Pursuant
to Section 10 of the Environmental Impact Assessment Ordinance (the EIAO), the
Director of Environmental Protection (the Director) grants the Environmental Permit No. EP-005/1998 to the HIGHWAYS DEPARTMENT (hereinafter
referred to as the “Permit Holder”) on 18 September 1998. Pursuant to Section 13 of the EIAO, the Director
amends the Environmental Permit (No. VEP-016/2000/A/EP-005) based on the
Application No. VEP-476/2015. The amendments, described below, are
incorporated into this Environmental Permit (No. EP-005/1998/B). This Environmental Permit as amended is for the
construction and operation of the designated project described in Part B subject to the conditions specified in Part
C. The
issue of this environmental permit is based on the documents, approvals or
permissions described below:
根據《環境影響評估條例》(環評條例) 第10條的規定﹐
環境保護署署長 (署長) 於一九九八年九月十八日將環境許可證批予路政署
(下稱＂許可證持有人＂) ，根據條例第13條的規定，署長因應申請書編號 VEP-476/2015 修訂環境許可證編號
VEP-016/2000/A/EP-005。下文說明的修訂，已包含在本環境許可證內(EP-005/1998/B)。本經修訂的環境許可證，適用於建造及營辦Ｂ部所說明的指定工程項目，但須遵守Ｃ部所列明的條件。本環境許可證是依據下列文件、批准或許可而簽發﹕-

PART C (PERMIT CONDITIONS)
C部 (許可證條件)
1. General
Conditions
一般條件
1.1 The
Permit Holder shall ensure full compliance with all conditions of this
environmental permit. Any
non-compliance may constitute a contravention of the EIAO and may become
subject of appropriate action being taken under the Ordinance.
許可證持有人必須確保完全符合本環境許可證的全部條件。 如有不符合本許可證的情況，可能構成違反環境影響評估條例的規定，而當局可根據條例採取適當行動。
1.2
The Permit Holder shall ensure full
compliance with all legislation from time to time in force including without
limitation to the Noise
Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water
Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466) and
Waste Disposal Ordinance (Cap. 354).
This Permit does not of itself constitute any ground of defense against
any proceedings instituted under any legislation or imply any approval under any legislation.
許可證持有人須時常確保完全符合現行法例的規定，例如：噪音管制條例(第400章)；空氣污染管制條例(第311章)；水污染管制條例(第358章)；海上傾倒物料條例(第466章) 及廢物處置條例(第354章)。 本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由，或根據任何法例默示任何批准。
1.3
The Permit Holder shall make copies of
this Permit together with all documents referred to in this Permit or the
documents referred to in Part A of the Permit readily
available at all times for inspection by the Director or his authorized
officers at all sites/offices covered by this Permit. Any reference to the Permit shall
include all documents referred to in the Permit and also the relevant documents
in the Register.
許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件或本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地／辦事處查閱。
凡提述本許可證，須包括本許可證所述的所有文件和登記冊內的相關文件。
1.4
The Permit Holder shall give a copy of
this Permit to the person(s) in charge of the site(s) and ensure that
such person(s) fully understands all conditions and all requirements
incorporated by the Permit. The site(s)
refers to site(s) of construction of the Project and shall mean the same
hereafter.
許可證持有人須將本許可證的一份複本交予有關工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指建造工程項目的工地，下文所提及的工地亦屬同一意思。
1.5
The Permit Holder shall display conspicuously
a copy of this Permit on the Project site(s) at all vehicular site entrances/exits
or at a convenient location for public’s information at all times. The Permit Holder shall ensure that the
most updated information about the Permit, including any amended permit, is
displayed at such locations. If the
Permit Holder surrenders a part or the whole of the Permit, the notice he sends
to the Director shall also be displayed at the same locations as the original
Permit. The suspended, varied or
cancelled Permit shall be removed from display at the Project site(s).
