Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the Environmental Permit (No. EP-134/2002) to the CIVIL ENGINEERING DEPARTMENT (now known as CIVIL ENGINEERING AND DEVELOPMENT DEPARTMENT) (hereinafter referred to as the "Permit Holder") on 28 June 2002.  Pursuant to Section 13 of the Ordinance, the Director amends the Environmental Permit No. EP-134/2002/J based on the Application No. VEP-389/2013.  The amendments described below, are incorporated into this Environmental Permit No. EP-134/2002/K. This Environmental Permit as amended is for the construction, operation and removal of the designated project described in Part B of this Permit subject to the conditions specified in and attached to Part C of this Permit.

 

根據環境影響評估條例(條例)第10條的規定，環境保護署署長(署長)於2002年6月28日將環境許可證編號EP-134/2002批予土木工程署(現稱土木工程拓展署)(下稱"許可證持有人")。根據條例第13條的規定，署長因應更改環境許可證的申請編號VEP-389/2013 修訂環境許可證編號EP-134/2002/J。以下修訂已包含在本環境許可證編號EP-134/2002/K 內。本經修訂的環境許可證，只適用於建造、營辦、及拆除本許可證B部所說明的指定工程項目﹐並須遵守本許可證C部所說明及附載的條件。

Hereunder is the description of the designated project mentioned in Part A of this environmental permit (hereinafter referred to as “the Permit”):

下列為本環境許可證(下稱“許可證”)A部所提述的指定工程項目的說明:

Fill Bank at Tseung Kwan O Area 137 [This designated project is hereinafter referred to as “the Project”].

Nature of Designated Project

To construct, operate and remove a temporary fill bank.

建造營辦及拆除一座臨時填料庫。

 

Location of Designated Project

指定工程項目的地點

 

Area 137 of Tseung Kwan O.  The location of the Project site is shown in Figure 1 of this Permit.

將軍澳第137區。工程項目的地點展示於本許可證圖1內。

 

Scale and Scope of Designated Project

指定工程項目的規模和範圍

The project site covers an area of approximately 104 hectares.  The scope of the project comprises :

1.          site clearance;

工地清理;

 

2.          construction of a temporary storm water system ;

建造臨時雨水系統;

 

3.          stockpiling of 6 million m3 of public fill ;

堆存六百萬立方米的公眾填料;

 

4.                  setting up two barging points : one at the Tseung Kwan O Basin (TKO Basin) and one at the Construction and Demolition Material Sorting Facility (C&DMSF) at the locations shown in Figure 2 of this Permit, for transporting the stockpiled public fill by barges；

設立兩座躉船轉運站 : 一座位於將軍澳內灣，另一座位於拆建物料分類設施，位處地點顯示於本許可證圖2，以供躉船運送堆存的公眾填料；

 

5.                  setting up a temporary barging point at the existing Explosives Off-loading Barging Point located in the south-eastern part of Area 137 (location shown in Figure 2 of this Permit) for the period of May 2004 to December 2004 for transporting the stockpiled public fill by barge;

6.                  construction and operation of a Construction and Demolition Material Sorting Facility (C&DMSF);

7.   setting up a Construction and Demolition Material Crushing Facility at the TKO Basin (location shown in Figure 2 of this Permit); and

8.   remove the temporary fill bank.

PART C ( PERMIT CONDITIONS )

C部 ( 許可證條件 )

 

1.                  General Conditions

一般條件

    

1.1        The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit.  Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject of appropriate action being taken under the Ordinance.

            許可證持有人及任何從事工程項目的人士必須完全符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況，可能違反環境影響評估條例 (第499章) 的規定，而當局可根據條例採取適當行動。

 

1.2       The Permit Holder shall ensure full compliance with all legislation from time to time in force including without limitation to the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466), Waste Disposal Ordinance (Cap. 354), Occupational Safety and Health Ordinance (Cap.509) and Factories and Industrial Undertakings Ordinance (Cap.59).  This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

      許可證持有人須經常確保完全符合現行法例的規定，包括但不限於噪音管制條例 (第400章)；空氣污染管制條例 (第311章)；水污染管制條例 (第358章)；海上傾倒物料條例 (第466章)；廢物處置條例 (第354章)；職業安全及健康條例 (第509章) 及工廠及工業經營條例 (第59章)。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由或根據任何法例默示任何批准。

 

1.3       The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit and the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit.  Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

      許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件及本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地 / 辦事處查閱。凡提述本許可證，須包括本許可證所述的所有文件及登記冊內的相關文件。

 

 1.4       The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit.  The site(s) refers to site(s) of construction, operation and removal of the Project and shall mean the same hereafter.

