks and the measurement of landfill
gas ingress from the cracks, if any;

(d) requirements for landfill gas
monitoring for carrying out maintenance works as recommended in section

The emergency plan shall contain actions to be taken including any evacuation
procedures in relation to landfill gas monitoring. The Environmental Manager
shall certify that the operation manual, maintenance plan and emergency plan
have incorporated the consideration of hazards associated with landfill gas and
the above requirements.

5.6
Before commencement of operation of the Project, the
Permit Holder shall submit for the approval of the Director 3 copies of
operational phase leachate monitoring programme and contingency plan for
treatment and/or disposal of leachate contaminated drainage water potentially
arising from operational stage of the Project. The operational phase leachate
monitoring programme and contingency plan shall be verified by the
Environmental Manager before submission. Additional copies may be required by
the Director.

5.7
Before operation of the school or population intake of the
cluster of residential towers of the planned CDA development in Area 86 nearest
to the open track section between Tseung Kwan O Area 106 and Wan Po Road
(whichever is earlier), the Permit Holder shall provide a 12 metres
cantilevered barrier for West Bound Main Track (WBMT) at the open track section.
A canopy-typed noise barrier shall be provided to cover 11 metres East Bound
Main Track (EBMT), 11.5 metres Reverse Siding Track (RST) and 12 metres East
Bound Depot Track (EBDT). The West
Bound Depot Track (WBDT) shall be fully enclosed by 38 metres long noise
barrier and the track close to the Pak Shing Kok tunnel shall be covered by a
10 metres long semi-enclosure noise barrier. The location and typical sections
of the noise barriers are indicated in Figures F, G and H respectively. The
noise barriers shall be of solid in continuous form and absorptive construction
with a surface density of not less than

5.8
Prior to the operation of the Project, the Permit Holder
shall submit to the satisfaction of Director a proposal for performance tests
proposal to illustrate that the new 8-car electric multiple unit trains, 2-car
locomotives and 4-car wagons would meet the specification of maximum levels
(Lmax) not exceeding 78 dB(A) at 80kph, 87 dB(A) at 65kph and 84.7 dB(A) at
65kph respectively, measures at

5.9
Prior to the operation of the Project, the Permit Holder
shall deposit to the Director a report on performance tests of the electric
multiple unit trains, locomotives and wagons on the basis of Condition 5.8. The
performance test report shall be verified by the Environmental Manager.
在工程項目投入運作前,許可證持有人須以第5.8項條件為基礎,測試電動多單元列車、火車頭及鐵路貨車的表現,並向署長存放表現測試報告。表現測試報告須經環境經理核證。
6 Measures
during the Operation Period
運作期間的措施
6.1
All design and/or operational mitigation measures
described in the submissions approved or deposited under section 5 above shall
be implemented during operation of the Project.
工程項目運作期間,須根據上文第5條所核准或存放的文件所載實施所有設計及/或運作期緩解措施。
6.2
Non ozone-depleting refrigerants, in compliance with the
Montreal Protocol, shall be used for all air-conditioning systems of the
Project.
工程項目的所有空調系統,須使用符合蒙特利爾議定書的非消耗臭氧層製冷劑。
6.3
Within six months after commencement of operation of the
Project, all compensatory replanting for all construction sites shall be
completed according to the compensatory replanting plan approved under
Condition 2.8 above.
在工程項目投入運作後6個月內,所有建造工地的各項補償再種植工作須按照上述第2.8項條件批准的補償再種植計劃進行。
6.4
Where the areas around the stations remain the
responsibility of the Permit Holder, the Permit Holder shall maintain the
planted areas to remove climbers and ensure the survival of the trees for the
first two years after completion of planting works.
凡車站附近屬於許可證持有人負責的範圍,許可證持有人須護養種植範圍以清除攀緣植物,並確保樹木在種植工作完成後首兩年可以存活。
6.5
Within six months after commencement of operation of the
Project, any advance planting of vegetation that have been disturbed adjacent
to Sheung Ning Road, Pui Shing Road, and Roads D1, P1, P
在工程項目投入運作後6個月內,在常寧路、培成路、將軍澳D1、P1及P2路,以及市鎮公園附近地方曾受干擾的預先栽種植物,須已復原原貌,而各項景觀美化工程也須依據上述第2.10項條件批准的視覺及景觀美化圖則完成。
6.6
Where the areas around the stations remain the
responsibility of the Permit Holder, the Permit Holder shall monitor and
maintain the success of landscape restoration measures for the first two years
after completion of the landscape restoration works.
凡車站附近屬於許可證持有人負責的範圍,在景觀美化修復工程完成後首兩年,許可證持有人須監察及維持景觀美化修復措施的成效。
6.7
The following mitigation measures shall be implemented to
control oil spills and leaks during operation of the railway depot in Area 86:
在第86區鐵路車廠運作期間,須執行下列緩解措施以控制溢濺油及漏油的問題:
(a) all plant maintenance areas
containing significant quantities of oil shall be bunded and constructed on a
hard standing, and provided with sediment traps and oil interceptors;
所有貯油量高的機器維修區須設在堅硬的地台上及築堤防漏,並設置沉澱物 收集器及截油器;
(b) traps and interceptors shall be
regularly cleaned and maintained, and especially after accidental spillage; and
收集器及截洗器須定期清潔及保養,尤其是在發生意外溢洩事故之後;及
(c) layers of sawdust, sand or
equivalent material shall be provided at any plant and equipment that may possibly leak oil.

