Pursuant to Section 10 of the Environmental Impact Assessment Ordinance (the Ordinance), the Director of Environmental Protection (the Director) granted the environmental permit (No. EP-438/2012) to the MTR Corporation Limited (hereinafter referred to as the “Permit Holder”) on 22 March 2012. Pursuant to Section 13 of the EIAO, the Director amends the environmental permit (No. EP-438/2012/K) based on the Application No. VEP-638/2024. The amendments, described below, are incorporated into this environmental permit (No. EP-438/2012/L). This environmental permit as amended is for the construction and operation of the designated project described in Part B subject to the conditions specified in Part C. The issue of this environmental permit is based on the documents, approvals or permissions described below:

 

根據《環境影響評估條例》(環評條例)第10條的規定，環境保護署署長(署長)於2012年3月22日將環境許可證(No. EP-438/2012)批予香港鐵路有限公司(下稱 “許可證持有人”)。根據環評條例第13條的規定，署長因應更改環境許可證的申請編號VEP-638/2024修訂環境許可證(No. EP-438/2012/K)。以下修訂已包含在本環境許可證內(編號EP-438/2012/L)。本經修訂的環境許可證作為建造及營辦B部所說明的指定工程項目，但須遵守C部所列明的條件。本環境許可證是依據下列文件、批准或許可而簽發：

PART B (DESCRIPTIONS OF DESIGNATED PROJECT)

B部 (指定工程項目的說明)

 

Hereunder is the description of the designated project mentioned in Part A of this environmental permit:

 

下列為本環境許可證A部所提及的指定工程項目的說明:

 

Title of Designated Project 指定工程項目的名稱	Shatin to Central Link (SCL) - Tai Wai to Hung Hom Section [The project is hereinafter referred to as “the Project”.] 沙中線 - 大圍至紅磡段 [上述工程項目下稱 “工程項目” ]
Nature of Designated Project 指定工程項目的性質	The Project covers the following Designated Project elements under Part I, Schedule 2 of the EIAO :   -          A railway and its associated stations (Item A.2 of Part 1 of Schedule 2 of the EIAO); -          A railway siding (Item A.4 of Part 1 of Schedule 2 of the EIAO); -          A railway tunnel more than 800 m in length between portals (Item A.7 of Part 1 of Schedule 2 of the EIAO); -          A railway bridge more than 100m in length between abutments (Item A.8 of Part 1 of Schedule 2 of the EIAO); -          An explosive depot in a stand-alone, purpose built building (Item K.10 of Part 1 of Schedule 2 of the EIAO); -          Decommissioning of an explosive depot (Item 11 of Part II of Schedule 2 of the EIAO).   根據環評條例，本工程項目包含了下列屬於指定工程項目的元素：   -          鐵路及其相聯車站 (「環評條例」附表2第1部A.2項)； -          鐵路側線 (「環評條例」附表2第1部A.4項)； -          入口之間的長度超過800米的鐵路隧道(「環評條例」附表2第1部A.7項)； -          橋 台 之 間 的 長 度 超 過 100米 的 鐵 路 橋 樑 (「環評條例」附表2第1部A.8項)； -          在某一單獨、特建的建築物內的爆炸品倉庫 (「環評條例」附表2第1部K.10項) ； -          解除運作一個爆炸品倉庫(「環評條例」附表2第II部第11項).
Location of Designated Project 指定工程項目的地點	General layout of the railway alignment and location of the railway stations and the works sites of the Project are shown in Figures 1,2, 3, 4 and 5 attached to this Permit.   工程項目及其工地的位置見載於本許可證夾附的圖1,2,3,4及5。
Scale and Scope of Designated Project 指定工程項目的規模和範圍	Construction and operation of the following key elements:   (i)                  a railway of approximately 11km long from Tai Wai to Hung Hom; (ii)                seven railway stations at Hin Keng, Diamond Hill, Kai Tak, To Kwa Wan, Ma Tau Wai, Ho Man Tin and Hung Hom; (iii)              stabling sidings at the former Hung Hom Freight Yard and associated launching/retrieval tracks; (iv)               associated ventilation building, ventilation shafts, emergency access, emergency escape access and emergency egress point; and (v)                supporting works areas, access roads, barging facilities and temporary explosive magazine during the construction of the Project.     Decommissioning of the following element:   (i)                  temporary magazine site at Tseung Kwan O (TKO) Area 137.   建造和營辦以下的主要部份：   (i)                  長約11公里的鐵路，路線由大圍至紅磡； (ii)                7個位於顯徑、鑽石山、啓德、土瓜灣、馬頭圍、何文田及紅磡的車站； (iii)              位於前紅磡貨運站的列車停放處和相關的進出站路軌; (iv)               與鐵路相關的通風大樓、通風管道及緊急救援通道;及 (v)                於施工期間的後勤施工區、幹道支路、躉船轉運設施、臨時爆炸品倉庫。   解除運作以下部份：   (i)                  將軍澳第137區的臨時爆炸品倉庫。   Remarks : For Ho Man Tin (HOM) Station and Hung Hom (HUH) Station, the civil construction works will be carried out under the Kwun Tong Line Extension (KTE) Project and the SCL (Mong Kong East to Hung Hom Section) Project respectively. The construction works to be carried out under this Project will mainly include internal fitting-out works, track laying works and provision of other station facilities.   建造何文田站及紅磡站的土木工程主要分別納入在「觀塘線延線」和「沙中線(旺角東至紅磡段)」的工程項目內，而本工程項目會在何文田站及紅磡站進行內部裝修、舖設路軌及提供其他車站設施。

PART C (PERMIT CONDITIONS)

C部 (許可證條件)

 

1.                   General Conditions

一般條件

 

1.1                The Permit Holder and any person working on the Project shall comply with all conditions set out in this Permit. Any non-compliance by any person may constitute a contravention of the Environmental Impact Assessment Ordinance (Cap. 499) and may become the subject of appropriate action being taken under the Ordinance.

許可證持有人及任何從事工程項目的人士必須完全符合本許可證載列的全部條件。任何人士如有不符合本許可證的情況，可能違反《環境影響評估條例》（第499章）的規定，而當局可根據條例採取適當行動。

 

1.2                The Permit Holder shall ensure full compliance with all legislation from time to time in force including, without limitation to, the Noise Control Ordinance (Cap. 400), Air Pollution Control Ordinance (Cap. 311), Water Pollution Control Ordinance (Cap. 358), Dumping at Sea Ordinance (Cap. 466) and Waste Disposal Ordinance (Cap. 354). This Permit does not of itself constitute any ground of defence against any proceedings instituted under any legislation or imply any approval under any legislation.

許可證持有人須經常確保完全符合現行法例的規定，包括但不限於《噪音管制條例》（第400章）、《空氣污染管制條例》（第311章）、《水污染管制條例》（第358章）、《海上傾倒物料條例》 (第466章)及《廢物處置條例》（第354章）。本許可證本身不會就根據任何法例提起的法律程序構成任何抗辯理由，或根據任何法例默示任何批准。

 

1.3                The Permit Holder shall make copies of this Permit together with all documents referred to in this Permit or the documents referred to in Part A of the Permit readily available at all times for inspection by the Director or his authorised officers at all sites/offices covered by this Permit. Any reference to the Permit shall include all documents referred to in the Permit and also the relevant documents in the Register.

許可證持有人須印製本許可證的複本，連同本許可證所述的所有文件或本許可證A部所述文件，以供署長或獲授權人員任何時間內在本許可證所涵蓋的所有工地／辦事處查閱。凡提述本許可證，須包括本許可證所述的所有文件及登記冊內的相關文件。

 

1.4                The Permit Holder shall give a copy of this Permit to the person(s) in charge of the site(s) and ensure that such person(s) fully understands all conditions and all requirements incorporated by the Permit. The site(s) refers to site(s) of construction and operation of the Project and shall mean the same hereafter.

許可證持有人須把本許可證的一份複本交予工程項目工地的負責人，並確保這些人士完全明白本許可證的所有條件與規定。工地是指工程項目的建造及營辦工地，下文所提及的工地亦屬同一意思。

 

1.5                The Permit Holder shall display conspicuously a copy of this Permit on the construction site(s) at all vehicular site entrances/exists or at a convenient location for public’s information at all times.  The Permit Holder shall ensure that the most updated information about the Permit, including any amended permit, is displayed at such location.  If the Permit Holder surrenders a part or the whole of the Permit, the notice he sends to the Director shall also be displayed at the same location as the original Permit.  The suspended, varied or cancelled Permit shall be removed from display at the construction site(s).

