Pursuant to Section 10 of the Environmental Impact
Assessment Ordinance (the Ordinance), the Director of Environmental Protection
(the Director) granted the Environmental Permit No. EP-009/1998 to the Highways
Department (the “Permit Holder”) on
根據環境影響評估條例(「條例」)第10條的規定,環境保護署署長(「署長」)於1998年 11月 24日將環境許可證編號 EP-009/1998 批予路政署(「許可證持有人」)。根據條例第 13條的規定,署長因應申請書編號 VEP-534/2017 修訂環境許可證編號 EP-009/1998/H。下文說明的修訂,已包含在本環境許可證內 (編號EP-009/1998/I)。本經修訂的環境許可證,適用於建造及營辦本許可證 B 部所說明的指定工程項目,但須遵守本許可證 C 部所列明及附載的條件。

the designated project mentioned in Part A of this
environmental permit:

Highway between Island House Interchange and Ma Liu Shui
Interchange, and improvements to the existing road curves of this section of
the Highway; (b) associated reclamation
and construction of seawall; (c) extension of existing
vehicular bridges and pedestrian/cyclist subways; (d) providing
a CCTV system and emergency telephone system along the same
section of the Highway; (e) widening of existing
cycle track along the same section of the Highway from 4.4 metres to 6.0 metres and
providing a 2.5-metre wide footpath on the seaward side of the cycle track; (f) reprovisioning of affected facilities in Chinese
University of Hong Kong; and (g)
ancillary works on road resurfacing, drainage, road
lighting, environmental mitigation, landscape, traffic signs and
pedestrian/cyclist facilities. |
1. General Conditions
1.1 The Permit Holder shall ensure full compliance with all conditions of this environmental permit. Any non-compliance may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap.499) and shall be definite ground for enforcement action or permit cancellation where applicable.
1.2 This permit shall not remove the responsibility of the permit holder to comply with any legislation currently in force such as the Noise Control Ordinance (Cap.400), Air Pollution Control Ordinance (Cap.311), Water Pollution control Ordinance (Cap.358), Dumping at Sea Ordinance (Cap.466), the Waste Disposal Ordinance (Cap.354), and others.
1.3 The Permit Holder shall make copies of this permit available at all times for inspection by the Director at all the sites covered by this permit.
1.4 The Permit Holder shall give a copy of this permit to the person(s) in charge of the site(s).
1.5 The Permit Holder shall display a copy of this permit on the construction site(s) at all vehicular site entrances/exits or at a convenient location for public information at all times. The permit holder shall ensure that the most updated information about the environmental permit, including any amended permit, is displayed at such locations. If the permit holder surrenders a part or the whole of the permit, the notice he sends to the Director of Environmental Protection shall also be displayed at the same locations as the original permit.
1.6 The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this permit.
1.7
The
Permit Holder shall ensure that the Project is designed, constructed and
operated in accordance with the information and all recommendations described
in the EIA Report (Register No. EIA-116/BC), the Supplementary
Information, the application documents for environmental permit (Application
No. AEP-009/1998), other relevant documents in the Register, and
the information or mitigation measures described in this Permit, or mitigation
measures to be recommended in submissions that shall be deposited with or
approved by the Director as a result of permit conditions contained in this
Permit, or mitigation measures to be recommended under on going surveillance
and monitoring activities during all stages of the Project. Where
recommendations referred to in the documents of the Register are not expressly
referred to in this Permit, such recommendations are nevertheless to be
implemented unless expressly excluded or impliedly amended in this Permit.
2. Submissions or Measures before Commencement of Construction
2.1 The Permit Holder shall revise the Environmental Monitoring and Audit (EM&A) Manual of the EIA Report to include the parameters copper, lead and zinc in the marine water quality monitoring programme and the proposed increase in monitoring frequency as stated in Part D7 of the Application (VEP-003/1999). The Permit Holder shall deposit 5 copies of the revised EM&A Manual with the Director.
2.2 An
Environmental Team shall be established before the commencement of construction
of the Project and shall not be in any way an associated body of the
Contractor. The Environmental Team shall be headed by a team leader who has at
least 7 years experience in EM&A or environmental management. The
Environmental Team Leader shall be responsible for the overall implementation
and management of the EM&A programme
in accordance with the EM&A requirements as contained in the revised
EM&A Manual.