6.8
The following mitigation measures shall be implemented to
minimise impacts from waste water discharge during operation of the railway
depot in Area 86:
在第86區鐵路車廠運作期間,須執行以下緩解措施以盡量減低廢水排放的影響:
(a) effective neutralisation of acid
shall be done at the acid washing facilities prior to discharge;
排放前須在酸洗設施進行有效的酸中和;
(b) prudent management practice
shall be used to minimise the amount of acid used;
須採取審慎的管理方法,以盡量減少酸的用量;
(c) opportunities for recycling of
water within the automatic washing facilities shall be sought;
須盡量將自動清洗設施內的水循環再用;
(d) the use of biodegradable
detergents shall be adopted as a preferred option.

6.9
Tunnel seepage shall be treated by oil/grease
interceptors prior to be discharged to stormwater drains.
隧道滲流須先經油/油脂截流器處理,才排入雨水渠。
6.10
A clear segregation of drainage systems between
unpolluted water and effluent contaminated with hydrocarbons, heavy metals or
other potentially hazardous chemicals arising from the railway depot shall be
provided.
須設置清楚分隔的排水系統,將未受污染的水與已受鐵路車廠所排出的碳氫化合物、重金屬或其他有潛在危險的化學品污染的污水分隔開。
6.11
The emergency spillage action plan for the railway depot
deposited under Condition 5.3 shall be implemented. Any changes to the
emergency spillage plan shall be verified by the Environmental Manager and
approved by the Director before implementation.
依據第5.3項條件存放的鐵路車廠意外溢洩行動計劃,須予以執行。意外溢洩行動計劃如有任何更改,執行前須經由環境經理核證,並得到署長批准。
6.12
A gas monitoring programme for methane, carbon dioxide
and oxygen shall be conducted in the following locations for a minimum period
of six months:
須在下列地點進行甲烷、二氧化碳及氧氣的氣體監測計劃,為期至少6個月:
(a) manholes, sump-pits and similar
below ground voids of the railway station/depot in Area 86 shall be monitored on monthly basis;
在第86區鐵路車站/車廠地下的沙井、槽井及同類的地穴,須每月進行監測一次;
(b) building compartments, including
the station, plant rooms and beneath the platform void of the railway station
and depot in Area 86, shall be monitored on a fortnightly basis;

(c) monitoring wells installed along
the northern site boundary of the railway depot in Area 86 shall be monitored on a monthly
basis;

(d) methane concentration within the
tunnel sections adjacent to Sai Tso Wan Landfill and Tseung Kwan O Stage I Landfill shall
be checked daily prior to the operation of the first train of the day to ensure that methane concentration
shall not exceed 0.5% by volume.