      許可證持有人須把本許可證的一份複本交予有關工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造、營辦及折除工程項目的工地，下文所提及的工地亦屬同一意思。

 

1.5        The Permit Holder shall display conspicuously a copy of this Permit on the Project site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such locations.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same locations as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site(s).

 

      許可證持有人須在有關工程項目工地的所有車輛進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證 (包括任何經修訂的許可證) 的最新資料。許可證持有人如交回許可證的部分或全部，必須把其送交署長的通知書，在備有原有許可證的各處相同地點展示。遭暫時吊銷、更改或取消的許可證必須從工程項目工地除下，不再展示。

 

1.6        The Permit Holder shall construct and operate and remove the Project in accordance with the project description in Part B of this Permit.

    許可證持有人須依據本許可證B部的工程項目說明，建造、營辦及拆除工程項目。

 

1.7        The Permit Holder shall ensure that the Project is designed, constructed, operated and removed in accordance with the information and all recommendations described in the EIA Report (Register No. AEIAR-060/2002), other relevant documents in the Register, the information and mitigation measures described in this Permit, mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under on going surveillance and monitoring activities during all stages of the Project.  Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目的設計、建造、營辦及拆除，按照下述資料及措施辦理：環評報告 (登記冊編號：AEIAR-060/2002) 所說明的資料及所有建議；登記冊內的其他相關文件；本許可證所說明的資料及緩解措施；根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施；以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或默示修訂。

 

1.8       All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any, made by the Director within one month of the receipt of the Director’s comments or otherwise as specified by the Director.

所有按本許可證規定存放的文件，須在接獲署長的意見 (如有者) 後1個月內 (除非署長另行指定)，根據署長的意見加以修正並再向署長提交。

 

1.9       All submissions approved by the Director, all submissions deposited without comments by the Director, and all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit.  Any variation of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499).  All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Conditions 2.1 and 2.2 below, before submitting to the Director under this Permit.

1.10     The Permit Holder shall release all finalized submissions as required under this Permit to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

       許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是把有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取署長指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的複本。

 

1.11     All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the Environmental Impact Assessment Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).  Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director, and shall be submitted at the same time as the hard copies.

      本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處 (現址為：香港灣仔軒尼詩道130號修頓中心27樓)。所有按本許可證規定提交的文件定稿的電子版本，均須以超文本標示語言 (HTML) (第4.0或較後版本) 和便攜式文件格式 (PDF) (第4.0或較後版本) 製作，除非另獲署長同意，並須與硬複本同時提交。

 

1.12     The Permit Holder shall notify the Director in writing the commencement date of construction of the Project at least 2 weeks prior to the commencement of construction of the Project.  The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

            許可證持有人須在工程項目的建造工程展開前，至少提早2個星期以書面方式把建造工程的施工日期通知署長。施工日期如有任何更改，許可證持有人必須立即以書面方式通知署長。

 

1.13      For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparations, or other works as agreed by the Director.

為執行本許可證，「工程項目的展開」不包括有關工地清理和預備的工程，或署長同意的其他工程。

 

2.         Special Conditions

特別條件

 

2.1               An ET shall be established by the Permit Holder no later than one month before commencement of construction of the Project.  The ET shall not be in any way an associated body of the Contractor or the IEC for the Project.  The ET shall be headed by an ET Leader.  The ET leader shall be a person who has at least 7 years' of experience in environmental monitoring and auditing (EM&A) or environmental management.  The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the requirements as contained in the EM&A Manual.  The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances which may affect the environmental impact assessment and each and every non-compliance with the recommendations of the EIA Report (Register No. AEIAR-060/2002) or this Permit.  This log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the EIA Report (Register No. AEIAR-060/2002) and this Permit or by the Director or his authorized officers.  Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader.  Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