許可證持有人須在建造工地所有車輛進出口或一處方便地點，顯眼地展示本許可證的複本，以供公眾在任何時間內閱覽。許可證持有人須確保在這些地點展示關於本許可證（包括任何經修訂的許可證）的最新資料。許可證持有人如交回許可證的部分或全部，必須把其送交署長的通知書，在備有原有許可證的各處相同地點展示。遭暫時吊銷、更改或取消的許可證必須從建造工地除下，不再展示。

 

1.6                The Permit Holder shall construct and operate the Project in accordance with the project descriptions in Part B of this Permit.

許可證持有人須依據本許可證B部的工程項目說明，建造及營辦本工程項目。

 

1.7                The Permit Holder shall ensure that the Project is designed, constructed and operated in accordance with the information and all recommendations described in the SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012); the SCL(HHS) EIA Report (Register No. AEIAR-164/2012); the application document (Application No. AEP-438/2012); other relevant documents in the Register; and the information or mitigation measures described in this Permit and the applications for variation of Environmental Permits as listed in Part A of this Permit, mitigation measures to be recommended in submissions that shall be deposited with or approved by the Director as a result of permit conditions contained in this Permit, and mitigation measures to be recommended under ongoing surveillance and monitoring activities during all stages of the Project. Where recommendations referred to in the documents of the Register are not expressly referred to in this Permit, such recommendations are nevertheless to be implemented unless expressly excluded or impliedly amended in this Permit.

許可證持有人須確保工程項目按照下述資料設計、建造及營辦：SCL(TAW-HUH)環評報告(登記冊檔號：AEIAR-167/2012)；SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所說明的資料及各項建議；申請文件（申請書編號：AEP-438/2012）；登記冊內的其他相關文件；本許可證所說明的資料或緩解措施及本許可證A部所臚列的更改環境許可證的申請文件；根據本許可證內載的條件須向署長存放或獲署長批准的提交文件所建議的緩解措施；以及在工程項目各階段進行的持續監察及監測工作所建議的緩解措施。登記冊文件所述建議如沒有在本許可證明確表示，則仍須實施這些建議，除非獲本許可證明確豁除或默示修訂。

 

1.8                All deposited submissions, as required under this Permit, shall be rectified and resubmitted in accordance with the comments, if any made by the Director within one month of the receipt of the Director’s comments or otherwise specified by the Director.

所有按本許可證規定提交的存放文件，須在接獲署長的意見（如有者）後1個月內（除非署長另行指定），根據署長的意見加以修正及重新提交。

 

1.9                All submissions approved by the Director, all submissions deposited without comments by the Director, or all submissions rectified in accordance with comments by the Director under this Permit shall be construed as part of the permit conditions described in Part C of this Permit.  Any variations of the submissions shall be approved by the Director in writing or as prescribed in the relevant permit conditions. Any non-compliance with the submissions may constitute a contravention of the EIA Ordinance (Cap. 499). All submissions or any variation of the submissions shall be certified by the Environmental Team (ET) Leader and verified by the Independent Environmental Checker (IEC) referred to in Conditions 2.1 and 2.2 below, before submitting to the Director under the Permit.

署長批准的所有提交文件、署長沒有給予意見的所有存放文件，或根據本許可證規定由署長給予意見修正的所有提交文件，均須詮釋為本許可證C部說明的許可證條件的一部分。提交文件如有任何修訂，均須獲署長的書面批准，或符合有關許可證條件訂明的規定。如有不符合提交文件的情況，則可能違反《環境影響評估條例》（第499章）的規定。所有提交文件或提交文件的任何修訂本，均須由下文條件第2.1及2.2項所述的環境小組組長核證及獨立環境查核人核實，然後才按本許可證規定向署長提交。

 

1.10             The Permit Holder shall release all finalized submissions, as required under this Permit, to the public by depositing copies in the EIA Ordinance Register Office, or in any other places, or any internet websites as specified by the Director, or by any other means as specified by the Director for public inspection.  For this purpose, the Permit Holder shall provide sufficient copies of the submissions.

許可證持有人須把所有按本許可證規定提交的文件定稿公開給公眾人士知道，方法是把有關文件複本存放於環境影響評估條例登記冊辦事處，或署長指定的任何其他地方，或署長指定的任何互聯網網站，或署長指定的任何其他方法，以供公眾查閱。因此，許可證持有人須提供足夠數量的複本。

 

1.11             All submissions to the Director required under this Permit shall be delivered either in person or by registered mail to the EIA Ordinance Register Office (currently at 27/F, Southorn Centre, 130 Hennessy Road, Wanchai, Hong Kong).  Electronic copies of all finalized submissions required under this Permit shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies.

本許可證規定向署長提交的所有文件，須親身送交或以掛號方式郵寄至環境影響評估條例登記冊辦事處（現址為：香港灣仔軒尼詩道130號修頓中心27樓）。所有按本許可證規定提交的文件定稿的電子版本，均須以超文本標示語言（HTML）（第4.0或較後版本）和便攜式文件格式（PDF）（第1.3或較後版本）製作，除非另獲署長同意，並須與硬複本同時提交。

 

1.12             The Permit Holder shall notify the Director in writing the commencement date of construction of the Project no later than one month prior to the commencement of construction of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the construction.

許可證持有人在工程項目的建造工程展開前，須至少提早1個月以書面方式通知署長工程項目建造工程的施工日期。建造工程的施工日期如有任何更改，許可證持有人須立即以書面方式通知署長。

 

1.13             For the purpose of this Permit, “commencement of construction” does not include works related to site clearance and preparation, or other works as agreed by the Director.

為執行本許可證，「建造工程的展開」不包括有關工地清理和預備工程，或署長同意的其他工程。

 

1.14             The Permit Holder notify the Director in writing the commencement date of operation of the Project no later than two months prior to the commencement of operation of the Project. The Permit Holder shall notify the Director in writing immediately if there is any change of the commencement date of the operation.

許可證持有人在工程項目的營辦展開前，須至少提早2個月以書面方式通知署長工程項目開始營辦的日期。開始營辦的日期如有任何更改，許可證持有人須立即以書面方式通知署長。

 

2.                   Special Conditions

特定條件

 

                Submissions and Measures before Commencement of Construction of the Project

工程項目施工前須提交的文件及採取的措施

 

           Employment of Environmental Monitoring and Audit (EM&A) Personnel

聘用環境監察及審核(環監)人員

 

2.1                An Environmental Team (ET) shall be established by the Permit Holder no later than one month before the commencement of construction of the Project. The ET shall not be in any way an associated body of the Contractor or the Independent Environmental Checker (IEC) for the Project. The ET shall be headed by an ET Leader. The ET Leader shall be a person who has at least 7 years of experience in environmental monitoring and auditing (EM&A) or environmental management. The ET and the ET Leader shall be responsible for the implementation of the EM&A programme in accordance with the EM&A requirements as contained in the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual. The ET Leader shall keep a contemporaneous log-book of each and every instance or circumstance or change of circumstances, which may affect the compliance with the recommendations of the SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and this Permit.  The ET Leader shall notify the IEC within one working day of the occurrence of any such instance or circumstance or change of circumstances. The ET Leader’s log-book shall be kept readily available for inspection by all persons assisting in supervision of the implementation of the recommendations of the SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and this Permit or by the Director or his authorized officers. Failure to maintain records in the log-book, failure to discharge the duties of the ET Leader as defined in the EM&A Manual or failure to comply with this Condition would entitle the Director to require the Permit Holder by notice in writing to replace the ET Leader. Failure by the Permit Holder to make replacement, or further failure to keep contemporaneous records in the log-book despite the employment of a new ET Leader may render the Permit liable to suspension, cancellation or variation.