The Permit Holder shall submit 3 copies of monthly report to the Director
presenting the results of monitoring in (a) to (d) above and shall recommend if
additional protection measures and/or monitoring are required to be implemented
during and after the six months monitoring period. The cease of monitoring of
methane concentration in (d) above after the six months monitoring period shall
be subject to the approval of the Director. The monthly report shall be
verified by the Environmental Manager before submission. Additional copies may
be required by the Director.
許可證持有人須向署長提交3份載明上文(a)至(d)項監測結果的每月報告,並須建議應否在6個月監察期期間及之後執行額外的保護措施及/或監測工作。在6個月的監察期屆滿後,上文(d)項所述的甲烷濃度監測工作如要停止,須獲署長批准。每月報告在提交前須由環境經理核實。署長可要求額外數量的文本.
6.13
The monitoring programme and contingency plan for
leachate contaminated drainage water during operational stage as approved under
Condition 5.6 above shall be implemented. Any changes to the monitoring
programme and contingency plan shall be verified by the Environmental Manager
and approved by the Director before implementation.
在運作期間,依據第5.6項條件批准的運作階段滲漏污水監察計劃及應變計劃,須予以執行。監察計劃及應變計劃如有任何更改,在執行前須經由環境經理核證,並得到署長批准。

This Permit consists of three parts, namely, Part A (Main
Permit), Part B (Description of Designated Project) and Part C (Permit
Conditions).
本環境許可證共有3部,即:A部(許可證主要部分);B部(指定工程項目的說明);及C部(許可證條件)。
2.
The Permit Holder may apply under Section 13 of the
Ordinance to the Director for a variation of the conditions of this Permit. The
Permit Holder shall replace the original permit displayed on the construction
site by the amended permit.
許可證持有人可根據條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須將經修改的許可證,替換在建造工地內展示的原有許可證。
3.
A person who assumes the responsibility for the whole or
a part of the designated project may, before he assumes responsibility of the
designated project, apply under Section 12 of the Ordinance to the Director for
a further environmental permit.
承擔指定工程項目的整項或部分工程的責任的人,在承擔指定工程項目責任之前,可根據條例第12條的規定向署長申請新的環境許可證。
4.
Under Section 14 of the Ordinance, the Director with the
consent of the Secretary for the Environment and Food, may suspend, vary or
cancel this Permit. This Permit shall be removed from the display on the
construction site.
根據條例第14條的規定,署長可在規劃環境地政局局長的同意下暫時吊銷、更改或取消本環境許可證。該許可證必須從建造工地除下,不再展示。
5.
If this Permit is cancelled or surrendered during the
construction or operation, an environmental permit must be obtained under the
Ordinance before the construction or operation of the project could be
continued. It is an offence under section 26(1) of the Ordinance to construct
or operate a designated project without an environmental permit.
如果本許可證在工程項目建造或營辦期間取消或交回,則在繼續進行建造或營辦工程項目之前,必須先根據條例規定取得環境許可證。根據條例第26(1)條的規定,任何人在沒有環境許可證的情況下建造或營辦指定工程項目,即屬犯罪。
6.
Any person who constructs or operates the Project
contrary to the conditions in the permit, and is convicted of an offence under
the Ordinance, is liable:-

(i) on a
first conviction on indictment to a fine of $ 2 million and to imprisonment for
6 months;
一經循公訴程序首次定罪,可處罰款200萬元及監禁6個月;
(ii) on a second
or subsequent conviction on indictment to a fine of $ 5 million and to
imprisonment for 2 years;
一經循公訴程序第二次或其後每次定罪,可處罰款500萬元及監禁2年;
(iii) on a first summary
conviction to a fine at level 6 and to imprisonment for 6 months;
一經循簡易程序首次定罪,可處第6級罰款及監禁6個月;
(iv) on a second or
subsequent summary conviction to a fine of $ 1 million and to imprisonment for
1 year; and

(v) in any case
where the offence is of a continuing nature, the court or magistrate may impose
a fine of $ 10,000 for each day on which he is satisfied the offence continued.

7.
The Permit Holder may appeal against any condition of
this Permit under Section 17 of the Ordinance within 30 days of receipt of this
Permit.