在工程項目的建造工程展開前，許可證持有人須至少提早1個月成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核或環境管理方面至少有7年經驗。環境小組及環境小組組長須按環境監察及審核手冊內載的規定，實施環境監察及審核計劃。環境小組組長須保存一本記錄冊，同時記載可能會影響環境評估的每件事項、每種情況或每次情況的變化，以及每次不符合環評報告 (登記冊編號：AEIAR-060/2002) 的建議或本許可證的情況。存放這本記錄冊的地方，須可供協助督導執行環評報告 (登記冊編號：AEIAR-060/2002) 建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環境監察及審核手冊所列明的環境小組組長職務，或未能符合本條件的規定，署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補，或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄，或會導致許可證遭暫時吊銷、取消或更改。

 

2.2               An IEC shall be employed by the Permit Holder no later than one month before commencement of construction of the Project.  The IEC shall not be in any way an associated body of the Contractor or the ET for the Project.  The IEC shall be a person who has at least 7 years' of experience in EM&A or environmental management.  The IEC shall be responsible for duties defined in the EM&A Manual and shall audit the overall EM&A programme, including the implementation of all environmental mitigation measures, submissions required in the EM&A Manual, and any other submissions required under this Permit.  In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit.  The IEC shall verify the log-book(s) mentioned in condition 2.1 of this Permit.  The IEC shall notify the Director by fax, within 24 hours of each and every occurrence, change of circumstances or non-compliance with the EIA Report (Register No. AEIAR-060/2002) and this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project.  In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC.  Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation.  Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

在工程項目的建造工程展開前，許可證持有人須至少提早1個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環境監察及審核或環境管理方面至少有7年經驗。獨立環境查核人須執行環境監察及審核手冊所列明的職務，以及審核整體環境監察及審核計劃，包括實施所有環境緩解措施、提交環境監察及審核手冊規定的文件，以及提交本許可證所要求的其他文件。此外，獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件，並須核實本許可證條件第2.1項所述的記錄冊。在每次出現事故、情況變化或不符合環評報告 (登記冊編號：AEIAR-060/2002) 及本許可證的情況，而可能會妨礙工程項目所造成不良環境影響的監察或控制工作時，獨立環境查核人須在24小時內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況，未能執行環境監察及審核手冊所列明的獨立環境查核人職務，或未能符合本條件的規定，署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人，或在聘用新獨立環境查核人後仍未能通知署長有關情況，則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件，許可證持有人的通知等同獨立環境查核人的通知。

 

2.3               The Permit Holder shall, within one month after commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

許可證持有人須在工程項目的建造工程展開後1個月內，把主要建造公司及 / 或以任何形式與工程項目的建造工程相關的合營企業的管理架構，以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

Submissions For the Project

為工程項目提交的文件

 

2.4        At least two weeks before commencement of the establishment phase, the Permit Holder shall deposit with the Director 3 sets of drainage plan prepared for the Project.  The drainage plan shall include at least the locations and alignment of the drainage channels, the design details, implementation schedules and drawings in the scale of 1:1000 or other appropriate scale.  The drainage plan shall clearly show the existing drainage channels already constructed for the reclamation at Tseung Kwan O (TKO) Area 137 which shall remain in use; the existing drainage channels to be realigned; the new drainage system to be constructed including those at C&DMSF and site car parking areas; the intercepting channels equipped with sand and silt removal facilities; the temporary drainage facilities including earth bunds and sand bag barriers to allow polluted stormwater to be diverted to the drainage and intercepting channels; the designated outfalls; and their respective implementation schedules.  The drainage plan shall be certified by the ET leader and verified by the IEC as conforming to the requirements set out in Section 6.5 of the EIA Report before deposit.

在建設階段展開前，許可證持有人須至少提早2個星期向署長存放3份為工程項目擬備的排水計劃。排水計劃須至少包括排水渠的位置及線向、設計詳情、實施時間表及比例1:1000或其他合適比例的圖則，清楚顯示為將軍澳第137區的填海工程現已敷設並須保留使用的排水渠、需要重定線向的現有排水渠、需要建造的新排水系統，當中包括拆建物料分類設施及工地停車場的排水系統、裝有清除沙泥設施的截流渠、臨時排水設施包括使用土堤及沙包作屏障，引導受污染雨水到裝有清除沙泥設施的排水渠及截流渠、指定渠口，以及這些項目的實施時間表。排水計劃存放前須由環境小組組長核證及獨立環境查核人核實，證明符合環評報告第6.5節所載規定。

 

2.5        At least one month before the silt curtain to be provided by the fill bank Project at the outward side of the TKO basin near the barging point, the Permit Holder shall deposit with the Director 3 sets of the proposal on the provision of the silt curtain(s) for the Project.  The proposal shall include the location(s), design details of the silt curtain(s), and drawings in the scale of 1:1000 or other appropriate scale.  The proposal of the silt curtain(s) shall be certified by the ET leader and verified by the IEC before deposit. 