在工程項目的建造工程展開前，許可證持有人須至少提早1個月成立一個環境小組。環境小組不得與工程項目的承辦商或獨立環境查核人有任何聯繫。環境小組須由一名環境小組組長帶領。環境小組組長須在環境監察及審核（環監）或環境管理方面至少有7年經驗。環境小組及環境小組組長須按SCL(TAW-HUH)及SCL(HHS)環監手冊內載的環監要求，執行環監計劃。環境小組組長須保存一本記錄冊，同時記載可能會影響SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)的建議及本許可證的符合情況的每宗事件、每種情況或每次情況變化。環境小組組長須在發生任何類似事件、情況或情況變化後1個工作天內通知獨立環境查核人。存放這本環境小組組長的記錄冊的地方，須可供協助督導執行SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)的建議及本許可證的所有人士、署長或獲授權人員隨時查閱。環境小組組長如未能在記錄冊保存記錄、未能執行環監手冊所列明的環境小組組長職務，或未能符合本條件的規定，署長有權以書面要求許可證持有人撤換環境小組組長。許可證持有人如未能安排人選替補，或在聘用新環境小組組長後仍未能在記錄冊保存同期的記錄，或會導致許可證遭暫時吊銷、取消或更改。

 

2.2                An IEC shall be employed by the Permit Holder no later than one month before commencement of construction of the Project. The IEC shall not be in any way an associated body of the Contractor or the ET for the Project. The IEC shall be a person who has at least 7 years of experience in EM&A or environmental management. The IEC shall be responsible for duties defined in the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual and shall audit the overall EM&A performance, including the implementation of all environmental mitigation measures, submissions required in the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual, and any other submissions required under this Permit. In addition, the IEC shall be responsible for verifying the environmental acceptability of permanent and temporary works, relevant design plans and submissions under this Permit. The IEC shall verify the log-book(s) mentioned in Condition 2.1 of this Permit. The IEC shall notify the Director by fax, within one working day of receipt of notification from the ET Leader of each and every occurrence, change of circumstances or non-compliance with the SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and this Permit, which might affect the monitoring or control of adverse environmental impacts from the Project. In the case where the IEC fails to so notify the Director of the same, fails to discharge the duties of the IEC as defined in the EM&A Manual or fails to comply with this Condition, the Director may require the Permit Holder by notice in writing to replace the IEC. Failure to replace the IEC as directed or further failure to so notify the Director despite employment of a new IEC may render the Permit liable to suspension, cancellation or variation. Notification by the Permit Holder is the same as notification by the IEC for the purpose of this Condition.

在工程項目的建造工程展開前，許可證持有人須至少提早1個月聘用一名獨立環境查核人。獨立環境查核人不得與工程項目的承辦商或環境小組有任何聯繫。獨立環境查核人須在環監或環境管理方面至少有7年經驗。獨立環境查核人須執行SCL(TAW-HUH)及SCL(HHS)環監手冊所列明的職務，以及審核整體的環監表現，包括實施所有環境緩解措施、提交SCL(TAW-HUH)及SCL(HHS)環監手冊規定的文件，以及提交本許可證所要求的其他文件。此外，獨立環境查核人須核實永久及臨時工程在環境上的可接受程度、相關的設計圖則和根據本許可證提交的文件，並須核實本許可證條件第2.1項所述的記錄冊。在每次發生事件、出現情況變化或不符合SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)及本許可證的情況，而可能會妨礙就工程項目所造成不良環境影響而進行的監察或控制工作時，獨立環境查核人須在接獲環境小組組長通知後1個工作天內以傳真方式通知署長。獨立環境查核人如未能通知署長有關情況，未能執行環監手冊所列明的獨立環境查核人職務，或未能符合本條件的規定，署長可以書面要求許可證持有人撤換獨立環境查核人。如未能按指示撤換獨立環境查核人，或在聘用新獨立環境查核人後仍未能通知署長有關情況，則或會導致許可證遭暫時吊銷、取消或更改。為執行本條件，許可證持有人的通知等同獨立環境查核人的通知。

            

Community Liaison Groups

社區聯絡小組

 

2.3                Before the commencement of construction of the Project, the Permit Holder shall set up Community Liaison Groups comprising representatives of concerned and affected parties, including owners’ corporations, management offices, local committees, residents and schools in the affected areas along the railway alignment, to facilitate communications, enquiries and complaint handlings on environmental issues related to the Project and maintain the Community Liaison Groups throughout the entire construction period of the Project.   The Permit Holder shall follow up with the Community Liaison Groups on the implementation of mitigation measures and other initiatives proposed by the Permit Holder such as Indirect Technical Remedies in the form of upgraded glazing and air-conditioning for eligible dwellings affected by air-borne construction noise impact, as well as arrangement of continuous construction noise monitoring.  The Permit Holder shall notify the Director the date of setting up the Community Liaison Groups, the membership, the terms of reference and the contact details at least one month before the commencement of construction of the Project.

在工程項目的建造工程展開前，許可證持有人須成立社區聯絡小組，由相關及受影響團體代表組成，包括位於鐵路路線上受影響地區的業主立案法團、管理公司、地區委員會、居民及學校，以便在整段建造期間內就工程項目的所有環境問題加強與有關人士的溝通，處理有關的查詢和投訴，並與社區聯絡小組保持聯絡。許可證持有人須與社區聯絡小組跟進許可證持有人所建議的緩解措施及其他措施的實施情況，例如實施間接技術補救措施，為受經空氣傳送建築噪音影響的合資格住宅安裝厚玻璃窗和空調設備，以及持續噪音監測的安排等。在工程項目的建造工程展開前，許可證持有人須至少提早1個月通知署長社區聯絡小組的確實成立日期、成員名單、職權範圍及聯絡詳情。

 

2.4                The Permit Holder shall set up a designated complaint hotline for the Project to address the environmental concerns and complaints in an efficient manner before the commencement of construction of the Project and maintain the designated complaint hotline throughout the entire construction period of the Project.

在工程項目的建造工程展開前，許可證持有人須為工程項目設立特定電話投訴熱線，以迅速回應及處理公眾關注的環境事宜和投訴。特定電話投訴熱線須於工程項目的整段建造期間維持運作。

 

Employment of Certified Arborist

聘請註冊樹藝師

 

2.5                The Permit Holder shall appoint a Certified Arborist for the Project to advise on, monitor and ensure proper implementation of measures for protecting trees affected by the Project as well as trees to be transplanted, and to prepare submissions as required under Condition 2.13 of this Permit.

許可證持有人須就工程項目委聘一名註冊樹藝師，以提供意見及進行監察，並確保各項保護受工程項目影響的樹木和將予移植樹木的措施能妥善執行，以及擬備根據本許可證條件第2.13項規定提交的文件。

 

                Employment of Qualified Archaeologist

                聘請合資格的考古學家

 

2.6                The Permit Holder shall appoint a qualified archaeologist to conduct further archaeological investigation at former Tai Hom Village site and the Sacred Hill (North) study area and to conduct rescue excavation to preserve any archaeological remains as required under Condition 2.16 of this Permit.

許可證持有人須聘請一名合資格的考古學家，根據本許可證條件第2.16項的規定，在前大磡村用地及聖山(北)的研究範圍作進一步考古勘探及進行搶救發掘，以保存任何考古遺物。

 

Management Organization of Main Construction Companies

主要建造公司的管理架構

 

2.7                The Permit Holder shall, no later than two weeks before the commencement of construction of the Project, inform the Director in writing the management organization of the main construction companies and/or any form of joint ventures associated with the construction of the Project.  The submitted information shall include at least an organization chart, names of responsible persons and their contact details.

許可證持有人須在工程項目的建造工程展開前，至少提早2個星期把主要建造公司及／或以任何形式與建造工程項目相關的合營企業的管理架構，以書面通知署長。提交的資料須至少包括一份組織圖、負責人的姓名及聯絡資料。

 

                Submission of Construction Programme and Environmental Permit (EP) Submission Schedule

提交建造工程計劃及環境許可證文件提交時間表

 

2.8                The Permit Holder shall, no later than two weeks before the commencement of the construction of the Project, deposit with the Director four hard copies and one electronic copy of the construction programme showing the commencement and completion dates of major items of construction works; together with the anticipated schedule of submissions for fulfilling the submission requirements as contained in this Permit.  The Permit Holder shall inform the Director accordingly in writing in case of any subsequent changes of items contained in this submitted construction programme and EP Submission Schedule.

許可證持有人在工程項目的建造工程展開前，須至少提早2個星期向署長存放建造工程計劃的4份硬複本及1份電子版本，展示建造工程主要項目的施工及竣工日期，以及為符合本許可證提交文件的規定的預計文件提交時間表。倘若已提交的建造工程計劃及環境許可證文件提交時間表其後如有任何項目更改，許可證持有人須以書面方式通知署長。

 

Submission of Construction Noise Mitigation Measures Plan (CNMMP)

提交建築噪音緩解措施計劃

 

2.9                To further reduce the air-borne construction noise impacts on the 19 noise sensitive receivers (NSRs) shown in Table 1 of this Permit with exceedance after mitigation as predicted in the SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012), the Permit Holder shall, no later than one month before the commencement of the construction of the Project, submit to the Director for approval four hard copies and one electronic copy of an updated Construction Noise Mitigation Measures Plan (CNMMP) and other initiatives proposed by the Permit Holder. The Plan shall include:-

為進一步減少經空氣傳送建築噪音對SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)內預計本許可證表1所示超標的19個噪音敏感受體在採取緩解措施後所受的影響，許可證持有人須在工程項目的建造工程展開前，至少提早1個月向署長提交許可證持有人建議的經更新的建築噪音緩解措施計劃和的其他措施的4份硬複本及1份電子版本，以供審批。有關計劃須包括：

 

(a)                 a schedule of construction works to be carried out at the works areas of the Project within 300m from the NSRs;

距離噪音敏感受體300米範圍內的工程項目工地進行的建造工程時間表；

(b)                an updated construction methodology of the construction works;

建造工程經更新的施工方法；

(c)                 an updated powered mechanical equipment (PME) list for the construction works;

建造工程經更新的機動設備名單；

(d)                an updated proposal of air-borne noise mitigation measures for the 19 NSRs as shown in Table 1 of this Permit, including the provision of noise barriers, enclosures and Indirect Technical Remedies;

為本許可證表1所示的19個噪音敏感受體提供經更新的經空氣傳送噪音緩解建議措施，包括設置隔音屏障和隔音罩及間接技術補救措施；以及

(e)                 an updated prediction of noise levels in accordance with the above updated information and mitigation proposals in place.