許可證持有人須在工程項目的工地的所有車輛進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。 許可證持有人須確保在這些地點展示關於本許可證(包括任何經修訂的許可證)的最新資料。許可證持有人如交回許可證的部分或全部，必須將其送交署長的通知書，在備有原本許可證的相同地點展示。 遭暫時吊銷、更改或取消的許可證必須在從工程項目的工地除下，不再展示。
1.6
The Permit Holder shall construct and
operate the Project in accordance with the project description in Part B of this Permit.
許可證持有人須依據本許可證B部的工程項目說明，建造及營辦工程項目。
1.7
The Permit Holder shall ensure that the
Project is designed, constructed and operated in accordance with the
information and recommendations described in the EIA Report (Register No.
EIA-110/BC); the application documents including all attachments for
Environmental Permit (Application No. AEP-005/1998), the application documents including all
attachments for variation of Environmental Permits (Application No. VEP-016/2000 and Application No. VEP-476/2015), other relevant documents in the
Register; and the information or mitigation measures described in this Permit,
or mitigation measures to be recommended in submissions that shall be deposited
with or approved by the Director as a result of permit conditions contained in
this Permit, or mitigation measures to be recommended under on going
surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the
documents of the Register are not expressly referred to in this Permit, such
recommendations are nevertheless to be implemented unless expressly excluded or
amended in this Permit.
許可證持有人須確保工程項目的設計、建造及營辦，按照下述資料及措施辦理：環評報告(登記冊編號：EIA-110/BC)內載的資料和建議；環境許可證申請文件包括所有附件(申請書編號: AEP-005/1998)所說明的資料及所有建議；所有更改環境許可證申請文件包括所有附件(申請書編號: VEP-016/2000及申請書編號: VEP-476/2015) 所說明的資料及所有建議；登記冊內的其他相關文件；及本許可證所說明的資料或緩解措施，或根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施；或在工程項目各階段進行的持續監察和監測工作所建議的緩解措施。
如登記冊文件所述建議沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或修訂。
1.8
All deposited submissions as required
under this Permit, shall be rectified and resubmitted in accordance with the
comments, if any, made by the Director, within one month of the receipt of the
Director’s comments or otherwise specified by the Director.
所有按本許可證規定存放的文件，須在接獲署長的意見(如有者)後一個月內(除非署長另行指定)，根據署長的意見加以修正並再向署長提交。
1.9
All submissions approved by the
Director, all submissions deposited without comments by the Director, or all
submissions rectified in accordance with comments by the Director under this
Permit shall be construed as part of the permit conditions described in Part C of this Permit.
Any variation of the submissions shall be approved by the Director in
writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions
may constitute a contravention of the EIAO.
署長批准的所有提交文件、署長沒有給予意見的所有存放文件，或根據本許可證規定由署長給予意見修訂的所有提交文件，均須詮釋為本許可證C部說明的許可證條件的一部分。
提交文件如有任何修訂，均須獲署長的書面批准或符合有關許可證條件訂明的規定。 如有不符合提交文件的情況，可能構成違反環境影響評估條例的規定。
1.10
The Permit Holder shall release all
finalized submissions, as required under this Permit, to the public by
depositing copies in the Environmental Impact Assessment Ordinance Register
Office, or in any other places, or any internet websites as specified by the
Director, or by any other means as specified by the Director for public
inspection. For this purpose, the
Permit Holder shall provide sufficient copies of the submissions.
許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是將有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或採取其指定的任何其他方法，以供公眾查閱。 因此，許可證持有人須提供足夠數量的複本。
1.11
All submissions to the Director required
under this Permit shall be delivered either in person or by registered mail to
the Environmental Impact Assessment Ordinance Register Office (currently at
27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).
本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處(現址為香港灣仔軒尼詩道130號修頓中心27樓)。
2. Submissions
or Measures before Commencement of Construction
展開建造工程前提交的文件或採取的措施
2.1 The
Permit Holder shall employ an Independent Environmental Checker before the
commencement of construction of the Project. The Independent Environmental Checker
shall have at least 7 years experience in environmental monitoring and auditing
or environmental management. The
Independent Environmental Checker shall verify the overall environmental
performance of the Project, including all the implementation of environmental
mitigation measures, submissions relating to environmental monitoring and
auditing, and any other submissions required under this permit.