2.3 The Permit Holder shall deposit with the Director 3 sets of 1 to 1000 scale layout drawings showing the details of the landscape and visual mitigation measures as recommended in Figure 10.11 of the EIA Report; and detailed plans showing the retention of vegetation, screen planting, re-vegetation of disturbed land and re-provisioning of amenity area/open space, and a management and maintenance schedule of the landscape areas to be managed, verified by the Engineer as conforming to the recommendations contained in Section 10.8 of the EIA Report. Additional copies of the layout drawings and the detailed plans may be required by the Director.
2.4 All deposited submissions as arising from Conditions 2.1 and 2.3 above shall be rectified in accordance with the comments, if any, made by the Director, within one month of the receipt of the Director's comments or otherwise specified by the Director.
2.5 All finalised submissions, as required by this part of the permit,
shall be released to the public if requested by the Director, by depositing
copies in the Environmental Impact Assessment Ordinance Register Office or any
other places or by any other means as specified by the Director for public
inspection. For this purpose, the Permit Holder shall provide sufficient copies
of submissions.
3. Measures for Construction and Operation of the Project
3.1 The noise barriers shall be constructed in accordance with Drawings 1 and 2 of the Environmental Permit Application No. VEP-036/2001, Figures 2, 3, 4, 11 and 12 of the Environmental Permit Application No. AEP-009/1998, Figures 5, 6, 7, 8 and 10 at Annex A of the Environmental Permit Application No. VEP-092/2003 (revised on 10.4.2003, 14.4.2003 and 28.4.2003) and Figure 9 of the Environmental Permit Application No. VEP-112/2003 before the Project comes into operation except as provided in Condition 3.2 and 3.3 of this Permit.
3.2 The
section of noise barriers as described in Schedule 1
of this permit shall be constructed before commencement of occupation at
planned developments at Tai Po Area 39. The upper portion of the section of
noise barriers as described in Schedule 2 shall be
modified to increase height and to provide canopy before commencement of
occupation at planned developments at Tai Po Area 39. Alternatively, the Permit
Holder shall submit a Noise Mitigation Plan to the Director for approval, and complete
the construction and/or modification of the sections of noise barriers as
described in the Noise Mitigation Plan before commencement of occupation at
planned developments at Tai Po Area 39.
3.3 The
section of noise barriers as described in Schedule 3
of this permit shall be constructed before commencement of occupation at the
planned hostel at Chung Chi Campus of the Hong Kong Chinese University (denoted
F24 in the EIA Report). The upper portion of the section of noise barriers as
described in Schedule 4 shall be modified to increase
height before commencement of occupation at the
planned hostel at Chung Chi Campus of the Hong Kong Chinese University.
Alternatively, the Permit Holder shall submit a Noise Mitigation Plan to
the Director for approval, and complete the construction and/or modification of
sections of noise barriers as described in the Noise Mitigation Plan before
commencement of occupation at planned hostel at Chung Chi Campus of the Hong
Kong Chinese University.
3.4 All noise barriers described in 3.1, 3.2 and 3.3 shall be continuous structures with no gap or opening except where access roads are required.
3.5 If the Project comes into operation before the relocation of the Marine Science Laboratory, split-type air conditioners with no air intakes at the road facades shall be provided at the Marine Science Laboratory.
3.6 Tidal flushing of the Tai Hang Bridge estuary shall not be hindered at any time during construction.
3.7 Bamboo shall be planted at the abandoned paddy near Tai Hang Bridge as recommended in Section 7.4 of the EIA Report.
3.8 Three rock clusters shall be constructed in accordance with the information contained in the Environmental Permit Application (AEP-009/1998).
3.9 Native trees which are lost due to construction shall be replanted.
3.10 Native species shall be used for re-vegetation.
3.11 Closed grab dredgers with silt screens enclosing the immediate grabbing areas shall be used for all dredging works. The maximum dredging volume shall be 8,000 m3 per day.
3.12 Foul effluent shall be directed to foul sewer or to a sewage treatment facility.
3.13 All
design and construction mitigation measures described in the submissions
approved or deposited under Section 2 above shall be properly constructed and
implemented. Any changes to the measures shall be verified by the Engineer as
complying with the environmental performance requirements contained in the EIA
Report before implementation. The verified changes shall be documented in the immediately
following monthly EM&A report.