根據上述經更新的資料及採取建議緩解措施後作出的更新噪音水平預測。

 

Before submission to the Director, the CNMMP shall be certified by the ET Leader and verified by the IEC as conforming to the relevant information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the approved CNMMP shall be fully and properly implemented.

建築噪音緩解措施計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)的有關資料及建議。核准的建築噪音緩解措施計劃所建議的全部措施均須徹底及妥善執行。

 

2.10             Submission of Continuous Noise Monitoring Plan

提交持續噪音監測計劃

 

              The Permit Holder shall, no later than one month before the commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a Continuous Noise Monitoring Plan for the Project.  The Plan shall include:

                在工程項目的建造工程展開前，許可證持有人須至少提早1個月把工程項目持續噪音監測計劃的4份硬複本及1份電子版本，提交署長批核。有關計劃須包括：

               

(a)                 updated environmental monitoring and audit requirements relating to continuous noise monitoring at the NSRs shown in Table 1 of this Permit with exceedance after mitigation in air-borne construction noise impact as predicted in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and as updated in the CNMMP approved under Condition 2.9;

就核准的SCL(TAW-HUH)環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS) 環評報告(登記冊檔號：AEIAR-164/2012)內預計及根據條件第2.9項核准的經更新建築噪音緩解措施計劃所指：為經空氣傳送建築噪音對本許可證表1所示超標的噪音敏感受體在採取緩解措施後所受的影響而實施有關持續噪音監測的經更新環境監測及審核規定；

(b)                drawings in the scale of 1:5,000 or other appropriate scale as agreed by the Director showing the proposed locations for conducting continuous noise monitoring;

用1:5 000或署長同意的其他合適比例繪製的圖則，展示建議進行持續噪音監測的地點；

(c)                 monitoring methodology and measurement parameters;

監測方法及測量參數；

(d)                a system to report the continuous noise monitoring results on a website within a period of 2 working days after the relevant noise monitoring data are collected or become available; and

在有關噪音監測數據收集或可供瀏覽後的2個工作天內於網站匯報持續噪音監測結果的系統；以及

(e)                 an Event and Action Plan giving details of the immediate active remedial measures in the event that the measured noise levels exceed the worst-case scenario predicted in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) or the levels as updated by the CNMMP approved under Condition 2.9.

事件及行動計劃，闡述倘若量度的噪音水平超逾核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)預計的最壞情況或根據條件第2.9項核准的建築噪音緩解措施計劃經更新的噪音水平時所採取的即時補救措施。

 

Before submission to the Director, the Continuous Noise Monitoring Plan shall be certified by the ET and verified by the IEC as conforming to the relevant information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) or the updated prediction of noise levels as contained in the CNMMP approved under Condition 2.9.  All measures recommended in the Continuous Noise Monitoring Plan approved under this Condition shall be fully and properly implemented.

持續噪音監測計劃在提交署長前，須由環境小組核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)的有關資料及建議，或根據條件第2.9項核准的建築噪音緩解措施計劃載述經更新的噪音水平預測。根據本條件核准的持續噪音監測計劃所建議的措施全部均須徹底及妥善執行。

 

Submission of Construction and Demolition Materials Management Plan (C&DMMP)

提交拆建物料管理計劃

 

2.11             The Permit Holder shall, no later than one month before commencement of construction of the Project, submit to the Director for approval four hard copies and one electronic copy of a construction and demolition (C&D) materials management plan (C&DMMP). The C&DMMP shall describe the arrangements for avoidance, reuse, recovery and recycling, storage, collection, treatment and disposal of C&D materials to be generated from the construction of the Project.  The C&DMMP shall indicate the disposal location(s) of all surplus excavated spoil and other wastes.  A trip ticket system shall be included in the C&DMMP.  Surplus excavated spoil and other wastes shall only be disposed of at designated disposal locations unless otherwise approved by the Director.

許可證持有人須在工程項目的建造工程展開前，至少提早1個月，向署長提交拆建物料管理計劃的4份硬複本及1份電子版本，以供審批。拆建物料管理計劃須說明建造工程項目時所產生的拆建物料在避免產生、再使用、回收、循環再造、貯存、收集、處理和棄置方面的安排。拆建物料管理計劃須顯示所有剩餘挖出棄土及其他廢物的棄置地點。拆建物料管理計劃亦須包括運載記錄制度。除非另獲署長批准，剩餘挖出棄土及其他廢物，只可在指定的棄置地點棄置。

 

Before submission to the Director, the C&DMMP shall be certified by the ET Leader and verified by the IEC as conforming to the relevant information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the approved C&DMMP shall be fully and properly implemented.

拆建物料管理計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的相關資料及建議。核准的拆建物料管理計劃建議的所有措施均須徹底及妥善執行。

 

Submission of Sediment Management Plan

提交沉積物管理計劃

 

2.12             The Permit Holder shall, no later than one month before the commencement of construction works which involves dredging / excavating sediments, submit to the Director for approval four hard copies and one electronic copy of a sediment management plan.  The sediment management plan shall include, but not limited to, details of proper treatment and handling of sediments to be generated from the construction of the Project before disposal.

在涉及疏浚／挖掘沉積物的建造工程展開前，許可證持有人須至少提早1個月把沉積物管理計劃的4份硬複本及1份電子版本提交署長審批。沉積物管理計劃須包括但不限於建造工程項目所釋出的沉積物在棄置前的妥善處理方法。

 

Before submission to the Director, the sediment management plan shall be certified by the ET Leader and verified by the IEC as conforming to the relevant information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the approved sediment management plan shall be fully and properly implemented.

沉積物管理計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的相關資料及建議。核准的沉積物管理計劃建議的所有措施均須徹底及妥善執行。

 

Submission of Visual, Landscape, Tree Planting & Tree Protection Plan

2.13             The Permit Holder shall, no later than one month before the commencement of construction of the Project, submit six hard copies and one electronic copy of the visual, landscape, tree planting & tree protection plan to the Director for approval.  The plan, with drawings in the scale of 1:1000 or other appropriate scales as agreed by the Director shall show the visual, landscape, tree planting & tree protection measures of the Project, and shall include at least the following information:

在工程項目的建造工程展開前，許可證持有人須至少提早1個月把視覺、景觀及植樹與樹木保護計劃的6份硬複本及1份電子版本提交署長審批。 有關計劃須包括比例1:1 000或署長同意的其他合適比例繪製的圖則，展示工程項目的視覺、景觀及植樹與樹木保護措施，並須至少包括以下資料：

 

(a)                 aesthetic landscape and architectural treatment for above ground structures including stabling sidings at the former Hung Hom Freight Yard, stations, entrances, ventilation building, ventilation shafts, portals, noise barriers/enclosures and viaduct section at Hin Heng;

就地面建築物包括前紅磡貨運站的列車停放處、顯徑車站、出入口、通風大樓、通風井、入口、隔音屏障／隔音罩及高架橋段所採取的景觀及建築優化措施；

(b)                tree protection proposal showing locations, size, number and plant species of trees to be retained; and detailed working method statement for protection of retained trees;

樹木保護建議，須顯示將予保留樹木的位置、大小、數量及品種；以及保護獲保留樹木的詳細作業方法說明；

(c)                transplantation proposal showing locations, size, number and tree species to be transplanted and the final locations for transplantation;

移植建議，須顯示將予移植樹木的位置、大小、數量及品種，以及樹木的最終移植地點；

(d)                tree felling proposal showing locations, size, number and plant species to be felled;

樹木砍伐建議，須顯示將予砍伐的植物位置、大小、數量及品種；

(e)                tree compensation proposal showing locations, size, number and plant species to be provided or compensated;

補償植樹建議，須顯示將予栽種或補償種植樹木的位置、大小、數量及品種；

(f)                 post-planting care proposal showing the proposed establishment period and associated maintenance care requirements and frequency of transplanted trees and trees planted as compensation under this Condition; and

植樹後護理的建議，須顯示就本條件規定而補償移植和種植樹木的建議培植期、相關的保養護理要求及次數；以及

(g)                implementation programme, maintenance and management schedules for measures proposed in (a) to (f) above.