在展開建造工程之前，許可證持有人須聘用一名獨立環境查核人。 該名獨立環境查核人須在環境管理或環境監察及審核方面至少有7年經驗。 獨立環境查核人須核證工程項目的整體環境表現，包括實施環境緩解措施、提交與環境監察及審核有關的文件、以及提交本許可證所要求的任何其他文件。
2.2 An Environmental Team
shall be established before the commencement of construction of the
Project. The Environmental Team
shall be headed by a team leader who has at least 7 years experience in
environmental monitoring and auditing or environmental management.
在展開建造工程之前，須先設立一個環境小組。 該環境小組須由一名在環境管理或環境監察及審核方面至少有7年經驗的組長帶領。
2.3
The Permit Holder shall deposit with the Director 3
sets of 1 to 1000 scale design drawings showing the locations and details of
the noise barriers, i.e. about (i) 374m of 3m high plain barriers, (ii) 199m of 3m high inverted-L barriers
with an inclined panel of 0.9m in length, and (iii) 301m of 3m high inverted-L barriers with an inclined panel of 1.3m
in length before the commencement of construction of the relevant sections of
the Project. Before submission, the
design drawings shall be verified by the Independent Environmental
Checker. Additional copies of the
design drawings may be required by the Director. The design of the noise barriers shall
also follow the attached Figures No.3 and 4 of this
Permit and
incorporating the following features into the design:-
(a) variety in
the height in the panel sections of the barriers with a staggered upper and
lower line;
(b) variety in the widths of the panel sections
interchanged in sequence;
(c) variety in the size of the solid and clear
vision panels to reduce the uniformity of the appearance; and
(d)
ribbed finish to the solid panels, in alternating
directions, in a range of four colors to blend in with the color tones and
textures of the surrounding roadside landscape and mitigation planting
proposals.
在展開工程項目各有關部分的建造工程之前，許可證持有人須向署長提交3套1:1000比例的設計圖則，顯示隔聲屏障（即約 (i) 374米長的3米高普通屏障；(ii)
199米長的3米高倒L型屏障，連同0.9米長的傾斜擋板; (iii) 301米長的3米高倒L型屏障，連同1.3米長的傾斜擋板）的地點及詳情，以待批准。
在提交之前，設計圖則須經由獨立環境查核人核證。 署長可要求設計圖則的額外副本。 隔聲屏障的設計須遵照本許可證附圖3及4，並在其設計加入以下特點：
(a) 屏障擋板部分高度不一，高低排交錯；
(b) 擋板部分闊度不一，逐一交替；
(c) 實心的透明擋板大小不一，以免外觀單調；及
(d) 以肋構裝飾的四色實心擋板，用交錯方向的方式排列，並與周圍路邊景觀美化及裁種植物的緩解措施建議的色調及特質配合。
2.4 The Permit Holder shall
deposit with the Director 3 sets of 1 to 1000 scale layout drawings showing the
following landscape and visual mitigation measures before the commencement of
construction of the relevant sections of the Project. Before submission, the layout drawings
shall be verified by the Independent Environmental Checker. Additional copies of the layout drawings
may be required by the Director.
(a) the alignments and configurations of all new
carriageways, drainage channels and footpaths to be refined to minimize
potential visual and landscape impacts;
(b) the light shield/recessed flat light to be
adopted on street lighting system along the carriageways;
(c) the bridge decks, abutments, pedestrian underpasses,
retaining walls, noise barriers, and the hard landscaping of pedestrian areas
adjacent to the carriageways to be architecturally treated;
(d) the engineered slopes to be trimmed to blend into adjacent natural slope profiles.