填料庫工程項目在將軍澳內灣外圍近躉船轉運站豎設淤泥屏障前，許可證持有人須至少提早1個月向署長存放3份為本工程項目豎設淤泥屏障的計劃書。計劃書須包括淤泥屏障的位置和設計詳情，以及比例1:1000或其他合適比例的圖則。淤泥屏障計劃書存放前須由環境小組組長核證及獨立環境查核人核實。

 

2.6        At least one month before commencement of the landscape works, the Permit Holder shall deposit with the Director 3 sets of the landscape plan prepared for the Project.  The landscape plan shall include the locations, design details, implementation schedules, and drawings in the scale of 1:1000 or other appropriate scale showing the landscape and visual mitigation measures.  The landscape plan shall be certified by the ET Leader and verified by the IEC as conforming to the requirements set out in Section 8.12 of the EIA Report before deposit.

 

展開景觀美化工程前，許可證持有人須至少提早1個月向署長存放3份為工程項目擬備的景觀美化計劃。景觀美化計劃須包括位置、設計詳情、實施時間表及比例1:1000或其他合適比例的圖則，顯示景觀及視覺緩解措施。景觀美化計劃存放前須由環境小組組長核證及獨立環境查核人核實，證明符合環評報告第8.12節所載規定。

 

Mitigation Measures To Be Provided During Establishment Phase, Operational Phase and Removal Phase

在建設、營辦及拆除階段須提供的緩解措施

 

2.7        All construction works shall be carried out during the non-restricted hours daily (i.e. 7:00 a.m. to 7:00 p.m. on weekdays other than general holidays).

所有建造工程不得在公眾假期任何時間內進行，及只可於每天的非限制時間內 (即每日上午7時至晚上7時內)進行。 

 

2.8A     The fill bank shall not be operated between 11:00 p.m. and 8:00 a.m. on the following day, except the following : (a) the Construction and Demolition Material Sorting Facility and the adjoining barging point; (b) delivery of public fill by barges and the transportation between north portion of stockpiling area and the barging points (three locations shown in Figure 2 of this Permit).  Except the Construction and Demolition Material Sorting Facility, the fill bank shall be closed during the Chinese New Year Holiday

填料庫不得在晚上11時至翌日上午8 時運作，以下設施除外：(a)拆建物料分類設施及毗連的躉船轉運站，(b)由躉船運走公眾填料及填料堆存區北部至躉船轉運站間填料運送 (三處地點顯示於本許可證圖2)。 除拆建物料分類設施外，填料庫須在農曆新年假期關閉。

 

2.8B   Additional 5 barging points and tipping halls and 6 Construction and Demolition Material Sorting Facilities shall be operated in area as shown in Figure 2 of this Permit. All facilities shall only be operated between 7:00 a.m. and 11:00 p.m. and no trucks movement between the stockpiling areas and the additional barging points shall be allowed between 7:00 a.m. and 8:00 a.m. The additional 5 barging points and tipping halls and 6 Construction and Demolition Material Sorting Facilities shall be closed during the Chinese New Year Holiday.

增加5座躉船轉運站及傾御大堂以及6個拆建物料分類設施在填料庫許可證圖2顯示地點內運作，全部設施只可在上午7 時至晚上11時運作，而運泥車在上午7 時至8時不得在儲泥區及新加的躉船轉運站之間行駛。以上5座躉船轉運站及傾御大堂以及6個拆建物料分類設施須在農曆新年假期關閉。

 

2.9      The temporary barging point at the existing Explosives Off-loading Barging Point (shown in Figure 2 of this Permit) shall not be operated for loading and unloading of public fill during 7:00 p.m. to 12:00 noon (Monday to Saturday) or any other periods when explosives are being handled at the Explosives Off-loading Barging Point.

設於炸藥卸載躉船轉運站的臨時躉船轉運站(地點顯示於許可證圖2)不得在星期一至星期六下午七時至正午十二時及炸藥卸載躉船轉運站處理炸藥的其他期間，裝卸公眾填料。

 

2.10      Site fencing of at least 2.4 m high shall be erected along the entire northern boundary of the site to separate Fat Tong Chau from the fill bank.