8.
Additional conditions 5.7, 5.8 and 5.9 have been added as
a result of Application No. VEP-004/1999. Drawings attached in Part B have been
replaced and conditions 2.12, 2.15, 5.4, 5.5 and 6.12 have been amended and
additional condition

Measures to Mitigate Water Quality Impacts from Site
Run-off and Drainage During Construction
建造工程期間工地徑流和排水的水質影響緩解措施
To mitigate the water quality impacts from site run-off
and drainage during construction, the following shall be implemented:
必須執行下列措施以緩解建造期間工作徑流和排水造成的水質影響:
(a)
Open stockpiles of construction materials (e.g.
aggregates, sand and fill material) of more than 50 cu.m. shall be covered with
tarpaulin or similar fabric during rainstorms. Measures shall be taken to
prevent the washing away of construction materials, soil, silt or debris into
any drainage system.
在暴雨期間,露天堆存而體積超逾50立方米的建築材料(如石料、沙及填料),須以帆布或同類質地的布料覆蓋。須採取措施防止建築物料、泥土、淤泥或碎屑沖入任何排水系統;
(b)
Manholes, including newly constructed ones, shall always
be covered and sealed so as to prevent silt, construction materials or debris
being washed into the drainage system and storm runoff being directed into foul
sewers during the construction period. Discharge of surface runoff into foul
sewers shall be prevented to avoid overloading the foul sewerage system.
在建造工程期間,沙井(包括新建的沙井)須經常覆蓋及密封,以防止淤泥、建築材料或碎屑被沖入排水系統,以及暴雨徑流被引入污水渠。須阻止讓地面徑流排入污水渠以免超出污水排污系統的負荷。
(c)
Precautions/actions relating to rainstorms as follows:
與暴雨有關的預防措施/行動如下:
(I)
Precautions to be taken at any time of year when
rainstorms are likely
年中可能出現暴雨時採取的預防措施
(i) Silt
removal facilities, channels and manholes should be maintained and the deposited
silt and grit should be removed regularly.
淤泥清除設施、渠道及沙井應進行保養,而沉澱的淤泥和砂礫應 定期清除。
(ii) Temporarily
exposed slope surfaces should be covered. eg. by tarpaulin.
暫時外露的斜坡表面應用帆布等物加以覆蓋。
(iii) Temporary
access roads should be protected by crushed stone or gravel.
臨時通道應以碎石或礫石加以保護。
(iv) Intercepting
channels should be provided (eg. along the crest/edge of excavation) to prevent
storm runoff from washing across exposed soil surfaces.
應設置截流渠道(例如在挖泥地點頂部或邊緣)以避免暴雨徑流沖刷外露的泥土表面。
(v) Trenches
should be dug and backfilled in short sections. Measures should be taken to
minimise the ingress of rainwater into trenches.
坑道應分小段挖掘回填。應採取措施以盡量避免雨水流入坑內。
(II)
Actions to be taken when a rainstorm is imminent or
forecast
暴雨將臨或預測會有暴雨時採取的行動
(i) Silt
removal facilities, channels and manholes should be checked to ensure that they
can function properly.
應檢查淤泥清除設施、渠道及沙井,以確保運作妥當。
(ii) Open
stockpiles of construction materials (eg. aggregates, sand and fill materials) on
site should be covered with tarpaulin or similar fabric.
工地內露天堆存的建築材料(如石料、沙及填料)應以帆布或同類質地的布料覆蓋。
(iii) All
temporary covers to slopes and stockpiles should be secured.
斜坡及堆存物料的所有臨時覆蓋物應該縛緊。
(III)
Actions to be taken during or after rainstorms
在暴雨期間或之後採取的行動
(i) Silt
removal facilities, channels and manholes should be checked and maintained to
ensure satisfactory working conditions.
應檢查及保養淤泥清除設施、渠道及沙井,以確保運作狀況令人滿意。
(d)
All vehicles and plant shall be cleaned before leaving a
construction site to ensure no earth, mud, debris and the like is deposited by
them on roads during the construction period. Wash-water arising from wheel
washing bay provided at every site exit shall have sand and silt settled out