4. Environmental Monitoring and Audit
4.1 The EM&A programme shall be implemented as set out in the revised EM&A Manual. Any changes to the programme shall be justified by the Environmental Team as conforming to the requirements set out in the revised EM&A Manual before submission to the Director for approval.
4.2 Samples and measurements for noise, air quality and water quality monitoring shall be taken in accordance with the requirements of the revised EM&A Manual by :
a) conducting baseline noise, air and water quality monitoring at the specified locations and frequencies;
b) conducting impact monitoring on noise, air quality and water quality at the specified locations and frequencies;
c) in cases where specified criteria in the revised EM&A Manual are exceeded, carrying out remedial actions in accordance with the Event/Action Plan, as set out in the revised EM&A Manual; and
d) logging and keeping records of the details of (a) and
(b) above, within 3 working days of the collection of data or completion of
remedial action, for the purposes of preparing and submitting the EM&A
Reports and to make available the information for inspection on site.
4.3 5 copies of the Baseline Monitoring Report verified by the Environmental Team shall be submitted to the Director before the commencement of any major construction works that would affect the monitoring results. Additional copies of the Baseline Monitoring Report may be required by the Director.
4.4 5 copies of monthly EM&A Report verified by the Environmental Team shall be submitted to the Director within 10 working days from the end of the reporting month or by other means as specified by the Director. Additional copies of the monthly EM&A Report may be required by the Director.
4.5 The submitted reports as required in Conditions 4.3 and 4.4 above shall be rectified in accordance with the comments made by the Director within one month of receipt of the Director's comments, or otherwise specified by the Director.
4.6 The actions described in the Event/Action Plans of the revised EM&A Manual shall be carried out, in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director.
4.7 All finalised submissions, as required under this part of the permit, shall be released to the public by depositing copies in the Environmental Impact Assessment Ordinance Register Office or any other places or by any other means as specified by the Director for public inspection. For this purpose, the Permit Holder shall provide sufficient copies of submissions.
Notes :
1. This
Permit consists of three parts, namely, Part A
(Main Permit), Part B (Description of Designated
Project) and Part C (Permit Conditions). Any person
relying on this permit should obtain independent legal advice on the legal
implications under the EIAO, and the following notes are for general
information only.
2. If
there is a breach of any condition of this Permit, the Director or his
authorized officer may, with the consent of the Secretary for the Environment,
order the cessation of associated work until the remedial action is taken in
respect of the resultant environmental damage, and in that case the Permit
Holder shall not carry out any associated works without the permission of the
Director or his authorized officer.
3. The
Permit Holder may apply under Section 13 of the EIAO to the Director for a
variation of the conditions of this Permit. The Permit Holder shall replace the
original permit displayed on the Project site by the amended permit.
4. A
person who assumes the responsibility for the whole or a part of the Project
may, before he assumes responsibility of the Project, apply under Section 12 of
the EIAO to the Director for a further environmental permit.
5. Under
Section 14 of the EIAO, the Director may with the consent of the Secretary for
the Environment, suspend, vary or cancel this Permit. The suspended, varied or
cancelled Permit shall be removed from display at the Project site.
6. If
this Permit is cancelled or surrendered during construction or operation of the
Project, another environmental permit must be obtained under the EIAO before
the Project could be continued. It is an offence under Section 26(1) of the
EIAO to construct or operate a designated project listed in Part I of Schedule 2 of the EIAO without a valid environmental
permit.
7. Any
person who constructs or operates the Project contrary to the conditions in the
Permit, and is convicted of an offence under the EIAO, is liable:
(i)
on a first
conviction on indictment to a fine of $2 million and to imprisonment for 6 months;
(ii)
on a second or
subsequent conviction on indictment to a fine of $5 million and to imprisonment
for 2 years;
(iii)
on a first
summary conviction to a fine at level 6 and to imprisonment for 6 months;
(iv)
on a second or
subsequent summary conviction to a fine of $1 million and to imprisonment for 1
year; and
(v)
in any case where the offence
is of a continuing nature, the court or magistrate may impose a fine of $10,000
for each day on which he is satisfied the offence continued.
8. The
Permit Holder may appeal against any condition of this Permit under Section 17
of the EIAO within 30 days of receipt of this Permit.
9. The