沿工地的整段北面界線須豎設至少2.4米高的圍欄，以分隔佛堂洲與填料庫。

 

2.11      No works shall be allowed within 10 m from the western boundary of the Clearwater Bay Country Park.

從清水灣郊野公園西面界線起10米範圍以內之填料庫工地，不得進行任何工程。

 

2.12      A buffer zone of at least 100 m shall be provided between the edge of the stockpiling area and the TVB Broadcast and Production Centre in the TKO Industrial Estate.  Only removal of public fill out of the buffer zone shall be allowed.

堆料區的邊緣須與將軍澳工業村內的無線電視廣播及製作中心保持至少100米的緩衝區。在緩衝區內，只可進行運走公眾填料的工作。

 

2.13      Truck speed within the site shall be limited to within 10 km per hour.

在工地內行駛泥頭車的速度須限於不超過每小時10公里。

 

2.14      No truckload drivers shall use the fill bank except those with a valid dumping licence during the operational and removal phases.

泥頭車司機不得進入填料庫，除非他們在營辦和拆除階段時持有有效的傾卸泥土牌照。

 

 

2.15      A marine based transportation route for public fill shall be provided at TKO Area 137 to allow public fill to be transported by barges to and from Area 137.  During the operation-removal overlapping phase (October 2003 to December 2018), delivery of public fill out of Area 137 shall all be by barges.

            須在將軍澳第137區提供一條以海路為主的公眾填料運送路線，以供躉船把公眾填料運往及運離第137區。在營辦和拆除階段的重疊期內 (二零零三年十月至二零一八年十二月)，第137區內的公眾填料須全部由躉船運走。

 

2.16      The fill bank shall not receive further public fill from 1st January 2019.

從二零一九年一月一日起，填料庫不得再接收額外的公眾填料。

 

2.17      The drainage works shall be constructed and implemented in accordance with the drainage plan deposited under Condition 2.4 above.

排水工程須按照上文條件第2.4項存放的排水計劃建造及實施。

 

2.18      All catchpits, sand and silt removal facilities, and the drainage and intercepting channels on site shall be properly maintained.

工地內所有集水井、清除沙泥設施、排水渠及截流渠須妥善維修保養。

 

2.19      The public fill stockpiling area shall be at least 100 m from the seafront.

公眾填料堆存區須與海旁相距至少100米。

 

2.20      The C&DMSF shall be at least 20m from the seafront.  Lighting provided at the C&DMSF and the associated barging point shall be directional down lighting to avoid light spill to surrounding areas.

拆建物料分類設施須與海旁相距至少20米。拆建物料分類設施及相關躉船轉運站的照明設備須為定向下射燈，避免光線散射四周。

 

2.21      The fill bank shall only store public fill.  No such materials as organic, soluble materials, dangerous or toxic materials, and floatable materials (e.g. bottles, plastic bags, foam boxes) shall be stockpiled at the fill bank.

填料庫只可貯存公眾填料。有機物、可溶解物料、危險或有毒物料和可浮水的物料 (例如水樽、膠袋和發泡膠盒等) 不得在填料庫堆存。

 

2.22      A wheel washing bay shall be provided at the site exit.

工地出口處須設置車輪清洗間。

 

2.23      Sewage from toilets shall be discharged into foul sewers.  Alternatively, chemical toilets or other sewage treatment and disposal facilities as approved by the Director shall be provided.

廁所污水須排放至污水渠。或按署長所批准，設置使用化學劑清理的廁所或其他污水處理及處置設施。

 

2.24      Wastewater collected from canteen kitchens, including that from basins, sinks and floor drains, shall be discharged into foul sewers via grease traps.  If no communal sewers can be provided, sewage generated from the workforce at the site offices shall be collected by septic tanks and removed by tankers.

由食堂廚房，包括洗滌盆、洗滌槽及地面排水渠收集的廢水須經隔油池過淨後才可排放到污水渠。如無敷設公用污水渠，則工地辦事處人員所產生的污水須由化糞池收集，並用缸車清除運走。

 

2.25      All marine vessels used for transportation of fill material shall be provided with tight fitting seals to their bottom openings to prevent leakage of material during transport.