and removed at least on a weekly basis to ensure the continued efficiency of
the process.
所有車輛及裝置在離開建造工地之前須進行清潔,以確保在施工期間,車輛及裝置沒有把泥土、碎屑及類似物料留在路面。每個工地出口設置的輪胎清洗處用作清洗輪胎的水,應至少每星期沉澱一次及把沙與淤泥清除,以確保這個程序繼續發揮效能。
(e)
If construction associated with the Project impinges upon
any of the small watercourses between Yau Tong and Tiu Keng Leng, the water
body shall be protected from site activities through screening or
covering/culverting, and waste management procedures and drainage facilities.
如果與工程項目相關的建造工程會影響到油塘與調景嶺之間的任何小型水道,須利用隔濾、覆蓋或設置下水道的方式,並執行廢物管理程序及提供排水設施,以保護水體免受工地作業活動影響。
(f)
At the start of site establishment, perimeter cut-off
drains around the site and internal drainage works shall be constructed. All
stormwater should be directed to silt removal facilities complying with the
guidelines in Appendix A1 of the ProPECC PN 1/94 issued by the Director.
在工地建立初時,須在工地四周建造周邊斷流渠及在內部建造排水裝置。所有雨水應引入淤泥清除設施,而該等設施須符合署長發出的《專業人士環保事務諮詢委員會專業守則》第1/94號附錄A1內載明的指引。
(g)
Construction works shall be programmed to minimize
surface excavation works during the rainy season (April to September). All
exposed earth shall be stabilized as soon as practicable after earthworks have
been completed.
建造工程須安排至以盡量避免在雨季期間(四月至九月)進行地面挖泥工程。土方工程完成後,須在切實可行情況下盡快把所有外露泥土穩定。
(h)
The overall slope of the site shall be kept to a minimum
to reduce the erosive potential of surface water flows and all trafficked areas
and access roads protected by coarse stone ballast.
工地的斜坡總數須盡量減少,以減輕地面水流可能造成的侵蝕,而所有行車的範圍及通道,須鋪設粗石道碴保護。
(i)
Sediment tanks of sufficient capacity constructed from
pre-formed individual cells of approximately 6 to 8 cubic metre capacity shall
be used for settling wastewater prior to disposal during the construction
period. Physical and chemical filters shall be added if refinement of the
sedimentation process is required.
在建造工程期間,廢水須先經沉澱才可排放,而所採用的沉澱池容量要足夠,由預先製成每個約6至8立方米的獨立槽池組成。如果需要進行更精細的沉澱程序,須附加使用物理及化學過濾器。
(j)
Silt contained in ground water and drilling water
collected from tunneling operations shall be removed with properly designed
silt removal facilities, such as the specified portable sedimentation tanks,
prior to the discharge of waters into storm drains.
隧道工程作業所收集的地下水及鑽井水,內含的淤泥須以妥善設計的淤泥清除設施(如指定的流動沉澱池)清除,才把水排入雨水渠。
(k)
All drainage facilities and erosion and sediment control
structures shall be regularly inspected and maintained to ensure proper and
efficient operation at all times and particularly following rainstorms.
所有排水設施及控制侵蝕及沉積物的裝置,須定期進行檢查及保養,以確保在任何時間(特別是暴雨後)都妥善有效操作。
(l)
Measures shall be taken to minimise the ingress of site
drainage into excavations. If the excavation of trenches in wet periods is
necessary, they should be dug and backfilled in short sections. Water pumped
out from trenches or foundation excavations shall be discharged into storm
drains via silt removal facilities.
須採取措施以盡量減少工地排水流入坑道內。如果必須在雨季挖掘坑道,則應分小段挖掘及回填。從坑道或地基挖掘所抽出的水,須經由淤泥清除設施排入雨水渠。
(m)
All fuel tanks and storage areas shall be provided with
locks and sited on sealed areas within bunds of a capacity equal to 110% of the
storage capacity of the largest tank.
所有燃料缸及貯存區須上鎖並設於以堤圍密封的範圍,其容量須相等於最大的燃料缸的貯存量的1.1倍。
(n)
Sewage shall be controlled by the use of portable
chemical toilets or sewage holding tanks and regularly collected by reputable
sewage collector for disposal.
須使用活動的化糞式廁所或污水貯存池,以控制污水,並定期由有良好信譽的污水收集商負責收集排放。