上文(a)至(f)項建議措施的實施計劃、保養及管理時間表。

 

                The proposals under Condition 2.13(b) to (f) shall be prepared by the Certified Arborist appointed under Condition 2.5.   The Plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012), SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and the application for variation of Environmental Permit as listed in Part A of this Permit.  All measures recommended in the approved Plan shall be fully and properly implemented and maintained for the Project.

                條件第2.13(b)至(f)項所指的建議須由條件第2.5項委聘的註冊樹藝師擬備。有關計劃須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)、SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)及本許可證A部所臚列的更改環境許可證的申請文件所載的資料及建議。核准計劃建議的所有措施均須為工程項目徹底及妥善執行及維持。

 

Submission of Transplantation Proposal for Plant Species of Conservation Importance

                提交具重要保護價值的植物品種移植建議

 

2.14             To mitigate the ecological impact due to the loss of plant species of conservation importance, Aquilaria sinensis, the affected plants within the works area shall be transplanted before the commencement of construction.  A detailed pre-transplantation survey shall be carried out to ascertain the presence and the locations of plant species, Aquilaria sinensis wthin the works area.  The Permit Holder shall, no later than two months before commencement of transplanting works, deposit with the Director four hard copies and one electronic copy of transplantation proposal. The detailed transplantation proposal shall include the following information:

為減輕因損失具重要保護價值的植物品種而造成的生態影響，工程範圍內受影響的植物牙香樹須在建造工程展開前移植，並須進行移植前的詳細調查，以確定植物品種牙香樹在工程範圍內的存在及位置。許可證持有人須在移植工作展開前，至少提早2個月向署長存放移植建議書的4份硬複本及1份電子版本。詳細的移植建議書須包括下列資料：

               

(a)                 qualification of the specialist(s) to carry out the transplantation works;

負責移植工作的專家資歷；

(b)                number, locations and photographs of plants to be transplanted;

將予移植的植物數量、位置及照片；

(c)                 locations of the receptor sites for transplantation;

接收移植植物地點的位置；

(d)                methodology and implementation programme; and

方法及執行計劃；以及

(e)                 detailed schedule for post-transplantation maintenance and monitoring of plants.

移植後詳細的植物保養及監察程序。

 

Before submission to the Director, the transplantation proposal shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).

移植建議書在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。

 

                Submission of Conservation Plan

2.15             The Permit Holder shall, no later than two months before the commencement of construction works affecting the two historic buildings, namely Former Royal Air Force Hangar and the Old Pillbox at the former Tai Hom Village site, submit four hard copies and one electronic copy of the conservation plan for the said two historic buildings to the Director for approval.  The conservation plan shall include at least the following information:

在影響兩座歷史建築物(即位於前大磡村用地的前皇家空軍飛機庫及機槍堡)的建造工程展開前，許可證持有人須至少提早2個月把該兩座歷史建築物保護計劃的4份硬複本及1份電子版本提交署長審批。保護計劃須至少包括以下資料：

            

(a)                 a detailed plan for dismantling and reinstating the two said historic buildings; and

拆卸及重置該兩座歷史建築物的詳細計劃；以及

(b)                implementation programme, maintenance and management schedules for actions recommended in the plan.

計劃所建議採取的執行計劃、保養及管理程序。

 

                Before submission to the Director, the conservation plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the approved conservation plan shall be fully and properly implemented for the Project.

                保護計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。核准的保護計劃建議的所有措施均須為工程項目徹底及妥善執行。

 

                Submission of Archaeological Action Plan(s) (AAP(s))

2.16             The Permit Holder shall, no later than two months before the commencement of the further archaeological investigation at the former Tai Hom Village site or the Sacred Hill (North) study area, deposit with the Director four hard copies and one electronic copy of Archaeological Action Plan(s) for the sites. The Archaeological Action Plan(s) shall include:

許可證持有人在前大磡村用地或聖山(北)的研究範圍作進一步考古勘探前，須至少提早2個月向署長存放有關土地的考古行動計劃的4份硬複本及1份電子版本。考古行動計劃須包括：

 

(a)                 a detailed plan for further archaeological investigation and rescue excavation at the former Tai Hom Village site and the Sacred Hill (North) study area;

在前大磡村用地及聖山(北)的研究範圍作進一步考古勘探及搶救發掘的詳細計劃；

(b)                 a contingency plan to address possible arrangement when significant archaeological findings are unearthed during the further archeological investigation and rescue excavation.

制訂應變計劃，應付當進一步考古勘探及搶救發掘進行期間有重大考古發現時的可能安排。

 

Before submission to the Director, the AAP(s) shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the deposited AAP(s) shall be fully and properly implemented for the Project.

考古行動計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。經存放的考古行動計劃建議的所有措施均須為工程項目徹底及妥善執行。

 

                Submissions or Measures to be Implemented During Construction of the Project

2.17             To avoid direct impact on the remains of Lung Tsun Stone Bridge and Former Kowloon City Pier, no at-grade construction works of the Project shall be carried out inside the “buffer zone” for the remains of Lung Tsun Stone Bridge and Former Kowloon City Pier as shown in the Figure 6 of this Permit.

為避免對龍津石橋及前九龍城碼頭的遺址有直接影響，本許可證圖6所示的龍津石橋和前九龍城碼頭遺址之間的「緩衝距離」內不得進行工程項目的地面建造工程。

 

                Measures for Mitigating Construction Dust Impact

                建築塵埃影響的緩解措施

 

2.18             In order to minimize the construction dust impact, the following dust mitigation measures shall be implemented:-

為盡量減低建築塵埃影響，須實施以下的塵埃緩解措施：

 

(a)                 watering once every working hour for active works areas, exposed areas and paved haul roads in Kowloon area to keep these active works areas, exposed areas and paved haul roads wet;

每1 個工作小時在九龍區施工中的工程區、露天地區和已鋪面的工地通道上灑水一次，以保持這些施工中的工程區、露天地區和已鋪面的工地通道濕潤；

(b)                watering once every 1.5 working hours for active works areas, exposed areas and paved haul roads in Tai Wai area to keep these active works areas, exposed areas and paved haul roads wet; and

每1.5個工作小時在大圍區施工中的工程區、露天地區和已鋪面的工地通道上灑水一次，以保持這些施工中的工程區、露天地區和已鋪面的工地通道濕潤；以及

(c)                 enclosing the unloading process at any barging point by a 3-sided screen with top tipping hall, and operating water spraying and flexible dust curtains at the discharge point.

卸泥的過程須在有蓋三面圍封的躉船轉運站的卸貨區進行，並須在排放口灑水和加裝彈性擋塵幕。

 

Measures for Mitigating Aerial Emissions from Construction Plant

建造機械空氣污染物排放的緩解措施

 

2.19             All diesel fuelled construction plant, including marine vessels if possible, used by the contractors within the works areas of the Project shall be powered by ultra low sulphur diesel fuel.

承辦商在工程項目施工區內所使用的柴油推動建造機械，包括船隻(如可能的話)，全部均須以超低含硫量柴油推動。

 

                Measures for Mitigating Water Quality Impact from Dredging Works

                挖泥工程對水質影響的緩解措施

 

2.20             All dredging works for the Kai Tak Runway Barging Point shall only be carried out within the site boundary as shown in Figure 7 of this Permit. No extension of the site boundary shall be permitted without the written approval of the Director.

啓德機場跑道躉船轉運站的所有挖泥工程只限在本許可證圖7所示的地界內進行。未經署長的書面批准，不得擴展地界。

 

2.21             Dredging shall only be carried out by closed grab dredger or backhoe dredger with closed bucket.  The dredging rate shall not exceed 500 m³ per day.  The dredging rate shall not exceed 41.7m³ per hour for closed grab dredger or 33.3 m³ per hour for backhoe dredger with closed bucket.  Other than closed grab dredger or backhoe dredger with closed bucket, the use of other type of dredger and the dredging rate shall be approved in writing by the Director before use.