在展開工程項目各有關部分的建造工程之前，許可證持有人須向署長存放以下文件：3套1:1000比例的設計規劃圖則，顯示下列的景觀美化及視覺緩解措施。 在提交之前，設計規劃圖則須經由獨立環境查核人核證。
署長可要求設計規劃圖則的額外副本。
(a) 所有新行車道的路線及排列、須改善的排水道及行人路，以盡量減少對視覺及景觀美化可能造成的影響；
(b) 行車道一帶街燈系統所採用的燈罩/凹入式平面電燈；
(c) 橋面、橋墩、行人隧道、護土牆、隔聲屏障及經建築處理的行車道附近行人範圍的嚴格景觀美化；
(d) 設計的斜坡整平後會與附近天然斜坡的外形融合。
2.5 The Permit Holder shall conduct a survey of the Project site area to determine and map the distribution and abundance of the existing vegetation types, to locate trees and other vegetation which should be retained, transplanted or replanted. The Permit Holder shall submit for the approval of the Director the survey report and 3 sets of 1 to 1000 scale layout drawings, showing existing vegetation to be retained and methods of protecting those vegetation from being damaged by any construction activities, the areas to be re-vegetated and planted within the Project site area, and the programme for their implementation before the commencement of construction of the relevant sections of the Project. Before submission, the survey report and the layout drawings shall be verified by the Independent Environmental Checker as conforming to the information and recommendations contained in the EIA report. Additional copies of the survey report and the layout drawings may be required by the Director.
在展開工程項目各有關部分的建造工程之前，許可證持有人須進行一項工程項目工地範圍調查，以確定及測繪各類現有植物的分布及數量，以及指出應予保存、移植或再植的樹木及其他植物的地點。
許可證持有人須向署長提交以下文件以待批准：調查報告及3套1:1000比例的設計規劃圖則，顯示擬保留的植物及保護植物免受任何建造作業活動損毀的方法、工程項目工地範圍以內擬再植及栽種樹木的地點，以及其實施計劃。

2.6 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale layout drawings showing the Woodland Mix (including Endospermum chinense in the compensating replanting) to be planted to all cut and embankment slopes and to other open areas within the Project site area; additional trees to be planted alongside the new carriageways and along the existing roads within the Project site area; as well as ornamental shrub to be planted in pedestrian areas before the commencement of construction of the Project. Before submission, the layout drawings shall be verified by the Independent Environmental Checker as conforming to the information and recommendations contained in the EIA report. Additional copies of the layout drawings may be required by the Director.
在展開工程項目的建造工程之前，許可證持有人須向署長存放以下文件：3套1:1000比例的設計規劃圖則，顯示所有切削及路堤斜坡，以及工程項目工地範圍內的其他露天地方，均種植不同林木(補償性再種植的包括黃桐)；在工程項目工地範圍內的新行車道及現有道路兩旁種植額外的樹木；以及行人區則種植裝飾的灌木。

2.7 3 sets of 1 to 1000 scale layout drawings showing the oil/grit separators to be used during the operational phase shall be deposited with the Director before the commencement of operation of the Project. Before submission, the layout drawings shall be verified by the Independent Environmental Checker as conforming to the information and recommendations contained in the EIA Report. Additional copies of the layout drawings may be required by the Director.
在展開工程項目的營運之前，須向署長提交以下文件：3套1:1000比例的設計規劃圖則，顯示營運期期間擬使用的油類/砂礫分隔器。 在提交之前，設計規劃圖則須經由獨立環境查核人核證其符合環評報告所載的資料及建議。 署長可要求設計規劃圖則的額外副本。
3. Submissions
or Measures during the Construction Period
建造工程期間提交的文件或採取的措施
3.1 3 sets of 1 to 1000 scale
layout plans showing the noise mitigation measures to be adopted during
construction in relevant sections of the Project shall be deposited with the
Director before the commencement of the construction of the corresponding
sections of the Project. Before
submission, the layout plans shall be verified by the Independent Environmental
Checker as conforming to the information and recommendations contained in
section 2.6.1 of the EIA report.
Additional copies of the layout plans may be required by the Director.
在展開工程項目各有關部分的建造工程之前，須向署長存放以下文件：3套1:1000比例的設計規劃圖則，顯示於工程項目各相應部分進行建造工程期間擬採用的噪音緩解措施。
在提交之前，設計規劃圖則須經由獨立環境查核人核證其符合環評報告中第2.6.1條所載的資料及建議。 署長可要求設計規劃圖則的額外副本。
3.2 A desilting facility to prevent debris settlement in the
existing streams and channels shall be provided.
