Conditions of Approval under section 8(3) of the EIA Ordinance
1. | Subject to the conditions listed below, the recommendations of the EIA Report, as exhibited in accordance with section 7(1) of the Ordinance, shall be properly implemented. |
2. | At the detailed design stage, the Applicant shall conduct a review of the landfill gas hazard assessment to confirm the level of risk assessed and to determine suitable mitigation measures to protect the proposed development and its associated utility services. The review shall also include an additional investigation on the fault lines and the need for a rigorous monitoring programme. The results and recommendations of the review shall be submitted to the Director for approval before the commencement of site formation works. If environmental problems are identified during the investigation and as directed by the Director, the applicant shall consult the ACE EIA Sub-committee on the proposed mitigation measures and address the comments raised by the Sub-committee. |
3. | The Applicant shall reassess, at the detailed design stage, the exact alignment and the impacts of the fully enclosed conveyor belt system for the off site transfer of construction waste so as to reduce environmental disturbance to residents to a minimum. The results and recommendations of the reassessment shall be submitted to the Director for approval before commencement of the site formation works. |
4. | The approval of the EIA Report shall not remove the applicant's responsibility to comply with other legislation or to obtain other government approvals. |