挖泥工程只可採用密封式抓斗挖泥機或閉合式鏟斗反鏟挖泥機進行。挖泥量每日不得超過500立方米。密封式抓斗挖泥機的挖泥量每小時不得超過 41.7立方米，而閉合式鏟斗反鏟挖泥機每小時不得超過33.3立方米。除密封式抓斗挖泥機或閉合式鏟斗反鏟挖泥機外，其他類型挖泥機的使用或挖泥量須在使用前事先獲署長書面批准。

 

2.22             Each closed grab dredger or backhoe dredger with closed bucket or other type of dredger approved by the Director shall be enclosed by silt curtain during dredging works.

在挖泥工程進行期間，每部密封式抓斗挖泥機或閉合式鏟斗反鏟挖泥機或署長批准的其他類型挖泥機須以隔泥幕圍封。

 

Submission of Contamination Assessment Report and Remedial Action Plan (SLCA)

提交污染評估報告和整治計劃書

 

2.23             Supplementary land contamination assessment (SLCA) for the New Territories South Animal Centre in Hin Keng as shown in Figure 8 of this Permit for soil sampling and analysis of cyanide (free) shall be carried out after the site is handed over to the Permit Holder.  The Permit Holder shall, no later than one month after the completion of the land contamination investigation, deposit with the Director three hard copies and one electronic copy of Contamination Assessment Report (CAR) to document the SLCA findings. If land contamination is confirmed, the Permit Holder shall also submit to the Director for approval three hard copies and one electronic copy of Remedial Action Plan (RAP) to formulate necessary remedial measures.  Before submission to the Director, the CAR and RAP shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012).

在土地移交許可證持有人後，許可證持有人須就本許可證圖8所示位於顯徑的新界南動物管理中心的泥土取樣和氰化物(游離)分析進行附加土地污染評估。許可證持有人須在完成土地污染調查工作後1個月內，向署長存放污染評估報告的3份硬複本及1份電子版本，該報告須記錄附加土地污染評估的結果。倘若土地證實受到污染，許可證持有人須制訂所需的整治措施，並把整治計劃書的3份硬複本及1份電子版本提交署長審批。污染評估報告及整治計劃書在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)所載的資料及建議。

 

                Measures for Mitigating Land Contamination and Submission of Remediation Works Report

                土地污染緩解措施及提交整治工程報告

 

2.24             If land contamination is confirmed, all remedial measures described in the RAP approved under Condition 2.23 of this Permit shall be fully implemented.

倘若土地證實受到污染，許可證持有人須徹底執行按本許可證條件第2.23項核准的整治計劃書載述的所有整治措施。

 

2.25             If remediation is required, the Permit Holder shall deposit three hard copies and one electronic copy of Remediation Report (RR) to the Director, no later than one month after the completion of the remediation works.  The RR shall provide details on the remediation works carried out, types and volume of contaminated soil, standards and levels of treatment, and locations of all on-site and off-site disposal sites (including record of disposal).  The RR shall be certified by the ET Leader and verified by the IEC to demonstrate that Condition 2.24 is fulfilled.  No construction works at the New Territories South Animal Centre in Hin Keng shall be carried out prior to the EPD's endorsement of the said RR.

如須進行整治，許可證持有人須在整治工程完成後1個月內，向署長存放整治報告的3份硬複本及1份電子版本。整治報告須提供所進行的整治工程詳情、受污染泥土的類別及數量、處理標準及水平，以及所有工地及工地以外的棄置地點位置(連同棄置記錄)。整治報告須由環境小組組長核證及獨立環境查核人核實，證明已履行條件第2.24項的規定。該整治報告獲環保署通過前，許可證持有人不得在位於顯徑的新界南動物管理中心進行建造工程。

2.26             The Permit Holder shall operate 8-car type SP 1900 / SP 1950 train or other train type with equivalent or better noise performance supported with justifications by the ET Leader and verified by the IEC as conforming to the information, requirements and recommendations as set out in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).

許可證持有人營辦工程項目須採用8節車廂的SP1900/SP1950型列車，或其他在噪音表現方面相等或較佳的列車型號，惟須由環境小組組長提出理據支持及由獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料、規定及建議。

 

2.27             The Permit Holder shall, no later than one month after completion of corresponding parts of the tunnel excavation of the Project, deposit with the Director four hardcopies and one electronic copy of an Operational Ground-borne Noise Mitigation Measures Plan to justify the adequacy of the operational ground-borne noise mitigation measures for the Project.  The Plan shall include the review and verification of the assumptions adopted in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012), such as line source response and ground vibration conditions, and shall also include justifications and recommendations for any contingency noise mitigation measures found necessary, including but not limited to:

許可證持有人須在工程項目隧道挖掘工程的相關部分竣工後1個月內，向署長存放地層傳導運作噪音緩解措施計劃的4份硬複本及1份電子版本，以證明就工程項目的地層傳導運作噪音所建議的緩解措施是否足夠。該計劃須檢討及核實核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)內採用的假設，例如線狀震源傳遞性及地層震動的情況，並須包括實施所需的任何額外噪音緩解措施的理據及建議，包括但不限於：

 

(a)                 resilent baseplates (type 1)

(b)                isolated slab track (type 4)

Before submission to the Director, the Operational Ground-borne Noise Mitigation Measures Plan shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).

地層傳導運作噪音緩解措施計劃在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。

 

2.28             The Permit Holder shall, no later than one month after completion of installation of rail tracks, deposit with the Director four hard copies and one electronic copy of a set of as-built drawing(s) for the operational ground-borne noise mitigation measures as recommended in the Operational Ground-borne Noise Mitigation Measures Plan deposited under Condition 2.27 above.  Before submission to the Director, the set of as-built drawing(s) shall be certified by the ET Leader and verified by the IEC to demonstrate that measures as set out in the Plan deposited under Condition 2.27 above has been fully and properly implemented.

許可證持有人須在鐵路路軌安裝工程竣工後1個月內，根據上文條件第2.27項存放的地層傳導運作噪音緩解措施計劃內建議的地層傳導運作噪音緩解措施，向署長存放整套竣工圖的4份硬複本及1份電子版本。整套竣工圖在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明按條件第2.27項存放的計劃所列明的措施已徹底及妥善執行。

 

2.29             To mitigate the operational air-borne noise from the viaduct section between Tai Wai Station and Hin Keng Station and from the operation of the stabling sidings at Hung Hom, noise mitigation measures as shown in Table 2 and Figures 9a, 9b, 10 and 11 of this Permit shall be installed.

為緩解大圍站至顯徑站的一段高架橋段及紅磡列車停放處運作時產生經空氣傳導的運作噪音，許可證持有人須設置本許可證表2和圖9a、9b、10及11所示的噪音緩解措施。

 

2.30             The Permit Holder shall, no later than one month after the completion of installation of noise mitigation measures as required under Condition 2.29 above, deposit with the Director four hard copies and one electronic copy of a set of as-built drawings showing:-

許可證持有人須在按上文條件第2.29項規定完成設置噪音緩解措施後的1個月內，向署長存放整套竣工圖的4份硬複本及1份電子版本，當中須顯示：

 

(a)                 the operational air-borne noise mitigation measures under Condition 2.29 above; and

按上文條件第2.29項規定設置的空氣傳導運作噪音緩解措施；以及

(b)                any additional or changes in measures if required.

任何額外措施或修訂措施(如有需要)。

 

Before submission to the Director, the as-built drawings for operational air-borne noise mitigation measures shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  All measures recommended in the deposited as-built drawings shall be fully and properly implemented and maintained for the Project.

空氣傳導運作噪音緩解措施的整套竣工圖在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。已存放的竣工圖所建議的全部措施，均須為工程項目徹底及妥善執行與維持。

 

2.31             At least one month before commencement of operation of the Project, the Permit Holder shall carry out noise performance test and deposit with the Director four hard copies and one electronic copy of a Noise Performance Test Report to confirm the compliance of the operational air-borne and ground-borne noise levels in accordance with the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  Before submission to the Director, the Noise Performance Test Report shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012).  Any necessary measure(s) as recommended in the Noise Performance Test Report shall be fully and properly implemented and maintained for the Project.

在工程項目展開營辦前，許可證持有人須至少提早1個月進行噪音水平測試，並向署長存放噪音水平測試報告的4份硬複本及1份電子版本，以確定空氣和地層傳導運作噪音水平符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)的規定。噪音水平測試報告在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合核准的SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)所載的資料及建議。噪音水平測試報告建議的所需措施，均須為工程項目徹底及妥善執行與維持。

 

2.32             At least one month before commencement of operation of the Project, the Permit Holder shall carry out fixed plant noise audit and deposit with the Director four hardcopies and one electronic copy of an audit report showing the design of the fixed plant noise sources associated with the Project complies with the maximum sound power levels determined in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and all relevant documents in the Register, or otherwise approved by the Director in compliance with the requirements in Technical Memorandum on Environmental Impact Assessment Process having due regard to the characteristics of tonality, impulsiveness and intermittency. The audit report shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012) and all relevant documents in the Register.