須設置清除淤泥設施，防止瓦礫碎屑沉積在現有的河溪及水道中。
3.3 Foul
water effluent shall be directed to a foul sewer or to a sewage treatment
facility.
污水須引入污水渠或污水處理設施。
3.4 All design and construction mitigation measures described in the submissions approved or deposited under Section 2 above and Condition 3.1 above shall be properly constructed and implemented. Any changes to the measures shall be verified by the Independent Environmental Checker as complying with the environmental performance requirements contained in the EIA Report before implementation. The verified changes shall be documented in the immediately following monthly EM&A report.
根據上列第2條及條件第3.1項所批准或存放的文件中所載述的所有設計及建造緩解措施，均須妥善地建造及執行。
有關措施如有任何更改，須經由獨立環境查核人核證其符合環評報告所載的環境表現規定，方可實行。 經核證的更改須立即在下一個月的環境監察及審核報告中載錄。
4. Environmental
Monitoring and Audit
環境監察及審核
4.1 The EM&A programme shall be implemented as set out in the EM&A
Manual of the EIA Report. Any
changes to the programme shall be justified by the
Independent Environmental Checker as conforming to the requirements set out in
the EM&A Manual of the EIA Report before submission to the Director for
approval.
環境監察及審核計劃須根據環評報告的環境監察及審核手冊所載而實行。 計劃若要作出任何更改，必須具備充分理由，經由獨立環境查核人核證其符合環評報告的環境監察及審核手冊訂明的規定，然後提交署長批准。
4.2 Samples and measurements for noise, air quality and landscape and replanting works monitoring shall be taken in accordance with the requirements of the EM&A Manual of the EIA Report by:
(a)
conducting baseline noise and air quality monitoring
at the specified locations and frequencies;
(b) conducting
impact monitoring on noise and air quality at the specified locations and
frequencies;
(c) conducting
monitoring on landscape and replanting works in accordance with sections 4 and
5 of the EM&A Manual of the EIA Report;
(d) in
cases where specified criteria in the EM&A Manual are exceeded, carrying
out remedial actions in accordance with the Event/Action Plan, as set out in
the EM&A Manual; and
(e) logging
and keeping records of the details of (a) to (c) above, within 3 working days
of the collection of data or completion of remedial action, for the purposes of
preparing and submitting the EM&A Reports and to make available the
information for inspection on site.
噪音、空氣質素、景觀美化及重新種植工程的樣本和量度結果，須按照環評報告的環境監察及審核手冊的規定抽取或進行：
(a)
在指定地點進行指定次數的噪音及空氣質素基線監測；
(b) 在指定地點進行指定次數的噪音及空氣質素影響監測；
(c) 根據環評報告的環境監察及審核手冊第4及5條，對景觀美化及重新種植工程進行監測；

4.3 5 copies of the Baseline Monitoring Report verified by the Independent Environmental Checker shall be submitted to the Director before the commencement of any major construction works that would affect the monitoring results. Additional copies of the Baseline Monitoring Report may be required by the Director.
在展開任何會影響監測結果的大型建造工程之前，須向署長提交5份經獨立環境查核人核證的基線監測報告。
署長可要求基線監測報告的額外副本。
4.4 5 copies of monthly EM&A Report verified by the Independent Environmental Checker shall be submitted to the Director within 10 working days from the end of the reporting month. Additional copies of the monthly EM&A Report may be required by the Director.
在須提交報告月的後10個工作天內，須向署長提交5份經獨立環境查核人核證的每月環境監察及審核報告。
署長可要求每月環境監察及審核報告的額外副本。
4.5 The actions described in the Event/Action Plans of the EM&A Manual shall be properly carried out, in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director.
環境監察及審核手冊的事故/行動計劃所載的行動，必須按照事故/行動計劃所訂明的時限或署長同意的時限，妥善執行。

Permit consists of three parts, namely, PART A (Main
Permit), PART B (Description of Designated Project) and PART C (Permit Conditions). Any person relying on this permit should
obtain independent legal advice on the legal implications under the Ordinance,
and that the following notes are for general information only.