用作運送填料的所有船隻，須密封及覆蓋低部孔口，以防止在運送期間漏出物料。

 

2.26      After the completion of the Contract “TKO Port Development at Area 137 Stage 2 – Construction of Seawalls and Reclamation”, the Permit Holder shall be required to provide silt curtains at the outward side of the TKO basin near the barging point throughout the operational phase when there is public fill intake by barges and throughout the removal phase when there is public fill delivered out by barges.  The silt curtains shall be constructed in accordance with the details deposited under Condition 2.5 above.  At the same time, a waste collection vessel shall be provided to remove floating debris on the sea around the fill bank.  When the barging point at the C&DMSF is in operation, a waste collection vessel shall also be provided to remove floating debris on the sea around the barging point.  The barging point at the C&DMSF should only be used for loading of sorted public fill free of refuse from the site to barges.  The temporary barging point located at the existing Explosives Off-loading Barging Point should only be used for loading 1 barge of public fill per day.  When the temporary barging point is in operation, a waste collection vessel shall be provided to remove floating debris on the sea around this barging point.

「將軍澳港口發展計劃第137區第2階段 － 建造海堤及填海工程」合約完成後，許可證持有人須在營辦階段 (躉船運入公眾填料) 及拆除階段 (躉船運離公眾填料) 的整段期間，在將軍澳內灣外圍近躉船轉運站豎設淤泥屏障。淤泥屏障須按照上文條件第2.5項存放的詳細資料豎設。與此同時，許可證持有人須使用廢料收集船清除填料庫附近海面的漂浮垃圾。在拆建物料分類設施的躉船轉運站運作期間，須使用廢料收集船清除躉船轉運站附近海面的漂浮垃圾。拆建物料分類設施的躉船轉運站只可作卸載來自工地經分類處理並不含垃圾的公眾填料至躉船之用。位於現時炸藥卸載躉船轉運站的臨時躉船轉運站只可用作每天卸載一隻躉船的公眾填料。在臨時躉船轉運站運作期間，須使用一隻廢料收集船清除躉船轉運站附近海面的漂浮垃圾。

 

2.27      Main site offices and site facilities shall be constructed outside the 250m Consultation Zone of the SENT Landfill.  In the case where an office or a facility is required to be set up at the site entrance and falls within the 250m Consultation Zone of the SENT Landfill, it shall be constructed on a raised hollow platform or on an area which has been proven to be gas free.  Ongoing monitoring shall be carried out to ensure these areas remain gas free.  “Gas free” condition in a mobile office is defined as the concentrations of the landfill gas parameters (methane, oxygen and carbon dioxide) to be within their target limits.    The target limits of each gas parameters are as follows: Methane:0.5%v/v (maximum); Carbon dioxide: 0.5%(maximum); and Oxygen: 19% (minimum).

主要的工地辦事處及工地設施須設於新界東南堆填區250米的諮詢區外。如需在工地入口處而亦在新界東南堆填區250米的諮詢區內設立辦事處或設施，則須建造升高的空心平台支承，或設於經證實不含氣體的地方。此外，須進行持續的監測工作，確保這些地方維持不含氣體。流動辦事處的「不含氣體」狀態界定為堆填區沼氣參數 (甲烷、氧氣及二氧化碳) 的含量不超出目標限值。各沼氣參數的目標限值分別為：甲烷：0.5% 容量 / 容量 (上限)；二氧化碳：0.5% (上限)；以及氧氣：19%(下限)。

 

2.28      No underground drainage and sewerage system including underground pipelines and chambers shall be constructed within the 250m Consultation Zone of the SENT Landfill.

在新界東南堆填區250米的諮詢區內不得建造地下排水和排污系統，包括地下管道和地下室。

2.29      Access by the general public to the fill bank site shall be restricted.

填料庫工地不准公眾人士進出。

 

 

2.30      During the construction of the drainage works or undertaking of other construction activities, should there be any sign of leachate-contaminated groundwater being detected, the SENT Landfill operator shall be informed to collect the leachate-contaminated groundwater and transfer them back to the sewage treatment works of the SENT Landfill for treatment by the SENT Landfill operator.