Submissions of As-Built Drawings of Measures for Mitigating Landscape and Visual Impacts

2.33             At least one month before the Project commences operation, four hard copies and one electronic copy of as-built drawing(s) on landscape and visual mitigation measures with an explanatory statement showing the final locations, size, number and species of planting to demonstrate compliance with the approved submissions under Condition 2.13 of this Permit shall be deposited with the Director.  This as-built submission shall be certified by the ET Leader and verified by the IEC that the Visual, Landscape and Tree Planting & Tree Protection Plan approved under Condition 2.13 has been fully and properly implemented.

2.34             To mitigate water quality impact from tunnel run-off from rail track :-

為緩解鐵路路軌的隧道徑流對水質的影響：

 

(a)                 track drainage discharges shall pass through oil/grit interceptors/chambers to remove oil, grease and sediment before discharging into public storm drainage/foul sewerage systems;

路軌排水渠排出的污水應先經過油污／砂礫截流管／池，以清除油污、油脂及沉積物，然後排進公眾雨水渠／公共污水渠系統；

(b)                the silt traps and oil interceptors shall be cleaned and maintained regularly; and

2.35             The Permit Holder shall ensure that there is no explosive being stored in the magazine and the “Licence to Possess Category 1 Dangerous Goods” has been returned and accepted by Mines Division of Civil Engineering and Development Department before the commencement of the decommissioning works.

許可證持有人須確保在解除運作工程展開前，該爆炸品倉庫並無貯存任何炸藥，並已交還「第一類危險品管有牌照」及獲土木工程拓展署礦務部接納。

 

                Submissions and Measures for Land Contamination Assessment

2.36             Land contamination assessment for the temporary explosive magazine site as shown in Figure 5 of this Permit shall be carried out. The Permit Holder shall,

許可證持有人須就本許可證圖5所示的臨時爆炸品倉庫進行土地污染評估。許可證持有人須：

 

(a)                no later than one month before the commencement of the land contamination site investigation, submit three hard copies and one electronic copy of Contamination Assessment Plan (CAP) to the Director for approval. The CAP shall include proposal with details of representative sampling and analysis required to determine the nature and extent of contamination;

在土地污染場地勘察工作展開前，至少提早1個月向署長提交污染評估計劃書的3份硬複本及1份電子版本，以供批准。污染評估計劃書須提出建議，連同為確定污染性質及範圍所須進行代表性取樣及分析的詳情；

 

(b)                no later than one month after the completion of the land contamination site investigation works, submit three hard copies and one electronic copy of Contamination Assessment Report (CAR) to the Director for approval which shall document the land contamination assessment findings.

在土地污染場地勘察工作完成後1個月內，向署長提交污染評估報告的3份硬複本及1份電子版本，載述土地污染評估結果，以供批准；

 

(c)                If land contamination and the need for remediation is confirmed, the Permit Holder shall submit to the Director for approval three hard copies and one electronic copy of Remediation Action Plan (RAP) to formulate necessary remedial measures. All remedial measures described in the approved RAP shall be fully implemented. The Permit Holder shall also submit three hard copies and one electronic copy of Remediation Report (RR) to the Director for approval, no later than one month after the completion of the remediation works.  The RR shall provide details on the remediation works carried out, types and volume of contaminated soil, standards and levels of treatment, and location(s) of disposal site(s) (including record of disposal).

倘若證實土地受到污染及有需要進行整治，許可證持有人須制訂所需整治措施並向署長提交整治計劃書的3份硬複本及1份電子版本，以供批准。核准整治計劃書載述的所有整治措施必須徹底執行。在整治工程完成後1個月內，許可證持有人亦須向署長提交整治報告的3份硬複本及1份電子版本，以供批准。整治報告須提供所進行整治工程的詳情、受污染泥土的類別及數量、處理標準及水平，以及棄置地點的位置(包括棄置記錄)。

 

Before submission to the Director, the CAP, CAR, RAP and RR shall be certified by the ET Leader and verified by the IEC as conforming to the information and recommendations contained in the application for Variation of Environmental Permit (No. VEP-495/2016).

污染評估計劃書、污染評估報告、整治計劃書及整治報告在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明其符合更改環境許可證申請文件(編號：VEP-495/2016)所載的資料及建議。

 

3.                   Environmental Monitoring and Audit (EM&A) Requirements

環境監察及審核規定

 

3.1                The EM&A programme shall be implemented in accordance with the procedures and requirements in the SCL(TAW-HUH) EM&A Manual, SCL(HHS) EM&A Manual and the Continuous Noise Monitoring Plan approved under Condition 2.10 of this Permit.  The Permit Holder shall review the EM&A requirements or programme based on the submitted construction programme required under Condition 2.8. Any changes to the EM&A requirements or programme and termination of the EM&A programme shall be supported with justifications by the ET leader and verified by the IEC as conforming to the requirements set out in the SCL(TAW-HUH) EM&A Manual, SCL(HHS) EM&A Manual and the Continuous Noise Monitoring Plan approved under Condition 2.10 of this Permit, and prior approval from the Director shall be sought before their implementation.

環監計劃須按SCL(TAW-HUH)環監手冊、SCL(HHS)環監手冊及按本許可證條件第2.10項核准的持續噪音監測計劃所載的程序及規定執行。許可證持有人須根據條件第2.8項提交的建造工程計劃檢討有關環監規定或計劃。環監規定或計劃如有任何更改，或環監計劃如需終止，須由環境小組組長提出充分理由支持，並由獨立環境查核人核實，證明其符合SCL(TAW-HUH)環監手冊、SCL(HHS)環監手冊及按本許可證條件第2.10項核准的持續噪音監測計劃所載規定，並須事先取得署長的批准，方可執行。

         

3.2                Samples, measurements and necessary remedial actions shall be taken in accordance with the requirements of the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual by:

取樣、測量及所需的補救行動，均須按照SCL(TAW-HUH)環監手冊及SCL(HHS)環監手冊所載規定進行：

 

(a)                       conducting baseline environmental monitoring;

進行環境基線監測；

(b)                      conducting impact monitoring;

進行影響監測；

(c)                      carrying out remedial actions described in the Event/Action Plans of the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual in accordance with the time frame set out in the Event/Action Plans, or as agreed by the Director, in case where specified criteria in the SCL(TAW-HUH) EM&A Manual and SCL(HHS) EM&A Manual are exceeded; and

如超逾SCL(TAW-HUH)環監手冊及SCL(HHS)環監手冊內指定的標準，則按照SCL(TAW-HUH)環監手冊及SCL(HHS)環監手冊內的事件／行動計劃所訂明的時限或署長所同意的時限，執行事件 / 行動計劃所說明的補救行動；以及

(d)                      logging and keeping records of the details of (a) to (c) above for all parameters within 3 working days of the collection of data or completion of remedial action(s), for the purpose of preparing and submitting the monthly EM&A Reports and to make available the information for inspection on site.

在收集數據或完成補救行動3個工作天內，記錄及備存上文(a)至(c)項所有參數的詳情，用作擬備並提交每月環監報告，並備妥有關資料以供在工地查閱。

 

3.3                Four hard copies and one electronic copy of the Baseline Monitoring Report shall be submitted to the Director at least 2 weeks before the commencement of construction of the Project.  The submission shall be certified by the ET Leader and verified by the IEC.  Additional copies of the submission shall be provided upon request by the Director.

在工程項目的建造工程展開前，須至少提早2個星期向署長提交基線監測報告的4份硬複本及1份電子版本。提交文件須由環境小組組長核證及獨立環境查核人核實。如署長要求，則須提交文件的額外複本。

 

3.4                Four hard copies and one electronic copy of monthly EM&A Report shall be submitted to the Director within 2 weeks after the end of the reporting month.  The EM&A Reports shall include a summary of all non-compliance (exceedances) of the environmental quality performance limits (Action and Limit Levels).  The submissions shall be certified by the ET Leader and verified by the IEC as complying with the requirements set out in the SCL(TAW-HUH) EM&A Manual, SCL(HHS) EM&A Manual.  Additional copies of the submission shall be provided to the Director upon request by the Director.