本許可證共有3部，即：A部（許可證主要部分）；B部（指定工程項目的說明）；及C部（許可證條件）。
任何援引本許可證的人士須就條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。
2. If
there is a breach of any conditions of this Permit, the Director or his
authorized officer may, with the consent of the Secretary for the Environment,
order the cessation of associated work until the remedial action is taken in
respect of the resultant environmental damage, and in that case the Permit
Holder shall not carry out any associated works without the permission of the
Director or his authorized officer.
如違反本許可證的任何條件，署長或獲授權人員可在環境局局長的同意下勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。
3. The
Permit Holder may apply under Section 13 of the Ordinance to the Director for a
variation of the conditions of this Permit. The Permit Holder shall replace the
original permit displayed on the construction site by the amended permit.
許可證持有人可根據條例第13條的規定向署長申請更改本許可證的條件。
許可證持有人須將經修改的許可證，替換在建造工地內展示的原有許可證。
4. A
person who assumes the responsibility for the whole or a part of the designated
project may, before he assumes responsibility of the designated project, apply
under Section 12 of the Ordinance to the Director for a further environmental
permit.
承擔指定工程項目的整項或部分工程的責任的人，在承擔指定工程項目責任之前，可根據條例第12條的規定向署長申請新的環境許可證。
5. Under
Section 14 of the Ordinance, the Director may with the consent of the Secretary
for the Environment suspend, vary or cancel this Permit. The suspended, varied or cancelled
Permit shall be removed from display at the construction site.
根據條例第14條的規定，署長可在環境局局長的同意下暫時吊銷、更改或取消環境許可證。
遭暫時吊銷、更改或取消的許可證必須從建造工地除下，不再展示。
6. If
this Permit is cancelled or surrendered during construction or operation of the
Project, another environmental permit must be obtained under the Ordinance
before the construction or operation of the Project could be continued. It is an offence under Section 26(1) of
the Ordinance to construct or operate a designated project listed in Part I of
Schedule 2 of the Ordinance without a valid environmental permit.
如果本許可證在工程項目建造或營辦期間取消或交回，則在繼續建造或營辦工程項目之前，必須先根據條例規定取得另一份環境許可證。 根據條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦條例附表2第I部所列明的指定工程項目，即屬犯罪。
7. Any
person who constructs or operates the Project contrary to the conditions in the
Permit, and is convicted of an offence under the Ordinance, is liable: -
(i) on a first
conviction on indictment to a fine of $2,000,000 and to imprisonment for
6 months;
(ii) on a second or
subsequent conviction on indictment to a fine of $5,000,000 and to imprisonment
for 2 years;
(iii) on
a first summary conviction to a fine at level 6 and to imprisonment for 6
months;
(iv) on
a second or subsequent summary conviction to a fine of $1,000,000 and to
imprisonment for 1 year; and
(v) in any case where
the offence is of a continuing nature, the court or magistrate may impose a
fine of $ 10,000 for each day on which he is satisfied the offence continued.
如任何人在違反本許可證的條件下建造及營辦工程項目，根據環評條例，即屬犯罪:
(i)
一經循公訴程序首次定罪，可處罰款$2,000,000及監禁6個月；
(ii) 一經循公訴程序第二次或其後每次定罪，可處罰款$5,000,000及監禁2年；
(iii) 一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；
(iv) 一經循簡易程序第二次或其後每次定罪，可處罰款$1,000,000及監禁1年；及
(v) 在任何情況下如該罪行屬持續性質，則法院或裁判官可就其信納該罪行持續的每一天另處罰款$10,000。
8. The
Permit Holder may appeal against any condition of this Permit under Section 17
of the Ordinance within 30 days of receipt of this Permit.
許可證持有人可在接獲本許可證後30天內，根據條例第17條就本許可證的任何條件提出上訴。
9. The Notes are for
general reference only and that the Permit Holder should refer to the EIA
Ordinance for details and seek independent legal advice.