在排水工程的建造或其他建造活動進行期間，如發現任何滲濾污染地下水的現象，須通知新界東南堆填區的營運者，來收集滲濾污染地下水，並運回堆填區的污水處理設施處理。

 

2.31      The maximum stockpiling height at the fill bank shall be limited to a maximum of +35.2 mPD.

填料庫堆存物料的高度不得超出主水平基準以上35.2米。

 

2.32      During the operational and removal phases, the Permit Holder shall implement the landscape and visual mitigation measures in accordance with the landscape plan deposited under Condition 2.6 above.  The Permit Holder shall then deposit with the Director 3 copies of the audit report, certified by the ET Leader and verified by the IEC, demonstrating the satisfactory completion of the landscape and visual mitigation measures.  The audit report shall be deposited within 2 weeks after completion of the measures.

在營辦和拆除階段，許可證持有人須按照上文條件第2.6項存放的景觀美化計劃，實施景觀及視覺緩解措施。許可證持有人須向署長存放3份由環境小組組長核證及獨立環境查核人核實的審核報告，顯示景觀及視覺緩解措施已經完成。審核報告須於措施完成後2個星期內存放。

 

 3.        Environmental Monitoring and Audit

環境監察及審核

 

3.1               The EM&A programme shall be implemented in accordance with the procedures and requirements in the EM&A Manual of the approved EIA report (Register No. AEIAR-060/2002).  Any changes to the EM&A programme shall be justified by the ET Leader and verified by the IEC as conforming to the requirements set out in the EM&A Manual and shall seek the prior approval from the Director before their implementation.

許可證持有人須按照已核准的環評報告 (登記冊編號：AEIAR-060/2002) 內的環境監察及審核手冊的程序及規定，執行環境監察及審核計劃。計劃如有任何更改，須由環境小組組長提出充分理由，並由獨立環境查核人核實，證明其符合環境監察及審核手冊所載規定，並在實施前先徵得署長的批准。

 

3.2               Water quality survey/monitoring shall be conducted at control station C1a (location revised to 845647E, 814146N), monitoring stations M4a and M5 (locations shown in Figure 3) for the period from two weeks before commencement of operation of the additional 5 barging points to 4 weeks after cessation of their operation.  The water quality survey/monitoring frequency and parameters at stations C1a, M4a and M5 shall be same as the requirements set out in the EM&A Manual and the monitoring results shall be incorporated in the monthly EM&A reports.

在增加5座躉船轉運站開始運作前2星期至停止運作後4星期期間內，須在圖3所示的對照站C1a (重新定位至坐標東845647, 坐標北814146)，監察站M4a及M5站進行水質調查／監察。在C1a，M4a及M5站進行水質調查／監察的頻率和參數一如環境監察及審核手冊的規定，監察結果則納入每月的環境監察及審核報告內。

 

3.3              The Permit Holder shall submit two hard copies and one electronic copy of the Baseline Monitoring Report to the Director at least 2 weeks before commencement of construction of the Project.  The submissions shall be certified by the ET Leader and verified by the IEC before submission to the Director.  Additional copies of the submission shall be provided upon request by the Director.

在工程項目的建造工程展開前，許可證持有人須至少提早2個星期向署長提交基線監測報告的2份硬複本及1份電子版本。文件提交署長前須由環境小組組長核證及獨立環境查核人核實。如署長要求，則須把提交文件的額外複本送交署長。

 

3.4               The Permit Holder shall submit two hard copies and one electronic copy of the monthly EM&A Report to the Director within 2 weeks after the end of the reporting month.  The submissions shall be certified by the ET Leader and verified by the IEC before submission to the Director.  Additional copies of the submission shall be provided upon request by the Director.

在規定提交報告的月份結束後2個星期內，許可證持有人須向署長提交每月環境監察及審核報告的2份硬複本及1份電子版本。文件提交署長前須由環境小組組長核證及獨立環境查核人核實。如署長要求，則須把提交文件的額外複本送交署長。

 

3.5               The actions described in the Event /Action Plans of the EM&A Manual shall be fully and properly carried out in accordance with the time frame as set out in the Event/Action Plans, or as agreed by the Director.

許可證持有人須按照環境監察及審核手冊內的事件 / 行動計劃所訂明的時限或如署長所同意的時限，徹底及妥善執行事件 / 行動計劃所說明的行動。

 

3.6               All environmental monitoring and audit data submitted under this Permit shall be true, valid and correct.