在規定提交報告的月份結束後2個星期內，須向署長提交每月環監報告的4份硬複本及1份電子版本。環監報告須包括各種不符合（超出）環境質素表現規限（行動及極限水平）情況的摘要。文件在提交署長前，須由環境小組組長核證及獨立環境查核人核實，證明符合SCL(TAW-HUH)環監手冊及SCL(HHS)環監手冊所載的規定。如署長要求，則須提交每月環監報告的額外複本。

 

3.5                All EM&A data submitted under this Permit shall be true, valid and correct.

根據本許可證提交的所有環監數據，均須有效及真實無誤。

 

4.                   Electronic Reporting of EM&A Information

環監資料的電子匯報

 

4.1                To facilitate public inspection of the Baseline Monitoring Report and monthly EM&A Reports via the EIAO Internet Website and at the EIAO Register Office, electronic copies of these Reports shall be prepared in Hyper Text Markup Language (HTML) (version 4.0 or later) and in Portable Document Format (PDF version 1.3 or later), unless otherwise agreed by the Director and shall be submitted at the same time as the hard copies as described in Condition 3.3 and 3.4 above of this Permit.  For the HTML version, a content page capable of providing hyperlink to each section and sub-section of these Reports shall be included in the beginning of the document. Hyperlinks to all figures, drawings and tables in these Reports shall be provided in the main text from where the respective references are made.  All graphics in these Reports shall be in interlaced GIF format unless otherwise agreed by the Director.  The content of the electronic copies of these Reports must be the same as the hard copies.

為方便公眾透過環評條例互聯網網站及在環評條例登記冊辦事處查閱基線監測報告及每月環監報告，以超文本標示語言 (HTML) (第4.0或較後版本) 及便攜式文件格式 (PDF) (第1.3或較後版本) 製作的報告的電子版本，除非另獲署長同意，須與本許可證上文條件第3.3及3.4項所說明的硬複本同時提交。關於HTML的版本方面，可與報告各節及小節作出超文本連結的目錄須在文件開端加入。報告內各類圖表須在載有相關資料的正文內作出超文本連結。除非另獲署長同意，報告內所有圖形均須以交錯存取的GIF格式制定。報告的電子版本內容，必須與硬複本的內容一致。

 

4.2                The Permit Holder shall set up a dedicated website and notify the Director in writing the internet address where the environmental monitoring data and project information is to be placed within 1 month after the commencement of construction of the Project.  All environmental monitoring data described in Condition 4.1 of this Permit and all submissions required by this Permit shall made available to the public via this dedicated website to be set up by the Permit Holder in the shortest time practicable, and in no event later than 2 weeks after the relevant environmental monitoring data are collected or become available, unless otherwise agreed with the Director.  The Permit Holder shall maintain the dedicated website for public access of the environmental monitoring data and reports throughout the entire construction period and during the first 3-year period of operation of the Project, or otherwise as agreed by the Director.

許可證持有人須在工程項目的建造工程展開後1個月內，設立特定網站存放環境監察及工程項目數據，並以書面通知署長有關網址所在。上文條件第4.1項說明的所有環境監察結果及本許可證規定提交的所有文件，均須盡快透過許可證持有人設立的特定網站供公眾查閱，在任何情況下均不得遲於有關環境監察數據收集或可供閱覽後的2個星期，除非另獲署長同意。許可證持有人除非另獲署長同意，否則須在工程項目整段施工期及首3年的營辦期期間維持特定網站的運作，以供公眾查閱環境監察的數據及報告。

 

4.3                The internet website as described in Condition 4.2 of this Permit shall enable user-friendly public access to the environmental monitoring data and project information including the approved SCL(TAW-HUH) EIA Report (Register No. AEIAR-167/2012) and SCL(HHS) EIA Report (Register No. AEIAR-164/2012), the environmental permit(s) and Project Profile of the Project. The internet website shall have features capable of:

本許可證條件第4.2項說明的互聯網網站，必須方便用戶使用，讓公眾容易接達監察數據及工程項目資料，包括工程項目的核准SCL(TAW-HUH) 環評報告(登記冊檔號：AEIAR-167/2012)及SCL(HHS)環評報告(登記冊檔號：AEIAR-164/2012)、環境許可證和工程項目簡介。除非另獲署長同意，互聯網網站須具備部件，提供下述功能：

 

(a)                      providing access to all environmental monitoring data of this Project collected since the commencement of construction;

1.       This Permit consists of three parts, namely, PART A (Main Permit), PART B (Descriptions of Designated Project) and PART C (Permit Conditions).  Any person relying on this Permit should obtain independent legal advice on the legal implications under the EIAO, and the following notes are for general information only.

本許可證共有3部，即A部（許可證主要部分）；B部（指定工程項目的說明）及 C部（許可證條件）。任何援引本許可證的人士須就環評條例的法律含意徵詢獨立法律意見，下述註解只供一般參考用。

 

2.       If there is a breach of any condition of this Permit, the Director or his authorized officer may, with the consent of the Secretary for Environment and Ecology, order the cessation of associated work until the remedial action is taken in respect of the resultant environmental damage, and in that case the Permit Holder shall not carry out any associated works without the permission of the Director or his authorized officer.

如違反本許可證的任何條件，署長或獲授權人員徵得環境及生態局局長的同意後可勒令停止相關工程，直至許可證持有人為所造成的環境損害採取補救行動為止。在此情況下，許可證持有人未經署長或獲授權人員同意，不得進行任何相關工程。

 

3.       The Permit Holder may apply under Section 13 of the EIAO to the Director for a variation of the conditions of this Permit. The Permit Holder shall replace the original permit displayed on the Project site by the amended permit.

許可證持有人可根據環評條例第13條的規定向署長申請更改本環境許可證的條件。許可證持有人須把經修改的許可證替換在工程項目工地內展示的原有許可證。

 

4.       A person who assumes responsibility for the whole or a part of the Project may, before he assumes responsibility of the Project, apply under Section 12 of the EIAO to the Director for a further environmental permit.

承擔工程項目整項或部分工程項目的責任的人，在承擔責任之前，可根據環評條例第12條的規定向署長申請新的環境許可證。

 

5.       Under Section 14 of the EIAO, the Director may with the consent of the Secretary for Environment and Ecology, suspend, vary or cancel this Permit. The suspended, varied or cancelled Permit shall be removed from display at the site.

根據環評條例第14條的規定，署長可在環境及生態局局長的同意下暫時吊銷、更改或取消環境許可證。遭暫時吊銷、更改或取消的環境許可證必須從工地除下，不再展示。

 

6.       If this Permit is cancelled or surrendered during construction of the Project, another environmental permit must be obtained under the EIAO before the Project could be continued. It is an offence under Section 26(1) of the EIAO to construct or operate a designated project listed in Part I of Schedule 2 of the EIAO without a valid environmental permit.

如果本許可證在工程項目建造期間取消或交回，則在繼續進行工程項目之前，必須先根據環評條例規定取得另一份環境許可證。根據環評條例第26(1)條的規定，任何人在沒有有效環境許可證的情況下建造或營辦環評條例附表2第I部所列明的指定工程項目，即屬犯罪。

 

7.         Any person who constructs the Project contrary to the conditions in the Permit, and is convicted of an offence under the EIAO, is liable:

 

(i)                 on a first conviction on indictment to a fine of $2 million and to imprisonment for 6 months;

(ii)               on a second or subsequent conviction on indictment to a fine of $5 million and to imprisonment for 2 years;

(iii)             on a first summary conviction to a fine at level 6 and to imprisonment for 6 months;

(iv)              on a second or subsequent summary conviction to a fine of $1 million and to imprisonment for 1 year; and

(v)                in any case where the offence is of a continuing nature, the court or magistrate may impose a fine of $10,000 for each day on which he is satisfied the offence continued.

 

如任何人在違反本許可證的條件下建造工程項目，且被裁定觸犯環評條例所訂明的罪行，即屬犯罪：

 

(i)                  一經循公訴程序首次定罪，可處罰款200萬元及監禁6個月；

(ii)                一經循公訴程序第二次或其後每次定罪，可處罰款500萬元及監禁2年；

(iii)              一經循簡易程序首次定罪，可處第6級罰款及監禁6個月；

(iv)               一經循簡易程序第二次或其後每次定罪，可處罰款100萬元及監禁1年；以及

(v)                在任何情況下如該罪行屬持續性質，法院或裁判官可就其信納該罪行持續的每天另處罰款10,000元。

 

7.       The Permit Holder may appeal against any condition of this Permit under Section 17 of the EIAO within 30 days of receipt of this Permit.

許可證持有人可在接獲本許可證後30天內，根據環評條例第17條就本許可證的任何條件提出上訴。