根據本許可證提交的所有環境監察及審核數據，均須有效及真實無誤。

 

 

4.                  Electronic Reporting of EM&A Information

環境監察及審核資料的電子匯報

 

4.1               To facilitate public inspection of the EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in the Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 4.0 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Conditions 3.2 and 3.3 of this Permit.  For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document.  Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made.  All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director. The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站及在環境影響評估條例登記冊辦事處查閱環境監察及審核報告，以超文本標示語言 (HTML) (第4.0或較後版本) 及便攜式文件格式 (PDF) (第4.0或較後版本) 製作的報告的電子版本，除非另獲署長同意，須與本許可證條件第3.2及3.3項所說明的硬複本同時提交。關於HTML的版本方面，可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意，報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容，必須與硬複本的內容一致。

1.                   This Permit consists of three parts, namely, Part A (Main Permit), Part B (Description of Designated Project) and Part C (Permit Conditions).  Any person relying on this permit should obtain independent legal advice on the legal implications under the Ordinance, and the following notes are for general information only.

本許可證共有3部，即A部 (許可證主要部分)；B部 (指定工程項目的說明) 及C部 (許可證條件)。任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。

 

2.         If there is a breach of any conditions of this Permit, the Director or his authorized officer may, with the consent of the Secretary for the Environment order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

如違反本許可證的任何條件，署長或獲授權人員徵得環境局局長的同意後可勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。

 

3.         The Permit Holder may apply under Section 13 of the Environmental Impact Assessment Ordinance (the “Ordinance”) to the Director for a variation of the conditions of this Permit.  The Permit Holder shall replace the original permit displayed on the Project site by the amended permit.

許可證持有人可根據環境影響評估條例 (“條例”) 第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。

 

4.         A person who assumes the responsibility for the whole or a part of the Project may, before he assumes responsibility of the Project, apply under Section 12 of the Ordinance to the Director for a further environmental permit.

承擔工程項目整項或部分工程的責任的人，在承擔責任之前，可根據條例第12條的規定向署長申請新的環境許可證。

 

5.      Under Section 14 of the Ordinance, the Director may with the consent of the Secretary for the Environment suspend, vary or cancel this Permit.  The suspended, varied or cancelled Permit shall be removed from display at the Project site.

根據條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的環境許可證必須從工程項目工地除下，不再展示。

 

 6.        If this Permit is cancelled or surrendered during construction or operation or decommission of the Project, another environmental permit must be obtained under the Ordinance before the Project could be continued.  It is an offence under Section 26(1) of the Ordinance to construct or operate or decommission a designated project listed in Schedule 2 of the Ordinance without a valid environmental permit.

如果本許可證在工程項目建造或營辦或解除運作期間取消或交回，則在繼續進行工程項目之前，必須先根據條例規定取得另一份環境許可證。根據條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦條例附表2所列明的指定工程項目或解除其運作，即屬犯罪。

 

7.         Any person who constructs or operates or decommissions the Project contrary to the conditions in the Permit, and is convicted of an offence under the Ordinance, is liable: -

如任何人在違反本許可證的條件下建造工程項目或營辦工程項目或解除工程項目的運作，根據環評條例，即屬犯罪—

 

(i)         on a first conviction on indictment to a fine of $2 million and to imprisonment for 6 months;

一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；

 

(ii)        on a second or subsequent conviction on indictment to a fine of $5 million and to imprisonment for 2 years;

一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；

 

 

(iii)               on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；

 

(iv)       on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；及

 

(v)        in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied the offence continued.

在任何情況下如該罪行屬連續性質，法院或裁判官可就其信納該罪行連續的每一天另處罰款10,000元。

 

8.         The Permit Holder may appeal against any condition of this Permit under Section 17 of the Ordinance within 30 days of receipt of this Permit.

許可證持有人可在接獲本許可證後30天內，根據條例第17條就本許可證的任何條件提出上訴。

 

9.                   The Notes are for general reference only and that the Permit Holder should refer to the EIA Ordinance for details and seek independent legal advice.

上述註解只供一般參考用，欲知有關詳情，許可證持有人須參閱環評條例及徵詢獨立法律意見。

 

10.        Occupational safety and health issues are governed by the Occupational Safety and Health Ordinance (Cap. 509), and Factories and Industrial Undertakings Ordinance (Cap. 59).  The Permit Holder is advised to contact the Labour Department for requirements relating to occupational safety and health issues.

職業安全及健康事宜，受職業安全及健康條例 (第509章) 和工廠及工業經營條例 (第59章) 所規管。有關職業安全及健康事宜的規定，許可證持有人宜聯絡勞工處。
